LEGE no. 681 681 of 19 December 2002 on the acceptance by Romania of amendments to the International Code of Management for the Safe Operation of Ships and for the Prevention of Pollution (International Safety Management Code-I.S.M. The Romanian Parliament adopts this law + Article 1 Amendments adopted by the International Maritime Organization by Resolution M.S.C. 104 (73) of December 5, 2000 to the International Code of Management for the Safe Operation of Ships and for the Prevention of Pollution (Code international safety management-I.S.M. Code), adopted in national law by Law no. 85/1997 on the acceptance by Romania of the International Code of Management for the Safe Operation of Ships and for the Prevention of Pollution (International Code of Safety Management Code I.S.M.), adopted by the Maritime Organization International by Resolution A 741 (18) of 4 November 1993. + Article 2 Law no. 85/1997 on the acceptance by Romania of the International Code of Management for the Safe Operation of Ships and for the Prevention of Pollution (International Code of Safety Management Code I.S.M.), adopted by the Maritime Organization International by Resolution A 741 (18) of 4 November 1993, published in the Official Gazette of Romania, Part I, no. 107 of 30 May 1997, shall be amended as follows: 1. Article 2 shall read as follows: "" Art. 2. -(1) The Ministry of Public Works, Transport and Housing is empowered, on behalf of the Romanian Government, to carry out the provisions of the International Safety Management Code-I.S.M. Code amended. (2) The Ministry of Public Works, Transport and Housing shall issue, through the Romanian Naval Authority, the Navigation Companies Compliance Document and the Ship Safety Management Certificate. " 2. Article 3 shall read as follows: "" Art. 3. -All sailing companies operating ships flying the Romanian flag and all ships flying the Romanian flag are obliged to obtain from the Romanian Naval Authority the compliance documents and the certificates of management of the safety, according to the provisions of the International Code of Safety Management Code I.S.M. fined. " 3. Article 4 shall read as follows: "" Art. 4. -(1) The compliance documents and safety management certificates shall be issued by the Romanian Naval Authority on the basis of the presentation of a documentation established by the methodological norms, as well as on the basis of the favorable audit reports prepared by the auditors. (2) The methodological norms shall be elaborated by the Ministry of Public Works, Transport and Housing through the Romanian Naval Authority and shall be submitted for approval to the Government. (3) The auditors are authorized natural or legal persons, Romanian or foreign, mandated by the Ministry of Public Works, Transport and Housing, through a special mandate contract, to carry out audits, checks and control, completed through an audit report, to the navigation companies operating ships flying the Romanian flag and to the vessels flying the Roman flag. (4) The remuneration and expenses incurred by the auditors regarding the preparation of the audit report will be borne by the navigation companies, in compliance with the relevant legislation, on the basis of contractual relations. " 4. Article 5 shall read as follows: "" Art. 5. -(1) For the issuance of the Compliance Document and the Safety Management Certificate are charged tariffs. (2) The tariffs mentioned in par. (1) shall be proposed by the Romanian Naval Authority and approved by order of the Minister of Public Works, Transport and Housing. " 5. Article 6 shall be repealed. + Article 3 Within 60 days from the date of entry into force of this law the Ministry of Public Works, Transport and Housing, through the Romanian Naval Authority, will develop and submit for approval to the Government the methodological norms on the implementation application of the provisions of the International Safety Management Code-I.S.M. Code amended, the procedure for issuing safety management certificates, as well as the mandating of auditors. + Article 4 Law no. 85/1997 , as amended by this law, will be republished in the Official Gazette of Romania, Part I, giving the texts the corresponding numbering. This law was adopted by the Senate at the meeting of December 2, 2002, in compliance with the provisions of art 74 74 para. (2) of the Romanian Constitution. p.
