Law No. 238 of 14 December 1998 concerning the awarding of military merit military pensioners, war veterans, published in PARLIAMENT ISSUING the OFFICIAL GAZETTE nr. 480 of 14 December 1998, the Parliament of Romania adopts this law.
Article 1 shall confer the order of military merit of military pensioners, war veterans, whose seniority in service, before and after august 23, 1944, is at least 15 years.
Article 2 the order of military merit is conferred on persons referred to in art. 1: a) the order of military merit 1st class, for 25 years of service;
b) Military Merit Order class II, for 20 years of service;
c) Military Merit Order class III, for 15 years of service.
Article 3 Seniority in service, within the meaning of this law shall be reckoned from the granting of the degree of officer, the master or officer in military activity, up to the reserve or the withdrawal of those directly concerned.
Military time frames have interrupted the service activity will not be counted in calculating seniority in the service, apart from when, by order of recall activity, provision was made for the cancellation of the order or reservation in retreat.
Article 4 military Retirees, war veterans, decorated with the order of military merit "class III, II and I shall receive, under the present law, an increase of 10%, 15% and 20% of the amount of the pension.
Article 5 Any other provisions contrary to this law are hereby repealed.
This law was adopted by the Senate at its meeting on 1 October 1998, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
