Law No. 22 of January 18, 1999 approving emergency Government Ordinance No. 67/1997 on the establishment, organization and functioning of the national Office of cinematography and Cinema Fund ISSUING national PARLIAMENT Published in MONITORUL OFICIAL nr. 18 of 21 January 1999 the Parliament adopts this law.


Article 1 shall approve the Emergency Ordinance of Government No. 67 of 24 October 1997 on the establishment, organization and functioning of the national Office of cinematography and the national cinema Fund, published in the Official Gazette of Romania, part I, no. 295 of 30 October 1997, with the following amendments and supplements: 1. Article 2 shall read as follows: Art. 2.-(1) the date of entry into force of this emergency Ordinance established the national Office of cinematography, the specialized body of the central public administration directly subordinated to the Government, through the reorganization of the national centre of cinematography which is dissolved.

(2) the national Office of cinematography shall have legal personality, while recurrent expenditure and capital expenditure is financed entirely from the State budget. "
  

2. Article 3 shall read as follows: Art. 3.-(1) the national Office of cinematography is headed by a President, whose function is similar to that of Secretary of State, as well as a Vice President, the rank of Undersecretary. Chairman and Vice-Chairman are appointed by the Prime Minister.

(2) the President of the national Office of cinematography is the main originator of loans. "
  

3. Article 5 shall read as follows: Art. 5.-(1) the national Office of cinematography coordinates the activity of film from Romania, managing assets of the national cinema, and the financial resources allocated for this purpose.

(2) the assets of the national cinema, located in the national Office of cinematography, consists of: a) Romanian films all genres: feature film, short film, documentary films, as well as materials of documentary films, unmounted animated films, negative and all primary materials, made with full financing from the State budget;
  

b) material remaining after completion of the full funded productions made from the State budget and which can be used in the production of new films, such as: furniture, props, costumes, weapons, or items of decor, purchased or made on the costs of the respective page in Company warehouses lt; Lt; Cinema Studio, gt; GT; Bucharest-S.A. or in any other place of storage;
  

c administration-owned cinemas) National Office of cinematography through the overhead of distribution and exploitation of Films film-Romania-Bucharest.
  

(3) the national Office of cinematography authorises, on the basis of uniform standards they develop, conduct all activities of the Hollywood film in the country, carried out by natural persons or legal entities, Romanian or foreign.
  

(4) in order to establish uniform methods of record-keeping, and authorizing all activities in the field, as well as the classification of cinematographic works, the register is hereby established cinema. "
  

4. Article 6 shall read as follows: Art. 6.-National Office of cinematography shall have the following duties: a) draft normative acts in the field of competence;
  

b) issue rules and instructions for subordinate units;
  

(c) the participation of Romanian cinematography) to bodies and national and international events;
  

d) issues the rules of organization and functioning of the cinematography, and the rules for the classification of cinematographic works;
  

e) manages and operates mobile and immovable heritage of cinematography;
  

f) arranges or supports the Organization of festivals and other cinematographic events in Romania;
  

g) supports the participation of Romanian cinematic productions at festivals and at other international events;
  

h) organises training and retraining of staff;
  

Retrieves the necessary data I) from individuals or legal entities that carry out activities in the field of cinema and forward them to the National Commission for statistics in order to produce lt; gt lt; cinematographic statistics; GT;;
  

j) shall monitor compliance with the regulations in the field of cinematography;
  

k) initiate and participate in the negotiation of conventions, agreements and other international or bilateral agreements in the field of cinema, according to the law;
  

l) can edit specialized publications and information in the field;
  

m) grant annually the national cinematography Prize and other awards may be instituted and for each of the specific fields and technical cinematographic creation. "
  

5. Article 7 shall read as follows: Art. 7. — (1) the Council Shall set up a national Office of cinematography, the coordinating body of the national strategy of the Office of cinematography.

(2) the national Office of cinematography shall be composed of the President and Vice-President of the national Office of cinematography and of 13 members.
  

(3) the national Office of cinematography 11 members are appointed by the President of the national Office of cinematography, from a number of two proposals for each place from the following legal entities: a) associations and unions of creators, existing: 4 members;
  

b) companies which have as their object the exploitation of films in theaters: 1;
  

c) companies whose main activity is the production of film: 2 members;
  

d) companies whose main activity is the distribution of films: a Member;
  

It's Romanian television Society): a Member;
  

f) private television companies on radio waves, with terrestrial or satellite transmission, and cable television companies: a Member;
  

g) specific cinematic publications: a member.
  

(4) the Minister of culture and Minister of Finance Appoints each one member on the Board of the national Office of cinematography.
  

(5) the work of the Council Secretariat of the national Office of cinematography is provided by the staff of the national Office of cinematography. "
  

6. Article 8 shall read as follows: Art. 8. — (1) the term of Office of the members of the national Office of cinematography shall be two years; Board members cannot exercise more than two mandates, they cannot be.

(2) members of the Board of the national Office of cinematography shall be remunerated according to the annex. 11 in the law. 40/1991 regarding the remuneration of the President and the Government of Romania, as well as staff of the Presidency, Government and other bodies of executive power, republished, with subsequent amendments. "
  

7. Article 9 shall read as follows: Art. 9. — (1) the Council of the national Office of cinematography shall have the following duties: a) the establishment of the development strategy of the Romanian film industry;
  

b promotion and representation) at international level the interests of national cinema;
  

(c) establishment of a national program) of film culture;
  

d) coordination of specific projects and programmes for the various forms of cinematographic creation;
  

e) award of Cinema and other prizes instituted by the national Office of cinematography;
  

f) setting strategy, principles and priorities for the allocation of Fund to support the national cinematographic production and distribution of the film.
  

(2) the national Office of cinematography takes decisions in the presence of not less than 11 members, with the majority of the votes of those present simple.
  

(3) the national Office of cinematography lays down rules for the granting of annual National cinematography Prize for each of the specific areas. "
  

8. Article 10(4) shall be repealed.
9. Article 11 shall read as follows: Art. 11.-(1) the Council of the national Office of cinematography jury establishes for the granting of financial support for the production, distribution and encouraging Romanian movie.

(2) the national Office of cinematography shall meet in ordinary sessions on a quarterly basis, at the request of the President of the national Office of cinematography or, in absence thereof, of the Vice-President.
  

(3) the national Office of cinematography can come together and extraordinary meetings, when convened by the President of the national Office of cinematography or, in its absence, the Vice-President, and at the request of at least 6 members of the Council. "
  

10. Article 12 shall read as follows: Art. 12. — (1) for the completion and the powers of the national Office of cinematography national cinema Fund, which is administered by the Office.

(2) national cinema Fund is constituted from appropriations from the State budget and from extra-budgetary sources. "
  

11. Article 13 shall read as follows: Art. 13.-(1) off-budget Sources of National Cinema Fund is constituted by the amounts made by the national Office of cinematography by: a) the organisation of cultural events, studies and projects, as well as the exploitation of goods contained in the equipment;
  

b) duties for realization of operations of classification, registration and authorization within the register of cinema;
  


c) a contribution of 1.5% of the wholesale selling price of recorded video cassettes, which adds to the price thereof, payable by the trader who makes the sale to the public and which is licensed as such. Businesses, wholesale distributors of recorded video cassettes, are obliged to send to the national Office of cinematography list with sales contracts, including their value, and the name of the economic agents, buyers for sales up to the 25th of the month, for the previous month;
  

d) a contribution of 3% of the price of minutes of advertising sold by the Romanian Society of television and private television stations broadcast about radioelectrica, terrestrial or satellite, plus at this price. Advertising agencies and businesses, which buy minutes of advertising from television, mentioned above, are required to send to the national Office of cinematography to purchase contracts list minutes of advertising, including their value, as well as economic agents, sellers name until the 25th of the month, for the previous month. Where between advertising agency and tv station there is an intermediary trader, the obligation to pay this contribution shall be the responsibility of the operator who has carried out intermediary sale of minutes the respective advertising agency;
  

e) a contribution of 3% of the price of minutes sold advertising space of one's own program for cable television companies that have a license to produce programs that add this price;
  

f) a contribution from the proceeds arising from the dissemination of films on any kind of support, in cinemas or in other public spaces intended for public viewing, whose rate is 10% for films of foreign origin and 20% for films that also ban the viewing for minors;
  

g) a contribution of 3% of the gross profit obtained by operators of commercial activities by another profile in spaces intended for exploitation films and the annexes thereto;
  

h) assignment of exploitation rights for Romanian films made with full financing from the State budget, produced before the date of entry into force of this emergency Ordinance, with the enforcement of copyright and related rights;
  

I) sums deriving from renting real estate or other property placed in its management;
  

j) amounts arising from the exploitation of goods in national cinema heritage;
  

k) operation, sale or renting of props, furniture, weapons, costumes, scenery or decoration items that have been purchased or made and recorded on costs during the production of films financed entirely from the State budget and carried out before the date of entry into force of this emergency Ordinance, respecting copyright laws;
  

l) a fee of 0.5% of the corresponding budget filming in Romania for the approval by the national Office of cinematography to foreign teams; the same fee applies and the budgets of films made by providing services for foreign partners, who add these budgets. Considering services and coproductiile to which the contribution in cash of the Romanian side is less than 5% of the production budget of the film;
  

m) other activities carried out directly by the national Office of cinematography.
  

(2) the definition of premises referred to in paragraph 1. (1) (a). g) and setting the amount of the contribution will be made by the national Office of cinematography within 90 days of its establishment.
  

(3) the sums deriving from contributions set out in paragraph 1. (1) (a). c)-g) are deductible expense in calculating the taxable profit of the economic operators concerned.
  

12. Article 14 shall read as follows: Art. 14. — (1) the contributions referred to in article 1. 13(2). (1) (a). d) can be reduced by 50%, at the request of the operator concerned, observing the use of integrals by sums arising from unfunded, for direct participation in the development of movies, in conditions of art. 28 para. (1) the design in cinemas or in other spaces defined as such by the national Office of cinematography.

(2) claims brought for this purpose will be submitted to national Office of cinematography until 31 December for the following year.
  

(3) the remaining amount available, neutilizata no later than 31 December of the current year, shall be paid by the national Office of cinematography at the latest on 25 January of the year following that for which the reduction is requested. "
  

13. Article 15 shall read as follows: Art. 15. — (1) the economic agents are obliged to declare and to transfer the national Office of cinematography the amounts referred to in article 1. 13(2). (1) (a). b)-g) and l) not later than the 25th of the month for the previous month, with the exceptions laid down in article 21. 14. (2) non-fixed-term or the failure of the amounts referred to in paragraph 1. (1) as well as non-value contracts, according to art. 13(2). (1) (a). c) and (d)) shall be imposed according to this emergency Ordinance.
  

(3) the remaining Revenue, extra-budgetary Fund national cinema at the end of the year after expenses shall be carried over to the next year, keeping the same destination. "
  

14. Article 16 shall be inserted in paragraph (2) with the following contents: "(2) for collection of amounts due, the national Office of cinematography shall be authorized to apply the procedures for execution, in accordance with the provisions laid down by law."
15. Article 17 shall read as follows: Art. 17. — (1) the sums managed by national Office of cinematography through the national cinema Fund will be used to give priority to providing financial support to producers and distributors of films of all genres: documentaries and fictional feature film, documentary, animation, experimental film or any kind of support, on the condition that the film be made according to the provisions of art. 28 para. (1) and (2) the financial support is granted in the form of repayable loans, without interest, as follows: a) credit for production and/or distribution;
  

b) credit for the development of the screenplay;
  

c) credit for success.
  

(3) the credits refundable, with the exception of the credit for success, are granted solely on the basis of a contest organized by the national Office of Cinematography: a) for financial support of the production and distribution of films, in the form of loans for production and/or distribution;
  

b financial support) of economic agents, film producers or individual authors, for preparing and carrying out screenplays in the form of loans for developing the screenplay. "
  

16. After article 17 article 17 shall enter ^ 1 with the following content: "Art. 17 ^ 1. -(1) the competitions to provide credit for production and/or distribution and credits for the development of the screenplay is organized twice a year.

(2) the national Office of cinematography shall appoint a jury differently for each session of competition, made up of 5 people.
  

(3) the designation of the jury shall be made in maximum 3 days after the expiry of the term for submission of competition projects.
  

(4) the jury deliberates and operates according to the regulation and the criteria approved by the Board of the national Office of cinematography.
  

(5) the decisions of the jury shall be taken by open vote, with simple majority of the total number of members, as in his judgment his rationale for the jury draw up a written statement of reasons within 10 days of deliberation.
  

(6) the decisions of the judges can be appealed within 30 days of the communication to the Council of the national Office of cinematography.
  

(7) the decisions of the Council of the national Office of cinematography can be appealed, according to the law, the Court's competence.
  

(8) to grant credit for the development of the screenplay is a letter of intent by an economic operator, film producer to clarify its intent to purchase the right to film after the script done with such support at a price at least equal to the loan amount requested. "
  

17. Article 18 shall read as follows: Art. 18. — (1) Credit for production and/or distribution, granted by the national Office of cinematography of the manufacturer or the distributor of the film, may not exceed 49% share of the total expenditure budget of the project submitted by the applicant.

(2) the amount of the credit granted to a movie may not exceed 20% of the amounts earmarked for this purpose from the national cinema Fund.
  

(3) Credit for production and/or distribution are granted solely for feature film presented at the contest and shall not be transferable.
  

(4) the national Office of cinematography may grant, on a competitive basis, and special forms of funding from the national cinema Fund: a) up to 75% of the total budget required the production of a film debut with the condition not to exceed the average budget of a film made in the previous year with support from the national Office of cinematography;
  

b) up to 75% of the total budget required for the production and distribution of experimental films, short fiction, documentary or animation. "
  

18. Article 19 shall read as follows:

"Art. 19. — (1) the physical person or legal entity requesting the Romanian credits for production and/or distribution times for success must provide evidence of a direct contribution to the financing of the project, amounting to at least 5% of the overall budget of the production or distribution of the film, in cash, in nature or in services, mark to market.

(2) This contribution may be in the form of credit or letter of banking guarantee of equivalent guarantees times.
  

(3) Credit for production and/or distribution times the credit for success may be granted only once for a movie, at the request of an authorized representative of coproducatorilor.
  

(4) the Romanian natural persons or legal entities applying for financial support in the form of credit must provide evidence that they have obtained the assignment of rights to achieve adaptation, as an object of derived, request, and in the case of economic operators manufacturers or distributors of the film, right or exclusive to the film for which it has requested this support from all its rights holders under the terms of legislation in the matter. "
  

19. Article 20 shall read as follows: Art. 20. — (1) credit for Both production and/or distribution and credit for success shall be granted on the basis of a contract concluded between the national Office of cinematography and the trader or producer, distributor of the film.

(2) the contract shall be concluded only after verifying the dossier of the project by the national Office of cinematography, whereby it should be attesting full financing of the project, both as a source and as timelines, is fully insured.
  

(3) loan for the development of the scenario is assigned on the basis of the contract between the agent film producer or author of the applicant and the national Office of cinematography.
  

(4) the term for submission of the screenplay, conducted with the help of the credit for the development of the screenplay, is one year from the date of grant thereof.
  

(5) the production of a film made with the help of the credit to the production and/or distribution of the time of the credit for success must begin no later than one year after the granting thereof, and the realization of standard copy shall not exceed 3 years after that date.
  

(6) Credit for production and/or distribution and credit for success can be combined, provided that it does not exceed a total of 60% of the costs of production and distribution.
  

(7) subject to the conditions laid down in paragraph 1. (6) an application for a credit for production and/or distribution may be made only to the extent that the amounts due as credit for success not wholly covers a percentage of 60%.
  

(8) In justified cases, the Council of the national Office of cinematography may extend the time limits referred to in paragraph 1. 5. (9) In the budgets of the films made with financial support, in accordance with the provisions of this Ordinance, shall be provided, at the request of the national Office of cinematography, premiums for the following insurance is concluded by the designers and manufacturers with specialized insurance companies: insurance against deterioration of tape film or video tape; insurance against illness or death for filmmakers, actors, principal Director, parent and others assimilated thereto; securing furniture and dummy bodies, of the setting; insurance against third parties; insurance amounts in cash. The national Office of cinematography may request the termination of an insurance producer to complete the film. "
  

20. Article 21 shall read as follows: Art. 21. — (1) the share of national cinema Fund what may be granted annual appropriations for success may not exceed one third of the total of the sums constituting the Fund.

(2) Credit for success are calculated by setting a fixed amount for each of the spectators paying a film, made pursuant to article. 28 para. (1) if the reference had at least 40,000 spectators paying.
  

(3) the amount of the sum granted under the terms of paragraph 1. (2) shall be fixed annually by the national Office of cinematography.
  

(4) when calculating the amount of the credit for success should be taken into account only the number of paying viewers in cinema halls or halls for visionaries with audiences, defined and authorized as such by the national Office of cinematography.
  

(5) Credit for the success of a manufacturer is granted only for the production of a new film, released under the terms of art. 28 para. 1. (6) where the share of national cinema Fund, distributed for that year, it is not sufficient to cover the amount of the credit for the success of a film, due under the terms of this emergency Ordinance, amounts not covered will be transferred to an entity of the national Office of cinematography for the coming year. "
  

21. Article 22(3) shall read as follows: Art. 22. — (1) the national Office of cinematography may take into consideration the advice of the Council National Office of cinematography, and other forms of financial support from extrabudgetary sources to accomplish his ends, in accordance with article 4. 5. (2) the national Office of cinematography can use budget funds placed at its disposal and for making capital expenditures, personnel, material and services, necessary for the performance of duties and responsibilities incumbent on it according to the provisions of article 3. 5 and 6. "
  

22. Article 23 shall read as follows: Art. 23. — (1) credits under the terms of this emergency Ordinance shall be reimbursed to the national Office of cinematography of the proceeds by using script or times the exploitation film, made with these credits.

(2) Beneficiaries of loans for production and/or distribution as well as credits for the successful guarantee with a percentage share of the revenue derived from exploitation of the film, corresponding to the participation of the national Office of cinematography to the production and distribution of the film in question.
  

(3) loan for the development of the screenplay is guaranteed by the beneficiary with part of the proceeds obtained through the transfer of rights over the screenplay, corresponding to the participation of the national Office of cinematography to its achievement.
  

4. the repayment obligation is extinguished after a period of 10 years from the date of commencement of the use or operation of the script times, where appropriate, of the film.
  

(5) the amount of non-refundable amounts remaining after that date shall be taken into account in determining the taxable profit of the entity benefiting from the credit.
  

(6) where an economic operator, natural or legal person, contributing to the production or distribution of a film with more than 10% of the budget, the recovery of this contribution is made on a priority basis. "
  

23. Article 24 shall read as follows: Art. 24. — (1) the beneficiaries of the loans for production and/or distribution as well as credits for the successful transfer of the national Office of cinematography, revenue from the operation of the film, the amounts corresponding to the percentage share of participation of the national Office of cinematography to the production and distribution of the film in question.

(2) the transfer of the amounts mentioned in paragraph 2. (1) shall be made up to the last working day of the month following that in which the revenue was achieved. "
  

24. Article 25 shall read as follows: Art. 25. — (1) the ownership of tape and all rights of exploitation of the film belong to the manufacturer, including where it has benefited from financial support from the national Office of cinematography.

(2) within 30 days after completion of the copy of the standard, negative and the film's primary materials realized with the financial support of the national Office of cinematography will be submitted in a film-processing laboratory, supported by both the national Office of cinematography, and the producer, on behalf of the manufacturer or manufacturers, as appropriate, and of the national Office of cinematography the costs of filing being borne by the producer. For 100% Romanian films production, after 3 years after the premiere of the materials referred to above will be submitted under the same conditions, at the National Archives, the costs being borne by the producer. A recording will return once the producer's repayment in full of the amounts granted. '
  

25. Article 26(2) shall read as follows: Art. 26.-not eligible for credits for production and/or distribution times for the development of the screenplay: a) the members of the juries, for the competition in which they have been appointed;
  

b) Chairman and Vice-Chairman of the national Office of cinematography;
  

c) personnel who operate within the national Office of cinematography. "
  

26. Article 27(2) shall read as follows: Art. 27. — (1) for the purposes of income Through this emergency Ordinance, means the totality of the amounts received by the trader, the producer of the film, from the use or operation of the screenplay of the movie times, depending on the circumstances, domestically and internationally, for exploitation in cinemas or in other halls intended for visionaries with the public through television or through bodies of cable distributors and the operating rights for the separate music , soundtrack, text, script, or by producing publications, recordings, audio and video cassettes and other derivative works, articles, games and the like, using opera or pre-existence as the source, the film in question and whose exploitation rights were obtained by the operator at the manufacturer, with respect to the legislation in the field of copyright and related rights.


(2) the economic agent that produces or distributes a film with financial support from the national Office of cinematography is compelled to outlining his accounts separately in the income and expenditure for this movie and to report periodically to the revenue from the use and operation thereof.
  

(3) Reporting will be done in the first year of operation, once a month, until the 25th of the month for the previous month, and then quarterly up to expiry of 3 years and then annually until the expiry of 10 years.
  

(4) failure by manufacturer to the operator. 23 and 24 on the reimbursement of support, according to this emergency Ordinance, attract loan contract and forcing the refund within 30 days, the amounts granted as financial support. "
  

27. Article 28 shall read as follows: Art. 28. — (1) are eligible for credits of the Romanian natural persons or legal entities who submit projects for film or screenplay that meet at least two of the following conditions: a) at least two of the authors of the film (writer, Director or composer), half the number of actors in the lead roles, half the number of technicians and half the number of workers to be Romanian citizens;
  

b) shooting to take place in the proportion of two-thirds, in Romania, with the exception of shooting in the studio, to be carried out in Romania; where the subject of the film requires otherwise, the compensation is done through other specialized services performed in Romania, such as installation, sound system, laboratory work, and other technical operations;
  

c) in the case of coproductiilor, the Romanian side must have a minimum participation share of 51% of the film budget, not including the costs for this scenario, music, Director, producer and main interpreters, except for programme productions made the Council of Europe, the European Commission and their subordinate bodies.
  

(2) the conditions referred to in paragraph Detailing. (1) shall be determined by the national Office of cinematography.
  

(3) not eligible for loans from the national Office of Cinematography: a) films that spread defamation of nation or country or that incite a war of aggression, national hatred, racial, class or religious discrimination along ethnic, religious or gender, territorial separatism;
  

b) prejudicial to the dignity of the films, the honor, the person's private life and the right to his own image;
  

c) films aimed at direct or indirect incitement to violence;
  

d) films with adult content, contrary to accepted principles of morality;
  

e) films, according to the national classification of the Office of cinematography, they ban the viewing for minors. "
  

28. Article 29(3) shall read as follows: Art. 29.-operators benefiting from financial support from the national Office of cinematography for the film have an obligation to teach National Archives Page a copy of it in Romanian language, on which the original version was made, within a period of 60 days from the date of completion of the copy. "
29. Article 31 shall read as follows: Art. 31.-for the purposes of this emergency Ordinance, cinema staff consists of individuals who participate in the form of artistic or technical, to organize production, laboratories, staff and personnel employed in the distribution and the exploitation of the film. "
30. Article 32 shall read as follows: Art. 32.-natural and legal persons producing or disseminating, marketed in cinema halls and other meeting rooms intended for public viewing, as defined and approved by the national Office of cinematography, film on any kind of support or performing any other activities in the field of cinematography are required to register with the register of cinematography and to obtain authorization for the operation. "
31. Article 34 shall read as follows: Art. 34. — (1) the economic agents that have as their objects exploitation films on any kind of support, in cinema halls and other meeting rooms intended for public viewing, have the obligation to broadcast films, produced in the article. 28 para. (1) in the proportion of not less than 5% of the total annual hours of projection.

(2) failure to comply with the provisions of paragraphs 1 and 2. (1) is charged with 10 million lei for every hour nedifuzata.
  

(3) the finding of the situations referred to in this article shall be made by the Trustees of the national Office of cinematography you who applied and penalties.
  

(4) against the findings and penalties applied to businesses may apply with complaint to the courts in whose territorial RADIUS are established. "
  

32. In article 35, paragraph (2) shall read as follows: "(2) the amount of and the percentages of implementation of penalties covered by this emergency Ordinance may be updated periodically, on a proposal from the national Office of cinematography, by decision of the Government."
33. Article 36 shall read as follows: Art. 36.-development of Romanian Cinema, local councils and other public authorities shall support, within the limits of their competence, the construction of new theaters with one or more screens, through the allocation of funds or rental or concession of land suitable for people who want to invest in this area. "
34. Article 39 shall read as follows: Art. 39.-operators which carry out page financed with private capital, a copy of the National Archive Page is not required. "
35. Article 40 shall be inserted in paragraph (2) with the following contents: "(2) For failure to comply with the obligations laid down in the rules to be developed by the national Office of cinematography art. 6 lit. (d)), in relation to the register of cinema, the Government will establish, together with their approval, and the amount of the irregularities and the arrangements for their application. "
36. Article 42 shall read as follows: Art. 42. — (1) for the purposes of European integration, the national Office of cinematography, together with the Ministry of Foreign Affairs and the Ministry of finance will act within a period of 90 days from the date of entry into force of this emergency Ordinance, to enrol in specialised EU programmes EURIMAGES as well as in other international organizations and programmes, including those for subordinate units.

(2) enrollment fees, and payment of annual contribution shall ensure from the State budget through the national Office of cinematography. "
  


Article 2 the Government's Emergency Ordinance No. 67/1997 on the establishment, organization and functioning of the national Office of cinematography and Cinema Fund with the changes and additions brought about by this law, will be republished in the Official Gazette of Romania, giving it a new texts.
This law was adopted by the Chamber of Deputies and the Senate sitting in the commune of 17 December 1998, in compliance with the provisions of art. 74 para. (2) and of article 23. 76 para. (2) of the Constitution of Romania.
