I-IV, which forms an integral part of this law; the tables may be modified by the registration of a new plant or substance, by the removal of a plant or substances or by transferring them from one table to another, on the proposal of the Minister the health or minister of home affairs; b) drugs-plants and narcotic drugs or psychotropic substances or mixtures containing such plants and substances, inscribed in tables no. I-III; c) high risk drugs-drugs registered in tables no. I and II; d) risk drugs-drugs listed in Table no. III; e) precursors-substances commonly used in the manufacture of drugs, listed in Table no. IV; f) toxic chemical inhalants-substances established as such by order of the Minister of Health; g) illicit drug use-the consumption of drugs under national control, without a prescription; h) consumer-the person who manages or allows him to be administered drugs, illicitly, by swallowing, smoking, injecting, receiving, inhaling or other pathways through which the drug can reach the body; i) dependent consumer-the consumer who, as a result of the administration of the drug repeatedly and under necessity or need, presents physical and mental consequences according to medical and social criteria; j) integrated consumer and drug-dependent consumer assistance program-the totality of health services and social psychological and social assistance services provided in an integrated and coordinated way to people consuming drugs, through medical, psychological and social, public, private and mixed; k) integrated consumer and drug-dependent consumer assistance circuit-the totality of integrated assistance programs provided to consumers and dependent consumers in order to improve health in the sense the physical, mental and social well-being of the individual; l) therapeutic program-the totality of services and integrated medical and psychological measures, individualized by evaluation, planning, monitoring and continuous adaptation for each dependent consumer, in order to interrupt consumption, removal of mental and/or physical dependence and/or reduction of the risks associated with consumption; m) psychological and social program-the totality of the individual or group evaluation, counseling and psychotherapy services and social services and measures, individualized through evaluation, planning, monitoring and continuous adaptation for each consumer, in order to eliminate his dependence, rehabilitation and social reintegration; n) therapeutic circuit-the set of therapeutic programs applied to the drug-dependent consumer in a complex, multidisciplinary, multisectoral and continuous way, aimed at improving the state of health; o) assessment-determining the psychological and social characteristics of the consumer by prevention, evaluation and drug counseling centers, in order to include and supervise the consumer in a psychological and social program by the case manager. p) national program for the prevention and medical, psychological and social assistance of drug users-tool for strategic and financial planning of public drug policies, representing the ensemble of multiannual actions aimed at development and strengthening of the integrated national system for the prevention of drug use and assistance services for drug users, implemented by the National Anti-Drug Agency; -------- Lit. p) of art. 1 1 was introduced by section 4.2. 1 1 of art. I of LAW no. 51 51 of 17 April 2014 , published in MONITORUL OFFICIAL no. 322 322 of 5 May 2014. q) national interest program for the prevention and medical, psychological and social assistance of drug users-tool for strategic and financial planning of public drug policies, representing the ensemble of multiannual actions that respond to national priorities in the field by ensuring the complementarity of drug prevention projects and assistance services for drug users implemented by civil society. -------- Lit. q) of art. 1 1 was introduced by section 4.2. 1 1 of art. I of LAW no. 51 51 of 17 April 2014 , published in MONITORUL OFFICIAL no. 322 322 of 5 May 2014. + Chapter II Sanction of trafficking and other illicit operations with substances under national control + Article 2 (1) Cultivation, production, manufacture, experimentation, extraction, preparation, processing, offering, selling, selling, distribution, delivery with any title, sending, shipping, procuring, buying, holding or other operations on the movement of risk drugs, without right, are punishable by imprisonment from 2 to 7 years and the prohibition of some rights. (2) If the facts provided in par. (1) have as their object high-risk drugs, the punishment is imprisonment from 5 to 12 years and the prohibition of some rights. + Article 3 (1) The introduction or removal from the country, as well as the import or export of risk drugs, without right, shall be punished with imprisonment from 3 to 10 years and the prohibition of some rights. (2) If the facts provided in par. (1) concern high-risk drugs, the sentence is imprisonment from 7 to 15 years and the prohibition of some rights. + Article 4 (1) The cultivation, production, manufacture, experimentation, extraction, preparation, transformation, purchase or possession of risk drugs for own consumption, without right, shall be punished with imprisonment from 3 months to 2 years or with a fine. (2) If the facts provided in par. (1) concern high-risk drugs, the sentence is imprisonment from 6 months to 3 years. + Article 5 Making available, with science, with any title, a dwelling or a local or any other arranged place, in which the public has access, for illicit drug use or the toleration of illicit consumption in such places is punishable by imprisonment from 2 to 7 years and prohibition of some rights. + Article 6 (1) Prescribing high-risk drugs, with intent, by the doctor, without it being medically necessary, is punishable by imprisonment from one year to 5 years and the prohibition of some rights. (2) With the punishment provided in par. (1) shall be sanctioned and released with high risk drug intent, based on a prescription medical prescription under the conditions provided in par. ((1) or a falsified medical prescription. (3) Obtaining high-risk drugs by using a prescription medical prescription under the conditions provided in par. (1) or a falsified medical prescription is punishable by imprisonment from one year to 3 years. + Article 7 The administration of high-risk drugs to a person, outside the legal conditions, is punishable by imprisonment from one to 5 years. + Article 8 The supply, for consumption, of chemical inhalants toxic to a minor is punishable by imprisonment from 6 months to 2 years. + Article 9 Financing of the acts provided in art. 2-5 is sanctioned with the penalties provided by law for these facts, their special limits increasing by one third. + Article 10 The urge to illicit high risk drug use, by any means, is punishable by imprisonment from 6 months to 3 years. + Article 11 If the facts provided in art. 2, 6-8 and 10 had as a result the death of the victim, the sentence is imprisonment from 10 to 20 years and the prohibition of some rights. + Article 12 (1) Attempted to the crimes provided in art. 2, 3, art. 4 4 para. ((2), art. 6 6 para. ((2)-(3), art. 7 and 9 is punishable. (2) It is considered the attempt and production or procurement of means or instruments, as well as the taking of measures in order to commit the crimes provided in par. ((1). + Article 13 (1) With regard to the crimes contained in this chapter, in addition to the situations provided in the Criminal Code, the following situations constitute aggravating circumstances: a) the person who committed the crime carried out a function involving the exercise of public authority, and the act was committed in the exercise of this function; b) the act was committed by a medical professional or by a person who has, according to the law, duties in the fight against drugs; c) drugs were sent or delivered, distributed or offered to a minor, to a mental patient, to a person in a therapeutic program or other such activities were carried out prohibited by law on one of these persons or if the act was committed in an institution or medical facility, educational, military, place of detention, social assistance centers, re-education or medical-educational institution, places where students, students and young people carry out activities educational, sports, social or near to them; d) the use of minors in the commission of the facts provided 2-10 2-10; e) drugs were mixed with other substances that increased their danger to the lives and integrity of people. (2) In the case of the aggravating circumstance provided in par. ((1) lit. c), regarding the commission of facts in an educational institution or in places where students, students and young people carry out educational, sports, social activities or near them, at the special maximum provided by law can be added an increase that cannot exceed 5 years, in the case of the prison, or the general maximum, in the case of the fine. + Article 14 The person who committed one of the offences referred to in art. 2-9 and which, before the prosecution was started, denounces the authorities its participation in the commission of the crime, thus contributing to the identification and criminal liability of the author or other participants. + Article 15 The person who committed one of the offences referred to in art. 2-9, and during the criminal investigation denounces and facilitates the identification and criminal liability of other persons who have committed drug crimes benefit from the reduction in half of the limits of the sentence provided by law. + Article 16 (1) Drugs and other goods that have been the subject of the crimes provided for in art. 2-9 is confiscated, and if they are not found, the convict is obliged to pay their equivalent in money. (2) The money, the values or any other goods acquired through the use of drugs and other goods provided in par. ((1). (3) The amounts resulting from the valorization of confiscated assets and confiscated money, according to par. ((1) and (2), constitute state budget revenues and stand out in separate account in the state budget. + Article 17 (1) High drugs for confiscation are destroyed according to art. 574 lit. d) of the Code of Criminal Procedure. The preservation of counterapproval is mandatory. (2) They are exempted from destruction: a) usable drugs, which have been remitted to pharmacies or hospital units, after the prior opinion of the Pharmaceutical Department and medical devices of the Ministry of Health; b) plants and substances usable in the pharmaceutical industry or other industry, depending on their nature, which have been remitted to a public or private economic operator, authorised to use or export them; c) some corresponding quantities, which will be kept for teaching and scientific research or have been remitted to institutions holding dogs and other drug detection animals, for the preparation and maintenance of their training, with compliance with legal provisions (3) The destruction of drugs shall be carried out periodically, by incineration or by other appropriate means, by a company governed by Law no. 31/1990 , republished, with subsequent amendments and completions, authorized, in the presence of a commission consisting of the judge delegated with execution, one representative of the National Anti-Drug Agency, the Ministry of Environment and Climate Change, a specialist within the central party specialized in preventing and combating illicit drug trafficking and use in the General Inspectorate of the Romanian Police and the manager of the chamber of delicate bodies of the same unit. If the destruction does not take place in the constituency of the executing court, the commission shall include the judge delegated with the execution from the appropriate court to the degree in which the destruction takes place. A copy of the minutes shall be sent to the executing court. + Article 18 If a consumer is sentenced to the prison sentence for committing a crime other than those provided for in art. 4, the court may order its inclusion in a therapeutic program carried out in the prison system. + Chapter III Procedural provisions + Article 19 (1) In case of committing the crimes provided in art. 4, the prosecutor orders, within 24 hours from the start of the prosecution, the consumer's assessment by the drug prevention, evaluation and counseling center, in order to include him in the integrated circuit of assistance of persons Drug users. ((2) According to the conclusions of the evaluation report prepared by the prevention, evaluation and drug counseling center, within 5 days from its receipt, the prosecutor has, with the consent of the consumer, its inclusion in the integrated program of the assistance of drug users. + Article 20 (1) If, until the judgment, the defendant referred to in art. 19 complies with the protocol of the integrated program for the assistance of drug users, the court may order the waiver of the sentence or the postponement of the application of the sentence, even if the conditions provided for in art. 80, respectively art. 83 of the Criminal Code. (2) Non-compliance, during the term of supervision, of the integrated program for the assistance of drug users shall properly attract the application of the provisions of art. 88 88 para. (1) of the Criminal Code. + Article 21 (1) The central parties specialized in preventing and combating illicit drug trafficking and use within the General Inspectorate of the Romanian Police, the General Inspectorate of the Romanian Border Police, the Public Ministry and the Directorate The data on the prevention and combating of illicit drug trafficking and use, essential chemicals, precursors and toxic chemical inhalants, necessary for the preparation of the report to the Government Romania and international bodies on evolution and level drug trafficking and use in Romania, as well as those necessary for the elaboration of studies, summaries and analyses for the foundation of policies and strategies to respond in the fight against drugs. (2) For the same purpose, the Ministry of Health, the Ministry of Labour, Family, Social Protection and the Elderly and the Ministry of National Education, as well as other public or private institutions accredited to carry out programs and activities prevention of illicit drug use transmit the data requested by the National Anti-Drug Agency, under the law. (3) The institutions provided in par. (2) may receive, upon request, the data centralized by the National Drug Enforcement Agency, essential chemicals, precursors and toxic chemical inhalants, including annual reports, syntheses and analyses. + Chapter IV Measures against illicit drug use + Article 22 (1) Drug use under national control, without a prescription, is prohibited on the territory of Romania. (2) The person who consumes illicit drugs under national control may be included, with his consent, in an integrated program for the assistance of drug users. The manifestation of the inclusion agreement in the integrated circuit of assistance of drug users is done by signing a document, according to the regulation for the application of the provisions of this law. (3) The establishment of the individualized psychological and social program is done by the prevention, evaluation and drug counseling center, based on the psychological and social evaluation and in accordance with the results of the medical examination requested by a unit medical, according to the criteria set out in the regulation implementing this law. (4) The establishment of the individualized therapeutic program is done according to the practice protocols, developed by the Ministry of Health, through its specialized structures and the Romanian College of Physicians. (5) Medical facilities in which therapeutic programs are carried out for dependent consumers transmit to prevention, evaluation and drug counseling centers the necessary data in order to maintain the continuity of the integrated assistance program drug users, based on a medical report. (6) The therapeutic program and the psychological and social program are carried out integrated, so that the consumer and the dependent consumer can benefit from a concurrent and continuous medical, psychological and social assistance, in compliance with the rights man and patient rights, according to the law. + Article 23 (1) The psychological and social programs shall be developed by the National Anti-Drug Agency in collaboration, as the case may be, with the Ministry of Health, the Ministry of Labour, Family, Social Protection and the Elderly and the Ministry of Justice and may be conducted in authorized and/or accredited centers in this regard, with open or closed, public, private or mixed regime. (1 ^ 1) National programs for the prevention and medical, psychological and social assistance of drug users and programs of national interest for the prevention and medical, psychological and social assistance of drug users are elaborated by to the National Anti-Drug Agency, in collaboration with other institutions, governmental and non-governmental organizations, and approved by the Government. -------- Alin. ((1 ^ 1) of art. 23 23 has been introduced by section 2 2 of art. I of LAW no. 51 51 of 17 April 2014 , published in MONITORUL OFFICIAL no. 322 322 of 5 May 2014. (1 ^ 2) National programmes for the prevention and medical, psychological and social assistance of drug users shall be implemented, monitored and evaluated by the National Drug Agency, as national policy coordinator. public domain. -------- Alin. ((1 ^ 3) Programs of national interest for the prevention and medical, psychological and social assistance of drug users shall be implemented by entities belonging to civil society with responsibilities in the field of drugs, monitored and evaluated by the National Drug Enforcement Agency. -------- Alin. ((1 ^ 3) of art. 23 23 has been introduced by section 2 2 of art. I of LAW no. 51 51 of 17 April 2014 , published in MONITORUL OFFICIAL no. 322 322 of 5 May 2014. (1 ^ 4) The technical and methodological norms for the implementation of programs of national interest for the prevention and medical, psychological and social assistance of drug users are approved by order of the Minister of Internal Affairs, which is published in Official Gazette of Romania, Part I. -------- Alin. ((1 ^ 4) of art. 23 23 has been introduced by section 2 2 of art. I of LAW no. 51 51 of 17 April 2014 , published in MONITORUL OFFICIAL no. 322 322 of 5 May 2014. (1 ^ 5) National programs for the prevention and medical, psychological and social assistance of drug users and programs of national interest for the prevention and medical, psychological and social assistance of drug users shall be financed from state budget, through the budget approved to the Ministry of Internal Affairs, within the budget funds approved to the National Drug Agency. -------- Alin. ((1 ^ 5) of art. 23 23 has been introduced by section 2 2 of art. I of LAW no. 51 51 of 17 April 2014 , published in MONITORUL OFFICIAL no. 322 322 of 5 May 2014. (2) The therapeutic programs shall be developed by the Ministry of Health and shall be carried out in centers established for this purpose, with open or closed, public, private or mixed regime. (3) The expenses occasioned by the evaluation of the consumer and the development of psychological and social programs shall be borne by the state budget, through the budget approved to the Ministry of Internal Affairs, within the limits of National Drug Enforcement. ---------- Alin. (4) The expenses occasioned by the application of the individualized therapeutic program for persons insured by the health insurance system are borne by the health insurance companies of the Single National Social Insurance Fund of health for diseases arising from drug use and health programs of the Ministry of Health and prevention programs of the National Drug Agency. (7) The Minister of Justice and the Minister of Health will establish, by joint order, the medical and educational measures or programs that will be applied to drug users in prisons. + Article 24 (1) The personal data of consumers addicted to drug use, included in the integrated consumer assistance program and drug-dependent consumers, benefit from confidentiality, according to the rules in force. (2) The centralized record of consumers included in the therapeutic circuit is related to the Romanian Drug and Drug Observatory of the National Drug Agency, in the unique code for drug users, based on data communicated by the Ministry of Health and other institutions that coordinate therapeutic, psychological and social programs, as well as established, public or private centers. (3) The Ministry of Health, through the designated directions, has access to the evidence provided in par. ((2). (4) The person to whom the measures provided for in art. 22 and 23 i will be issued a nominal certificate or an electronically coded identification card, in which they will be mentioned: the issuing unit, the identification data of the person concerned, the duration, the object and the result of the treatment, the reason for the termination treatment, the condition of the person's health at the beginning and termination of (5) All data on persons subject to the integrated consumer assistance programme and drug-dependent consumers will be destroyed 10 years after the end of medical supervision. In the case of persons subject to integrated consumer assistance programmes and drug-dependent consumers several times, the data will be destroyed 10 years after the end of the last period of medical supervision. + Article 25 Any person who has knowledge of a drug user can refer one of the medical facilities established by the Ministry of Health, which will proceed according to the law. + Chapter V Final provisions + Article 26 Within 60 days from the date of entry into force of this Law, the Ministry of Health, with the opinion of the Ministry of Internal Affairs, Ministry of Justice and the Ministry of Public Finance, will issue the Regulation for the application of the present law, which is hereby approved by the Government. *) Note
