The content of this act is not an official document, being intended to inform users The Romanian Parliament adopts this law + Article 1 The mutual aid houses of pensioners are civic organizations, legal persons of private law with non-patrimonial character, non-governmental, apolitical, with purpose of charity, mutual aid and social assistance. + Article 2 The establishment, organization and functioning of the pensioners ' mutual aid houses shall be established on the basis of the provisions concerning associations of Government Ordinance no. 26/2000 on associations and foundations, approved with amendments and additions by Law no. 246/2005 , with subsequent amendments and completions. --------- Article 2 has been amended by section 2. 1 1 of art. I of LAW no. 248 248 of 5 December 2011 , published in MONITORUL OFFICIAL no. 866 866 of 8 December 2011. + Article 3 The mutual aid houses of pensioners constituted until the date of entry into force of this Law under the conditions Law no. 13/1972 on the mutual aid houses of pensioners retain their acquired legal legal personality. These mutual aid houses of pensioners shall apply, from the date of entry into force of this law, the legal regime provided for by this law. + Article 4 The mutual aid houses of pensioners may be constituted by exercising the right to free association of the following categories of persons: a) pensioners, regardless of the social security system to which they belong; b) beneficiaries of social assistance; c) family members-husband, wife, as well as major children unable to work, dependent on the maintenance of pensioners or beneficiaries of social assistance-members of that mutual aid house of pensioners. + Article 5 The mutual aid houses of pensioners are usually constituted by territorial areas. + Article 6 The mutual aid houses of pensioners can be constituted in central associations of the same profile. + Article 7 The pensioners 'mutual aid houses are primarily aimed at supporting their members by providing redeemable loans, grants and aid to cover expenses with former members' funeral, as well as through providing services accessible to all its members. --------- Article 7 has been amended by section 7. 2 2 of art. I of LAW no. 248 248 of 5 December 2011 , published in MONITORUL OFFICIAL no. 866 866 of 8 December 2011. + Article 8 The mutual aid houses of pensioners may carry out other activities and services than those stated for the main purpose: a) the organization of cultural, artistic, touristic and recreational activities, using their own or rented means of transport; --------- Letter a) of art. 8 8 has been amended by section 4.2 3 3 of art. I of LAW no. 248 248 of 5 December 2011 , published in MONITORUL OFFICIAL no. 866 866 of 8 December 2011. b) the provision of services, against reduced rates, for the members of the mutual aid houses of pensioners and their family members, using the work of pensioners, members of the respective house; --------- Letter b) of art. 8 8 has been amended by section 4.2 3 3 of art. I of LAW no. 248 248 of 5 December 2011 , published in MONITORUL OFFICIAL no. 866 866 of 8 December 2011. c) the organization of stores for the disposal of food products at purchase prices, the administration of rest and treatment houses, the organization of workshops for the repair of various household appliances, clothing, shoes, carpentry and others; --------- Letter c) of art. 8 8 has been amended by section 4.2 3 3 of art. I of LAW no. 248 248 of 5 December 2011 , published in MONITORUL OFFICIAL no. 866 866 of 8 December 2011. d) performing funeral services for the deceased members of the mutual aid houses: making coffins and providing transport; e) other actions and forms of social assistance. f) the provision of medical services against reduced rates to cover the material expenses and salaries of specialized personnel, within the individual medical and dental offices that operate according to the laws in force. --------- Letter f) of art. 8 8 was introduced by section 4.2. 4 4 of art. I of LAW no. 248 248 of 5 December 2011 , published in MONITORUL OFFICIAL no. 866 866 of 8 December 2011. + Article 9 Registration in the mutual aid houses of pensioners is conditional on the payment of a registration fee in fixed amount or in the percentage share of the amount of the pension or social aid, established by the status of each house. + Article 10 (1) Members of the pensioners ' mutual aid houses shall be required to pay monthly contributions, as well as monthly contributions, the percentage or fixed amounts of which shall be determined by the board of directors of that house, within the limits and in the the conditions established by statute. ((2) Upon termination of the membership of the mutual aid house of pensioners, for whatever reasons, the amounts deposited as monthly dues shall be returned to the holder or his followers, as the case may be. (3) The contribution for the death benefit fund shall be returned to the offspring of the member who died. + Article 11 The income of the pensioners ' mutual aid houses shall be: a) registration fees; b) monthly contributions and contributions of members; c) interest from the placement of the amounts available under legal conditions; d) incomes made from the provision of services; e) interest on the amounts borrowed; f) incomes from the organization of cultural, artistic and recreational events; g) donations and sponsorships; h) other income provided by law. + Article 12 (1) From the incomes realized the mutual aid houses of pensioners may constitute, under the conditions provided by the statute: a) funds for loans; b) funds for granting grants; c) funds for cultural, artistic, touristic and recreational activities; d) funds for investments; e) funds for subsidizing the basic food products, established by the board of directors, for the sale to the members of the mutual aid houses of pensioners through their own and saved type stores; f) funds for general expenses. (2) The investment funds may finance, with the approval of the board of directors, the purchase of premises, the arrangement and their endowment for carrying out activities specific to the mutual aid houses of pensioners, including shops own and of an economic type and spa treatment and rest units, the purchase of means of car transport, under the conditions of the legal provisions in force. + Article 13 ((1) The interest that is levied on loans granted to members of the pensioners ' mutual aid houses shall be determined by the board of directors. (. The Governing Board shall determine the annual amount of the treatment rates to be reimbursed to the members of each other's retirement aid houses and the amount of expenditure to be paid for health and health activity. + Article 14 The loan contracts are enforceable. The establishment of the stops is made by the creditor and they are not subject to validation. + Article 15 The county and local pension houses, at the request of the pensioners ' mutual aid houses, will support the recovery of loans granted to bad-paying pensioners, by setting up attachment on their pension income, until to liquidate the flow, in compliance with art. 193 193 para. ((1) of Law no. 19/2000 on the public pension system and other social security rights, with subsequent amendments and completions. + Article 16 The county and local councils and the General Council of Bucharest will support the operation of the mutual aid houses of pensioners by renting the necessary spaces, depending on the possibilities, for carrying out their activities and by reducing the rental rates by 75%. + Article 17 This law shall enter into force within 60 days from the date of publication in the Official Gazette of Romania, Part I. + Article 18 On the date of entry into force of this Law, the Law no. 13/1972 on the mutual aid houses of pensioners, published in the Official Bulletin, Part I, no. 138 of 29 November 1972. This law was adopted by the Chamber of Deputies at its meeting on June 18, 2002, in compliance with the provisions of 74 74 para. (2) of the Romanian Constitution.
