Chapter I General provisions Article 1 the provisions of this law shall apply to military and civilian personnel of the Ministry of national defense, Ministry of Interior, Romanian Intelligence Service, the foreign intelligence service, security guard and protection service, the special telecommunications service and the Ministry of Justice.

Article 42 (1) Frames and military soldiers employed on a contract basis, while is in the delegation, secondment, temporary incapacity of work, annual leave, maternity leave and other paid leave which is granted on the basis of legal provisions, the furlough and during the execution of the disciplinary sanctions prescribed in the regulations, receiving monthly soldele and other pecuniary rights.
  

(2) upon departure on leave of rest frames and military soldiers employed on a contract basis receive the result in advance, a monthly which is charged at least 5 days prior to departure on leave.

The period of parental leave under the age of 2 years or 3 years in the case of the child with disability constitute seniority in service, and that it takes into account in determining what rights are granted in relation to this.

Article 62 military personnel who, under special regulations, it is obliged to reside in the premises of the establishment or in the homes of its service, is exempt from paying the rent.

Article 65 military units which is financed partially or fully from extrabudgetary resources are now available, as well as sports clubs of the Ministry of national defense and the Ministry of the Interior may apply the provisions of this law.


Article 66 the specific rights of the staff in the ministries and the institutions referred to in article 1. 1 are contained in the annex. 9. Article 67 military Frames that follow higher education institutions, and applicants are entitled to an annual leave, with pay, of 30 calendar days.


Article 68 military Frames, military activity employees contract employees and civilians, sent a delegation of more than 30 days uninterrupted in the same locality may be awarded in exceptional circumstances, with the prior approval of Ministers or, where appropriate, of the heads of central institutions, delegating full allowance for the duration of the delegation.



Article 69 monetary Grant Rights regulated by this law will be made within the limits of budgetary funds approved central ministries and institutions annually. 1. Article 70 during mobilization or war shall apply the provisions of this law, as well as some specific rules laid down by decision of the Government.

Annex 5 RIGHTS of staff who carry out work on construction sites, in industry, agriculture, geo-topo-Photogrammetry and other sectors of activity. the rights of conscripts within Soldiers receive a monthly premium for exceeding the value plan, that is the norm in terms of value, which shall be paid out of a fund set up in the amount of:-70% of the value plan for overcoming those which supply manual;
-20% of the value of the individual laid down rules to be exceeded for drivers and mechanics of conductors;
-5% of the total value exceeding the rules on subunit (machines) for awarding conscripts from repair shops.
The individual levels of the premium may not exceed 50% of minimum gross basic salary per country.
Soldiers within indirectly productive benefits from monthly premium in up to 40% of the average achieved first on the unit or subunit to which they belong. The first will meet revenue and does not affect the prize intended conscripts directly productive.
B. rights of military activity, of military contract employees and employees in civil military Frames, military activity, contract employees and civilian employees receive: a) the allowance of delegation or secondment in the amount prescribed by the laws in force, on condition that the work to be elsewhere than the place where he has his domicile or residence and only if it is not possible to return home (residence).

Individual amount of the premium shall not exceed the following percentages of the result at the monthly basic salary corresponding to the time worked, as follows:-up to 25% for the complete menu tree directly productive (platoon, detachment, company, team, workspace, section, lot, battalion equipment and transport, dock);
-up to 20% for the rest of the staff-indirect productive — from the battalions, brigades sectors (M.U.);
-up to 15% for staff of the relevant compartments with coordination headquarters and central departments, approved by the Minister or by the head of the central institution;

d) a furlough or a boss for 4 days (two working days), once every 45 days, with soldă duties, i.e. salary and reimbursement of transportation, those who work in other than those in which they have their habitual residence;
  

s) free shipping under the same conditions in which it is granted the military moved into the interests of the service in other garrisons than their place of residence.
  

Provisions common to lit. A and B to the value of the individual and plan Rules in value depending on the monthly premiums are granted shall be determined on the basis of regulations drawn up by central ministries or institutions.

-up to 20% of the monthly service, base salary for members indirectly productive.
Military and civilian personnel to whom the provisions of subparagraph (a) shall apply. A and B do not benefit from early and annual prize, established in article 11. 28 and 29 of the Act for the period in question, by paying more than the normal working hours provided work and no allowance.
C. Rights in military activity of military contract employees and employees ' civilians which supply geo-topo-photogrammetric field

Military frames, military activity, contract employees and employees who execute civilians in ground works of astronomy, geodesy, Photogrammetry and topo-levelling, while is in other than the headquarters unit, shall be: (a) full delegation) compensation, in the amount prescribed by the laws in force, regardless of the distance and duration in days of participation in the works provided that the work to be in other than the place where domiciles and only if it is not possible to return home;
  

(b) accommodation expenses), according to the regulations in force, for staff moving into the interests of the service, when they cannot provide accommodation free of charge.
  

Military and civilian personnel who benefit from the rights referred to above do not benefit from the payment provided over the normal hours of work and no allowance.
D. Units and categories of personnel to which it applies the provisions of this annex shall be laid down by order of the Minister, the ruler of the central institution.
