LEGE no. 119 119 of 14 July 2014 on the empowerment of the Government to issue ordinances

The Romanian Parliament adopts this law + Article 1 Pursuant to art. 115 115 para. (1) of the Romanian Constitution, republished, the Government is empowered that, from the date of entry into force of this Law, but not before the end of the first ordinary session of 2014, until the resumption of the Parliament's work in the second Ordinary session of 2014, to issue ordinances in areas not subject to organic laws, as follows: I. Public Finance and Economy 1. rectification of the state budget for 2014; 2. rectification of the state association insurance budget for 2014; 3. regulation of fiscal and budgetary measures; 4. modification and completion Government Emergency Ordinance no. 156/2007 on the compensation of individuals who have constituted deposits at the House of Savings and Consemnations C.E.C. -S.A. for the purchase of cars, approved with amendments and completions by Law no. 232/2008 , with subsequent additions; 5. measures regarding the macro-prudential supervision of the national financial system; 6. measures to implement the Regulation (EU) No 648/2012 of the European Parliament and of the Council of 4 July 2012 on OTC derivatives, central counterparties and trade repositories; 7. measures to implement the Regulation (EU) No 260/2012 of the European Parliament and of the Council of 14 March 2012 laying down technical and commercial requirements for credit transfers and direct debits in euro and amending Regulation (EC) No 924/2009 ; 8. measures to implement the Regulation (EU) No 236/2012 of the European Parliament and of the Council of 14 March 2012 on short selling and certain aspects of credit default swaps; 9. regulations on national standardisation; 10. modification and completion Government Emergency Ordinance no. 37/2008 on the regulation of financial measures in the budgetary field, approved with amendments Law no. 275/2008 , with subsequent amendments and completions; 11. modification and completion Government Emergency Ordinance no. 26/2012 on some measures to reduce public spending and strengthen financial discipline and to amend and supplement some normative acts, approved with amendments and completions by Law no. 16/2013 ,, as amended; 12. modification and completion of the legislation on privatization; 13. modification and completion Government Emergency Ordinance no. 6/2014 on the exercise of rights and the fulfillment of obligations arising from the status of shareholder of the state at the National Electric Power Transport Company "Transelectrica"-S.A. and at the National Natural Gas Transport Company "Transgaz" -S.A. Medias and for the modification of some normative acts; 14. measures for the development of electricity storage and balancing infrastructure of the National Energy System, through the construction and operation of hydroelectric power plants with pumping accumulation; 15. regulations on the transfer without payment of packages of shares from the Romanian state property and from the administration of the Ministry of Economy, through the Department for Energy, in the private property of some administrative-territorial units; 16. modification and completion Law no. 11/1991 on combating unfair competition, with subsequent amendments and completions, and other acts in the field of competition protection; 17. the approval of the payment of contributions to international bodies to which Romania is a party; 18 18. measures transposing the provisions of the European directive on public procurement-Directive 2014 /23/EU of the European Parliament and of the Council of 26 February 2014 on the award of concession contracts, 2014 2014 /24/EU of the European Parliament and of the Council of 26 February 2014 on public procurement and repealing Directive 2004 /18/EC and Directive 2014 /25/EU of the European Parliament and of the Council of 26 February 2014 on procurement by entities operating in the water, energy, transport and postal services sectors and repealing Directive 2004 /17/EC . II. Regional development, public administration 1. modification and completion Government Emergency Ordinance no. 127/2007 on the European Grouping of Territorial Cooperation, approved with amendments Law no. 52/2008 ; 2. the regulation of measures on construction; 3. regulation of measures on public investments financed from the state budget; 4. modification and completion Government Emergency Ordinance no. 118/2006 on the establishment, organization and conduct of the activity of cultural settlements, approved with amendments and completions by Law no. 143/2007 , with subsequent amendments and completions; 5. modification and completion Law no. 153/2011 on measures to increase the architectural-environmental quality of buildings, with subsequent amendments and completions; 6. regulations on the duration of rental contracts for housing areas with the destination of housing; 7. modification and completion Law no. 24/2000 on the norms of legislative technique for the elaboration of normative acts, republished, with subsequent amendments and completions, as well as some measures regarding the republication of normative acts. III. National Defence and Home Affairs 1. the establishment of measures, as well as some rights and obligations of Romanian personnel sent abroad for preparation in order to achieve the aerial operational capability contained in Phase 1 of the initial transition of the Concept of gradual achievement of air defence capability under the Air Force Multi-role programme; 2. modification and completion Law no. 122/2006 on asylum in Romania, with subsequent amendments and completions; 3. amendment of para. ((3) art. 9 of Government Ordinance no. 2/2001 on the legal regime of contraventions, approved with amendments and additions by Law no. 180/2002 , with subsequent amendments and completions; 4. regulations regarding the employment and posting of foreigners on the territory of Romania and for the modification and completion of some normative acts on the regime of foreigners in Romania; 5. modification and completion Government Emergency Ordinance no. 195/2002 on traffic on public roads, republished, with subsequent amendments and completions. IV. Health, work and social protection 1. modification and completion Pharmacy Law no. 266/2008 , republished, as amended; 2. modification and completion Law no. 202/2006 on the organization and functioning of the National Employment Agency, republished; 3. modification and completion Government Emergency Ordinance no. 144/2008 on the exercise of the profession of general medical assistant, of the profession of midwife and of the profession of nurse, as well as the organization and functioning of the Order of General Nurses, Midwives and Nurses of Romania, approved with changes by Law no. 53/2014 , with subsequent amendments and completions; 4. measures regarding the reorganization of the activity of payment of social assistance benefits, as well as of the social inspection activity. V. Agriculture and environment 1. modification and completion Government Emergency Ordinance no. 34/2000 on organic agri-food products approved by Law no. 38/2001 , with subsequent amendments and completions; 2. modification and completion Government Ordinance no. 42/2004 on the organization of veterinary and food safety activity, approved with amendments and additions by Law no. 215/2004 , with subsequent amendments and completions; 3. modification and completion Government Emergency Ordinance no. 196/2005 on the Environmental Fund, approved with amendments and additions by Law no. 105/2006 , with subsequent amendments and completions; 4. modification and completion Government Emergency Ordinance no. 57/2007 on the regime of protected natural areas, the conservation of natural habitats, flora and wildlife, approved with amendments and additions by Law no. 49/2011 , with subsequent amendments and completions; 5. approval of the National Program for the realization of forest curtains for the protection of national highways and roads; 6. modification and completion Government Emergency Ordinance no. 23/2010 on the identification and registration of pigs, sheep, goats and equidae, as well as for the modification and completion of some normative acts, approved with amendments and additions by Law no. 191/2012 ; 7. regulations on the granting of incentives for energy plant crops; 8. regulations on the establishment of the National Authority for the Hunting And Sports Fishing Regime. VI. European funds 1. modification and completion Government Emergency Ordinance no. 196/2008 on the establishment of the activity of conducting and managing the institutional twinning projects financed by the European Union, for which Romania has a technical assistance donor, approved with amendments and completions by Law no. 168/2009 ,, as amended; 2. modification and completion Government Emergency Ordinance no. 23/2013 on the financial management of non-reimbursable external funds related to the Financial Mechanism of the European Economic Area 2009-2014 and to the Norwegian Financial Mechanism 2009-2014, approved with amendments and completions by Law no. 242/2013 ; 3. measures to stimulate the absorption of structural instruments in the current financial year; 4. measures for the implementation of the European Structural and Investment Funds 2014-2020; 5. modification and completion Government Emergency Ordinance no. 66/2011 on the prevention, finding and sanctioning of irregularities arising from the obtaining and use of European funds and/or their national public funds, approved with amendments and additions Law no. 142/2012 , with subsequent amendments and completions. VII. Justice 1. regulations on the status of probation personnel; 2. the unitary regulation of the activity of administration and valorization of receivables from crimes. VIII. Education and research 1. Regulation of content problems for pre-university education; 2. regulations in the field of scientific research, higher education and funding of these fields; 3. regulations on quality assurance in higher education; 4. regulations on the organization, operation and financing of structures subordinated to and coordination of the Ministry of National Education. IX. Transport and infrastructure 1. measures to extend the validity of the route licenses and the transport program on the basis of which the regular passenger transport services are carried out between Bucharest and Ilfov County; 2. measures to amend the Regulation on transport on railways in Romania, approved by Government Ordinance no. 7/2005 , republished; 3. modification and completion Government Ordinance no. 21/2011 on the establishment of the Bucharest Metropolitan Transport Authority, approved with amendments and completions by Law no. 8/2012 ,, as amended; 4. modification and completion Government Ordinance no. 81/2000 on the certification of the classification of vehicles registered or registered in the technical rules on road traffic safety, environmental protection and in the category of use as intended, by regular technical inspection, approved by changes and additions by Law no. 167/2003 , with subsequent amendments and completions; 5. measures for the approval of the Master of the General Transport Plan in order to meet the ex-ante conditionality necessary for the approval by the European Commission of structural funds for transport infrastructure; 6. measures for the development of intermodal transport in Romania, necessary in order to access structural funds during the 2014-2020 programming period; 7. measures to streamline the use of financial resources allocated to the railway transport sector in Romania, through amendments to the legislation on compensation from the state budget of rail transport and other incident normative acts in the field 8. measures necessary to streamline the absorption of structural funds from SOP Transport, as well as other measures to establish the institutional framework for the 2014-2020 programming period; 9. measures necessary to accelerate the realization of bypass variants of cities and municipalities by handing over their administration from the National Highway and Road Company of Romania-S.A. to local public administrations, in order to access to European funds; 10. regulation of financial measures regarding the reduction of arrears for the manager of railway infrastructure 11. modification and completion Law no. 38/2003 on taxi and rental transport, with subsequent amendments and completions. X. Prorogation or modification of some time limits stipulated in normative acts + Article 2 According to the provisions of art. 115 115 para. (3) of the Romanian Constitution, republished, the ordinances issued by the Government pursuant to art. 1 will be submitted for approval to the Parliament, according to the legislative procedure, until the resumption of Parliament's work in the second ordinary session of 2014.
