The content of this act is not an official document, being intended to inform users The Romanian Parliament adopts this law + Article I Approval Government Ordinance no. 42 42 of 29 January 2004 on the organisation of veterinary activity, adopted under art. 1 1 section III.1 of Law no. 559/2003 on the empowerment of the Government to issue ordinances, published in the Official Gazette of Romania, Part I, no. 94 of 31 January 2004, with the following amendments and additions: 1. The title of the ordinance shall read as follows: " ORDINANCE on the organisation of veterinary and food safety " 2. Article 2 shall read as follows: "" Art. 2. -Natural persons and legal persons owner or holders of live animals or germinal material of animal origin, those who produce, store, collect, transport, process, intermediate, put on the market, import, export or export trade live animals or germinal products of animal origin, animal products and by-products, veterinary medicinal products, waste, animal by-products not intended for human consumption or pathogens of origin animal, products and materials used in animal nutrition or other materials and products may influence the animal health condition responsible for the application and observance of the provisions of the veterinary legislation, in order to ensure and guarantee animal health, public health, animal protection, protection the environment and food safety. " 3. Article 3 shall read as follows: "" Art. 3. -The state supports the activity of animal health defense, surveillance, prevention and control of diseases that can be transmitted from animals to humans, by providing the institutional and legal framework, financial resources, base technical-materials necessary for the optimal conduct of activities in the veterinary field. " 4. The title of Chapter II shall read as follows: "" Organisation and operation of veterinary services ' 5. Article 4 shall read as follows: "" Art. 4. -Veterinary and food safety services shall be organised and operated as a single veterinary system and shall be structured as follows: a) State-public services-veterinary and food safety; b) veterinary activities of free practice. I of EMERGENCY ORDINANCE no. 88 88 of 4 November 2004 published in MONITORUL OFFICIAL no. 1.053 1.053 of 12 November 2004. 6. Article 5 shall read as follows: "" Art. 5. -The state veterinary services are organized according to a unified conception, in the pyramid system of the order flow, on the territorial principle, as a distinct and autonomous sector, having the following structure: a) The National Veterinary Health and Food Safety Authority, hereinafter referred to as the Authority, is the central veterinary and food safety authority, which technically and administratively coordinates the entire activity of the veterinary and food safety services, organise and control the performance of veterinary public activities and food safety; ------------ Lit. a) a art. 5 of ORDINANCE no. 42 42 of 29 January 2004 published in MONITORUL OFFICIAL no. 94 94 of 31 January 2004, approved by LAW no. 215 215 of 27 May 2004 ,, has been amended by section 4.2 2 2 of art. I of EMERGENCY ORDINANCE no. 88 88 of 4 November 2004 published in MONITORUL OFFICIAL no. 1.053 1.053 of 12 November 2004. b) veterinary institutes, national reference authorities for their specific fields of competence, with legal personality, subordinated to the Authority; c) the veterinary directions and for the safety of the county food and the city of Bucharest, veterinary authorities and for the safety of the county food and the city of Bucharest, with legal personality, subordinated The Authority, which is established by the reorganization of the county veterinary health departments and the city of Bucharest, decentralized public services that operate under the Ministry of Agriculture, Forestry and Rural Development; d) sanitary-veterinary constituencies and veterinary and food safety constituencies, without legal personality, organized in the structure of veterinary directions and for the safety of county food and Bucharest Municipality e) border inspection posts, without legal personality, organized in the structure of the Authority. " 7. Article 6 shall read as follows: "" Art. 6. -(1) The Authority shall be established by the reorganization of the Romanian Food Safety Agency, the National Veterinary Health Agency of the Ministry of Agriculture, Forestry and Rural Development, as well as some services that work in the structure of the Ministry of Agriculture, Forestry and Rural Development. ((. The units operating under the Authority are set out in Annex no. 2. (3) The Authority shall take over the rights, obligations, powers, personnel and financial resources of the National Veterinary Health Agency and the Romanian Food Safety Agency. " 8. After Article 6, Articles 6 ^ 1 -6 ^ 9 are inserted as follows: Art. 6 ^ 1. --(1) Abrogat. ------------ Alin. ((1) art. 6 ^ 1 of ORDINANCE no. 42 42 of 29 January 2004 published in MONITORUL OFFICIAL no. 94 94 of 31 January 2004, approved by LAW no. 215 215 of 27 May 2004 ,, has been repealed by section 6.6. 1 1 of art. I of EMERGENCY ORDINANCE no. 27 27 of 18 March 2009 published in MONITORUL OFFICIAL no. 183 183 of 24 March 2009. (2) The financing of the Authority shall be ensured from its own income and allowances from the state budget. Art. 6 ^ 2. -The Authority shall aim at: " a) the protection of animal health, animal protection, the prevention of the transmission of animal diseases to humans, the safety of food of animal origin intended for human consumption, the sanitation of animal feed and the protection of the environment, in relation to animal husbandry, identification and registration of animals with the exception of equidae; '. ------------ Lit. a) a art. 6 ^ 2 of ORDINANCE no. 42 42 of 29 January 2004 published in MONITORUL OFFICIAL no. 94 94 of 31 January 2004, approved by LAW no. 215 215 of 27 May 2004 has been amended by section 1 1 of art. I of EMERGENCY ORDINANCE no. 49 49 of 28 June 2006 published in MONITORUL OFFICIAL no. 566 566 of 30 June 2006. b) making food safety, from the production of raw materials to the distribution of food to the consumer. Art. 6 ^ 3. -The Authority has the following main tasks a) organize the state veterinary services and determine their financing needs; b) organize public veterinary activities on the entire territory of the country, after a unified conception, to ensure animal health, public health, animal protection, environmental protection and food safety; c) determine the duties and responsibilities of the state veterinary services; d) develop and promote, in collaboration with other competent authorities involved, the legal framework in the field of food safety and quality; e) participate in the activity of standardization, grading and qualification of food products; f) organize the activity in the field of food safety and quality, in collaboration with other competent authorities involved, according to the limits of legal competence; g) carry out, in collaboration with other competent authorities involved, the system of analysis, management and communication of risk in the field of food safety and quality; h) issue scientific opinions and provide technical and scientific assistance on national and community legislation in areas that have a direct or indirect influence on food and feed safety. Provides independent information on all issues in these areas and communicates the risks; i) contribute to the achievement of a high level of protection of human life and health, taking into account animal health and welfare, plant health and environmental protection; j) collect and analyse data to enable the characterisation and monitoring of risks that have a direct or indirect influence on food safety and feed; k) provide scientific advice and technical and scientific assistance on human nutrition, taking into account the provisions of national and community legislation, issue scientific opinions on issues related to animal health and welfare and plant health, as well as scientific advice on products other than food and feed, in relation to genetically modified organisms as defined by Government Ordinance no. 49/2000 on the regime of obtaining, testing, using and marketing genetically modified organisms through the techniques of modern biotechnology, as well as the products resulting from them, approved with amendments and additions by Law no. 214/2002 ; l) issue scientific opinions that serve as a scientific basis for the development and adoption of measures in the fields concerning its object of activity; m) elaborates draft normative acts in order to carry out specific tasks. Art. 6 ^ 4. -(1) The Authority operates in cooperation with the Ministry of Agriculture, Forestry and Rural Development, the Ministry of Health and the National Authority for Consumer Protection, as well as with the other national authorities that have executive powers in food safety. ((. The Authority shall cooperate with the European Food Safety Authority, similar Community institutions and Member States and similar international institutions. Art. 6 ^ 5. --(1) In the performance of his duties the Authority shall constitute the contact structure with the European Food Safety Authority and act on the basis of functional and decision-making autonomy according to the commitments made by Romania. (2) The Authority shall operate the Operational Secretariat for the Codex Alimentarius, headed by the President of the Authority. "" Art. 6 6 ^ 6. -(1) The Authority shall be headed by a President with the rank of Secretary of State and of 2 Vice-Presidents with the rank of Undersecretary of State, appointed by decision of the Prime Minister. (3) The President shall be supported in his work by a Scientific Council and an Advisory Board, without legal personality. (4) The President of the Authority is the principal authorising officer Art. 6 ^ 7. -The Secretary-General of the Authority is appointed by decision of the Prime Minister. His duties are established by order of the President of the Authority Art. 6 ^ 8. -(1) The Scientific Council shall consist of at least 7 personalities recognized in the fields of competence of the Authority. (2) The composition and regulation of organization and functioning of the Scientific Council shall be approved by order of the President, within 15 days of his appointment. Art. 6 ^ 9. -(1) The advisory council shall consist of representatives of ministries, other public administration authorities competent in the veterinary field and food safety and civil society representatives. (. The Advisory Board shall be chaired by the Chairperson of (3) The composition and regulation of organization and functioning of the Advisory Council shall be approved by order of the President, within 15 days of his appointment. ((. Members of the Scientific Council shall receive a participation allowance of not more than 20% of the gross allowance of the President of the Authority. " 9. Article 7 shall read as follows: Article 7-Abrogat. ------------- Article 7 of ORDINANCE no. 42 42 of 29 January 2004 published in MONITORUL OFFICIAL no. 94 94 of 31 January 2004, approved by LAW no. 215 215 of 27 May 2004 ,, has been repealed by section 6.6. 2 2 of art. I of EMERGENCY ORDINANCE no. 27 27 of 18 March 2009 published in MONITORUL OFFICIAL no. 183 183 of 24 March 2009. 10. Article 7 (1) shall be inserted after Article 7: "" Art. 7 7 ^ 1. -(1) The authority carries out its activity according to the principles of independence, transparency, confidentiality, access to documents and information under the law. (2) The Authority shall submit annually to the Government a report on the work carried out, which includes the results 11. Article 8 shall read as follows: "" Art. 8. -(1) The official veterinarians are the veterinarians of the Authority, veterinary institutes and veterinary departments and for the safety of the county food and the city of Bucharest. ((2) Veterinary doctors operating in the structure of other ministries have official duties and powers of official veterinarian and may be passed, with the agreement of the parties, in the structure of the Authority. " 12. The title of Chapter III shall read as follows: "Duties and powers of state veterinary services" 13. Article 9 shall read as follows: "" Art. 9. -The areas of competence of the state veterinary services are: a) the establishment of obligations and responsibilities of natural and legal persons in the veterinary field; b) establishing the obligations and responsibilities of public administration institutions and bodies in the veterinary field; c) authorization, approval and accreditation in the veterinary field; d) national veterinary information system; e) self-assessment of veterinary services; f) definition of the technical terms used in the veterinary field, as set out in Annex no. 1 1; g) animal health: qualification of animal health status, veterinary certification, protective measures, veterinary notification, declaration of diseases, disease control in animals and prevention of their transmission from animals to man; h) veterinary public health; "" i) identification and registration of animals, with the exception of equidae; '. ------------- Lit. i) a art. 9 of ORDINANCE no. 42 42 of 29 January 2004 published in MONITORUL OFFICIAL no. 94 94 of 31 January 2004, approved by LAW no. 215 215 of 27 May 2004 has been amended by section 2 2 of art. I of EMERGENCY ORDINANCE no. 49 49 of 28 June 2006 published in MONITORUL OFFICIAL no. 566 566 of 30 June 2006. j) establishment of veterinary requirements and control of the production, internal movement, placing on the market, trade, import, transit and export of live animals, germinal material of animal origin, products and by-products subject to surveillance and veterinary checks; k) animal nutrition, medicated feed and feed additives; l) establishment of veterinary requirements for the protection and welfare of animals and the control of their application; m) inspection and veterinary checks; n) the veterinary requirements for the breeding activity of animals; o) establishment of expenditure in the veterinary field; p) elaboration and implementation of the training system in the veterinary field; q) establishment of investment and endowment needs in the veterinary field. " 14. Article 10 shall read as follows: "" Art. 10. -The Authority shall: a) organize public veterinary activities on the entire territory of the country, after a unified conception, to ensure animal health, public health, animal protection, environmental protection and food safety; b) develop veterinary norms that are approved by order of the President of the Authority, for the areas of competence of veterinary services, unique and mandatory for the natural and legal persons provided in art. 2 2; c) control the application of veterinary rules; d) determine the general responsibilities of veterinarians; e) establishes the rights and obligations of official veterinarians; f) establishes the rights and obligations of veterinarians of free practice empowered to carry out public veterinary activities; g) participate in the elaboration or endorsement of conventions and agreements on cooperation in the veterinary field; h) together with the Ministry of Health is responsible for the organization and application of the necessary measures to prevent and combat diseases common to man and animals, as well as for the safety of food "" i) organise, coordinate, manage and control the work on the identification and registration of animals, with the exception of equidae; '. ------------- Lit. i) a art. 10 of ORDINANCE no. 42 42 of 29 January 2004 published in MONITORUL OFFICIAL no. 94 94 of 31 January 2004, approved by LAW no. 215 215 of 27 May 2004 has been amended by section 3 3 of art. I of EMERGENCY ORDINANCE no. 49 49 of 28 June 2006 published in MONITORUL OFFICIAL no. 566 566 of 30 June 2006. j) organize, coordinate, manage and control the activity of border inspection posts; k) organize and ensure the functioning of the national veterinary computer system and its connection to the veterinary computer system of the European Union; l) elaborates the regulations of organization and functioning of the state veterinary services and establishes their duties and responsibilities; m) organizes and controls the public veterinary activities carried out by the authorized free practice veterinarians; n) establish veterinary requirements; o) develop national veterinary programmes approved by order of the President of the Authority. " 15. Article 11 shall read as follows: "" Art. 11. -The rights and powers of the Authority are a) has free access, in order to exercise its specific competences, in the objectives provided in art. 18 18 para. (1), as well as in other places which are subject to veterinary supervision and control; b) request the submission and verification of any relevant documents, data and information, regarding the objectives referred to in art. 18 18 para. ((1); c) has protective and restriction measures on live animals, animal germinal material, products and by-products subject to surveillance and veterinary control from the objectives provided for in art. 18 18 para. ((1); d) suspend or prohibit the operation of the objectives referred to in 18 18 para. ((1); e) imposes restriction measures on movement and veterinary certification for live animals, animal germinal products, products and by-products subject to surveillance and veterinary control that are in the intended objectives to art. 18 18 para. ((1); f) limit or prohibit trade, import, production or placing on the market, export and transit of live animals, germinal products of animal origin, products and by-products subject to surveillance and veterinary control; g) harvest samples for laboratory examinations, to elucidate risk factors on animal health, public health, animal protection, environmental protection and food safety; h) check whether the staff employed the objectives referred to in art. 18 18 para. (1) comply with veterinary requirements on animal health, public health, animal protection, environmental protection and food safety; i) inspect and control compliance with the veterinary requirements for the objectives referred to in art. 18 18 para. ((1); j) order the placing under veterinary seizure or killing of animals or the placing under veterinary seizure, confiscation and destruction of products and by-products subject to surveillance and veterinary control; k) apply contravention sanctions in case of committing acts that constitute contraventions to the veterinary legislation; l) require central and local public administration bodies to apply legal measures in case of necessity or imminent risk to animal health, public health, animal protection, environmental protection and food safety. " 16. Article 12 shall read as follows: "" Art. 12. -In order to carry out public veterinary activities, within the competence limits of the state veterinary services, the Authority collaborates with the central and local public administration authorities, with the associations and employers of the agricultural and pharmaceutical industry, representatives of civil society and international veterinary organisations. " 17. Article 12 (1) shall be inserted after Article 12: "" Art. 12 12 ^ 1. -The tasks of the Food Safety Authority are also established by specific legislation. " 18. Article 13 shall read as follows: "" Art. 13. -In the exercise of the profession veterinarians have the following obligations: a) to urgently notify the veterinary and food safety authority about any suspicion of the occurrence of a disease subject to mandatory notification, according to the law, as well as any risk on animal health, health public, animal welfare and protection, environmental protection and food safety; b) take emergency measures provided by law, to prevent and stop the dissemination of communicable diseases of animals or any risk likely to affect animal health and public health, animal protection, environmental protection and food safety; c) to participate, at the request of the veterinary department and for the safety of the county food, respectively of the city of Bucharest, or, as the case may be, of the Authority, to actions to eradicate some communicable diseases of animals or those of control in case of emerging communicable diseases for Romania; d) to comply with the withdrawal and withdrawal periods, relating to the disposal or the presence of residues in live animals, in products or by animal by-products intended for human consumption; e) to register and keep, for a period established by the Authority, a register of the activity carried out and the record of the manner of prescribing, distribution and use of veterinary medicinal products, feed additives and feedingstuffs medicated; f) to maintain confidentiality over any facts, information or documents that they become aware of in the exercise of activities, for which there are copyright, protection of commercial confidentiality or if the use of such data is Licensed. " 19. Article 14 shall read as follows: "" Art. 14. -(1) Official veterinarians have the following main obligations: a) have the application of the provisions of the veterinary legislation, control their compliance and carry out the public veterinary activities that fall under their responsibility; b) have the necessary measures and supervise their application by natural and legal persons, for the protection and improvement of animal health, protection of public health, animal protection, environmental protection and food safety; c) have without delay the necessary measures, until the clarification of any suspicions regarding the occurrence of a disease or an element of risk in relation to animal health, public health, animal protection, environmental protection and safety food; d) have the necessary measures to specify the causes of illness and control the application of specific measures for the control and eradication of transmissible diseases of animals and zoonoses; e) participate in the assessment of compensation costs, in the case of cutting or killing of live animals, of those of equarisation and processing of animal waste, of disinfection, deratization and disinsection, of confiscation or destruction of germinal material of animal origin or products and by-products subject to veterinary supervision and control; f) ensure the control of products and by-products of animal origin intended for human consumption, and of those not intended for that purpose, of feed materials used in animal nutrition and veterinary medicinal products, in all phases of production, storage, collection, transport, processing, intermediation, placing on the market, and those subject to import, export, transit and trade; g) participate in training courses in the veterinary field. ((2) The measures established by official veterinarians in the exercise of their duties and responsibilities are mandatory for all natural and legal persons who carry out activities covered by the competences of the services Veterinary. (3) The specific rights of official veterinarians are conferred by the powers of the veterinary and food safety authority, provided in art. 11. ((4) Depending on the national strategy in the veterinary field, the Authority may also establish other rights and obligations of official veterinarians. " 20. Article 15 shall read as follows: "" Art. 15. -(1) The veterinarians of free practice empowered have the obligations provided in art. 13, as well as those resulting from the contracts for carrying out public veterinary activities, concluded with the veterinary directions and for the safety of the county food and the city of Bucharest. " (2) For the non-professional holdings of veterinary activities contained in the programme of actions for surveillance, prevention and control of animal diseases, those transmissible from animals to humans, animal protection and environmental protection, identification and registration of bovine animals, pigs, sheep, goats and equidae, as well as other actions provided for in other national programmes, which the Authority must implement, the directions veterinary and veterinary food safety and the city of Bucharest can conclude contracts with veterinarians, organized under the law, can hire their own veterinary staff, under the law, in situations where no contracts can be concluded with veterinarians, organized under the law. (4) The activities of veterinary assistance shall be provided exclusively by private veterinary health services. " 21. The title of Chapter V shall read as follows: "" obligations and responsibilities in the veterinary field " 22. Article 16 shall read as follows: "" Art. 16. -Individuals and legal entities referred to in art. 2 2 have the following obligations: a) to notify the veterinary department and for the safety of the county food or the city of Bucharest the start or cessation of activities subject to supervision and veterinary control; b) to provide the necessary support to the veterinary authorities and to the safety of food to carry out their duties and responsibilities; c) allow the free, permanent and unrestricted access of the veterinary authorities and for the safety of food to carry out inspections, controls, checks or examinations in the objectives provided for in art. 18 18 para. ((1); d) provide veterinary and food safety authorities with the necessary assistance during the controls, inspections, checks and examinations they undertake to achieve the objectives, duties and responsibilities e) to notify without delay the veterinary authorities and for the safety of local food and local public administration about the occurrence of any suspicion or illness of animals, and until the arrival of the veterinarian, to isolate sick, dead, killed or cut animals, being prohibited from the use or marketing of meat and other products and by-products from these animals, without the approval of the veterinary authority and for the safety of local food; f) to notify the veterinary authorities and for the safety of local food, within the deadline set by the specific legal provisions, about the entry/exit of animals into/from localities, alienation and acquisition of animals, disappearance, death, the cutting of animals as well as any other animal movement events; g) to support the veterinary authorities and for the safety of food in carrying out veterinary actions of public interest; h) to present the animals for carrying out veterinary actions of public interest, at the place, date and time laid down by the official veterinarian or by the authorized veterinarian of free practice; i) comply with the measures established by the veterinary authority and for food safety; j) to notify the veterinary authority and for the safety of local food and to request the animal and transport health certificate or other documents necessary for the movement or transport of live animals, germinal material of animal origin, products and by-products subject to veterinary supervision and control; k) to send to the veterinary and food safety authority, at its request, copies of the documents and certificates accompanying live animals, animal germinal material, products and subproducts subject to surveillance and veterinary checks; l) comply with the prohibitions and restrictions established by the veterinary authority and for the safety of food on the activities provided for in art. 2 2; m) to put on the market, import, export and market only live animals, animal germinal products, products and by-products from animals, for which, if treated with veterinary medicinal products, they have complied with the withdrawal or withdrawal periods; n) comply with the prohibition and restriction measures for veterinary medicinal products and for products and materials used in animal nutrition, for some substances prohibited or unauthorised to be administered to animals or to be used in relationship with products of animal origin; o) provide veterinary and food safety authorities with live animals or germinal products of animal origin, animal products and by-products, veterinary medicinal products, waste, by-products of animal origin not intended for human consumption or animal pathogens, products and materials used in animal nutrition or other materials and products which may influence the animal health, for examination and testing them, for the detection of prohibited or unauthorised substances to be used for veterinary purposes; p) comply with measures to prohibit or restrict the placing on the market, import, export, transit and trade in products and by-products not intended for human consumption or are unfit for human consumption or for animal nutrition, as well as the provisions of the veterinary authority and for the safety of food for the destruction of products and by-products not intended for human consumption or are unfit for human consumption or for animal nutrition, which may constitute a potential risk to animal health, public health, protection animals, environmental protection and food safety; q) apply the veterinary rules on the requirements of zoohygiene, housing, care, breeding and rational use of animals, as well as the additional measures established by the veterinary authorities and for safety food in these areas; r) to apply veterinary measures to prevent animal diseases and to control and eradicate or prevent their diffusion into the territory; s) to maintain in good working and hygiene, in strict compliance with the veterinary rules, the objectives provided in art. 18 18 para. Article 24 shall read as follows: "" Art. 24. -(1) The germinal material of animal origin must be produced in specialised establishments authorised by the veterinary authority and for food safety. (2) The specialized units referred to in par. ((1) must be entered in the official list drawn up by the Authority and are subject to inspection and veterinary checks, in order to comply with the veterinary requirements provided for by veterinary legislation. ((3) The sampling, processing and storage of germinal products of animal origin shall be carried out by specialised teams authorised by the Authority. " 33. Article 25 shall read as follows: "" Art. 25. -(1) In trade, transit or import of live animals and germinal products of animal origin, products and by-products subject to veterinary supervision and control, the Authority may, in certain cases, order measures to be taken. special protection against any risk likely to affect animal health, public health, animal protection, environmental protection and food safety. (4) The disinfection activity of the road transport means from the border crossing points is provided by the veterinary directions and for the safety of the county food, respectively of the city of Bucharest, according to the norms veterinary-veterinary elaborated by the Authority and approved by order of the President. (5) If at the inspection points and veterinary checks the border veterinary checks are found to be communicable diseases of the animals or there is a suspicion thereof or a risk of another nature that may endanger animal health, public health, animal protection, environmental protection and food safety, the entire batch of animals will be returned to the country of origin, and if this measure is not possible, the Authority may order immediate cutting and recovery under special conditions or killing the entire batch of animals as well as destruction of objects and materials Related. (6) In the situations provided in par. (5) The Authority must notify the measures ordered to the central veterinary authority of the exporting country. (7) When by the conventions or veterinary agreements concluded by Romania with other states it has been established thus, it will be done according to their provisions. " 53. Article 41 shall read as follows: "" Art. 41. -(1) Live animals, animal germinal products, products and by-products subject to veterinary supervision and control, originating in Member States or third countries, shall be subject to inspection and veterinary checks. at the border, carried out by the veterinary authorities on the basis of the specific veterinary requirements, provided for by the veterinary rules developed by the Authority and approved by order of the President. (2) The animals from import shall be compulsorily subject to prophylactic quarantine, in isolated and specially arranged places, authorized by the veterinary directions and for the safety of the county food, respectively of the city of Bucharest, which allow the introduction of animals in these places only after verifying the fulfilment of the specific veterinary requirements. " 54. Article 42 shall read as follows: "" Art. 42. -(1) The Authority shall establish and implement, by the veterinary authorities and for food safety, the veterinary requirements for inspection and veterinary checks to be carried out for live animals, the germinal material of animal origin, products and by-products subject to veterinary supervision and control and controls compliance with these requirements. ((2) Responsibility to the hygiene conditions for the production, transport, placing on the market and marketing of live animals, germinal products of animal origin, products and by-products subject to surveillance and control veterinary-veterinary belongs to the units referred to in art. 18 18 para. ((1). (3) The authority shall control compliance with the hygiene conditions referred to in ((2). (4) The Authority shall develop and implement the national inspection and veterinary checks programme, establishing the responsibilities of the Authority and the veterinary departments and for the safety of the county food and of the municipality Bucharest. " 55. Article 43 shall read as follows: "" Art. 43. -For the purpose of importing from third countries the products referred to in art. 18 18 para. ((1), drawing up official lists of countries, establishments or enterprises authorized for export to Romania, representatives of the Authority may carry out veterinary assessments in the countries and on the mentioned objectives regarding compliance with the requirements veterinary health and compliance of these objectives with the provisions of the Romanian veterinary legislation governing the import from third countries. " 56. The title of Chapter XIII shall read as follows: " veterinary requirements for the protection and welfare of animals 57. Article 44 shall read as follows: "" Art. 44. -(1) Owners, keepers or keepers of animals are required to comply with and apply the provisions of veterinary legislation or other provisions on housing and care of animals in holdings, gardens, parks and reserves. zoological or temporary agglomerations of animals or during grazing, in order to comply with their physiological and behavioural requirements, according to the legislation in the field of animal protection and welfare. (3) The Authority, in collaboration with non-governmental organizations for the protection of animals, will take the necessary measures to comply with the veterinary requirements provided in par. ((2). ' 58. Article 45 shall read as follows: "" Art. 45. -(1) The Authority shall establish, by order of the President, the veterinary requirements for the production, testing, authorization, storage, transport, marketing, use, import, transit, export and trade in feed, materials fodder, premixtures, zooforts, feed additives, complete feedingstuffs, additional feed, compound feed, other materials and products used in animal feed and nutrition. ((. The Authority shall determine the list of the different categories of feed and feed materials, premixes, feed additives, complete feedingstuffs, supplementary feedingstuffs, compound feedingstuffs and other materials and products used in animal feed or nutrition Romania. " 59. Article 46 shall read as follows: "" Art. 46. -(1) The Authority shall establish, by order of the President, the veterinary requirements for the production, testing, authorization, storage, transport, marketing, use, import, transit, export and trade in medicinal products veterinary. ((. The Authority shall draw up and update, by order of the President, the list of establishments which manufacture veterinary medicinal products, and the list of manufacturers and distributors authorized to possess active substances with properties Anabolic, anti-infectious, anti-parasitic, anti-inflammatory, hormonal or psychotropic, which can be used in the manufacture of veterinary medicinal products. (. The Authority shall establish and update, by order of the President, the list of approved veterinary medicinal products, waiting and interruption periods, and prohibitions on the use of some of these products. ((. The Authority shall develop and implement a pharmacovigilance programme. '; 60. Article 47 shall read as follows: "" Art. 47. -Together with the national authority responsible for animal breeding and selection activities and animal breeders ' organisations and associations, the Authority shall determine the veterinary requirements for animals and activity of breeding. " 61. The title of Chapter XIV shall read as follows: "" Financing and expenditure of state veterinary services and activities " 62. Article 48 shall read as follows: "" Art. 48. --(1) The financing of the current and capital expenditure of the Authority and of the units subordinated to it, set out in Annex no. 2, shall be provided from its own revenue and from public funds. (2) The Authority shall ensure the financing of expenditure on the basis of programmes approved as annexes to its budget, in order to: " a) actions contained in the programme of actions for surveillance, prevention and control of animal diseases, those transmissible from animals to humans, animal protection and the protection of the environment, the identification and registration of bovine animals, pigs, sheep, goats and equidae; ' ------------ Lit. a) a par. (3) The activities provided in par. ((2) lit. f) is carried out on the basis of a contract concluded, under the law, with educational institutions or with other competent institutions. ((4) The incomes made from the exercise of the inspection and veterinary control activity shall be transferred monthly by the units provided in art. 19 19 para. (1) on behalf of the veterinary and veterinary departments and for the safety of the county food and of the city of Bucharest and constitute, for them, their own incomes intended for the financing of current and capital expenditures, which are registered in Separate accounting. (5) Own incomes for the institutions referred to in art. 5 lit. b) and c) are constituted from the exercise of inspection and veterinary control activity, from tariffs for veterinary and laboratory activities, from consultancy and other specific benefits: disinfection actions, disinsectisation, deratization, examinations and laboratory work, as well as from other activities in the veterinary field. (6) The own income referred to in par. ((4) and (5) are intended to finance current and capital expenditure and shall be recorded in separate accounts. These revenues will also be used to hire specialist and auxiliary staff. " (7) The amount of tariffs for own income shall be approved by order of the President of the Authority and shall be updated annually, depending on the inflation rate of the previous year. ------------- Alin. ((7) art. 48 of ORDINANCE no. 42 42 of 29 January 2004 published in MONITORUL OFFICIAL no. 94 94 of 31 January 2004, approved by LAW no. 215 215 of 27 May 2004 ,, has been amended by section 9 9 of art. (8) The Authority's own revenues shall be from a share of the own income of the subordinated units set out in Annex no. 2. (9) The quotas referred to in par. (8) is approved annually by order of the President of the Authority, shall be used to finance the current and capital expenditure of the Authority and, depending on the veterinary policy and food safety, may be redistributed to subordinate units. ' 63. Article 49 shall read as follows: "" Art. 49. -(1) The inspection and veterinary inspection activity of the border shall be carried out by the Authority through the border inspection posts. The Authority's own revenue shall also be from the inspection and veterinary inspection tariffs that exporters, importers or, where appropriate, the person responsible for, according to the convention concluded, for transit activities, import and export with live animals, germinal products of animal origin, products and by-products subject to supervision and veterinary control are required to pay them. (2) The level of tariffs provided in par. ((. shall be established by order of the President of the Authority. 64. Article 50 shall read as follows: "" Art. 50. -(1) The expenses involved in the execution of the measures ordered by the Authority at the border inspection posts, provided for in art. 40 40 para. (5), shall be borne by the exporter, importer or, as the case may be, the person responsible, according to the agreement concluded (2) The national veterinary information system includes: the Intranet computer system, the computer system for the registration of animals, the computer system for the notification of transmissible animal diseases, the rapid computer system alert, the computer system for monitoring the movement of animals, the computer system on the monitoring of import and transit, the computer system on veterinary surveillance of transmissible animal diseases, and other IT systems necessary to carry out animal health-veterinary within the limits of their competence. " 65. Article 50 (1) shall be inserted after Article 50: "" Art. 50 50 ^ 1. -The Authority may contract consulting services in the field of information and communication technology, public relations, organization of promotion, advertising, education and information campaigns related to specific activity. " 66. Article 51 shall read as follows: "" Art. 51. -(1) The facts that constitute contraventions to the veterinary norms, as well as persons who may find contraventions and apply sanctions shall be established by Government decision. (2) The contravention sanctions shall also apply to legal entities. (3) The provisions of this ordinance on contraventions shall be supplemented by the provisions Government Ordinance no. 2/2001 on the legal regime of contraventions, approved with amendments and additions by Law no. 180/2002 ,, as amended. " 67. After Article 51, Articles 51 ^ 1 and 51 ^ 2 are inserted as follows: "" Art. 51 51 ^ 1. -(1) Within the schools of postgraduate studies from the faculties evaluated and approved by the European Commission, continuous training and veterinary training centres shall be established, with legal personality, in the coordination of the Authority. (2) Attestation regarding the graduation and promotion of courses within the continuous training and veterinary training centers is made by issuing a graduation diploma issued jointly by the Authority and the faculties evaluated and approved by the European Commission. (3) The regulation on the organization and functioning of the continuous training and veterinary training centers shall be established by order of the President of the Authority, with the opinion of the Ministry of Education and Research. Art. 51 ^ 2. -(1) The Codex Alimentarius National Committee shall be established without legal personality in the coordination of the President of the Authority. ((. The composition and duties of the Codex Alimentarius National Committee shall be established by order of the President of the Authority. 68. Article 52 shall read as follows: "" Art. 52. -For the unitary application of the provisions of this ordinance the Authority shall develop and approve, by order of the President, the veterinary norm on the definition of the terms used in the veterinary field. " 69 articles 53 and 54 shall be repealed. 70. Article 55 shall read as follows: " Article 55. -Government Ordinance no. 83/2003 on the approval of border inspection posts organised at border crossings established for the import, export and transit of the types of goods subject to veterinary checks and the conditions for the approval of posts of border inspection responsible for veterinary checks on live animals and products from third countries, published in the Official Gazette of Romania, Part I, no. 622 of 30 August 2003, approved with amendments by Law no. 524/2003 ,, is amended as follows: 1 1. The letter d) of Article 3 shall read as follows: " d) administrator-National Veterinary Health and Food Safety Authority. '; 2. Paragraph 1 of Article 4 shall read as follows: "" Art. 4. -(1) In order to be included in the list of border inspection posts approved for the control of live animals, animal products and other products subject to veterinary checks, the PIF must correspond to the general conditions and special established by the National Veterinary Health and Food Safety Authority by order of its president. " 3. Paragraph 1 of Article 5 shall read as follows: "" Art. 5. -(1) The temporary or permanent closure of the PIF or of an inspection centre in its structure, as well as the updating of the list of border inspection posts in which veterinary checks are organized shall be made by joint order of central public authorities responsible for public administration, agriculture, food, veterinary and food safety, forestry, environmental protection and transport. " 4. Article 6 shall read as follows: "" Art. 6. -The types of goods that are subject to veterinary checks for each PIF shall be established by joint order of the central public authorities responsible for public administration, agriculture, food, veterinary and veterinary matters. food safety, forestry, environmental protection and transport. " 5. Article 7 shall read as follows: "" Art. 7. -The veterinary inspection services at the border crossing points shall be organized and operated within the PIF, in the structure of the National Veterinary Health and Food Safety Authority. " 6. Article 9 shall read as follows: "" Art. 9. -The duties of the staff employed in the PIF will be determined by order of the President of the National Veterinary Health and Food Safety Authority. " 7. Article 10 shall read as follows: "" Art. 10. -The coordination and control of the technical and administrative work of the PIF, the powers and responsibilities on the command line shall be established by order of the President of the National Veterinary Health and Food Safety Authority. " 8. Paragraph 3 of Article 11 shall read as follows: " (3) After the mentioned debates, the Ministry of Agriculture, Forestry and Rural Development, the Ministry of Administration and Interior, the Ministry of Public Finance, the National Veterinary Health and Food Safety Authority and The National Customs Authority will develop methodological norms for the implementation of the provisions of this ordinance, on the long-term strategy, which will be approved by Government decision and will include the responsibilities and deadlines, framed in the national strategy on joining the European Union, for those responsible for the construction, equipping and personnel insurance for future PIF of national interest. " 9. Article 12 shall read as follows: "" Art. 12. -The National Veterinary Health and Food Safety Authority shall be responsible for the financing of the design and construction of the PIF set out in the long-term strategy. " 10. Article 13 shall read as follows: "" Art. 13. -The buildings necessary for the establishment and operation of the PIF will be acquired in public property of the state in one of the ways provided for in art. 7 7 of Law no. 213/1998 on public property and its legal regime, as amended, and will be given in the administration of the National Veterinary Health and Food Safety Authority. "" 71. Article 56 shall read as follows: "" Art. 56. -(1) The organizational structure, operation and number of posts within the Authority, as well as the total number of posts for subordinate units shall be approved by Government decision. " ------------- Alin. ((1) art. 56 of ORDINANCE no. 42 42 of 29 January 2004 published in MONITORUL OFFICIAL no. 94 94 of 31 January 2004, approved by LAW no. 215 215 of 27 May 2004 ,, has been amended by section 11 11 of art. I of EMERGENCY ORDINANCE no. 88 88 of 4 November 2004 published in MONITORUL OFFICIAL no. 1.053 1.053 of 12 November 2004. (2) The number of posts of the Authority shall be ensured by taking a number of 14 posts financed from the state budget from the Ministry of Agriculture, Forestry and Rural Development, 14 posts financed from the state budget from the Ministry of Health and 35 posts funded from the state budget, taken over by the reorganization of the National Veterinary Health Agency of the Ministry of Agriculture, Forestry and Rural Development, and the posts financed from their own income and from the funds public related units subordinated to the Ministry of Agriculture, Forests and Rural Development at the Authority. (3) The staff of the Authority and within the veterinary and veterinary departments and for the safety of the county food and the city of Bucharest are made up of both civil servants and contract staff. (4) Salarization of staff within the Authority is made according to the legal provisions applicable to salarized personnel from their own income and public funds, and the salary of the personnel in the veterinary directions and for safety the county food and the city of Bucharest is made according to the legal provisions applicable to the staff of the decentralized services of (5) The staff of the central institutes shall consist of both civil servants and contract staff. The salary of the staff is made according to the legal provisions applicable to the staff in the ((6) The inclusion in the new organizational structure of the staff shall be based on a test of professional knowledge verification, within the limits of available posts. " 72. Article 57 shall read as follows: "" Art. 57. -(1) The Ministry of Public Finance is authorized to introduce the amendments arising from the application of the provisions of this ordinance in the structure of the state budget, the budget of the Ministry of Agriculture, Forestry and Rural Development and the The Ministry of Health for 2004 and its annexes, on the basis of the protocol of delivery-reception concluded between the Ministry of Agriculture, Forestry and Rural Development, the Ministry of Health and Authority, within 6 months from the entry into force of this ordinance. (1), from the state budget through the budget of the Ministry of Agriculture, Forestry and Rural Development shall be provided the financial sources for the activities provided in: a) Government Emergency Ordinance no. 113/2002 on the identification and registration of bovine animals in Romania, published in the Official Gazette of Romania, Part I, no. 708 of 27 September 2002, approved with amendments by Law no. 25/2003 ; b) Government Emergency Ordinance no. 127/2003 on the identification and registration of pigs, sheep and goats, published in the Official Gazette of Romania, Part I, no. 931 of 23 December 2003, approved with amendments by Law no. 118/2004 ; c) Government Ordinance no. 83/2003 on the approval of border inspection posts organised at border crossings established for the import, export and transit of the types of goods subject to veterinary checks and the conditions for the approval of posts of border inspection responsible for veterinary checks on live animals and products from third countries, published in the Official Gazette of Romania, Part I, no. 622 of 30 August 2003, approved with amendments by Law no. 524/2003 .. " 73. Article 57 shall be inserted after Article 57 (1) with the following contents: "" Art. 57 ^ 1-The ongoing projects through the PHARE program implementation unit within the Ministry of Agriculture, Forestry and Rural Development, which have as beneficiary the Authority, will continue to be carried out through the structures specialized of the Ministry of Agriculture, Forestry and Rural Development and co-financed from the budget of the Ministry of Agriculture, Forestry and Rural Development until their completion.
