Chapter I General provisions Article 1 In this law the following terms and definitions shall apply: a) substances under national control of drugs and precursors included in tables-Annex nr. I-IV, which is an integral part of this law; tables can be modified through the inclusion of new plants or substances, through the cancellation of a plant or substance or by transferring them from one table to another, at the recommendation of the Minister of health or the Minister of Internal Affairs;
  

b) drugs-narcotic plants and psychotropic substances or mixtures containing such substances, plants listed in tables no. I-III;
  

c) high-risk drug-drugs listed in tables no. I and II;
  

d) drug-risk drugs listed in table no. III;
  

e) precursors in substances frequently used-manufacture drugs listed in table no. IV;
  

f) toxic chemical substances inhalanţi-established as such by order of the Minister of health;
  

(g) illicit drug consumption)-drug use under national control, without a prescription;
  

h) consumer-the person who is managing or allows to be administered drugs, in procuring through swallowing, injecting, smoking, prizare, inhalation or other avenues by which the drug reaches the body;
  

I) consumer-consumer-dependent, as a result of administering drugs repeatedly and under necessity times need, presents physical and mental consequences according to medical and social criteria;
  

j) integrated program of assistance to consumers and consumers addicted to drugs-the totality of health services and services of psychological and social assistance in an integrated and coordinated manner to drug users, persons through medical units, psychological and social, public, private and mixed;
  

k) integrated circuit to support consumers and consumers addicted to drugs all integrated programmes provided assistance to consumers and consumers addicted to improve health status for the purpose of well-being physical, psychological and social rehabilitation of the individual;
  

l) program all services and therapeutic measures for integrated medical and psychological assessment, individualized through planning, monitoring and continuous adaptation to every consumer in order to addict the interruption expense, the psychological dependence and/or physical and/or reducing risks associated with consumption;
  

m) psychological and social program all services assessment, counselling and individual or group psychotherapy and social services and measures, by assessing, planning, monitoring and continuous adaptation to every consumer with a view to elimination of the dependency, social rehabilitation and his reinserţiei;
  

n) therapeutic range of circuit-therapeutic programs applied consumer drug addict in the complex, multidisciplinary, multisectoral and continuously, with the objective of improving health status;
  

assessment-a) psychological and social profiling of the consumer by the prevention, evaluation and drug counseling, to include oversight of the consumer in a psychologically and socially by the case manager.
  

p) national programme for prevention and health care, psychological and social consumer drug-tool for strategic planning and financial ensuring of public policies against drugs, representing the totality of multiannual actions aimed at developing and strengthening integrated national system of prevention of drug use and assistance services for drug users, implemented by the National Anti-drug Agency;

q) national programme for prevention and health care, psychological and social consumer drug-tool for strategic planning and financial ensuring of public policies against drugs, representing the totality of multiannual actions which respond to national priorities in this area by ensuring the complementarity of the projects for the prevention of drug use and assistance services for drug users, implemented by civil society.

Chapter II Sanctioning traffic and other illicit operations with substances under national control in article 2 (1) Cultivation, production, manufacture, extraction, preparation, experimentation, transformation, offering, offering for sale, distribution, sale, delivery on any basis, sending, transportation, procurement, purchase, possession or other operations relating to the movement of drugs, without right, is punished with imprisonment from 2 to 7 years and the prohibition of certain rights.
  

(2) if the acts referred to in paragraph 1. (1) the purpose of high-risk drugs, the penalty is imprisonment from 5 to 12 years and the prohibition of certain rights.
  


Article 3 (1) the introduction or removal from the country, as well as import export drug times risk-free law, are punishable by imprisonment from 3 to 10 years and the prohibition of certain rights.
  

(2) if the acts referred to in paragraph 1. (1) high risk drug concern, the punishment is imprisonment from 7 to 15 years of age and prohibition of certain rights.
  


Article 4 (1) Cultivation, production, manufacture, extraction, preparation, experimentation, transformation, purchase or possession of the drug's risk for own use, without any right, shall be punished with imprisonment from three months to two years or by a fine.
  

(2) if the acts referred to in paragraph 1. (1) high risk drug concern, the punishment is imprisonment from 6 months to 3 years.
  


Article 5 provision, with science, with any title, of a dwelling or a local or any other place, where the public has access, for illicit consumption of illicit drug consumption in times of tolerating such places shall be punished with imprisonment from 2 to 7 years and the prohibition of certain rights.


Article 6 (1) Prescription Drugs of great risk, intentional, by the doctor, without it being necessary on medical grounds, shall be punished with imprisonment from one year to five years and the prohibition of certain rights.
  


(2) the penalties provided for in paragraph 1. (1) there shall be imposed, and intentional release of high-risk drugs, on the basis of a medical prescription recipes under the conditions laid down in paragraph 1. (1) or of a forged medical recipes.
  

(3) high risk drugs using a prescribed medical recipes under the conditions laid down in paragraph 1. (1) or of a forged medical recipes shall be punished with imprisonment from one year to three years.
  


Article 7 management of high-risk drug a person outside the conditions laid down by law, shall be punished with imprisonment from one to five years.


Article 8 providing for the consumption of toxic chemicals, the inhalanţi of a minor shall be punished by imprisonment from 6 months to 2 years.


Article 9 Financing of the facts referred to in art. 2-5 are sanctioned with penalties prescribed by law for these facts, special limits increasing by a third.


Article 10 any instigation to illegal drugs consumption of great risk, by whatever means, shall be punished with imprisonment from 6 months to 3 years.


Article 11 where the acts referred to in article 1. 2, 6 to 8 and 10 were following the death of the victim, the penalty is imprisonment for 10 to 20 years and the prohibition of certain rights.


Article 12 (1) Attempted to offences referred to in articles. 2, 3, art. "". (2), art. 6 paragraph 1. (2) to (3), art. 7 and 9 shall be punished.
  

(2) it is considered tentative and the production or acquisition of the means and instruments, such as the times taking action to commit offences referred to in paragraph 1. 1. Article 13 (1) with regard to the offences listed in this chapter, in addition to the situations described in the penal code, constitute aggravating circumstances: a) the person who committed the offence serving a function involving the exercise of public authority, and the deed was committed in the exercise of this function;
  

b the deed was committed) by a health professional or a person who, under the law in the fight against drugs;
  

c) drugs have been sent or delivered, distributed or offered to a minor, a mentally ill, a person placed in a therapeutic program or have performed such other activities prohibited by law with respect to one of these persons or if the Act was committed in an institution or education unit, medical, military, prison, social welfare centres, re-education or medical-educational institution the students, students and youth activities, sports, social or in their vicinity;
  

d) use minors in the perpetration of acts mentioned in article 1. 2-10;
  

e) drugs have been mixed with other substances that they have increased the danger to the life and integrity of persons.
  

(2) in the case referred to in paragraph 1, aggravating the scope. (1) (a). (c)), concerning the perpetration of acts in an educational institution or in places in which students, students and youth activities, sports, or in their vicinity, the maximum prescribed by law is particular to add an increase not exceeding 5 years, or in the case of imprisonment, the maximum fine in the case.
  


Article 14 is not punished the person who has committed one of the offences mentioned in article 1. 2-9 and that, prior to being commenced criminal proceedings, denouncing the authorities its participation in committing the offence, thus contributing to the identification and prosecution of the author or other participants.


Article 15 a person who has committed one of the offences mentioned in article 1. 2-9, while during the criminal investigation, and facilitates the identification and denounces the criminal liability to other people who have committed drug-related offences benefit from reduction of the limits of the punishment prescribed by law.


Article 16 (1) Drugs and other goods that have been subjected to the offences mentioned in article 1. 2-9 shall be forfeited, and if they are not found, the convict is obliged to pay their equivalent in money.
  

(2) shall be forfeited, also the money, values or any other goods acquired by capitalizing on drugs and other property referred to in paragraph 1. (1) and (3) the amounts derived from the sale of seized property and money confiscated in accordance with paragraph 1. (1) and (2) shall constitute revenue of the State budget and is highlighted in separate account in the State budget.
  


Article 17 (1) for the purposes of confiscation raised Drugs fall under art. 574 lit. d) of the code of criminal procedure. Preservation of counter-evidence.
  

(2) Are exempted from destruction: a) medicines that were usable, pharmacy or hospital units delivered, after the prior opinion of the pharmaceutical and medical devices Directorate within the Ministry of health;
  

(b)) usable substances and plants in the pharmaceutical industry or in another industry, depending on their nature, that have been submitted to a public or private economic operator authorised to use them or to export;
  

c appropriate amounts) some of which will be preserved for teaching and scientific research, or have been delivered to institutions that own dogs and other animals to detect drugs, for preparing and maintaining their training, in compliance with legal provisions.
  

(3) destruction of drugs is carried out periodically by incineration or by any other appropriate means, by a company governed by the law nr. 31/1990, republished, with subsequent amendments and additions, in the presence of an authorized Commission composed of judge delegated with the execution, one representative of the National Anti-drug Agency, Ministry of the environment and climate change, a central party specialist specializing in preventing and combating trafficking in and illicit consumption of drugs from the General Inspectorate of the Romanian police and the Chamber's Manager of bodies of the same offence. Where destruction has no place in the constituency of enforcement, the Commission delegated judge forms part with execution of the appropriate court in the degree in which the 2nd Circuit destruction. A copy of the minutes shall be sent to the Court of enforcement.
  


Article 18 where a consumer is sentenced to jail for committing a crime other than those referred to in article 1. 4, the Court may order its inclusion in a therapeutic program carried out in the prison system.


Chapter III procedural Provisions in article 19 (1) in the case of offences referred to in articles. 4, the Prosecutor shall, within 24 hours of the commencement of prosecution, the assessment of the consumer by the Center for the prevention, assessment and counselling service, in order to include it into the integrated circuit support of people consuming drugs.
  

(2) depending on the conclusions of the assessment report drawn up by the Centre for the prevention, assessment and advice service within 5 days of receiving it, the Prosecutor has, with the consent of the consumer, its inclusion in the integrated support programme for persons consuming drugs.
  


Article 20 (1) where, by the time judgment, the defendant referred to in art. 19 comply with Protocol integrated programme of assistance to the persons consuming drugs, the Court may order the abandonment of the application or to postpone the application of the death penalty, even if you are not satisfied the conditions laid down in article 21. 80 respectively art. 83 of the penal code.
  

(2) Failure, during the term, the integrated programme of assistance to the persons consuming drugs draws properly apply the provisions of article 4. 88 para. (1) of the penal code.
  


Article 21 (1) of the Central specialized Formations in preventing and combating trafficking in and illicit consumption of drugs within the General Inspectorate of the Romanian police, the General Inspectorate of the Romanian border police, the Public Ministry and the Directorate General of Customs shall transmit to the National Anti-drug Agency data on prevention and combating trafficking in and consumption of illicit drugs, precursors, essential chemicals and toxic chemical inhalanţi, necessary statement is produced by the Romanian Government and by international bodies concerning the evolution and the level of traffic and the use of drugs in Romania, as well as those needed to develop studies, syntheses and analyses for justification of response policies and strategies in the fight against drugs.
  

(2) for the same purpose, the Ministry of health, Ministry of labour, social protection and the family, the Elderly and the Ministry of national education, and other public or private institutions accredited to carry out programs and activities to prevent illicit drug consumption shall transmit the data required under the National Anti-drug Agency, in accordance with the law.
  

(3) the institutions referred to in paragraph 1. (2) may receive, upon request, the data centralized by the National Anti-drug Agency on drugs, precursors, essential chemicals and toxic chemical inhalanţii, including annual reports, summaries and analysis.
  


Chapter IV measures against illegal drugs consumption in article 22 (1) drug use under national control, without a prescription, is prohibited on the territory of Romania.
  

(2) a person who consumes illegal drugs under national control may be included, with his consent, in an integrated program of assistance to individuals to drug users. The manifestation of the agreement include an integrated circuit support to persons consuming the drug is made by signing a document, according to the regulation for the application of the provisions of this law.
  


(3) establishment of individualized psychological and social programme is done by the Center for the prevention, assessment and counselling, drug based on assessment of psychological and social development and in accordance with the results of the medical examination required of a medical unit in accordance with the criteria laid down in the implementing rules of this law.
  

(4) establishing individualized therapeutic programme is performed according to the protocols of practice, developed by the Ministry of health, through its specialized structures and College of physicians from Romania.
  

(5) medical Units in therapeutic programs for addicted consumers convey prevention centres, drug counseling and assessment data required in order to maintain the continuity of the integrated programme of assistance to drug users, persons on the basis of a medical report.
  

(6) the therapeutic and psychological and social program is conducted, so that the consumer and the consumer hooked on the benefits of a medical, psychological and social concomitant and continuous, with respect for human rights and the rights of the patient, according to the law.
  


Article 23 (1) psychological and Social Programmes shall be drawn up by the National Anti-drug Agency, in collaboration with the Ministry of health, Ministry of labour, social protection and Family, Older Persons and the Ministry of Justice and can be run in approved centres and/or accredited for this purpose, with open or closed, public, private or mixed.
  

(1 ^ 1) National prevention programs and health care, psychological and social consumer of drugs and national programmes of prevention and health care, psychological and social consumer drug is developed by the National Anti-drug Agency, in collaboration with other institutions and non-governmental organizations, and is approved by the Government.

(2) therapeutic Programmes shall be drawn up by the Ministry of health and is being conducted in centres established for this purpose, with open or closed, public, private or mixed.
  

(3) the costs of assessment of the consumer and conduct psychological and social programmes are supported from the State budget through the budget of the Ministry of the Interior approved, subject to a National Anti-drug Agency approved funds.

(4) expenditure incurred by the implementation of the programme for persons insured with the individualized therapeutic system of health insurance are covered by the health insurance fund single national health insurance for diseases resulting from drug and health programs of the Ministry of health and prevention programs of the National Anti-drug Agency.

(7) the Minister of Justice and the Minister of health shall establish, by order, medical and educational measures or programmes which will be applied to drug users in prisons.
  


Article 24 (1) the personal data of consumers addicted to drug use, included in the integrated program of assistance to consumers and consumers addicted to drugs, enjoy privacy, in accordance with the rules in force.
  

(2) centralized Records of consumers included in the therapeutic circuit keep the Observatory of drugs and drug addiction within the National Anti-drug Agency, coded in the register concerning the unique drug users, based on data supplied by the Ministry of health and other institutions that coordinate programmes of social, psychological and therapeutic, and established centers, public or private.
  

(3) the Ministry of health, through the designated departments, has access to the data of a record referred to in paragraph 1. (2) and (4) the person to whom the measures have been applied. 22 and 23 will release a nominal certificate or legitimation in electronic form encoded, which will mention: the issuing unit identification data of the person concerned, duration, subject matter and treatment outcome, with the completion of the treatment, the reason the State of health of the person concerned at the beginning and end of treatment.
  

(5) all data relating to persons subject to integrated programme of assistance to consumers and consumers addicted to drugs will be destroyed after 10 years from the termination of medical surveillance. In the case of persons subject to multiple times to support integrated programmes to consumers and consumers addicted to drugs, the data will be destroyed after 10 years after the cessation of his last medical supervision.
  


Article 25 any person who has knowledge about a drug consumer may refer to one of the medical units set by the Health Ministry, which will proceed according to the law.


Chapter V final provisions article 26 within a period of 60 days from the date of entry into force of this law, the Ministry of health, the Ministry of Internal Affairs, the Ministry of Justice and the Ministry of public finances, will issue Regulation for application of the provisions of the present law, approving a decree of URGuvernului.*) Note ─ ─ ─ ─ ─ ─ ─ ─ ─ ─ *) see Judgment No. 860/2005 approving the regulation for the application of the provisions of law No. 143/2000 on preventing and combating trafficking in and illicit consumption of drugs, with amendments and additions thereto, as published in the Official Gazette of Romania, part I, no. 749 17 august 2005, with subsequent amendments, which repealed the Government decision nr. 1.359/2000 approving the regulations governing the application of the provisions of law No. 143/2000 on combating trafficking in human beings and illegal drugs consumption.
