The Romanian Parliament adopts this law + Article 1 Approval Government Emergency Ordinance no. 4 4 of 31 August 1996 on the licensing of installation and operation of GSM networks and the establishment of the license fee, published in the Official Gazette of Romania, Part I, no. 207 of 2 September 1996, with the following amendments and additions: 1. Article 1 shall read as follows: "" Art. 1. --(1) The licences for the installation and operation of the GSM networks and for the performance of the digital mobile terrestrial mobile service (GSM), hereinafter referred to as GSM licences, shall be granted by public tender and with international participation, organised by Ministry of Communications. (2) In the 1800 MHz frequency spectrum, the Ministry of Communications will assign two operating licenses for the DCS 1800 digital cell phone system. One of the licenses will be awarded by public auction and the second will be attributed only to the Autonomous Regia < >, by direct entrustment, according to art. 10 of the Telecommunications Law no. 74/1996 under the same conditions as the winner of the tender. 2. Article 3 (2), (3), (4) and (5) shall be inserted as follows: " (2) DCS 1800 licenses are issued by the Ministry of Communications to the declared winner of the License and Autonomous Regia < >, after paying the license fee of $25 million U.S. for each license. (3) The amount obtained from the license fees, provided in par. (1), is intended for the Ministry of National Defence for the replacement of transmission equipment currently operating in the 1800 MHz frequency spectrum and shall be transferred until the end of the first quarter of 1998. (4) DCS 1800 licences shall become operational after the release of the 1800 MHz frequency spectrum by the Ministry of National Defence within 18 months of payment of the last instalment. ((5) The tariffs for the use of spectrum shall be determined according to the regulations in force and shall be paid, for the first year of operation, when the frequencies are assigned. " 3. in Article 5, paragraph 2 is inserted, with the following contents: "(2) The Ministry of Communications will provide all digital cellular operators, operating in the 900 and 1800 MHz frequency bands, equal and non-discriminatory conditions, aiming to achieve fair competition." + Article 2 Approval Government Emergency Ordinance no. 24/1997 for completion Government Emergency Ordinance no. 4/1996 on the licensing of installation and operation of GSM networks and the establishment of the license fee, published in the Official Gazette of Romania, Part I, no. 114 of 6 June 1997, with the amendments made by art. I of the present law. + Article 3 Government Emergency Ordinance no. 4/1996 on the granting of licenses for the installation and operation of GSM networks and the establishment of the license fee, as amended, including those brought by this law, will be republished in the Official Gazette of Romania, giving the texts a new numbering. This law was adopted by the Senate at the meeting of September 29, 1997, in compliance with the provisions of art 74 74 para. (2) of the Romanian Constitution. p.
