Article I the Government Ordinance is approved. 42 of 29 January 2004 on the work of the Organization, pursuant to art. 1 (III) of the law No. 559/2003 concerning the Government's empowerment issue decrees published in the Official Gazette of Romania, part I, no. 94 of 31 January 2004, with the following amendments and supplements: 1. Title of the Ordinance shall read as follows: "ORDINANCE on the Organization of work of the sanitary-veterinary and food safety" 2. Article 2 shall read as follows: Art. 2.-individuals and legal entities owning or holding times of live animals animal bedding material, those that produce, store, collects, transports, processes, intermediates, put on the market, importing, exporting or sells live animals times seedlings, animal products and animal by-products, veterinary medicinal products, waste, animal by-products not intended for human consumption or animal pathogens , products and materials intended for use in animal nutrition or other materials and products that can influence the State of health of animals shall be responsible for the implementation and enforcement of legislation just for health, in order to ensure and guarantee the animals ' health, public health, animal protection, environmental protection and food safety. "
3. Article 3 shall read as follows: Art. 3. supports the work of the State of health of livestock, surveillance, prevention and control of diseases that can be transmitted from animals to humans, by providing legal, institutional and financial resources of the technical-material basis necessary for optimal deployment of activities in the field of animal health. "
4. The title of chapter II shall read as follows: "Organization and functioning veterinary services" 5. Article 4 shall read as follows: Art. 4.-veterinary services and food safety are organized and function as a single system for veterinary use and are structured as follows: a) State-public services-veterinary and food safety;
  

b) veterinary activities practice. "

6. Article 5 shall read as follows: Art. 5.-veterinary services are organized by the State after a unified conception, the pyramid scheme of order flow, on the principle of territorial jurisdiction, as distinct and autonomous sector, having the following structure: a) the national authority Veterinary and Food Safety Authority, hereinafter referred to as, is the central authority for animal health and food safety, which coordinates the whole technical and administrative work of the veterinary services and food safety organizes and controls the activities of veterinary public health and food safety;

b veterinary authorities) institutes of reference at national level for their specific fields of competence, with legal personality, subordinated to the authority;
  

c) directions for health and food safety and to Bucharest authorities, sanitary-veterinary and food safety and the municipality of Bucharest, with legal personality, subordinated to the authority, which is set up by reorganizing the health regions and divisions of the municipality of Bucharest, decentralized public services which operates under the Ministry of agriculture, forestry and rural development;
  

d) circumscriptions zonal veterinary and health districts and for food safety, unincorporated, organized in divisions of the veterinary and food safety and the municipality of Bucharest;
  

e) border inspection posts, unincorporated, organized structure of authority. "
  

7. Article 6 shall read as follows: Art. 6. — (1) the authority shall be established by the reorganization of the Romanian Agency for food safety, the health of the national agency of the Ministry of agriculture, forestry and rural development, as well as some services operating in the structure of the Ministry of agriculture, forestry and rural development.

(2) establishments that operate under the Authority set out in the annex. 2. (3) the authority takes over the rights, duties, powers, personnel and financial resources of the national agency of Veterinary and Food Safety Agency "for."
  

8. Article 6 shall be inserted After article 6 ^ 6 ^ 1-9 with the following contents: Art. 6 ^ 1. -(1) Repealed.

(2) the authority shall ensure Financing from own income and allowances from the State budget.
  

Art. 6 ^ 2. -The Authority aims to: "the animal health), defending the protection of animals, prevent the transmission of diseases from animals to humans, the safety of food of animal origin intended for human consumption, animal feed and health and environmental protection, in relation to animal husbandry, identification and registration of animals except equidae;".

b) achieving food safety, from production of raw materials up to the distribution of food to the consumer.
  

Art. 6 ^ 3. -The authority has the following main tasks: to) organise the veterinary services of the State and sets funding needs;
  

b) organises public veterinary activities throughout the country, following a unitary concept, in order to ensure animal health, public health, animal protection, environmental protection and food safety;
  

c) establishes the functions and responsibilities of the veterinary services of the State;
  

d) develops and promotes, in collaboration with other authorities involved skill, the legal framework in the field of food safety and quality;
  

e) participate in the work of standardization, grading and qualification of food;
  

f) organise the work in the area of food quality and safety, in collaboration with other authorities concerned, in accordance with the ability of legal competence;
  

g) carried out in collaboration with other authorities involved skill, system analysis, management and communication of risk safety and food quality;
  

h) issues scientific opinions and scientific and technical assistance concerning national legislation and community in areas that have a direct or indirect influence on the safety of food and feed. Provide independent information on all matters relating to those fields and communicates risks;
  


I) contributes to the achievement of a high level of protection of human life and health, taking account of the animal health and welfare, plant health and environmental protection;
  

j) collects and analyzes data to allow the characterisation and monitoring of risks which have a direct or indirect influence on the safety of food and feed;
  

k) shall advise the scientific and scientific and technical assistance on nutrition, taking account of community and national legislation, scientific advice on matters relating to animal health and welfare and plant health, as well as scientific opinions on products other than food and feed, in relation to genetically modified organisms as defined by Government Ordinance. 49/2000 on the regime for obtaining, testing, use and sale of genetically modified organisms through modern biotechnology techniques and products resulting therefrom, approved with amendments and completions by law No. 214/2002;
  

l) issues scientific opinions that serve as the scientific basis for the drafting and adoption of measures in the areas relating to its object;
  

m) draft normative acts for the performance of specific duties.
  

Art. 6 ^ 4. -(1) the authority shall work in cooperation with the Ministry of agriculture, forestry and rural development, Ministry of health and the national authority for consumer protection, as well as with other Governments that have executive powers in the field of food safety.

(2) the authority shall cooperate with the European Food Safety Authority, with similar institutions of the community and of the Member States, as well as with similar international institutions.
  

Art. 6 ^ 5. -(1) in carrying out its duties the authority constitute the structure of the contact with the European Food Safety Authority and acts on the basis of functional and decisional autonomy according to the commitments entered into by Romania.

(2) under the authority of the operational Secretariat work for the Codex Alimentarius Commission, headed by the President of the authority.
  

« 6 ^ 6. -(1) the authority is headed by a President with the rank of Secretary of State and 2 Vice-Presidents with the rank of Undersecretary of State, appointed by decision of the Prime Minister. (1) of article 1. 6 ^ 6 of ORDINANCE No. 42 of 29 January 2004, published in Official Gazette No. 94 of 31 January 2004, approved by law No. 215 of 27 May 2004 was amended by subparagraph (a). to a point 30) of art. 1 of law No. 71 from 28 March 2013, published in MONITORUL OFICIAL nr. 171 of 29 March 2013.

(2) in exercising the functions incumbent on President issues orders and instructions, in accordance with the law.
  

(3) the President shall be assisted in its work by a Scientific Council and an Advisory Council without legal personality.
  

(4) the President is the main Authority for loan originator.
  

Art. 6 ^ 7. -The Secretary-General of the Authority shall be appointed by decision of the Prime Minister. Its powers shall be laid down by order of the President of the authority.
Art. 6 ^ 8. -(1) the Scientific Council is composed of a minimum of 7 recognized personalities in the fields of competence of the authority.

(2) the composition and rules of organization and functioning of the Scientific Council are approved by order of the President, within 15 days from its appointment.
  

Art. 6 ^ 9. -(1) the Advisory Board shall be composed of representatives of ministries, other public administration authorities competent in the field of animal health and food safety and civil society representatives.

(2) the Advisory Board shall be chaired by the President of the authority.
  

(3) the composition and rules of organization and functioning of the Consultative Council shall be approved by order of the President, within 15 days from its appointment.
  

(4) members of the Scientific Council shall receive an allowance for the participation of up to 20% of gross compensation of the President of the authority. "
  

9. Article 7 shall read as follows: Art. 7 — Repealed.

10. After article 7 article 7 is inserted: ^ 1 with the following content: "Art. 7 ^ 1. -(1) the authority shall operate in accordance with the principles of independence, transparency, confidentiality, access to documents and information in accordance with the law.

(2) the authority shall submit annually a report on Government work, which includes the totals the results. "
  

11. Article 8 shall read as follows: Art. 8.-(1) official veterinarians are veterinarians within the Veterinary Authority, institutes and divisions for the sanitary-veterinary and food safety and the municipality of Bucharest.

(2) veterinary surgeons operating in the structure of other ministries have duties and powers of the official veterinarian and can be passed with the consent of the parties, the structure of the authority. "
  

12. The title of chapter III shall read as follows: "the Duties and powers of the veterinary services ' 13. Article 9 shall read as follows: Art. 9.-competencies of the veterinary services of the State are: the establishment of obligations and responsibilities) natural and legal persons in the veterinary field;
  

(b) obligations and responsibilities) the establishment of the institutions and organs of the public administration in the veterinary field;
  

c) acceptance, approval and accreditation in the field of health;
  

d) health information system;
  

e) self-assessment of the veterinary services;
  

f) definition of technical terms used in the field of animal health, referred to in the annex. 1;
  

g) animal health: health status qualification of animals, veterinary certification, protective measures, notification, the notification of diseases, veterinary control animal diseases and prevent their transmission from animals to humans;
  

veterinary public health);
  

"i) identification and registration of animals except equidae;".

j) establishing veterinary requirements and internal control production, movement, sale, trade, import, export and transit of live animals, seedlings, animal products and by-products subject to surveillance and veterinary control;
  

k) medicated feedingstuffs, compound feedingstuffs and feed additives;
  

l) establishing requirements for the protection of animal health and animal welfare and control their implementation;
  

m) inspection and veterinary checks;
  

n) veterinary requirements for breeding animals;
  

a) establishment spending on health;
  

p) elaboration and implementation of the system of instruction in the field of animal health;
  

q) establishment and endowment investment needs in the veterinary field. "
  

14. Article 10 shall read as follows: Art. 10.-has the following attributions: Authority to) organize public veterinary activities throughout the country, following a unitary concept, in order to ensure animal health, public health, animal protection, environmental protection and food safety;
  

b) elaborates health rules that are approved by order of the President of the authority, in their respective spheres of competence of the veterinary services, unique and mandatory for individuals and businesses. 2;
  

(c) monitoring compliance with animal health rules);
  

d) determines the general responsibilities of veterinarians;
  

e) determines the rights and obligations of official veterinarians;
  

f) establishes the rights and obligations of Veterinary Surgeons practising empowered to carry out veterinary activities;
  

g) participate in the elaboration of conventions or agreements and advising on cooperation in the veterinary field;
  

h) together with the Ministry of health is responsible for the Organization and implementation of measures for prevention and control of common diseases of man and animals, as well as for the safety of food of animal origin;
  

"i) organizes, coordinates, manages and controls on the identification and registration of animals except equidae;".

j) organizes, coordinates, manages and controls the border inspection posts;
  

k) organizes and ensures the functioning of the health information system and connecting it to the veterinary information system of the European Union;
  

l) develops regulations for organization and functioning of veterinary services and establishes the powers and responsibilities thereof;
  

m) organizes and controls the activities of public health carried out by Veterinary Surgeons practising attorneys;
  

n) lays down animal health requirements;
  

an elaborate national programmes) in the veterinary field, approved by order of the President of the authority. "
  

15. Article 11 shall read as follows: Art. 11.-the rights and powers of the authority are as follows: a) has free access to exercise specific powers, the objectives set out in article 3. 18 paragraph 1. (1), and in other places are subject to surveillance and veterinary control;
  

b) require the production and checking of any documents, data and relevant information relating to the objectives laid down in article 21. 18 paragraph 1. (1);
  

c) has safeguards and restriction on live animals, bedding material, animal products and by-products are subject to surveillance and veterinary control of the objectives mentioned in article 1. 18 paragraph 1. (1);
  

d) suspends or prohibits the operation of the objectives laid down in article 21. 18 paragraph 1. (1);
  

e) imposes restrictive measures concerning movement and the veterinary certification for live animals, seedlings, animal products and by-products subject to surveillance and control of animal health in the objectives set out in article 11. 18 paragraph 1. (1);
  

f) restrict or forbid trade in or manufacture, import, placing on the market, export and transit of live animals, seedlings, animal products and by-products subject to surveillance and veterinary control;
  

g) collected samples for laboratory examinations, intended to elucidate risk factors relating to animal health, public health, animal protection, environmental protection and food safety;
  

h) checks whether the staff of the objectives laid down in article 21. 18 paragraph 1. (1) comply with the animal health requirements concerning animal health, public health, animal protection, environmental protection and food safety;
  

I) inspects and controls compliance with veterinary requirements for the objectives set out in article 3. 18 paragraph 1. (1);
  

j) features the sequestration or killing veterinary times sequestration, confiscation and destruction of products and by-products subject to surveillance and veterinary control;
  

k) apply sanctions in case of Commission of acts constituting the offence to veterinary legislation;
  

it) requires public administration bodies of Central and local application of legal measures in case of necessity or of imminent risk for animal health, public health, animal protection, environmental protection and food safety. "
  

16. Article 12 shall read as follows: Art. 12.-In order to achieve the public veterinary activities, within the limits of competence of the veterinary services of the State, the authority cooperates with the central public administration authorities and local associations and employers in the agricultural sector and the pharmaceutical industry, with representatives of civil society and international organisations in the field of health. "
17. After article 12 article 12 shall enter ^ 1 with the following content: "Art. 12 ^ 1. -Powers of the authority in the field of food safety are established and through specific legislation. "
18. Article 13 shall read as follows: Art. 13.-in exercising that profession veterinarians have the following obligations: a) to announce the emergency authority veterinary health and food safety of any suspicion regarding the occurrence of a disease subject to compulsory notification, in accordance with the law, and that any risk regarding animal health, public health, animal welfare and protection, environmental protection and food safety;
  

b) take emergency measures provided for by law, to prevent and stop the dissemination of diseases transmissible to animals or any risk liable to affect animal health and public health, animal protection, environmental protection and food safety;
  

c) to participate, at the request of the Directorate of veterinary and food safety to the respective District of Bucharest, or, where appropriate, to the authority, the actions for the eradication of communicable diseases of animals or to those in the case of an outbreak of emerging communicable diseases for Romania;
  

d) to order compliance with the waiting periods and, relating to the disposal or presence of the residues in live animals, products or by-products of animal origin intended for human consumption;
  

e) to record and keep, for a period determined by the authority, the records of the work done and track how prescribing, distribution and use of veterinary medicinal products, of feed additives and feed medicated;
  

f) maintain confidentiality of any facts, information and documents upon which acquire knowledge in the pursuit of the activities, for which there is copyright, protection of commercial confidentiality or if use is licensed. "
  

19. Article 14 shall read as follows: Art. 14.-(1) official veterinarians have the following obligations: a) have provisions of veterinary legislation, compliance controls and carries out public health activities falling within their responsibility;
  

b) necessary measures and feature supervising their application by natural and legal persons, for the protection and improvement of the health of animals, the protection of public health, the protection of animals, environmental protection and food safety;
  

c) have the necessary measures without delay, up to clarify any suspicions concerning the occurrence of a disease or an element of risk in relation to animal health, public health, animal protection, environmental protection and food safety;
  

d) measures necessary to have an indication of the causes of the disease and monitoring compliance with specific measures for the control and eradication of communicable diseases and zoonoses;
  

e) participates in the assessment of compensation costs in the case of slaughter or killing of livestock, rendering plant and processing of animal waste, disinfection, disinsection, deratization and confiscation or destruction of seedlings of animal products and by-products times subject to surveillance and veterinary control;
  

f) ensures control of products and by-products of animal origin intended for human consumption and which are not intended for that purpose, of the feed materials used in feedingstuffs and veterinary medicinal products, in all phases of production, storage, collection, transportation, processing, marketing, mediation, and of those who are subject to the import, export, transit and trade;
  

g) participate in the training courses in the field of animal health.
  

(2) the measures provided for by the official veterinarians in the exercise of their powers and responsibilities are mandatory for all natural and legal persons carrying out activities falling within the powers of the veterinary services.
  

(3) the specific rights of official veterinarians are conferred the powers of the veterinary authority and food safety, as provided for in art. 11. (4) depending on the national strategy in the field of health, the authority may establish and other rights and obligations of official veterinarians. "
  

20. Article 15 shall read as follows: Art. 15. — (1) veterinary surgeons practising attorneys have obligations under article 4. 13, as well as those arising from contracts for veterinary activities, public health departments and food safety and the municipality of Bucharest.

"(2) for performing the nonprofesionale holdings of some veterinary tasks listed in the program of surveillance, prevention and control of animal diseases, those transmissible between animals and humans, animal protection and environment protection, for the identification and registration of bovine animals, pork, sheep, goats and equidae, as well as other actions provided for in other national programmes, the authority must implement , directions of veterinary and food safety and the municipality of Bucharest can conclude contracts with surgeons, organised in accordance with the law, they can hire their own personal health, in accordance with the law, in situations in which you cannot enter into contracts with surgeons, organised in accordance with the law. (3) Repealed.

(4) the activities of veterinary medical assistance are provided exclusively for veterinary medical services. "
  

21. The title of chapter V shall read as follows: "the duties and responsibilities of the veterinary field" 22. Article 16 shall read as follows: Art. 16.-individuals and legal entities referred to in article 1. 2 have the following obligations: a) to announce and veterinary Directorate for food safety Bucharest County or the start times subject to surveillance and restriction of the activities of veterinary control;
  

b) to provide the necessary support to the authorities for veterinary and food safety for the accomplishment of their duties and responsibilities;
  

c) allow free access and unrestricted, permanent health authorities and food safety to carry out inspections, examinations, checks or checks in the objectives set out in article 11. 18 paragraph 1. (1);
  

d) provide health authorities and food safety assistance needed during the checks, inspections, checks and examinations performed by them to achieve the objectives, competences and responsibilities thereof;
  

e) without delay inform veterinary authorities and local food safety and local public administration about the appearance of any suspicion or animal diseases, and until the arrival of the veterinarian, to isolate sick animals, death, killed, being cut times prohibited the use or marketing of meat and other products and by-products from these animals, without the approval of the veterinary authority and local food safety;
  

f) to inform the authorities of the veterinary and food safety local within the set of specific legal provisions about the entrance/exit of the animals from localities, alienation and acquisition, extinction, death, animals, and any other events relating to the movement of animals;
  

g) to support the veterinary authorities and food safety in conducting sanitary-veterinary actions in the public interest;
  

h) to present the animals for carrying out sanitary-veterinary actions in the public interest, the place, date and hour fixed by the official veterinarian or by the veterinarian authorized practice;
  

I) to comply with the measures laid down by the veterinary and food safety;
  

j) to inform the veterinary authority and local food safety and animal health certificate request and transport or other documents necessary for the movement or transport of live animals, seedlings, animal products and by-products subject to surveillance and veterinary control;
  

k) to send the veterinary authority and for food safety, at its request, copies of documents and certificates accompanying animals, bedding material, animal products and by-products are subject to surveillance and veterinary control;
  

l) comply with the prohibitions and restrictions laid down by the veterinary and food safety relating to the activities referred to in article 1. 2;
  

m) to put on the market, importing, exporting, and sell only live animals, seedlings, animal products and by-products derived from animals which have been treated with veterinary medicinal products, have been waiting periods or interruption;
  

n) to abide by the measures of prohibition and restriction on veterinary medicinal products and for products and materials used in animal nutrition, for some banned substances or unauthorized use of animals or be used in relation to products of animal origin;
  

o) to provide health authorities and food safety live animals or material, animal bedding products and animal by-products, veterinary medicinal products, waste, animal by-products not intended for human consumption and pathogens of animal origin products and materials intended for use in animal nutrition or other materials and products that may influence the health status of animals in order to examine and test them for the presence of certain substances prohibited or unauthorized use for health purposes;

(2) the authority shall determine, by order of the President of the veterinary requirements for the protection of animals kept for farming purposes, during transport animals during the slaughter or killing of animals used for research, experimentation or diagnostic animal parks, Zoological gardens, nature reserves, wildlife, pets or service animals competition of clumps for temporary pets , of the animal species threatened with extinction and controls the compliance with these requirements.
  

(3) the authority, in collaboration with non-governmental organizations for the protection of animals, will take the necessary measures to comply with the veterinary requirements referred to in paragraph 1. (2)."
  

58. Article 45 shall read as follows: Art. 45. — (1) the authority shall determine, by order of the President of the veterinary requirements for the manufacture, testing, approval, storage, transportation, sale, use, import, transit, export and trade in feedingstuffs, feed materials, premixtures, zooforturi, feed additives, feedingstuffs, compound feedingstuffs, feed additional, other materials and products used in animal nutrition and feeding.

(2) the authority shall determine a list of the different types of feed and feed materials, premixtures, additives, feedingstuffs, feed additives, animal feedingstuffs, compound feedingstuffs and supplementary to other materials and products used in feeding or animal nutrition in Romania. "
  

59. Article 46 shall read as follows: Art. 46. — (1) the authority shall determine, by order of the President of the veterinary requirements for the manufacture, testing, approval, storage, transportation, sale, use, import, transit, export and trade in veterinary medicinal products.

(2) the authority shall draw up and keep up to date, by order of the President, a list of establishments producing veterinary medicinal products, and the list of manufacturers and distributors authorized to have possession of active substances with anabolic, anti-infectious, antiparasitic, anti-inflammatory, hormonal or psychotropic substances which may be used in the manufacture of veterinary medicinal products.
  

(3) the authority shall establish and keep up to date, by order of the President, the list of authorised veterinary medicinal products, and waiting periods, and bans on the use of some of these products.
  

(4) the authority shall develop and implement a pharmacovigilance programme. "
  

60. Article 47 shall read as follows: Art. 47.-together with the national authority responsible for the selection of activities and improvement of livestock and the organizations and associations of producers, the authority shall lay down the animal health requirements relating to animals and breeding activity. (1) on behalf of the veterinary divisions and for the safety of novel foods and of Bucharest and constitute, for them, for their own income intended for financing current expenditure and capital, which is recorded in the accounts separately.
  

(5) the income for the institutions referred to in article 1. 5 letter b) and (c)) is constituted by the exercise of the activity of the inspection and veterinary control, from rates for sanitary-veterinary laboratory, from consulting and other specific benefits: actions of disinfection, disinsection, deratization, exams and laboratory work, and other activities in the field of animal health.
  

(6) own revenue under paragraph 1. (4) and (5) are intended for financing current expenditure and capital and shall be recorded in the accounts separately. These revenues will be used to hire staff and auxiliary.

64. Article 50 shall read as follows: Art. 50. — (1) the expenditure involved in executing the measures ordered by the Authority at the border inspection posts as referred to in art. 40 para. (5), shall be borne by the exporter, the importer or, where applicable, the person responsible, in accordance with the Convention.

(2) veterinary information system including: national information system, Intranet information system for registration of animals, the computer system for notifying communicable diseases of animals, rapid alert system, the computer system for monitoring the movement of animals, the computer system on monitoring import and transit, the computer system for monitoring animal health communicable diseases of animals, as well as other information systems necessary for the powers of the veterinary services of the State within the limits of their competence. "
  

65. Article 50 shall be inserted After article 50 ^ 1 with the following content: "Art. 50 ^ 1. -The authority may contract advisory services in the field of information technology and communications, public relations, promotional campaigns, organization, publicity, education and information relating to the specific activity. "
66. Article 51 shall read as follows: Art. 51. — (1) the acts constituting the offence the health and veterinary rules as well as people who can to check irregularities and apply the penalties shall be established by decision of the Government.

67. According to article 51 shall be inserted in articles 51 and 51 ^ 1 ^ 2 with the following content: "Art. 51 ^ 1. -(1) The schools postgraduate studies from the faculties assessed and approved by the European Commission shall establish training centers and veterinary training, with legal personality, the coordination authority.

(2) an attestation concerning the graduation and promotion of courses within the training centres and veterinary training is done by receiving a graduation diploma issued by the authority and faculties assessed and approved by the European Commission.
  

(3) the rules of organization and functioning of centres for training and veterinary training shall be determined by order of the President of the authority, with the opinion of the Ministry of education and research.
  

Art. 51 ^ 2. -(1) the National Committee shall be established in the Codex Alimentarius, without legal personality, in coordinating the President's authority.

(2) the composition and duties of National Committee on Codex Alimentarius shall be determined by order of the President of the authority. "
  

68. Article 52 shall read as follows: Art. 52.-For the uniform implementation of the provisions of this Ordinance the authority shall draw up and approve, by order of the President, veterinary norm concerning the definition of terms used in the veterinary field. "
69. Articles 53 and 54 shall be repealed.
70. Article 55 shall read as follows: Art. 55.-Government Ordinance. 83/2003 regarding the approval of border inspection posts set up in border crossing points established for the import, export and transit of the types of goods subject to veterinary checks and the conditions for approval of border inspection posts responsible for veterinary checks on live animals and products coming from third countries, published in the Official Gazette of Romania, part I, no. 622 of 30 august 2003, as amended by law No. 524/2003, shall be amended as follows: 1. In subparagraph (d)) of article 3 shall read as follows: «d) administrator-national authority for Health and food safety. "
2. Paragraph 1 of article 4 shall read as follows: «Art. 4.-(1) to be included in the list of approved border inspection for control of live animals, animal products and other products subject to veterinary checks, the IFD must comply with the General conditions and Special Health Authority and for food safety by order of its President.»
3. Paragraph 1 of article 5 shall read as follows: «Art. 5.-(1) the temporary or permanent Closure of the PIF or an inspection of its structure, as well as updating the list of border inspection points in which are organized veterinary checks are carried out by order of the central public authorities that are responsible for public administration, agriculture, food, sanitary-veterinary and food safety, environmental protection, forestry and transport.»
4. Article 6 shall read as follows: «Art. 6.-types of goods which are subject to veterinary control for every PIF will be established by order of the central public authorities that are responsible for public administration, agriculture, food, sanitary-veterinary and food safety, environmental protection, forestry and transport.»
5. Article 7 shall read as follows: «Art. 7.-veterinary services control at border crossing points are organized and function within the structure of the Authority's PIF, the National Veterinary and food safety. "
6. Article 9 shall read as follows: «Art. 9.-the duties of the staff employed in the IFD shall be determined by order of the President of the National Sanitary veterinary and food safety. "
7. Article 10 shall read as follows: «Art. 10.-coordination and control of the technical and administrative activity of the PIF, the powers and responsibilities on the command line are determined by order of the President of the National Sanitary veterinary and food safety. "
8. In paragraph 3 of article 11 shall read as follows: "(3) upon the completion of debate, the Ministry of agriculture, forestry and rural development, Ministry of administration and Interior, the Ministry of public finance, national authority for Health and food safety and the ANV will elaborate guidelines for the implementation of the provisions of this Ordinance, a long-term strategy that will approve the Government's decision and will involve responsibilities and deadlines , placed in the national strategy for joining the European Union, for those responsible for the construction, equipping and providing personnel for future PFI national interest.»
9. Article 12 shall read as follows: «Art. 12.-the national authority animal health and food safety is responsible for funding the design and construction of the PIF strategy laid down in the long term.»
10. Article 13 shall read as follows: «Art. 13.-formation and functioning of Buildings needed MUNA will be acquired in the public property of the State in one of the ways provided for in art. 7 of law No. 213/1998 public property and its legal status, and its subsequent amendments, and will be given in the administration of the National Sanitary veterinary and food safety. "

(2) the number of posts of Authority shall ensure by taking a number of 14 posts funded from the State budget from the Ministry of agriculture, forestry and rural development, 14 posts funded from the State budget from the Ministry of health and 35 posts financed from the State budget, taken by reorganizing the National Health Agency of the Ministry of Agriculture Rural development and forestry, and publicly funded stations own incomes and public funds from subordinate units under the Ministry of agriculture, Forests and rural development at authority.
  

(3) the staff of the authority and within the divisions of the veterinary and food safety and Bucureşti is formed from both civil servants and contractual staff.
  

(4) personnel within the Authority is made according to the legal provisions applying to the staff paid from public funds and own incomes, and personnel from the directions of veterinary and food safety and the municipality of Bucharest is made according to the legal provisions applicable to the staff of decentralised departments of ministries.
  

(5) the staff of the institutes is formed from both civil servants and contractual staff. Personnel is done according to the legal provisions applying to the staff of the budget.
  

(6) employment in the new organizational structure of the personnel shall be made on the basis of a verification test of professional knowledge, up available stations. "
  

72. Article 57 shall read as follows: Art. 57. — (1) the Ministry of public finance is authorised to introduce changes which will result from application of the provisions of this Ordinance in the structure of the State budget, the budget of the Ministry of agriculture, forestry and rural development and the Ministry of Health's budget for 2004 and the annexes thereto on the basis of delivery-receipt protocol concluded between the Ministry of agriculture, forestry and rural development, Ministry of health and authority, within 6 months after the entry into force of this Ordinance.

(2) pending the conclusion of the Protocol referred to in paragraph 1. (1) the actions and activities of the authority and of the units set out in the annex. 2 ensure that the Ministry of agriculture, forestry and rural development.
  

(3) pending the conclusion of the Protocol referred to in paragraph 1. (1) from the State budget through the budget of the Ministry of agriculture, Forests and rural development shall ensure financial sources for activities set out in: (a) Emergency Ordinance) No. 113/2002 on the identification and registration of bovine animals in Romania, published in the Official Gazette of Romania, part I, no. 708 of 27 September 2002, as amended by law No. 25/2003;
  

b) Government Emergency Ordinance nr. 127/2003 on the identification and registration of ovine and caprine animals, pork, as published in the Official Gazette of Romania, part I, no. 931 of 23 December 2003, as amended by law No. 118/2004;
  

c) Ordinance No. 83/2003 regarding the approval of border inspection posts set up in border crossing points established for the import, export and transit of the types of goods subject to veterinary checks and the conditions for approval of border inspection posts responsible for veterinary checks on live animals and products coming from third countries, published in the Official Gazette of Romania, part I, no. 622 of 30 august 2003, as amended by law No. 524/2003. Article II on the date of entry into force of this law shall be repealed Ordinance No. 90/2003 on the establishment of the Romanian Agency for food safety, which was published in the Official Gazette of Romania, part I, no. 624 of 31 august 2003, as amended by law No. 600/2003, and any other provisions to the contrary.


Article III Ordinance No. 42/2004 on the organisation of the veterinary activity, published in the Official Gazette of Romania, part I, no. 94 of 31 January 2004, with amendments and additions made by this Bill, will the Republic Official Gazette of Romania, part I, posing a new texts.
