The Romanian Parliament adopts this law + Article 1 (1) Order of the Cultural Merit and the Cultural Merit Medal, provided at art. 7 lit. A and B of Law no. 29/2000 on the national system of decorations of Romania, as amended, are part of the category of civil decorations on fields of activity. (2) The Order of Cultural Merit is a decoration that is awarded both to Romanian and foreign citizens, as well as to public cultural institutions and settlements in the country and abroad, for the special talent and services brought to culture, art, science and promoting the charitable spirit, through works of creation, interpretation and social, of national impact. (3) The Cultural Merit Medal is a decoration that is awarded to Romanian and foreign citizens, who reward the merits, talent and services of culture, art, science and promotion of social, local or regional impact. + Article 2 (1) The Order of Cultural Merit is presented in two forms with equal hierarchical value: insignia and rosette. (2) The Order of Cultural Merit includes 8 categories, corresponding to specific activities and related to the cultural field The order sign is identical for all categories, but the ribbons are specific to each category. (3) The sign of the Order of Cultural Merit is a cross with equal arms, made of silver, enameled blue-purple, having on the obverse a circular medallion on which the coat of arms of Romania is stamped. + Article 3 (1) The Cultural Merit Medal presents itself in one form: the mark. (2) The Cultural Merit Medal includes 8 categories, corresponding to the specific activities and related to the cultural field. The medal mark is identical for all categories of merit, but the ribbons are specific to each category. (3) The sign of the Cultural Merit Medal is a circular piece, made of tombac, which has on the obverse the coat of arms of Romania. + Article 4 The Regulations on the description and the way of granting the Order of Cultural Merit and the Cultural Merit Medal, for each degree or class, as well as the drawn model and the ribbons specific to each category are provided in Annexes no. 1 1-4 which are an integral part of this law. + Article 5 (1) The Order of Cultural Merit and the Cultural Merit Medal shall be conferred by the President of Romania by decree, based on the proposals for individual decoration made, according to art. 4 4 para. ((2) lit. c) of Law no. 29/2000 , as amended, by the competent minister for persons in his field of activity. (2) The nominal proposals for the conferment of the Cultural Merit Order and the Cultural Merit Medal are endorsed by the Chancellery of Orders, in accordance with art. 5 5 of Law no. 29/2000 ,, as amended. (3) The President of Romania may confer the Order of Cultural Merit and the Cultural Merit Medal and on his own initiative, 1% of the total number established by law, for each degree or class of each decoration, except for the degree of Great Officer, according to art. 4 4 para. ((3) of Law no. 29/2000 ,, as amended. + Article 6 (1) The distribution of the maximum number of decorations regarding the Order of Cultural Merit and the Cultural Merit Medal, which is granted annually, is carried out by the Chancellery of Orders, within the limits of vacant places. (2) For the first year after the entry into force of this law, a maximum of 15% of the number of decorations for each grade and class can be conferred. + Article 7 (1) The Order of Cultural Merit is limited to a maximum of 7,500 members. (2) The institutions and public places of culture, to which the Order of Cultural Merit was awarded, do not enter the number provided in par. ((1). (3) Foreign citizens or public institutions and settlements of culture abroad, to which the Order of Cultural Merit was awarded, do not enter the number provided in par. ((1). + Article 8 The Cultural Merit Order comprises 4 degrees. The hierarchy in descending order is as follows: a) Great Officer; b) Commander; c) Officer; d) Knight. + Article 9 The Cultural Merit Medal includes 3 classes. The hierarchy in descending order is as follows: a) Class I; b) Class II; c) Third grade. + Article 10 (1) The Cultural Merit Medal may be granted unlimited for classes III and II and is limited to 6,800 members for Class I. (2) The class I Cultural Merit Medal, conferred on foreign citizens, does not enter the number provided in par. ((1). + Article 11 (1) Attestation of the Order of Cultural Merit and of the Cultural Merit Medal is made by a patent, in accordance with art. 24 24 of Law no. 29/2000 ,, as amended. (2) The patents for the Order of Cultural Merit are validated, for the ranks of Knight and Officer, through the paraphernalia of the President of Romania, and for the ranks of Commander and Grand Officer, by the autograph signature of the President of Romania. Patents for all grades are countersigned autographed by the relevant minister and the chancellor of the orders, according to art. 26 lit. b) of Law no. 29/2000 ,, as amended. (3) The patents for the Cultural Merit Medal are validated, for the third and second grade, through the paraphernalia of the competent minister and the signature of the chancellor of the orders, and for the first class, by the signature of the competent minister and the signature of the chancellor orders, in accordance with art. 28 28 of Law no. 29/2000 ,, as amended. + Article 12 Members of the Order of Cultural Merit, regardless of the degree they have, are called "Knights of the Order of Cultural Merit". + Article 13 (1) The Day of the Order of Cultural Merit is celebrated on July 19, the date of the first institution of the order, in 1931. (2) For the adjudication of dishonorable acts, which prejudge the members of the order, other than those that led to the conviction of the members of the Order of the Cultural Merit to a custodial sentence by judicial decision final, an honorary council shall be constituted, in accordance with art. 53 53 of Law no. 29/2000 ,, as amended. + Article 16 (1) The Honorary Council of the Order of Cultural Merit is composed of 5 members, as follows: one member from the ranks of Knight, Officer and Commander and two members from the rank of Grand Officer. The president of the board of honor will, as a rule, be the oldest member in the rank of Grand Officer. (2) If the board of honor does not include any member of the same category as the accused person, the honorary council will be co-opted for the case in question and two Knights of the order of the same category, with the right to vote deliberative. (3) The Board of Honor shall be constituted or shall be elected on the occasion of the Day of the Order of the Cultural Merit, within 5 years, by the Knights of (4) May be re-elected for a new period 3 of the members of the honorary council, of which at least one of the lower ranks. ((1) of Law no. 29/2000 ,, as amended. + Article 19 The amounts necessary to make the marks, rosettes, patents and boxes of the decorations of the Order of Cultural Merit and the Cultural Merit Medal will be provided from the budget approved annually to the Presidential Administration. No. 8. + Annex 1 REGULATION on the description and granting of the Order of + Article 1 The Order of Cultural Merit is granted for life. + Article 2 (1) The Order of Cultural Merit includes 8 categories corresponding to specific activities and related to the cultural field, as follows: a) Category A-"Literature"; b) Category B-"Music"; c) Category C-"Plastics"; d) Category D-"Performing art"-theatre, opera, film, ballet, etc.; e) Category E-"National Cultural Heritage"; f) Category F-"Promotion of culture"; g) Category G-"Cults"; h) Category H-"Scientific research". (2) The Order of Cultural Merit is limited to a maximum of 7,500 members, divided by categories and degrees as follows: A. Category A-"Literature"-850 members, of which: a) Knight-450; b) Officer-225; c) Commander-125; d) Great Officer-50. B. Category B-"Music"-700 members, of which: a) Knight-350; b) Officer-200; c) Commander-110; d) Great Officer-40. C. Category C-"Plastics"-1.000 members, of which: a) Knight-500; b) Officer-300; c) Commander-150; d) Great Officer-50. D. Category D-"The Art of the Show"-theatre, opera, film, ballet etc. --1,000 members, of which: a) Knight-500; b) Officer-300; c) Commander-150; d) Great Officer-50. E. Category E-"National Cultural Heritage"-1.000 members, of which: a) Knight-500; b) Officer-300; c) Commander-150; d) Great Officer-50. F. Category F-"Promotion of Culture"-1,150 members, of which: a) Knight-580; b) Officer-350; c) Commander-170; d) Great Officer-50. G. Category G-"Cultele"-1.000 members, of which: a) Knight-500; b) Officer-300; c) Commander-150; d) Great Officer-50. H. Category H-"Scientific Research"-800 members, of which: a) Knight-400; b) Officer-250; c) Commander-100; d) Great Officer-50. ((3) The marks of the orders of each category shall have the ribbons in different colours, as follows: a) Category A-white with a purple band at the edges; b) Category B-white with one orange band at the edges; c) Category C-white with one red band at the edges; d) D-white category with a blue band at the edges; e) E-white category with one yellow band at the edges; f) F-white category with one blue band at the edges and one green on the center; g) Category G-white with three equal bands, two red and one blue on the center; h) H-white category with a green band at the edges. (4) The exceeding of the members of each grade and category constitutes a breach of this Regulation. The decorations awarded above the limit number are null and void, and the insignia will be returned. + Article 3 (1) The rank of Knight of the Order of the Cultural Merit is a cross with equal arms, 10 mm wide, made of silver with the title of 800 per thousand, enameled blue-violet, having the height and width of 40 mm; the metal border of the mark is mm wide and polished, obliquely polished. (2) On the obverse, central, a silver medallion is applied, 18 mm in diameter, on which are stamped, central, the coat of arms of Romania, and on the edge, a wreath of laurel leaves. (3) On reverse, central, a medallion is applied, 18 mm in diameter, which has inscribed with blue "MERITUL/CULTURAL", with 4 mm high letters. The medallion is bordered by a ring, enameled white, 4 mm wide, on which it is inscribed with blue at the top, the motto of the order: "THROUGH CULTURE TO FREEDOM", and in the lower part, with high figures of 1.5 mm, years: "1931", "1961", "2000", representing historical data on the Cultural Merit Order. The data is separated by a star. (4) The sign is surmounted by a half-moon of laurel leaves with an outer width of 30 mm and a height of 20 mm, having the ends of the semi-joint united by a bar through which the ribbon is spent. On the bar, on the reverse, are the title of silver, the category of distinction with the capital letter and the current number of decoration in that category. (5) The ribbon in white moarat rips is 40 mm wide and 50 mm high. The colored bands have, as a rule, the width of 6 mm and are placed at 2 mm of edge, for all the ribbons, with the following exceptions: category F, which has the three wide bands of 5 mm; category G, which has the bands of 5 mm placed joined and Center. (6) For female persons the ribbon is folded in the form of a bow and has a length of 120 mm. (7) The rosetta is presented as a rectangular ribbon of rips, 16 mm long and 6 mm wide, having the dimensions of the coloured bands of the respective category ribbon reduced to 40%. On the back has a clamping system. + Article 4 The insignia and rosette of the rank of Officer of the Order of Cultural Merit have the general characteristics of the meaning and rosette of the Knight, with the following a) the mark is gilded; b) the ribbon receives a rosette of 25 mm diameter; c) the rosette shall be in the form of a reel of 10 mm diameter rips and the height of 6 mm, having the dimensions of the coloured bands of the respective category ribbons reduced to 40%; on the back it has a clamping system; d) for female rosette people apply on the middle of the rope. + Article 5 (1) The rank of Commander of the Order of Cultural Merit is a cross with equal arms, 12 mm wide, made of silver with the title of 925 per thousand, gilded, having the height and width of 50 mm. (2) The other elements of the meaning have the general characteristics of the rank of Officer, with the following peculiarities a) the medallion on the obverse is 22 mm in diameter; b) the medallion on the reverse is 22 mm in diameter; c) the ring that surrounds them is 5 mm wide; d) the letters of the inscription are 5 mm high, and the figures and letters of the estimate are 2 mm high; e) the insignia is surmounted by a perforated fixed cylinder, 6 mm in diameter and 7 mm high, passing a circular ring with a diameter of 15 mm. A flat ring, 30 mm high and 4 mm wide, is spent through the circular ring; on the reverse of the ring are the title of silver, the category of distinction with the capital letter and the current number of decoration in that category. (3) The ribbon is 45 mm wide and has the adjustable length to be adapted to the neck circumference. The width of each colored strip is 7 mm. (4) The rosette of the rank of Commander is formed by the overlap of the rosette of the Officer over that of the Knight. + Article 6 (1) The sign of the Grand Officer of the Order of Cultural Merit is composed of the insignia itself and the degree board. (2) The actual sign of the rank of Grand Officer is identical to the rank of Commander. (3) The plaque of the grade is a bulging star with 4 groups of rays, made of silver with the title of 925 per thousand, each group consisting of 7 rays, the central one being the largest. The diameter of the plate is 75 mm. On the center, between the ray groups, the insignor obverse of the rank of Commander is applied. On the reverse, in a central medallion, the name of the producer firm and the title of silver are pounded. On the back has a clamping system. (4) The rosette of the grade is presented in the form of a rectangular ribbon of silver rips, 16 mm long and 6 mm wide, over which the rosette of the rank of Officer is applied. On the back has a clamping system. + Article 7 (1) The box in which the decoration is kept is dressed in blue matte leather-purple and inside is lined with white plus. (2) On the lid of the box are printed gold coat of arms of Romania, the name and degree of the order, as well as + Article 8 (1) The Order of Cultural Merit shall be carried, as a rule, on the occasion of the National Day of Romania and of the other national or religious holidays, on the occasion of the Day of the Order and at the cultural-artistic (2) The Knight and Officer Grades of the Order of Cultural Merit shall be worn on the left side of the chest. (3) The rank of Commander of the Order of Cultural Merit is worn at the neck, with the ribbon caught under the tie, the insignia being visible at 50 mm on the left side, under the tie knot. (4) The degree of Grand Officer of the Order of Cultural Merit is carried on the left side of the chest. (5) Only the highest degree of the Order of the Cultural Merit which has been conferred is always carried. (6) The rosette can be worn daily, but only the rosette of the highest degree. The rosette is worn at the buttonhole from the left reverse of the garment or the cutter. + Article 9 (1) The conferment of the Order of Cultural Merit is made mandatory starting with the rank of Knight. (2) The previous decoration with the Cultural Merit Medal is a positive factor, which will be taken into account in the proposals for granting the Order of Cultural Merit, but it is not mandatory to obtain a medal or go through the medal hierarchy for conferring order. (3) In order to confer a higher degree to the same person, it is necessary to carry out an internship in the immediate lower degree, 0 a) from the rank of Knight to the Officer-3 years; b) from the rank of Officer to the Commander-4 years; c) from the rank of Commander to the Great Officer-5 years. (. The proposals for conferencing shall take into account the criteria laid down in this Regulation, including the first class of decoration. (5) The direct conferral of the higher grades at the first promotion is made as a result of a summation of outstanding merits, which could have led to the granting of successive degrees. (6) For special merits, obtained by the same person in two or more categories, the same order may be granted with different ribbons, specific to those categories, without taking into account the minimum period provided for a new decoration and starting, for each category, from the rank of Knight. + Article 10 For merits with everything special the minimum age in grade, provided in art. 9 9 para. ((3), may be reduced by a maximum of one third. + Article 11 (1) The conferment of a higher degree automatically leads to the deletion of the name of the respective person from the lower grade, the place becoming (2) The lower grade mark remains in possession of the decorated one. + Article 12 (1) The Order of Cultural Merit is a decoration that rewards the special talent and services to the culture, art, science and promotion of the charitable spirit, by citizens or institutions and public places of culture, through works of creation, interpretation and social, national impact. (2) By talent and special services, for the purposes of this Regulation, it is understood: a) the creation of significant cultural and artistic values in all fields: literature, essay, philosophy, science, music of all genres, fine arts of all genres; b) interpretation with sensitivity and refinement of literary, musical or choreographic works; c) the discovery, preservation and restoration of important assets of the movable or immovable national cultural heritage and their enhancement to the public, through permanent exposure or temporary exhibitions in the country or abroad; d) the initiation and organization of confessional actions to contribute to the strengthening of the civic spirit and of the general human solidarity among the parishioners, as well as actions aimed at alleviating the suffering for people in difficulty; e) important actions of mecenat for the support of cultural, artistic and scientific institutions or cultural, artistic and scientific programs and actions, national or international level, of the significant increase of the patrimony national cultural, artistic and scientific, through direct donations of parts or amounts necessary to purchase them. (3) The Order of Cultural Merit can be conferred, exceptionally, to institutions and public settlements of high prestige culture. (4) The Order of Cultural Merit can also be conferred on citizens and cultural institutions abroad who have established themselves internationally through important works of creation or interpretative, which have supported cultural exchanges with Romania and have promoted in their countries Romanian culture. + Article 13 Within 30 days from the publication of the present law in the Official Gazette of Romania, Part I, the relevant ministry, in collaboration with the public institutions and settlements of culture, will elaborate, based on art. 12, regulations specific to each category of merits, approved by order of the competent minister, in which the conditions under which the Order of Cultural Merit is conferred will be detailed. + Annex 2 REGULATION on description and award of the Cultural Merit Medal + Article 1 The Cultural Merit Medal is awarded for life. + Article 2 (1) The Cultural Merit Medal includes 8 categories corresponding to the specific activities and related to the cultural field, as follows: a) Category A-"Literature"; b) Category B-"Music"; c) Category C-"Plastics"; d) Category D-"Performing art"-theatre, opera, film, ballet, etc.; e) Category E-"National Cultural Heritage"; f) Category F-"Promotion of culture"; g) Category G-"Cults"; h) Category H-"Scientific research". (2) The Cultural Merit Medal is unlimited in number of members for classes III and II and is limited to 6,800 members for Class I, divided by categories as follows: a) Category A-"Literature"-1,000 members; b) Category B-"Music"-1.000 members; c) Category C-"Plastics"-1.000 members; d) Category D-"Performing art"-theatre, opera, film, ballet, etc. -1,000 members; e) Category E-"National Cultural Heritage"-1.000 members; f) Category F-"Promotion of culture"-600 members; g) Category G-"Cults"-600 members; h) Category H-"Scientific research"-600 members. (3) The marks of the medal of each category have the ribbons in different colors, as follows: a) Category A-white with a purple band at the edges and a purple stripe on the center; b) Category B-white with an orange band at the edges and an orange stripe on the centre; c) Category C-white with a red tape at the edges and a red stripe on the center; d) D-white category with a blue band at the edges and a blue stripe on the centre; e) E-white category with a yellow band at the edges and a yellow stripe on the center; f) F-white category with one blue band at the edges and two green stripes on the center; g) Category G-white with two red and one blue bands, crossed by a white stripe on the center; h) H-white category with a green strip at the edges and a green stripe on the center. (. Overcoming the number of members provided for each category, for Class I, constitutes a violation of this Regulation. The decorations awarded above the limit number are null and void, and the insignia will be returned. + Article 3 (1) The mark of the Cultural Merit Medal presents itself in the form of a circular piece with a diameter of 30 mm, has a slightly elevated border and is made of tombac. (2) On the obverse is the coat of arms of Romania, which has a height of 25 mm. At 1 mm of the border is stamped a pearl circle. (3) On the reverse side, on the left side, a laurel branch is stamped, in the upper part is inscribed the motto: "THROUGH CULTURE AT FREEDOM" with high letters of 1.5 mm, and the central is inscribed with 3 mm high letters: "MERITUL/CULTURAL". ((4) The medal is surmounted by a half-moon of laurel leaves, with the outer width of 30 mm and the height of 20 mm, having the ends of the semi-joint united by a bar through which the ribbon is spent. On the bar, on the reverse, are the category of the distinction with the letter capital and, in the first class, the current number of the decoration in that category. (5) The ribbon, 35 mm wide and with the apparent height of 50 mm, is from the moarat rips, having the colored bands wide of 4 mm, and the colored stripes are 1 mm wide. (6) For female persons the ribbon is folded in the form of a bow and has a length of 100 mm. + Article 4 The distinction between classes is as follows: a) the third grade is aramite; b) Class II is silver; c) Class I is gold plated. + Article 5 (1) The box in which the medal is kept is made of cardboard dressed in blue-purple pergamoid and is lined with white silk. (2) The name, class and category of the medal are printed on the box cover. + Article 6 (1) The Cultural Merit Medal is usually worn on the occasion of the National Day of Romania and the other national or religious holidays, on the occasion of the Order Day and at the cultural-artistic events of national importance. (2) The Cultural Merit Medal, regardless of class, is worn on the left side of the chest. (3) It is always only the insignia of the highest class of the Cultural Merit Medal which has been conferred. + Article 7 The conferral of the Cultural Merit Medal is made mandatory starting with the third grade. + Article 8 (1) In order to confer an upper class to the same person it is necessary to perform an internship in the immediate lower class of at least 2 years (2) The direct conferment of the upper classes at the first promotion can be made as a result of a summation of special merits that could have led to the granting of successive classes. + Article 9 For entirely special merits, the minimum age in the class, provided in art. 8 8 para. ((1), may be reduced by a maximum of half. + Article 10 (1) The conferment of an upper class automatically leads to the deletion of the name of that person from the lower class (2) The lower class sign remains in possession of the decorated one. + Article 11 The Cultural Merit Medal is a decoration that is awarded to Romanian and foreign citizens, who reward the merits, talent and services of culture, art, science and promotion of social, local or regional impact. + Article 12 Within 30 days from the publication of the present law in the Official Gazette of Romania, Part I, the relevant ministry, in collaboration with the public institutions and settlements of culture, will elaborate, based on art. 11, regulations specific to each category of merits, approved by order of the competent minister, in which the conditions under which the Cultural Merit Medal is awarded will be detailed. + Annex 3 NOTE C.T.C.E.: -------------- The drawn model of the Order CULTURAL MERIT, is found in the Official Gazette of Romania, Part I no. 77 77 of 6 February 2003, on pages 7-10. + Annex 4 NOTE C.T.C.E.: -------------- The drawn model of the CULTURAL MERIT MEDAL, is found in the Official Gazette of Romania, Part I no. 77 77 of 6 February 2003, on pages 11-12. --------------
