LEGE no. 291 291 of 24 June 2004 on the empowerment of the Government to issue ordinances

The Romanian Parliament adopts this law + Article 1 Pursuant to art. 115 115 para. (1) of the Romanian Constitution, republished, the Government is empowered that, from the date of entry into force of this Law, but not before the end of the first ordinary session of 2004 until the resumption of the Parliament's work in the second Ordinary session of 2004, to issue ordinances in areas not subject to organic laws, as follows: I. Economy and Public Finances: 1. regulations on the rectification of the state budget and the state social insurance budget for 2004; 2. modification and completion Law no. 571/2003 on the Fiscal Code, as amended, for the year 2005; 3. the regulation of financial measures; 4. modification and completion Government Ordinance no. 119/1999 on internal control and preventive financial control, republished; 5. modification and completion Accounting Law no. 82/1991 , republished; 6. modification and completion Government Emergency Ordinance no. 60/2001 on public procurement, approved with amendments and additions by Law no. 212/2002 , with subsequent amendments and completions; 7. regulation of the payment of the personnel employed on the basis of conventions for the collection of tax receivables; 8. modification and completion Government Ordinance no. 64/2001 on the distribution of profits to national companies, national companies and companies with full or majority state capital, as well as to autonomous regions, approved with amendments by Law no. 769/2001 ; 9. measures to improve the business environment; 10. regulations regarding the employment and development of statistical projects financed by non-reimbursable external funds 11. the passage of a land from the public domain of the state and from the administration of the National Forest Regia-Romsilva in the private domain of the state and in the administration of the National Natural Gas Society "Romgaz"-S.A. Medias; 12. modification Government Emergency Ordinance no. 214/2000 on certain measures for the execution of the rehabilitation works of Group no. 1 from the Mintia-Deva Thermal Power Plant, approved with modifications and additions by Law no. 449/2001 ; 13. exemption from the payment of import rights of materials, machinery, installations and know-how that are imported for the realization of the investment " Rehabilitation of Group no. 4 4 150 MW of CET Paroseni '; 14. modification and completion Government Emergency Ordinance no. 120/2002 on the approval of the System for the support and promotion of export with financing from the state budget, approved by Law no. 663/2002 , with subsequent amendments and completions; 15. the removal from operation of fixed assets, including their related constructions, physically or morally used, not fully amortized, from production capacities stopped by economic agents from the portfolio of the Ministry of Economy and Trade; 16. measures regarding the completion of the privatization of some companies in difficulty; 17. modification Government Emergency Ordinance no. 8/2003 on stimulating the restructuring, reorganization and privatisation of national companies, national companies and commercial companies with majority state capital, as well as autonomous companies and regions subordinated to the authorities local public administration, approved with amendments and additions by Law no. 569/2003 , with subsequent amendments and completions; 18. modification and completion Law no. 608/2001 on the conformity assessment of products, with subsequent amendments and completions; 19. measures to ensure the security of oil, gas, condensate, liquid ethane and petroleum products with gendarmes and exemption from payment of services provided; 20. measures on the establishment and efficient use of special purpose revenues in the energy sector; 21. removal from the state reserve in the form of loan of quantities of fuel; 22. measures regarding the free transfer of certain packages of shares from the state property to the private property of the local administrative-territorial units; 23. The transport regulation on railways in Romania; 24. regulations relating to the construction, maintenance, repair and operation of railways, other than those managed by the National Railway Company "C.F.R." --S.A.; 25. establishment and sanctioning of contraventions to the transport of persons by metro on the railway network managed by the Commercial Transport Company with the Bucharest Metro "Metrorex"-S.A.; 26. modification and completion Government Ordinance no. 15/2002 on the introduction of the tariff for the use of the national road network in Romania, approved with amendments and additions by Law no. 424/2002 ; 27. improvement of the legislative framework in the field of transport, in order to align with Community legislation; 28. arrangement, conservation and sustainable territorial development, relaunching of activity in the construction field; 29. development of activity in the field of housing construction through programs at national level; 30. completion Law no. 148/2000 on advertising, with subsequent amendments and completions. II. Agriculture: 1. establishment, at national level, of the Agricultural Accounting Information Network; 2. modification Government Emergency Ordinance no. 36/2001 on the regime of regulated prices and tariffs, which are established with the opinion of the Competition Office, approved with amendments and completions by Law no. 205/2002 , with subsequent amendments and completions; 3. approval of the number of specimens of bear, wolf and wild cat species, which can be harvested during the hunting season 2004-2005; 4. regulations on the establishment, organization and operation of game farms and hunting complexes; 5. establishing the necessary measures for the accessibility of the forest fund through the construction of forest roads; 6. stimulation of the association of owners of private forests, for the purpose of their sustainable management; 7. modification art. 48 of Government Ordinance no. 42/2004 on the organization of veterinary and food safety activity, approved with amendments and additions by Law no. 215/2004 . III. Public administration: 1. establishment of the CENAFER National Training and Training Center; 2. establishment of the National Transplant Agency; 3. completion Decree-Law no. 126/1990 on some measures regarding the Romanian Church United with Rome (Greek-Catholic); 4. the extension of some deadlines provided for in normative acts with the force of law. IV. Health: 1. measures to strengthen financial-economic discipline in the health system; 2. modification Hospital law no. 270/2003 , with subsequent amendments and completions; 3. modification Government Emergency Ordinance no. 150/2002 on the organization and functioning of the health insurance system, with subsequent amendments and completions; 4. modification and completion Law no. 296/2002 on the provision of healthcare in Romania to foreign citizens on the basis of agreements, agreements, conventions or international protocols for reciprocity in the field of health, to which Romania is a party; 5. completion art. 8 8 of Law no. 100/1998 on public health assistance, with subsequent additions; 6. modification and completion Government Ordinance no. 70/2002 on the administration of public health facilities of county and local interest, approved with amendments and completions by Law no. 99/2004 ,, as amended. V. Work and social solidarity: 1. modification and completion Government Ordinance no. 129/2000 on the vocational training of adults, republished; 2. modification and completion Law no. 202/2002 on equal opportunities between women and men; 3. modification and completion Government Ordinance no. 68/2003 on social services, approved with amendments and additions by Law no. 515/2003 ; 4. modification Government Ordinance no. 44/2004 on the social integration of foreigners who have acquired a form of protection in Romania, approved with modifications by Law no. 185/2004 . VI. National defence, public order and national security: 1. granting tax incentives to the North Atlantic Treaty Organization during the deployment in Romania of the Informal Meeting of Defense Ministers of NATO member countries; 2. modification and completion Law no. 138/1999 on the payroll and other rights of military personnel in the public institutions of national defence, public order and national security, as well as the granting of salary rights to civil personnel in these institutions, as amended and subsequent additions. + Article 2 (1) In accordance with the provisions of art. 115 115 para. (3) of the Romanian Constitution, republished, the ordinances issued by the Government pursuant to art. 1 will be submitted for approval to the Parliament, according to the legislative procedure, until the resumption of Parliament's work in the second ordinary session of 2004. Failure to comply with the deadline draws the end ... (2) Ordinances adopted by the Government according to art. 1 will be debated as a priority. ...
