Law No. 163 of 22 October 1997 approving Government Emergency Ordinance nr. 4/1996 and the Government Emergency Ordinance nr. 24/1997 PARLIAMENT published in ISSUING the OFFICIAL GAZETTE nr. 290 of 27 October 1997, the Romanian Parliament adopts this law.


Article 1 shall approve the Emergency Ordinance of Government No. 4 of 31 august 1996 concerning the licensing and operation of GSM networks and establishment licensing fee, which shall be published in the Official Gazette of Romania, part I, no. 207 of 2 September 1996, with the following amendments and supplements: 1. Article 1 shall read as follows: Art. 1.-(1) licenses for the installation and operation of GSM networks and for performing cellular digital land-based mobile (GSM), hereinafter the GSM licenses are granted by public auction and with international participation, organized by the Ministry of communications.

(2) The frequency spectrum of 1800 MHz, the Ministry of communications will award two licenses for digital cellular telephone system DCS 1800. One of the licenses will be assigned by public auction, and the second will be attributed to Overhead only through Autonomous > direct custody, according to art. 10 of the law on telecommunications No. 74/1996, under the same conditions with the winner. "
  

2. Article 3 shall be included in paragraphs (2), (3), (4) and (5), with the following contents: "(2) DCS 1800 Licenses are issued by the Ministry of Communications declared winner of license and, after Directing Autonomous > license fee of 25 million dollars for each license S.U.A..

(3) the amount obtained from the licence fees referred to in paragraph 1. (1) the Ministry of national defence is intended to replace equipment that broadcasts currently operates in the frequency spectrum of 1800 MHz band and shall be transferred by the end of the quarter I 1998.
  

(4) Licenses DCS 1800 become operational after the release of spectrum frequency 1800 MHz by the Ministry of national defense, in a period of 18 months from the payment of the last installments.
  

(5) tariffs for the use of frequency spectrum shall be determined in accordance with the regulations in force and will be paid for the first year of operation, the frequency allocation. "
  

3. Article 5 shall be inserted in paragraph (2) with the following content: "(2) the Ministry of communications will ensure that all operators of cellular telephony, operating in frequency bands 900 and 1800 MHz, equal and non-discriminatory conditions, aiming to achieve a fair competing."


Article 2 shall be approved by the Government Emergency Ordinance nr. 24/1997 for the completion of the Emergency Ordinance of Government No. 4/1996 concerning the licensing and operation of GSM networks and establishment licensing fee, which shall be published in the Official Gazette of Romania, part I, no. 114 of 6 June 1997, as amended by art. I of this law.


Article 3 of the Emergency Ordinance of Government No. 4/1996 concerning the licensing and operation of GSM networks and establishment licensing fee, with subsequent amendments, including those made by this Bill, will the Republic Official Gazette of Romania, giving it a new texts.
This law was adopted by the Senate at its meeting on 29 September 1997, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
