+ Chapter 1 Purpose and heritage + Article 1 It is established, on the date of this decree-law, besides and under the control of the Ministry of Agriculture and Domains "Autonomous Direction of Agricultural Exploitations, Animal Husbandry, Agricultural Industries and Masins", with the abbreviated name " R. E. A. Z. I. M. '. R. E. A. Z. I. M. is the legal person of public law, with its own heritage and management, organized according to the provisions of the present law. The headquarters of Regia is in the capital + Article 2 The aim of this Kingdom is to make the rational exploitation of agricultural goods and enterprises of its heritage and to put them at the service of the country's agriculture. + Article 3 In order to achieve its purpose, R. E. A. Z. I. M.: Will endow all technical units with rational means; It will produce and supply farmers with goods necessary for agriculture, as: seeds, reproducers, wine and horticultural materials and any other goods and means intended for the same purpose; Make available to farmers, for use, machinery, agricultural tools, workshops, reproducers and any other goods available to it; It will facilitate the advantageous valorization of the products of peasant agriculture, through industrialization, conservation, standardization and any other means. It will disseminate agricultural knowledge through the professional, cultural guidance of farmers around its holdings and businesses; Will form skilled workers; She will serve through her units for the practice of students and students in agricultural education and zootechnical veterinary *). ------------------ Note * *) Text corrected according to the rectification published in the Official Gazette No. 283 of December 6, 1946. + Article 4 The production plan, working hours and distribution on the territory of the country of agricultural machinery resorts and installations of industrialization of agricultural products will be carried out by the Regie according to the directives given by the Ministry of Agriculture and Domains through the specialized directions. + Article 5 The goods that pass on the Regia are of two categories: property given in property and goods in use. a) Trec in the property " R. E. A. Z. I. M. ': 1. D., which are not dammed or subject to operations of land improvers, shall be exploited, for fishing purposes, by P. A. R. I. D., when they shall be covered with water. This exploitation will be done by P. A. R. I. D., in agreement with the local administration of the Regia. 2. All agricultural, wine, horticultural, zootechnical goods, pastures and meadows with related buildings and living and dead inventory, owned or used by other ministries or state institutions, except those that have a character of specialty, in direct connection with the respective authority's attributions (shooting range, permanent training field, etc.). Their passage into the property of R. E. A. Z. I. M., will be made on the basis of the journal of the Council of Ministers, prepared by the Ministry of Agriculture and Domains, at the request of the Regia. 3. The agricultural land with the related buildings and the living and dead inventory, which were and will be confiscated and passed into the patrimony of the State, according to the final decisions, given on the basis of exceptional laws. 4. All the barracks, fixed and mobile workshops to repair the cars, in use to the Ministry of War. Their passage into the patrimony of R. E. A. Z. I. M. shall be made on the journal basis of the Council of Ministers, drawn up by M. A. D., at the request of R. E. A. Z. I. M. 5. The living inventory that entered the patrimony of the State from the effect of the agrarian reform law of 1945, necessary for the endowment of the Kingdom's holding. 6. All goods due to the State by the effect of law No. 485 of 1944, which belonged to the German Ethnic Group. 7. All rights and obligations of the institutions abolished, by the effect of the present law or those that are directly related to the goods listed in the property of R. E. A. Z. I. M., apart from the debts regarding the goods resulting from the application the agrarian reform law of 1945 and which is to be regulated by a special law. b) Trec in use R. E. A. Z. I. M.: 1. All agricultural land in the patrimony of the National Colonization Office, which until the appearance of the present law, have not been assigned, following that the Regia will return them to the National Office of Colonizations, when they will actually be given to colonization. 2. All small goods resulting from the agrarian reform of 1919-1921 and 1945, which do not constitute, at the publication of this law, holdings in their own right, nor are they annexed, administratively, to other holdings. + Article 6 The goods passed into the property or use of the Regia will be inventoried by a central Commission, composed of three members: the Director-General of the Regia or his delegate, a delegate of the Ministry of Agriculture and Domains and a delegate of the Ministry of Finance. To the extent of the needs, the steering committee, with the opinion of the committee of the previous paragraph, will be able to set up local inventory commissions. The inventory will be drawn up descriptively and enumeratively. He will be evaluated and centralized until March 31, 1947, according to the instructions given by the Central Commission. + Article 7 In the relations with the authorities and individuals, as well as before the judicial courts, the Regia is represented by its director-general or by its replacement, or by the local governing bodies, within the limits of the powers conferred on them. + Article 8 All the authorities of the State, county and civil and military commune, are obliged to give their contest, at the request of the Regia or its subalterne organs, no matter how much they will be asked, in the interest of + Chapter 2 Administration bodies + Article 9 The direction is administered by: a) the Management Board; b) Steering Committee; c) Director-General. a. Board of Directors + Article 10 The Management Board shall consist of 14 members: 1. Director General of the Regia. 2. Director General of the Agronomic Research Institute of Romania. 3. Director-General of the National Animal Institute. 4. Director of Plant Production, Director of Viticulture and Horticulture and Director of Animal Growth in M. A. D. 5. A representative of the Ministry of Finance. 6. Two specialists in agricultural machinery and industries of the Ministry of Agriculture and Domains or Ministry of National Education. 7. Four small farmers, with the property up to 10 ha, from typical regions of the country and recognized as good householders. 8. A representative of the property over 25 ha, recognized as good householder. The members of section 6 will be in service for at least 5 years. + Article 11 The appointment of board members shall be made over a period of 4 years. Both the appointment and the revocation of the members of the board of directors will be made by royal decree, at the proposal of M. A. D. When for various reasons a holiday would arise during the 4-year period, the member to be appointed instead of vacant, will operate only until this period is fulfilled. Filling the ivite holidays will be done with people in the same category as the member out of the council. + Article 12 Board members will not be able to sit on the boards or committees of competing institutions or businesses or working for the Régie. + Article 13 The board of directors will elect at the beginning of each year, from the bosom or a president, which is confirmed by the decision of the Ministry of Agriculture and The Minister of Agriculture and Areas or the Undersecretary of State from the same department, may take part in any work of the Board, in which case they preside. The Council shall meet once every three months or whenever it shall be convened by the President at an extraordinary meeting. The meetings of the board of directors shall be chaired by the President or in his absence by the most senior of the members present. + Article 14 The decisions of the board of directors will be taken by a majority of votes and in the presence of at least 8 members, including, necessarily, the Director General of the Regia or his replacement. In case of parity, the president's vote will decide. + Article 15 The Director-General shall be the Board's reviewer and shall attend the deliberative voting session. In the event of hindering, it will delegate on the general subdirector, who will also have deliberative voting. + Article 16 The members of the board of directors will be repaid with the presence token, according to the legal norms in force. + Article 17 The Management Board shall have the following tasks: a) Examines and approves the activity and investment plan of the Regia, drawn up by the Director-General; b) Intocmeste the revenue and expenditure budget of the Regia and submit it for approval to the Ministry of Agriculture and Domains and the Ministry of Finance; c) Approve the balance sheet together with the profit and loss account, the inventory concluded at the end of the year and the bookkeeping of the various special funds d) Approve and submit to the Ministry of Agriculture and Domains the reports drawn up by the Directorate-General on the technical and financial merit of the Regia; e) Examines any other works that will be submitted to him by the steering committee or the general manager; f) Decide on the necessary transfers, within the expenditure budget, as well as on the openings of additional appropriations from the credit opening fund; g) Decide on proposals to exceed the total expenses provided by the budget, if it were found that there is a plus of income, covering the expenses plus. b. Steering Committee + Article 18 The steering committee shall consist of: the Director-General of the Director and three members of the Management Board, namely: Director of Plant Production and Director of Animal Growth of the Ministry of Agriculture and Domains and representative of the Ministry of Finance. The Director-General chairs the steering committee. The Committee shall meet whenever necessary at the convocation of its chairman. The decisions and opinions of the steering committee shall be taken by a majority. In case of parity, the president's vote decides. + Article 19 The members of the steering committee will be repaid according to the legal norms in force. + Article 20 The steering committee shall have the following tasks: a) To hire and perform the expenses operations, within the limit of budgetary or extra-budgetary credits, up to a ceiling to be established by the journal of the Council of Ministers, with the opinion of the Ministry of Finance. Above this ceiling, employment will be approved by the Ministry of Agriculture and Domains. b) Decide to carry out loans for no more than 5 years, for the amounts necessary for the holdings. c) Based on the opinion of the Council of Lawyers, it decides the conclusion of transactions to extinguish disputes up to a ceiling that will be established by the journal of the Council of Ministers, with the opinion of the Ministry of Finance and endorses those of a more large, to be submitted to the Ministry of Agriculture and Domains, to be approved by the Council of Ministers; d) Decide the conclusion of conventions with public institutions and enterprises in the country and abroad, which will have to be approved by the Ministry of Agriculture and Domains; e) Aims on the draft budget drawn up by the Director General; f) Aaims at the proposals to set up the various special funds that the Regia needs, for the regular going of the exploits. g) Decide the conclusion of long-term loans for investments from credit institutes recommended by the Ministry of Finance. These decisions are subject to the Ministry of Agriculture and Areas to be approved by the journal of the Council of Ministers, with the opinion of the Ministry of Finance; h) Decide on the sale or disposal of buildings that no longer need or may no longer serve the purpose of the Regia, to be submitted to the Ministry of Agriculture and Domains, on the basis of an authorization law; i) Aims to the balance sheet, profit and loss account and budget execution account. It also has the way of drawing up the inventory and evaluation of the goods; j) Aims on the activity and investment plan of the Regia, in order to be submitted to the board of directors for approval; k) Aims on the reports drawn up by the Director-General on the technical and financial merit of the Regia. + Article 21 The steering committee may be part of its duties to the Director-General. c. Managing Director + Article 22 The Director-General shall have the following a) Decision on administrative, legal, financial, technical, commercial, industrial, exploitation, control and inspection matters, data in the competence of the Autonomous Regia of Agricultural, Animal and Agricultural Industries, in the Agricultural and Farming Industries, in the compliance with the present law; b) He has under his orders the entire staff of the Reg c) Employs the expenses, as well as the supply of materials up to a ceiling that will be established by the journal of the Council of Ministers; d) Names, engages, submits, transfers, retires, sanctions and sends before the discipline commissions the staff of the Regia in accordance with the provisions of the Statute of the Civil Servants, the laws of organization of the Technical Bodies and of the working-class laws in force; e) Intocmeste, together with the Central Directions, the plan of activity and investments. f) Intocmeste, together with the Central and County Departments, the draft annual revenue and expenditure budget of the Regia; g) Intocmeste, together with the Accounting Direction, the inventory and the balance sheet for the expired year, which, together with the profit and loss account, the budget execution account, the control commission report, the opinion of the steering committee and the decision the board of directors, will be submitted to the Ministry of Agriculture and Domains, to be subject to the High Court of Accounts through the Ministry of Finance; h) Inkey, with the opinion of the Council of Lawyers, transactions up to a ceiling established by the journal of the Council of Ministers; i) Control the implementation of the budget j) assign, with the opinion of the steering committee, between the Directions and Services, the allocated amounts, in accordance with the needs of each service; k) Intocmeste the annual report of the technical and financial and commercial activity of the Regia; l) Send delegates or participate personally in domestic or international congresses and conferences, in which agricultural production, machinery or agricultural industries are to be discussed and may give special assignments for different studies and Research. m) Care for the preparation of specifications for works, materials and services; n) It has public tenders, according to the rules established by the present law. o) Watch and control, personally or through its delegates, that the accounting records in money and materials should be kept up to date and that the preparation of financial statements, balance sheet, annexes and inventory should be made on time; p) Set the operating rules of all technical units; q) Control, through the organs of the Regia, the normal course of all services; r) Intocmeste the draft convention with public institutions and enterprises in the country and abroad and forwards them with the decision of the steering committee, the Ministry of Agriculture and Domains, for approval; s) Intocmis the report on the technical and financial merit of the Regia; t) Study personally or through different Directions and services, any general or special matters of order that could bring an improvement to the technical units of the Regia; u) The Director-General may delegate part of his duties to his subordinates. + Article 23 If the steering committee could not be met, to take action or resolve urgent matters, which would entail the danger of losses or other shortcomings for the Kingdom, the Director-General is authorised to take, on his own responsibility, the measures he will find with way to avoid them, which he will then submit for ratification to the steering committee at his first meeting. + Chapter 3 Organizing services + Article 24 The General Direction is headed by a Managing Director, aided in the exercise of its duties by two sub-directors-general *). They will be appointed by royal decree and can be revoked, if it is established that they have brought material and moral damage to the Regia, found by the conclusion of the board of directors. -------------------- Note * *) Text corrected according to the rectification published in the Official Gazette No. 283 of December 6, 1946. + Article 25 Besides the General Direction will operate a Body of inspectors of various specialties with guidance and control attributions, the number of which will be determined, as required, by budget. Techniques of various specialties will work for consultation and technical advisors, the number of which will be established by budget. + Article 26 The General Direction is composed of the Departments and Central Services, as well as from county and other external services. + Article 27 Each direction is led by a specialist director, aided by a sub-director. + Article 28 The directions and central services of the General Directorate are as follows: A. The direction of Agricultural and Animal Husbandry, which has the following services: 1. Agricultural service, which organizes and leads the production of selected seeds. 2. The livestock and male breeding service, which organises and leads the breeding and use of prasile animals. 3. The wine service, which organizes and leads the production of the vine planting material. 4. The fruit and horticultural service, which organizes and leads the production of fruit and horticultural propagating material. 5. The agricultural industries service, which organizes and manages the industrial and agricultural enterprises of the Regia. 6. Sericultural, beekeeping and poultry service. 7. Animal Health Defense Service. 8. Service of product undoing. 9. Service of goods in use. B. Directorate of Machine Stations, has the following services: 1. Organization service: a) Keep track of car resorts; b) Collaborate in the preparation of investment plans; c) Make proposals for the staff movement. 2. The Service of Exploitation, which shall develop instructions for the organization and operation of the machines, for a rational and as cost-effective exploitation. 3. Technical service, which runs the repair shops and cares for the repair of the cars. C. Planning direction, has the following services: 1. Service of centralization of production results and planning. a) Based on the data provided by the Accounting Directorate and the research at the technical units, it establishes the profitability of each unit and of each production branch. b) Calculate the production cost; c) Make proposals to increase profitability; d) Prepare the production planning projects. 2. Land and Construction Service: a) Keep the archive and the existing cadastral and construction plans; b) In collaboration with the Exploitation Direction, it prepares the investment plans that fall within its competence; c) Make proposals and follow the execution of land improvements; d) Intocmeste the construction projects and execute the new constructions; e) Intocmeste projects and executes repairs and reconstructions. 3. Service of goods and purchases: a) In collaboration with the Exploitation Direction, it prepares the investment plan that enters its competence; b) Based on the investment plan and following the commitment of necessary funds, it meets the formalities for the purchase of the necessary goods to the Regia; c) It leads the central deposits and prepares, in collaboration with the Accounting Directorate, instructions for the organization of deposits to external services. D. Accounting Department, has the following services: 1. Income service: a) Follow the financial situation of the Regia, make proposals for the procurement of necessary funds. b) Organize the realization of the revenue budget and prepare, the works for the contracting of loans. 2. Service of expenses: A. Central services expenditure section: a) Keep the accounting of the central services of the Kingdom; b) In collaboration with the Goods and Procurement Service and with the external services expenses section, prepare the works for the preparation of the King's balance sheet. B. External services expenditure section: a) Prepare the rules for keeping the external services accounting; b) Centralize data on the accounting of external services; c) Keep track of the execution of the budget by external services d) Make proposals for the use of surpluses and coverage of deficits found in external services; e) Centralize the balance of external services; f) Make proposals for the making of inspections and the movement of accounting staff to external services. 3. Budget and inventory service: a) Prepare the works for the composition of the Regia budget; b) Prepare the works and keep the general inventory of the Regia; c) Prepare instructions for the preparation, maintenance and communication at the center of the inventory of external services, in collaboration with the external services expenses section. E. Administrative Direction, has the following services: 1. Staff Service: a) Do the work in relation to the staff movement. b) Intocmeste the personnel files, alphabetically and on services, and keeps the archive of staff records; c) Execute the works in connection with the mobilizations for work. 2. The contentious service. 5. Registry and archive service. F. The cashier's service. + Article 29 The exterior services of the Kingdom are: a) Regional inspectorates for the technical and financial control of the County Directions and the production units. The heads of the Regional Agricultural, Zootechnical and Veterinary Inspectorates of the Ministry of Agriculture and Domains can also be tasked to perform the function of heads of the Regional Inspectorates of the Regia; b) County departments of exploitation of agricultural livestock, machinery and agricultural industries on which the technical units in that county depend; The county directives will be set up, as necessary, through the budget. The directors of the County Agricultural Chambers, may be charged with the performance and function of county directors of the Regia. The county directors will be assisted in the performance of their duties by a sub-director; c) Technical units led by an administrator, having in administration goods that may be the subject of separate operations. These units are: 1. Farms, tamaslakes, herghelies, oieries, poultry farms, nurseries, vineyards, orchards of fruit trees, vegetable gardens. The organization of each unit mentioned above, in terms of the framework of the activity, the production branch and the staff, will be done by the General Direction. 2. Agricultural car resorts, machine repair shops, spare parts warehouses, fuel and lubricants. The organization of these units, in terms of headquarters, activity and personnel, will be done by the General Direction. The use of agricultural machinery will be carried out according to the plan drawn up by agreement with the head of the agricultural detour in whose radius the car resort is found. The payment of work carried out with agricultural machines can be done by farmers up to 5 hectares and in nature. 3. Manufacture, installations of any kind for processing, industrialization, preservation, standardization of agricultural products of any kind, cellars, cellars, greenhouses. The organization of each unit mentioned above, in terms of the framework of the activity, the branch of the production and the staff, will be made by the General Direction, within the program, fixed by the Ministry of Agriculture and Domains. + Chapter 4 Personal provisions relating to staff + Article 30 The staff of the Regia is two categories a) Staff recruited according to the provisions of the Statute of civil servants or the laws of organization of technical bodies, which is subject to the rights and obligations provided by these laws; b) Staff employed according to the law of employment contracts. + Chapter 5 Financial organisation + Article 31 All operations of the Regia and accounting records are made according to the norms provided in the trade laws, where it does not otherwise have the present + Article 32 The direction is obliged to organize and hold the accounting in the double game, on units and kinds of exploitation. + Article 33 The annual revenue and expenditure budget will form an annex to the general budget of the State, in which only the benefits or subsidies given to the Kingdom will be shown. + Article 34 The revenues of the Regia come from the sale of products of any category, rents, interest, sales of materials, subsidies from the State and other unforeseen sources. Subsidies from the State, will be provided in the budget of the Ministry of Agriculture and Domains and will cover investment, guidance, propaganda and any other expenses that are not subject to their own exploitation and maintenance, in the extent to which they cannot be covered by the Régie's own funds. + Article 35 The works carried out by the Director for public institutions, will be paid on the basis of the justification of expenses for materials and salaries, plus general expenses. + Article 36 The budget year begins on April 1 and ends on March 31. + Article 37 The operations of receipts and payments will be made by: The National Bank, the House of Savings and Postal Checks, the Cassa de Depuneri, the Financial Administrations or through the Administration's own cashier offices. The latter will only keep on them the strictly necessary availability. + Article 38 In the course of the implementation of the budget, in case of need or to obtain better results, any budgetary expenditure, except those provided for the payment of administrative staff, may increase, based on the reasoned proposals made by the Director general, with the approval of the Ministry of Agriculture and Domains and the Ministry of Finance, if there will be income increases corresponding to the expenses. + Article 39 If during the budget year the receipts would not reach the coverage of the current expenses, the Regia can obtain advances from the State or procure the necessary amounts through loans. + Article 40 The losses at the end of the year will be debt and debt. The Ministry of Finance, at the request of the Régie and with the opinion of the Minister of Agriculture and Domains, can cover the losses + Article 41 At the end of each budget year, the Regia will draw up the general inventory, which will include the inventory of movable and immovable property, with their evaluation, and the inventory of all carried over in the following year. Mobile goods will be counted at the cost price or the price of the day, if it will be lower than the cost price. The goods that by their nature are exposed to wear and depreciation, will establish the share of attrition and depreciation, with the approval of the Ministry of Agriculture and Domains, based on the proposal of the Regia. + Article 42 Also, at the end of the year, the budget execution account, the balance sheet and the profit and loss account will be drawn up. The inventory, the general balance sheet, the profit and loss account and the budget execution account, accompanied by the general manager's report, on the results obtained and on the conclusion of the control commission, will be submitted to the Ministry of Agriculture and Areas, within three months from the expiry of the exercise, to be subject to the control of the High Court of Accounts through the Ministry of Finance. + Article 43 From the annual benefits will be created a reserve fund, by taking a quota of 10%, until 20% will be reached from the evaluation of the goods listed in the inventory. The reserve fund serves to cover losses produced by force majeure cases, as well as to cover expenses necessary to replace destroyed installations before the amortization deadline or become unusable as a result of technical progress. M. A. D., in agreement with the Ministry of Finance, can decide, at the request of the Regia, the establishment and other funds. + Article 44 The works, materials and services of the Regia can be executed either in directing or in the half, as determined by the competent administration bodies; they will be executed in directing, whenever the technical and financial capacity of the Regia, ensures execution in superior and advantageous conditions. + Article 45 The works, materials and services can be contracted by good agreement: a) When for their performance no competitors can be obtained; b) When for their performance an execution capacity is required without which a good result cannot be guaranteed; c) When they require an emergency in execution; d) When materials are produced by art, instruments or precision machines, the execution of which can be entrusted only to artists or specialists, when the manufacture of materials is made exclusively by the owner of a patent or when the sale is made through a single organization; e) When the materials are taken from their own production of the State, county or commune enterprises. f) When the smooth running of the Kingdom would be jeopardised by the delay caused by the holding of a tender; g) When the supply of the furnace is found to be necessary supplements that have not been provided and only if they do not exceed 30% of the total value of the first adjudication; h) When the works, materials and services are worth up to 50 million lei as material, work or service, their fractionation being prohibited; i) When payment will be made by giving some materials; j) Whenever the competent body, which approved the work, its material or service, will determine, on the basis of a prior examination, that it is more advantageous for the Regie to contract by good agreement. + Article 46 In all other cases, the works, materials and services, will be contracted by public or restricted auction. + Article 47 The competent bodies will be able to decide that the tender will be restricted to certain enterprises when the works, materials or services are urgent and could not wait for the forms of a public tender to be fulfilled. + Article 48 Auctions will be announced by the Official Gazette and two main newspapers at least 30 days from the date fixed before for auction. In urgent cases this term can be reduced up to 10 days.
