+ Chapter 1 General provisions + Article 1 The Ministry of Agriculture, Food Industry, Forestry and Water responds to the quantitative and qualitative assurance of seeds and propagating material necessary to achieve the annual agricultural production plan, organizing together with the Academy of Agricultural and Forestry Sciences, faculties of agriculture, horticulture and biology, through specialized departments, within a unitary system, production, use and control of their quality. + Article 2 The Academy of Agricultural and Forestry Sciences, through agricultural research institutes and experimental resorts, is responsible for: a) Creation of varieties and hybrids of agricultural plants, with superior attributes, able to make the most of the productive potential of soils, the different climatic conditions in our country and the material technical basis with which agriculture is equipped, Thus: -to cereals and legumes for grains, new varieties and hybrids must be of high productivity and of high quality, to react favorably to fertilizers and irrigation, to be adapted to mechanical works, resistant to frost, drought, diseases, pests and earlier; -to technical crops, new varieties must be highlighted by higher yields and high industrial qualities: high sugar content, oil, dry matter, fibre and other such components; -in medicinal and aromatic plants, the new varieties must ensure higher and higher production of the active substance, which satisfies the needs of the manufacturing industry; -to feed crops will be created productive varieties and with a high content of nutritional principles; -to vegetables and potatoes will be obtained more productive varieties and hybrids, resistant to diseases and pests, to lend themselves to mechanized harvesting, to transport and storage and to have valuable nutrients; -to flowers and other ornamental plants, to create varieties, which correspond to the requirements of beauty of housing, green spaces and other purposes; -in trees and vines, the new varieties must be more productive, with higher commercial and technological qualities. b) Maintain and improve the productive potential and superior attributes of homologated and imported native varieties and hybrids, introduced into the crop, within the process of producing seeds from biological categories higher than what is carried out in own units, based on the perspective plan developed together with the Ministry of Agriculture, Food Industry, Forestry and Water. c) Establishment of the deadlines for the renewal in production of the seed material, differentiated by species and varieties, depending on the genetic basis and the origin. d) Development of technologies for the production and multiplication of seeds and propagating material, in research units, specialized farms and semincere lots in agricultural production units. Also, the research institutes and agricultural experimental resorts respond to the technical guidance of the production of seeds and propagating material in specialized farms, organized in the socialist agricultural units within their range of activity. + Article 3 The Ministry of Agriculture, Food Industry, Forestry and Water, through the State Commission for the testing and approval of varieties, is responsible for the introduction into production of new created or imported varieties and hybrids, as well as of the removal from the culture of the least valuable. To this end, together with the Academy of Agricultural and Forestry Sciences organize their verification in experimental and production conditions and is responsible for the introduction and zoning on the territory of the most valuable varieties or hybrids, as well as the proportion Their production. Both the introduction and removal from the production of varieties and hybrids is based on well-founded economic and technical documents, resulting from the research and production activity. On the basis of checks and analyses on quality and technological attributes, the State Commission for the testing and approval of the varieties will approve the varieties and hybrids that ensure, under similar conditions, a production increase of at least 10 to percent, or present other physiological or qualitative superior attributes to the best varieties or hybrids cultivated in the area: better resistance to frost, drought, fall, diseases and pests, higher sugar content, fat, protein, vitamins, dry matter, fibre and the like, which are economically justified . The Commission also permanently checks the maintenance of biological attributes, the productive and qualitative potential of varieties and hybrids used in production. The Ministry of Agriculture, Food Industry, Forestry and Water, through the State Commission for the testing and approval of varieties, is responsible for keeping the state register of varieties and hybrids up to date and annually publish their official list. + Chapter 2 Production and use of seed and propagating material + Article 4 It is considered seed and propagating material, for the purposes of this law: -seed or any propagation material of agricultural plants, belonging to varieties or hybrids with valuable biological or technological attributes for the conditions in our country and which was obtained after a variety-specific technology and the hybrid that ensures both the original characters and attributes, as well as an appropriate cultural value; -propagating material produced by grafting or other methods of reproduction by vegetative means, belonging to species and varieties with appropriate biological, productive, technological or commercial attributes. For the classification under the previous paragraph the Ministry of Agriculture, Food Industry, Forestry and Water shall carry out the certification of seeds and propagating material, by establishing biological purity and phytosanitary condition in the field. and by determining the cultural value by way of analysis in the laboratory. + Article 5 The Academy of Agricultural and Forestry Sciences, through research institutes and experimental resorts, is responsible for the production of seeds and propagating material, from the upper biological categories: superelite, elite, parental forms, necessary for renewal periodical seed based on the plan established by the Ministry of Agriculture, Food Industry, Forestry and Water. + Article 6 The Ministry of Agriculture, Food Industry, Forestry and Water responds to the production of seeds from the multiplication I and the multiplication of II which is made on specialized farms and on semincere lots, organized in state agricultural enterprises and agricultural production cooperatives. Hybrid seeds, as well as those of technical plants, of vegetables, of forage, medicinal, chromatic, floricole and ornamental plants, whose production requires isolation spaces and a certain technology, will be carried out only in experimental resorts and specialized farms, organized in agricultural state units and agricultural production cooperatives. Also, together with the Academy of Agricultural and Forestry Sciences, is responsible for: -the production of seed potatoes from the superelite biological categories, the elite, the multiplication I and partially the multiplication of II that is made in specialized units, located in closed areas, with the most favorable conditions for obtaining healthy material, free of viruses; -ensuring the production of fodder plant seeds necessary for the improvement of natural pastures and finesse. + Article 7 The production of altoiti trees, grafted branches, seedlings, portaltoi cuttings and fruit shrubs, as well as strawberry stolons, is only carried out within the Institute of Research for Fruit, experimental resorts and agricultural units. state, which are obliged to deliver high quality propagating material, free of viruses, of species, varieties and valuable clones, in the structure established by the fruit growing program. + Article 8 The production of grafted cattle and on its own roots, of altoi chords and rootstock cuttings, shall be as follows: -The research institute for viticulture and winemaking and experimental resorts will produce elite propagating material, from varieties and clones, as well as altoi chords and selected portaltoi cuttings, for the establishment of mother plantations. -The state agricultural units will multiply the valuable biological material and will ensure the necessary quantities of portaltoi cuttings and grafts both for their own needs and for cooperative units. -Agricultural production cooperatives will produce high-quality vine propagating material in the structure of varieties provided for each wine-growing area and in the quantities requested by the beneficiaries. + Article 9 Specialized farms in state agricultural units and agricultural production cooperatives will produce seeds and propagating material on the basis of the authorization issued by the Ministry of Agriculture, Food Industry, Forestry and Water. Specialists from state agricultural units and agricultural cooperatives who organized specialized farms for the production of seeds and propagating material, as well as those in the units with their own semincere lots, are responsible for the application of technologies specific to each crop, variety or hybrid, through the execution of special works of isolation, castration, purification, maintenance, harvesting, conditioning and storage until recovery. If it is found that some specialized units do not apply the measures provided for in seed and propagating material production technologies and do not carry out quantitative and qualitative plan tasks, sanctions will be applied to those guilty, and the respective units will be withdrawn the authorization given by the Ministry of Agriculture, Food Industry, Forestry and Water. + Article 10 In order to maintain the production and quality potential of seeds, socialist agricultural units, cooperative members and producers with individual households are obliged to renew their seed for each culture, at the intervals. set out in Annex no. 1. + Article 11 Socialist agricultural establishments, cooperative members and producers with individual households are required to use only seeds or propagating material from varieties or hybrids entered in the state register and the official list of varieties and hybrids, published annually by the Ministry of Agriculture, Food Industry, Forestry and Water and which meet the quality conditions laid down in state standards and internal rules. It shall be prohibited to use in the production of seed or propagating material which does not meet the conditions laid down in this Article, with the exception of those found during the verification period authorised for that purpose. + Article 12 The county general directions for agriculture, food industry, forestry and water are responsible for the organization and realization of the plan for the production of seeds and propagating material on specialized farms and on semi-incere lots of agricultural units Socialist, the periodic renewal of seeds, as well as the use by each unit of production of seeds and quality propagating material. + Article 13 The Ministry of Agriculture, Food Industry, Forestry and Water will constitute the seed fund for production and reserve seed fund. The seed of the fund for production and the reserve fund shall be constituted outside the state fund of consumer products. + Article 14 The fund for production consists of certified seeds, obtained in specialized farms, as well as from seeds produced on the own semincere lots of socialist agricultural units. The Ministry of Agriculture, Food Industry, Forestry and Water, with consultation of interested central bodies and county general directorates for agriculture, food industry, forestry and waters, will annually establish the quantities of seeds. what is constituted in the fund of seeds for production, by biological categories, for each individual crop. + Article 15 The reserve fund shall be from certified seed produced on specialised farms, and in exceptional cases and from seeds identified from the substance of consumer products held by the central bodies, within the limits of the quantities determined by decision of the Council of Ministers. The reserve fund will be used by the Ministry of Agriculture, Food Industry, Forestry and Water for the realization of production and production tasks, provided for by the annual state plans, in case of natural calamities or other cases fortuitous. + Article 16 The takeover, conditioning and delivery of seeds and propagating material from the production or reserve fund shall be made under the conditions established by the decision of the Council of Ministers. + Chapter 3 Contracting, circulation and storage of seeds and propagating material + Article 17 Contracting the production of seeds and propagating material, the pursuit of production, conditioning, marketing and their delivery, to the beneficiary units, are made through the specialized enterprises of the profile plants of Ministry of Agriculture, Food Industry, Forestry and Water. + Article 18 Seeds and propagating material will be transported in conditions that guarantee the maintenance of their quality and authenticity throughout the duration of the transport and will be accompanied by documents stating the variety and quality, issued by the bodies of specialty of the Ministry of Agriculture, Food Industry, Forestry and Water. The imported seeds and propagating material will circulate, until the destination indicated by the domestic beneficiary, with documents of origin and quality, issued by the specialized bodies in the country of the exporter. + Article 19 The establishments producing seeds and propagating material, their taking and marketing bodies, as well as the beneficiary units, have the obligation to store and keep them in appropriate conditions, so that their quality does not depreciate. + Chapter 4 Quality control of seeds and propagating material + Article 20 Quality control of seeds and propagating material, in all phases: production, conditioning, storage, storage, marketing, transport, as well as the use of seeds or propagating material in the agricultural production process, as well as the issuance of certificates and analysis bulletins on their quality, shall be made by the Ministry of Agriculture, Food Industry, Forestry and Water by the State Inspection for the quality of seeds and propagating material. + Article 21 The Ministry of Agriculture, Food Industry, Forestry and Water, through its specialized bodies, will follow the observance of the provisions of this law, in which purpose it will organize the control and prohibit from sowing or planting, the seeds or propagating material, which does not meet state standards or internal rules. + Article 22 The units that produce or those that deliver seeds or propagating material shall be responsible for their authenticity and quality and shall bear the damage caused to the beneficiary units, in relation to the fault of each of them, for the delivery of seeds and material Improper planting. + Article 23 The violation of the provisions provided for in this law attracts, as the case may be, disciplinary, contravention, material, civil or criminal liability. Delivery with science or negligence of seeds and materially propagating material to state standards or internal rules, as well as delivery to citizens or foreign enterprises of seeds or propagating material of valuable varieties and hybrids without authorization, constitutes a crime and is punishable according to art. 248 or 249 of the Criminal Code. Violation of provisions of Article 9 para. 1 and 3, 10, 11, 19 and 21 of this law, as well as the enjoyment of other acts that will be established and sanctioned by the decision of the Council of Ministers, constitute contravention. Provisions of Law no. 2/1970 regarding the insurance and quality control of the products are applicable in all the activity of production and use of seeds and propagating material, in so far as this law does not have otherwise. + Chapter 5 Encouraging agricultural producers + Article 24 The production of seeds and propagating material, as well as their use, is supported by the State, which provides, through specialized units, the necessary material basis and specialized technical assistance, as well as the coverage of part of production expenses, in some seeds delivered to agricultural cooperatives, in the form of a subsidy, within the limits of the amounts provided for in the state budget annually. + Article 25 The socialist agricultural units, which produce seeds and quality propagating material, will benefit from remuneratory prices, which will ensure the realization of appropriate income. For the seeds and propagating material of the crops listed in Annex no. 2 ceiling prices for purchase and wholesale sale will be established, by decision of the Council of Ministers. For the other seeds and propagating material, the prices will be determined by the Ministry of Agriculture, Food Industry, Forestry and Water, with the agreement of the National Union of Agricultural Production Cooperatives, and for flax seeds. cinepa and the agreement of the Ministry of Light Industry. For new varieties of the crops listed in Annex no. 2 The Ministry of Agriculture, Food Industry, Forestry and Water, with the agreement of the National Union of Agricultural Cooperatives of Production, will set provisional prices for 2 years after their registration in the official list of varieties and hybrids, following the final prices to be approved by the decision of the Council of Ministers. + Article 26 Agricultural production cooperatives will pay in money the works carried out by the resorts for the mechanization of agriculture, on the areas of semincere crops, according to the legal tariffs. + Article 27 In order to co-interest workers in agricultural units, which produce high quality seed and planting material, the Ministry of Agriculture, Food Industry, Forestry and Water will organize annually prize competitions. + Chapter 6 Final provisions + Article 28 The Ministry of Agriculture, Food Industry, Forestry and Water and the Academy of Agricultural and Forestry Sciences will develop collaboration with socialist countries and other countries in the field of new variety creation and seed production, by exchange of biological material, documentation and specialists, as well as the import and export of seeds and propagating material from valuable varieties and hybrids, based on bi and multilateral conventions. + Article 29 The import and export of seeds and propagating material shall be made by the Ministry of Agriculture, Food Industry, Forestry and Water, through its enterprises as well as through other enterprises, with its authorization and in accordance with the rules legal on foreign trade activity. + Article 30 This law shall enter into force 90 days after the date of publication. On the same date, any provision contrary to this law shall be repealed. + Annex 1 Time limits for the renewal of sowing material I.
