The Romanian Parliament adopts this law + Article 1 ((1) The war decorations provided for in art. 9 9 of Law no. 29/2000 on the national system of decorations of Romania, as amended, as well as in the laws and regulations specific to each decoration can be conferred to military or military units for heroism and for acts of weapons or command and service on the battlefield. (2) The war decorations may be conferred on the Romanian military and the Romanian military units, in the case of: a) Romania's training in a declared war with other states; b) an armed aggression directed against Romania; c) participation in joint combat actions with soldiers of other states, under the mandate of international bodies or coalitions to which Romania is a party. + Article 2 (1) War decorations may also be conferred on foreign military and foreign military units, as follows: a) military and military units of the states allied to Romania, in case of war or armed conflict; b) commanders, armed forces, placed under the jurisdiction of international bodies, for which Romanian units or subunits act; c) military and foreign military units that, through their actions, saved the lives of Romanian soldiers or significantly helped the Romanian units in carrying out the missions that were returning to them within multinational forces. (2) Exceptionally, the President of Romania may give war decorations to military commanders of other states, who have distinguished themselves particularly in war or armed conflicts in which the Romanian state did not participate directly with troops, but which supported them logistically and/or only politically. + Article 3 (1) The war decorations shall be conferred on officers, military foremen, sub-officers and military within the term, contract-based employees or reserves mobilized, depending on the military degree they had, as well as the category of weapons or weapons acts. Command and service during combat actions. (2) Exceptionally, civil persons not classified in any organized military form, who have brought special services during the fighting of military or military units in combat, can be decorated with orders and medals of war. (3) War decorations shall be conferred on military units according to the category of acts of weapons committed during combat actions. + Article 4 The categories of acts of weapons and services, as well as war decorations in various degrees or classes, which can be conferred, are provided in the Regulation on the conferral of war decorations in the annex that is an integral part of this law. No. 517. + Annex REGULATION on the conferral of war decorations + Article 1 (1) The war decorations may be conferred on officers, military foremen, sub-officers and military personnel in the term, military personnel on the basis of contract or reserves mobilized, for the following categories of facts: a) category I: acts of weapons or of an entirely exceptional command; b) category II: weapons or special command acts; exceptional service on the battlefield; c) category III: acts of weapons or meritorious command; performance of special services on the battlefield. (. By means of wholly exceptional weapons or command, for the purposes of this Regulation, it shall be understood: a) acts of bravura and heroism committed by the military under the fire of the enemy; b) acts of initiative in offensive or fiercely resistant actions in the position, which have significantly influenced the conduct of combat actions; c) facts of the commanders of the units in combat or of the major state officers who distinguished themselves by initiative, courage and decision and who, through their actions of command, decisively influenced the actions of fighting on the whole of the front. (3) By acts of special weapons or command, for the purposes of this Regulation, it is understood: a) acts of initiative in offensive or position-resistance actions, which have had an important role in the conduct of combat actions; b) facts of the commanders of the units on the battlefield or of the major state officers who stood out by the initiative, courage and decision and who, through their actions of command, brought an improvement in the situation on the battlefield. (4) By performing exceptional services on the battlefield, for the purposes of this Regulation, it is understood the organisation and management of the actions of the various logistics services behind the front, the contribution of which has been essential in the carrying out combat actions. (5) By acts of weapons or by meritorious command, for the purposes of this Regulation, it is understood: a) the skilful management of the combat actions by the subunit and unit commanders or the major state officers, which resulted in the performance of the combat missions with minimal personnel and combat technique losses; b) acts of initiative and success committed by the military in small combat missions; c) successful actions in operations carried out under the mandate of international bodies or coalitions. (6) By performing special services on the battlefield, for the purposes of this Regulation, it is understood to provide logistical services behind the front, through which the success of combat actions has been achieved. + Article 2 (1) War decorations may be conferred on military units for the following categories of facts: a) category I: deeds of entirely exceptional weapons committed on the battlefield; b) category II: acts of special weapons committed on the battlefield; c) category III: acts of meritorious weapons committed on the battlefield. (2) By acts of totally exceptional weapons committed on the battlefield, for the purposes of this Regulation, it is understood combat actions carried with heroism and particular bravery by military units, through which victories with implications have been obtained. of operative or tactical order and which have significantly influenced the conduct of military actions on the whole. (3) By acts of special weapons committed on the battlefield, for the purposes of this Regulation, it is understood combat actions carried with bravery and destoineness by military units, as a result of which important successes were achieved; actions of extent and with the high risk quota, carried out by the Romanian military units in missions under the mandate of international bodies or coalitions. (4) By acts of weapons the meritorious perpetrated on the battlefield, for the purposes of this Regulation, shall be understood: a) current combat actions, successfully carried out by military units; b) the successful performance of the missions entrusted in the framework of post-conflict operations or in actions of implementation and maintenance of peace, carried out under the mandate of international bodies or coalitions to which Romania is a party, which have involved and some small-scale combat actions. + Article 3 War decorations can be conferred on officers, military foremen, sub-officers and military within the term, military contract-based employees or mobilized reservists, as follows: I. Category I of facts provided in art. 1 1 para. ((1) lit. a): A. Officers: a) Order Mihai Viteazul in all classes; b) Order of the Romanian Star in the rank of Grand Cross; c) Order of the Faithful Service in the rank of Grand Cross; d) Order Star of Romania in the rank of Grand Officer; e) Order for Merit in the rank of Grand Cross; B. Military Maistri, sub-officers and military in-term, military personnel on contract or reserves mobilized: Military Virtue Medal of war in all classes. II. Category II of facts provided for in art. 1 1 para. ((1) lit. b): A. Officers: a) Order of the Star of Romania in the rank of Knight, Officer and Commander; b) Order of the Faithful Service in all grades, except for the degree of Grand Cross; c) Order for Merit in all grades, except for the degree of Grand Cross; B. Sub-officers, military foremen and military within the term, military contract-based employees or mobilized reservists: a) Cross the Faithful Service in all classes; b) Medal of the Faithful Service in all classes; c) Medal for Merit in all classes. III. Category III of facts provided for in art. 1 1 para. ((1) lit. c): A. Officers: a) Military Virtue Order in all grades; b) Aeronautical Virtue Order in all grades; c) Order of Maritime Virtue in all grades; d) Order of Health Merit in all grades; B. Sub-officers, military foremen and military within the term, military contract-based employees or mobilized reservists: a) Medal of Manhood and Faith in all classes; b) Aeronautical Virtue Medal in all classes; c) Medal of Maritime Virtue in all classes; d) The Health Merit Medal in all classes. + Article 4 War decorations can be conferred on military units as follows: I. Category I of facts provided in art. 2 2 para. ((1) lit. a): a) Order Mihai Viteazul in all classes; b) Order of the Romanian Star in the rank of Grand Cross; c) Order of the Faithful Service in the rank of Grand Cross; d) Order Star of Romania in the rank of Grand Officer; e) Order for Merit in the rank of Grand Cross. II. Category II of facts provided for in art. 2 2 para. ((1) lit. b): a) Order of the Star of Romania in the rank of Knight, Officer and Commander; b) Order of the Faithful Service in all grades, except for the degree of Grand Cross; c) Order for Merit in all grades, except for the degree of Grand Cross. III. Category III of facts provided for in art. 2 2 para. ((1) lit. c): a) Military Virtue Order in all grades; b) Aeronautical Virtue Order in all grades; c) Order of Maritime Virtue in all grades. + Article 5 The description of the war decorations is the one provided in the laws and regulations specific to each decoration. + Article 6 War decorations that can be awarded for each degree or class can be awarded in unlimited numbers. + Article 7 In case of committing acts of weapons with everything out of the ordinary, which fall into categories I-III, hierarchical superior decorations can be granted from the beginning, except for the second and I classes of the Mihai Viteazul Order. + Article 8 In the event of war or armed aggression, hierarchical commanders may propose or grant the war decorations provided for in art. 9 9 of Law no. 29/2000 on the national system of decorations of Romania, as amended, as follows: I. Independent battalion commanders and their similars may propose or grant: A. For category II facts: a) subordinate officers in the rank of sub-lieutenant and lieutenant, Order for Merit in the rank of Knight, with the approval of the immediately superior echelon; b) military foremen, sub-officers and military personnel, military personnel on the basis of contract or reserves mobilized, Medal for Merit class III; B. For acts of category III: a) subordinate officers in the ranks of sub-lieutenant and lieutenant, orders Military Virtue, respectively Aeronautical Virtue or Maritime Virtue in the rank of Knight; military doctors in the ranks of sub-lieutenant and lieutenant, Order of Merit Sanitary in the rank of Knight; b) military foremen, sub-officers and military personnel in the term, military personnel on a contract basis or reservists mobilized, manhood and faith medals, respectively Virtue of Aeronautics or Maritime Virtue, class III; sub-officers Health, the Third Class Health Medal. II. Brigade commanders and their similars may propose or grant: A. For category II facts: a) officers in the degrees of captain and major, the Order of the Faithful Service in the rank of Knight and Order for Merit in the rank of Officer, with the approval of the immediately superior echelon b) military foremen, sub-officers and military personnel, military personnel on the basis of contract or reserves mobilized, Medal of Faithful Service III class and Medal for Merit class II; B. For acts of category III: a) officers in the degrees of captain and major, orders Virtue Military, respectively Aeronautical Virtue or Maritime Virtue in the rank of Officer; military doctors in the ranks of captain and major, Order of Health Merit in the rank of Officer; b) military foremen, sub-officers and military personnel in the term, military personnel on the basis of contract or reserves mobilized, medals of the Barbation and Faith, respectively Virtue of Aeronautics or Maritime Virtue, class II; The Sanitary Merit Medal second grade. III. Masters of divisions and their similarity may propose or may grant: A. For category II facts: a) officers in the ranks of Major and Lieutenant-Colonel, Order of the Faithful Service in the rank of Officer, Order for Merit in the rank of Officer and Commander, with the approval of the immediately superior echelon; b) military foremen, sub-officers and military personnel, military personnel on the basis of contract or reserves mobilized, Cross Service Faithful Class Ii, Medal Faithful Service second class and I and Medal for Merit class I; B. For acts of category III: a) officers in the ranks of major and lieutenant colonel, orders Military Virtue, respectively Aeronautical Virtue or Maritime Virtue in the rank of Commander; military doctors in the ranks of Major and Lieutenant Colonel, Order of Sanitary Merit in the rank of Commander; b) military foremen, sub-officers and military personnel in the term, military personnel on a contract basis or reservists mobilized, manhood and faith medals, respectively Aeronautical Virtue or Maritime Virtue, class I; health sub-officers, The Sanitary Merit Medal class I. IV. Army corps commanders may propose or grant: A. For facts in category I: military foremen, sub-officers and military within the period, military contract-based employees or mobilized reservists, Military Virtue Medal of Class II War. B. For category II facts: a) officers in the rank of colonel, unit commanders, and officers in the rank of general, the Order of the Faithful Service in the rank of Commander, with the approval of the immediately superior echelon; b) military foremen, sub-officers and military within the period, military employees on the basis of contract or reserves mobilized, Cross of the Faithful Service class II. C. For acts of category III: a) officers in the rank of colonel, commanders of units and large units, and officers with the rank of general, the Order of Military Virtue, respectively Aeronautical Virtue or Maritime Virtue in the rank of Grand Officer; military doctors with the rank of general, Order of Health Merit in the rank of Grand Officer; b) military foremen, sub-officers and military personnel in the term, military personnel on the basis of contract or reserves mobilized, medals Manhood and Faith, respectively Virtue of Aeronautics or Maritime Virtue, in all classes; sub-officers Health, the Health Merit Medal in all classes. V. The head of the Grand District General may propose or grant: A. For category I facts: a) officers in the rank of general, Order for Merit in the rank of Grand Cross and Order of the Star of Romania in the rank of Grand Officer, with the approval of the Minister of b) military foremen, sub-officers and military personnel, military personnel on the basis of contract or reserves mobilized, Medal of Military Virtue of Class I War; B. For category II facts: a) officers in the rank of general, Order of the Faithful Service in the rank of Grand Officer b) military foremen, sub-officers and military within the period, military personnel on the basis of contract or reserves mobilized, Cross Service Creditor class I. C. For acts of category III: officers in the rank of general, orders Military Virtue, respectively Aeronautical Virtue or Maritime Virtue in the rank of Grand Officer; military doctors with the rank of general, Order of the Sanitary Merit in the rank of Great Officer. VI. The Minister of National Defence may propose or grant the following war decorations: A. For facts in category I: officers in the rank of general, military war order Mihai Viteazul grades III and II and the Order of the Faithful Service in the rank of Grand Cross, with the approval of the President of Romania; B. For acts of category II: officers in the rank of general, Order of the Star of Romania in the rank of Knight, Officer and Commander, with the approval of the President of Romania. + Article 9 (1) In case of war or armed aggression, the President of Romania may confer, at the proposal of the Minister of National Defence or on his own initiative, war decorations in all grades and classes. (2) Military War Order Mihai Viteazul 1st class and Order of the Star of Romania in the rank of Grand Cross are granted only by the President of Romania. + Article 10 In case of war or armed aggression, military units that have distinguished themselves on the battlefield can be decorated, depending on the category of merits, as follows: a) category I and II of facts: by the President of Romania, based on the proposals made by the Minister of National Defence; b) category III of facts: by the Minister of National Defence, based on the proposals made by the Head of the Grand Headquarters General. + Article 11 (1) All decorations and proposals for decoration shall be made on a daily basis that will include the reasons for granting and shall be endorsed by the immediately superior echelons. (2) Within 3 days from the date of the proposal for decoration, each echelon will submit the nominal tables with the proposals for decoration on the hierarchical path. The Grand District General will submit, weekly or whenever appropriate, to the Minister of National Defence, centralizing tables with proposals for decoration, in order to draw up the final formalities of decoration. At the same time the Grand District General will issue for those decorated provisional decoration certificates. (3) The Minister of National Defence shall draw the tables, under his signature, to the Chancellery of Orders that will subject them to the approval The patents of the decorations will have, in addition to the signature or the paraphernalia of the President of Romania and the Chancellor of the Orders, the signature or the The regime of signatures on the patents of war decorations is similar to those of peace, provided in the regulations of each decoration. + Article 12 Officers injured on the battlefield receive the Order of the Faithful Service of War as follows: a) Sub-lieutenants and lieutenants, in the rank of Knight; b) captains, in the rank of Officer; c) Major and Lieutenant-Colonel, in the rank of Commander; d) colonels, in the rank of Grand Officer; e) generals, in the rank of Grand Cross. + Article 13 Military maisters, sub-officers and soldiers in the term, military-employed personnel or reservists mobilized, injured during the fighting, receive the faithful Service Medal of right, as follows: a) the military in term, the military hired on the basis of contract or the reserves mobilized, class III; b) the sub-officers, class II; c) military maistrii, class I. + Article 14 The assimilations of the officer ranks for the military navy and military aviation are those provided for in art. 2 2 para. 2 lit. C and para. 2 2 ^ 1 lit. B of Law no. 80/1995 on the status of military personnel, with subsequent amendments and completions. + Article 15 (1) If the wounds cause invalidity of the first degree, the decorations granted will be with a class, respectively with a degree, higher than those provided in art. 12 12 and 13. (2) If the decorations are made post-mortem, the officers receive the Order of the Star of Romania, and the military maistrii, the subofficers and the military within, the military employed on the basis of contract or the reserves mobilized, the Cross the grades and classes referred to in art. 12 12 and 13. + Article 16 (1) If the injured have already been decorated with an order, cross or equivalent hierarchical medal with that granted according to art. 12 and 13, will be conferred for disability, regardless of degree, a distinction with an immediately superior degree/class. (2) If the posthumously decorated have the Order of the Star of Romania or the Cross Faithful Service in the degree/class established according to art. 12 and 13, will confer the grade/class immediately superior, except for the military foremen who will be decorated with the Military Virtue Medal of War. + Article 17 ((1) In case of participation of Romanian subunits or military units in joint combat actions with the military of other states under the mandate of international bodies or coalitions to which Romania is a party, the commander of the subunit or military unit Romanian can propose for decoration with Romanian military decorations Romanian and foreign soldiers, within the limit of the echelon they represent, according to the regulations of art. 8. (2) The commander of the Romanian subunit or military unit can report weapons and merits of foreign military units or officers, military foremen, non-commissioned officers and military personnel, who, through their actions, had a special role in the successful conduct of the missions received or directly supported the Romanian military and whose decoration, by the Romanian state, would be recommended. + Article 18 In case of participation in joint combat actions with the military of other states under the mandate of international bodies or coalitions to which Romania is a party, the methodology of granting war decorations for Romanian and foreign soldiers or units Romanian and foreign military is the one art. 4 4, 77 and 78 of Law no. 29/2000 ,, as amended. + Article 19 The Romanian war decorations are carried out according to the provisions art. 32 32 of Law no. 29/2000 ,, as amended. + Article 20 Decorations awarded for weapons by other states allied with Romania or by international organizations, under whose mandate Romanian troops participated in multinational military actions, will be carried according to the provisions of art. 38 38 of Law no. 29/2000 ,, as amended. + Article 21 The Knights of the National War Orders will be invited to all the annual meetings of the respective orders, through the care of the Chancellery of Orders. + Article 22 (1) The Ministry of National Defence may issue honorary badges and plaques attesting the participation of military and civilian personnel, Romanian and foreign, to multinational military actions carried out under the mandate of international organizations. (2) The description of the forms, dimensions, models, and the conditions under which they may be granted shall be regulated by order of the Minister of National Defence. (3) Honorary badges and wafers are not part of the national decoration system. They shall be carried after all other distinctions received by that military, except for the honorary sign in the Army Service provided for in art. 10 10 section 3 3 and 4 of Law no. 29/2000 ,, as amended. + Article 23 The chancellery of the Orders will keep a separate record for all war decorations. + Article 24 The orders and the war medals conferred can only be withdrawn for cases of treason in time of war. + Article 25 (1) Upon adoption of this Regulation the Chancellery of Orders shall order a minimum necessary stock of each order, cross and medal of war. The amounts necessary for the manufacture of decorations, patents, rosettes, bars and boxes of war decorations will be provided from the budget approved annually to the Presidential Administration. (2) In special situations, when it is necessary to make war decorations, the amounts necessary to make them will be made available to the Chancellery of Orders from the reserve of the state budget at the disposal of the Government in the year or, in case of war, from the budget of the Ministry of National Defence ----------------
