The Romanian Parliament adopts this law + Article UNIC Approval Government Ordinance no. 63 63 of 28 August 1997 establishing facilities for the development of rural tourism, issued pursuant to art. 1 lit. c) of Law no. 134/1997 for the empowerment of the Government to issue ordinances and published in the Official Gazette of Romania, Part I, no. 226 of 30 August 1997, with the following amendments and additions: 1. In Article 2, letters b) -h) shall read as follows: " b) the granting of priorities for the installation of lines for telecommunications, the connection to the electricity grid, the water supply and sewerage network, as well as the methane gas distribution network; c) specialized technical assistance, in all forms, from the Ministry of Tourism, in collaboration with professional associations; d) free presentation of tourist offer of tourist pensions and agritourism in tourist promotion materials and promotion actions undertaken by tourist information offices in the country and abroad of the Ministry of Tourism; e) inclusion in the programs of educational institutions with tourism or agricultural profile of problems specific to tourist pensions and agritourism pensions; f) exemption from income tax, respectively on profit, for a period of 10 years from the time of classification, tourist pension or agritourism; g) payment, at the rate established for household consumption, electricity and methane gas, respectively at the tariff for individuals, telecommunications services used in tourist guesthouses and agritourism pensions; h) the granting of loans with preferential interest for a maximum period of 10 years for the development and/or modernization of accommodation capacities; the interest borne by the beneficiaries of the loans will represent 50% of the interest level on the banking market. " 2. Article 3 shall read as follows: "" Art. 3. --1. Tourist guesthouses are tourist structures located in the countryside, having an accommodation capacity of up to 10 rooms, totaling a maximum of 30 places, operating in citizens ' homes or in independent buildings, which provide, in spaces specially arranged, accommodation of tourists and conditions of preparation and service of the table. 2. The agritourism pensions are the tourist guesthouses that can provide some of the food to tourists with products from their own 3. The provisions of this ordinance shall also apply to individuals, family associations and companies, provided in art. 1, holder of tourist hostels or agritourism hostels, located in villages or communes belonging to cities or municipalities, according to the law. " 3. Article 5 shall read as follows: "" Art. 5. --1. Individuals, family associations and companies, provided in art. 1, are obliged to maintain their object of activity, the classification of tourist pensions and agritourism pensions throughout the period in which they benefit from the facilities provided for in this ordinance. 2. If the tourist guesthouses or the agritourical guesthouses, which benefit from the income tax exemption, respectively on profit, in accordance with art. 2 lit. f), it ceases its activity in a period less than double the exemption period, they have the obligation to transfer to the state budget or to the local budgets the income tax, respectively on profit, calculated for the entire exemption period. " 4. Article 5 shall be inserted after Article 5, with the following contents: "" Art. 5 5 ^ 1. -Coverage of expenses occasioned by the provision of free services, in accordance with the provisions of art. 2 lit. d), as well as to ensure the necessary amounts for granting loans with preferential interest, in accordance with the provisions of art. 2 lit. h), will be made from the Special Fund for the development and promotion of tourism, within the limits provided by the Ministry of Tourism. " This law was adopted by the Chamber of Deputies at the meeting of March 10, 1998, in compliance with the provisions of 74 74 para. (2) of the Romanian Constitution. p.
