The Romanian Parliament adopts this law + Article UNIC Approval Government Ordinance no. 7 7 of 26 January 1998 on certain social protection measures of military and civilian personnel, which will apply during the restructuring of the major units, units and formations in the composition of the Ministry of National Defence, issued pursuant to art. 1 lit. e) of Law no. 221/1997 on the empowerment of the Government to issue ordinances and published in the Official Gazette of Romania, Part I, no. 34 of 29 January 1998, with the following amendments: 1. Article 1 shall read as follows: "" Art. 1. -Military personnel and civilian employees of the military units, who are made redundant shall benefit from the social protection measures provided for in this ordinance, as a result of the army restructuring program, which refers to: a) the abolition of commands, large units, units, subunits and formations from the composing of the army in peacetime; b) the transformation or resizing of military structures, having as a result the reduction of the number of functions provided in the states of organization in peacetime c) relocation of military structures to other localities, at a distance of more than 50 km. " 2. Article 2 shall be repealed. 3. In Article 5, letter b) shall read as follows: " b) the contract-based military, whose contracts are terminated before the expiry of the term for reasons or needs of the Ministry of National Defence, following the modification of the states of organization or reorganization of the army, without being the possibility of concluding a new contract with the Ministry of National Defence within one month after the termination of the initial contract is offered; " 4. In Article 11 (1), points a)-c) shall read as follows: "" a) 6 gross monthly balances, for those less than 5 years old; b) 9 gross monthly balances, for those aged between 5 years and 7 years; c) 12 gross monthly balances, for those more than 7 years old. " 5. Article 13 shall read as follows: "" Art. 13. -The total amount of money, as compensatory payment, is established for each civil employee who has been undone the individual employment contract according to the present ordinance, corresponding to the length of work, as follows: a) 12 average net salaries on economy, for a working age of less than 7 years; b) 15 average net salaries on economy, for a working age between 7 years and 15 years; c) 20 average net salaries on economy, for a working age of more than 15 years. " 6. Article 18 shall read as follows: "" Art. 18. -The rights due to the staff made redundant under the conditions of this ordinance shall be opened on the date of passing into reserve, respectively of the dissolution of the contract. " 7. Article 19 shall read as follows: "" Art. 19. -Military and civilian personnel made redundant during the restructuring period of the army may benefit from the money rights provided for in this ordinance only once. These rights shall be granted no later than 60 days from the date of passing into reserve, respectively of the dissolution of the contract. " 8. Article 21 shall read as follows: "" Art. 21. -The rights due to military personnel made redundant under the conditions of this ordinance shall be paid by the financial compartments of the military units concerned, and for those abolished, by the military units through which the liquidation is ensured management and taking over financial obligations. " 9. Article 24 shall read as follows: "" Art. 24. -Military personnel retired under the conditions of this ordinance may cumulate the pension with the salary obtained if they continue their activity as an employee or with the additional income made through activities for profit. " This law was adopted by the Senate at the meeting of December 7, 1999, in compliance with the provisions of art 74 74 para. (2) of the Romanian Constitution. SENATE PRESIDENT NICOLAE VACAROIU This law was adopted by the Chamber of Deputies at the meeting of February 15, 2001, in compliance with the provisions of 74 74 para.
