The Romanian Parliament adopts this law + Article UNIC Approval Government Ordinance no. 56 56 of 30 January 2000 on the regulation of the storage of cereals and oilseeds, the system of certificates of deposit for them, and the establishment of the Guarantee Fund for certificates of deposit *), issued pursuant to art. 1 lit. D. 1 1 of Law no. 206/1999 on the empowerment of the Government to issue ordinances and published in the Official Gazette of Romania, Part I, no. 45 of 31 January 2000, with the following amendments and additions: 1. Article 2 shall read as follows: "" Art. 2. -In order to ensure, guarantee the integrity of the cereals and/or oilseeds stored and their surrender is established a system of operating guarantees, which includes a guarantee of good operation and a deposit guarantee fund, under the conditions of this ordinance. 2. In Article 4, points a) and g) shall read as follows: " a) the warehouse-a building, a structure or a protected space, including silo, legally administered by an economic operator and specially equipped for the storage of cereals and/or oilseeds intended for sale; ............................................................... g) the grading activity-the evaluation and certification of the quality of cereals and/or oilseeds handed over to the depositary, brought by the depositor in order to store and obtain the certificate of deposit. " 3. Article 7 shall read as follows: "" Art. 7. -The deposit licence has a validity period of 5 years from the date of its issuance for each deposit. " 4. Article 10 shall read as follows: "" Art. 10. -After determining all financial losses, established by the relevant ministry or, as the case may be, the inspectors authorized by the relevant ministry, they will be covered and reimbursed to depositors primarily from the guarantee of good operation offered by each depositary and, in addition, from the Guarantee Fund for certificates of deposit provided for the protection of these depositors, according to this ordinance and the methodological norms provided for in art. 36 36. " 5. Article 11 shall read as follows: "" Art. 11. -There is the possibility of extending the deposit license, at the request of the depositary, after the expiry of the deadline provided for in 7 7. " 6. Article 14 shall read as follows: "" Art. 14. -(1) The depositary shall display permanently in a visible place, in spaces intended for relations with the public, the storage tariff practiced, which will include the operations provided in art. 4 lit. f), and will publish it in two newspapers, one of which is a national spread. ((2) The payment is made in money or in kind, the value in nature being calculated at the price of the day of the stored product. " 7. Article 15 shall read as follows: "" Art. 15. -For pre-payment storage services the negotiated period will not exceed 12 months. If the storage period exceeds the negotiated period, the depositor will pay the tariff charged by the depositary, at the time of delivery of cereals and/or oilseeds. " 8. Article 17 shall read as follows: "" Art. 17. -The depositary shall keep the cereals and/or oil seeds separately, depending on their quality recorded in each certificate of deposit issued, in order to allow at any time a precise identification as well as their delivery. proper quality. This provision will be applied after one year from the date of entry into force of this ordinance. " 9. In Article 18, paragraph 2 shall read as follows: " (2) The National Commission for the Garden of Cereals and Oleaginous Seeds is established, as an non-governmental body, without legal personality, consisting of representatives of the Ministry of Agriculture and Food, employers, agents representative economic operators in the field and of professional and interprofessional organizations on the product or group of products. " 10. Article 19 shall be supplemented by paragraph 2 with the following contents: " (2) Grades of cereals and oilseeds may also have the status of employee of the company in charge of storage activities, marketing or processing. " -------------- Note * *) Government Ordinance no. 56/2000 has been amended by Government Emergency Ordinance no. 109/2000 , published in the Official Gazette of Romania, Part I, no. 312 312 of 5 July 2000. This law was adopted by the Senate at the meeting of September 26, 2000, in compliance with the provisions of art 74 74 para. (2) of the Romanian Constitution.
