---------- The Romanian Parliament adopts this law + Title I General provisions + Article 1 The provisions of this Statute shall apply to teaching, auxiliary and management teaching staff from the entire state and private education system, to teaching staff who perform guidance and control functions, as well as to the other categories of teaching staff, nominated in the statute. + Article 2 This law regulates: a) the functions, competences, responsibilities, rights and obligations specific to the teaching and auxiliary teaching staff, as well as of the management, guidance and control; b) the conditions and modalities of filling positions and teaching positions, auxiliary teaching, management, guidance and control functions, as well as the conditions and modalities of release from these posts and functions, to cease the activity and retirement of teaching and auxiliary teaching staff; c) the refresher and evaluation system; d) the criteria of norsea and payroll, of awarding distinctions and prizes, of application of sanctions. + Article 3 (1) The teaching staff shall include the persons in the education system responsible for training and education. (2) The teaching staff may include persons who meet the conditions of studies provided by law, who have the capacity to exercise full rights, a moral conduct in accordance with professional deontology and are fit medical to perform the function. + Article 4 (1) Incadence and maintenance in an auxiliary teaching or teaching function, as well as in a management, guidance and control function are subject to the presentation of a medical certificate, issued on a specific form developed by Ministry of Education, Research and Innovation together with the Ministry of Health. Medical incompatibilities with the teaching function are established by protocol between the two mentioned ministries. -------------- Alin. ((1) art. 4 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (2) I cannot occupy the posts mentioned in par. (1) persons deprived of this right, for the duration established by a final judicial decision of criminal conviction. (3) In situations of professional inaptitude of a psychobehavioral nature, the management of the unit or of the educational institution may request, with the agreement of the teaching council or the faculty council, a new complete medical examination. The same provision applies, similarly, to management, guidance and control functions, as well as to staff in education-related establishments. (4) I cannot occupy the teaching, management or guidance and control posts in education persons who carry out activities incompatible with the dignity of the teaching function, such as: a) the provision by the teacher of any commercial activity in the premises of the educational establishment or in the surrounding area; b) trade in obscene or pornographic written, audio or visual material; c) the practice, in public, of activities with the lubrica component or others involving the exhibiting, in the obscene manner, of the body. (5) The teaching, auxiliary, guidance, management and control staff, who consider themselves wronged, may request an expertise of the work capacity. + Title II Preuniversity education + Chapter I Auxiliary teaching and teaching functions. ((2) art. 6 was amended according to JUDGMENT no. 381 381 of 25 April 2007 , published in MONITORUL OFFICIAL no. 287 287 of 2 May 2007. + Section 2 Conditions for the occupation of auxiliary teaching and teaching + Article 7 (1) The following conditions of studies must be fulfilled for the occupation of teaching positions a) for the position of educator/educator in pre-school education-graduation with diploma examination of the pedagogical high school or an equivalent school, or graduation with bachelor's degree or graduation, followed by a course in the field of psycho-pedagogical and specific methodical b) for the position of teacher-graduation with diploma examination of the pedagogical high school, the department for teachers, or the teacher-teachers or equivalent school; c) for the position of institutor-graduation with diploma examination of the pedagogical university college, pedagogical high school or equivalent school, followed by the diploma graduation of a long-term or short higher education institution duration or graduation with diploma of the first cycle of undergraduate studies or graduation with bachelor's degree or graduation, followed by a specific course in the field of psycho-pedagogical and methodical; the provisions of this letter do not apply graduates of the Pedagogy of Pre-School and Primary Education, who benefit from the application provisions of para. II of EMERGENCY ORDINANCE no. 40 40 of 22 April 2009 , published in MONITORUL OFFICIAL no. 286 286 of 30 April 2009, with point 1 1 ^ 2. e) for the position of teacher in high school and post-secondary education-graduation with bachelor examination of a long-term higher education institution or its equivalence in the job profile or graduation with diploma of courses postgraduate lasting at least one and a half years, approved for this purpose by the Ministry of Education, Research and Innovation-in-depth studies, postgraduate academic studies, postgraduate studies of specialization, in the profile of the post-, as well as fulfilling the condition required by art. 68 of the Education Law no. 84/1995 , republished, with subsequent amendments and completions, or graduation with diploma of the second cycle of master's degree, in the profile of the post, subject to the holding of at least 60 credits of transferable studies from the training program psycho-pedagogical offered by the departments for the preparation of the teaching staff or the graduation of a pedagogical high school or a pedagogical university college and the holding of at least 30 transferable study credits from the training program psycho-pedagogical offered by the departments for the training of teaching staff ------------ Letter e) a par. ((1) lit. d), in the special education, the conditions of studies referred to in par. (1), as well as an attested internship of theoretical and practical training in special education. (3) For the occupation of teaching positions in the units related to pre-university education, the conditions of studies provided in par. ((1). (4) For the position of coach in school sports clubs, in palaces and in children's clubs, it is required to graduate with a diploma of a high school and a school of coaches or a post-secondary or higher profile educational institution, with specialization in the respective sports branch and meeting the conditions laid down in art. 68 of the Education Law no. 84/1995 . (5) The titular teaching staff who, subsequently, acquires through studies and other teaching specializations may request the transition into the new specialization, with the preservation of the status of titular teaching staff. The teachers in the restriction of activity have priority. ------------ Alin. ((5) of art. 7 7 has been introduced by section 5 5 of art. I of LAW no. 349 349 of 14 July 2004 , published in MONITORUL OFFICIAL no. 683 683 of 29 July 2004. (6) Coaches at school sports clubs can be employed with a work contract, as a rule, for a period of 4 years, an Olympic cycle. ------------ Alin. ((6) of art. 7 7 has been introduced by section 5 5 of art. I of LAW no. 349 349 of 14 July 2004 , published in MONITORUL OFFICIAL no. 683 683 of 29 July 2004. + Article 8 For the purposes of auxiliary teaching, the following study conditions shall be met a) for the position of librarian, documentarian and editor-graduation with diploma examination of an educational institution, department of library economics, or other educational institutions whose graduates studied during schooling the profile disciplines in the field of library economics; can serve as librarian, documentarian or editor and other graduates of higher education, post-secondary or high school with diploma, for a fixed period, if they followed a course of initiation in the field b) for the position of computer scientist-graduation with the diploma of a higher education institution or a pre-university education unit, of profile; c) for the function of laboratory and technician-graduation with diploma examination, in the profile of the post, of a post-secondary school or high school, followed by an initiation course in the field, under the conditions established by the Ministry of Education, Research and Innovation. -------------- Point c) art. 8 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. d) for the position of school teacher-graduation of the high school with baccalaureate exam; e) for the position of instructor-animator-graduation with the diploma of a higher education institution, a post-secondary school, a pedagogical high school or its equivalent, or of another high school and the graduation of special courses for obtaining the aptitude certificate for this function; f) for the position of extracurricular education instructor-graduation of a high school or pedagogical high school, with a baccalaureate diploma; g) for the position of social worker-graduation of a higher education institution of profile, long or short term, with bachelor's or graduation exam, or of a post-secondary health school or of a post-secondary school of leaders puericrowers; h) for the position of co-repeater-graduation of a higher education institution of profile, long or short term, or of a specialized high school. i) auxiliary teaching functions referred to in lett. a), b), e), g) and h) can also be in charge of persons who have graduated with the first cycle degree of bachelor's degree or second cycle of master's degree in the profile of the post. ----------- Letter i) of art. 8 8 was introduced by section 4.2. 3 3 of art. II of EMERGENCY ORDINANCE no. 40 40 of 22 April 2009 , published in MONITORUL OFFICIAL no. 286 286 of 30 April 2009. + Section 3 Filling and issuing of auxiliary teaching and teaching positions + Article 9 (1) Teachers may be filled with full, associate or substitute staff. The titular and associated teaching staff must meet the conditions provided for in art. 7 7 and 8. (2) The teaching positions are in competition. The contest consists of written evidence, at the employment of the holders, in written or oral evidence, at the employment of the substitutes, in the interview and in the presentation of a curriculum vitae, when hiring the associate teaching staff The competitions are organized on the basis of a methodology developed by the Ministry of Education, Research and Innovation, in consultation with the representative trade union federations in education, approved by order of the Minister. -------------- Alin. ((2) art. 9 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (3) The methodological coordination of competitions for the filling of teaching positions declared vacant is provided by the Ministry of Education, Research and Innovation, and their organization and conduct by school inspectorates and directors pre-university educational establishments. -------------- Alin. ((3) art. 9 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (4) The competitions for the filling of teaching positions in private education shall be organized by the respective school unit, in accordance with the provisions of par. ((2). + Article 10 (1) The order of filling teaching positions in state education is: a) the transfer of the titular teaching staff made redundant by the restriction of activity or by the abolition of some school units; the transfer is carried out respecting the provisions of 7 7, which shall apply accordingly; ----------- Letter a) a par. ((1) of art. 10 10 has been amended by section 4.2 4 4 of art. II of EMERGENCY ORDINANCE no. 40 40 of 22 April 2009 , published in MONITORUL OFFICIAL no. 286 286 of 30 April 2009. b) the pre-transfer of the teaching staff, on request, in the same locality or in the locality where he/she has his domicile, 7 7, which shall apply accordingly; ----------- Point b) of par. ((1) of art. 10 10 has been amended by section 4.2 4 4 of art. II of EMERGENCY ORDINANCE no. 40 40 of 22 April 2009 , published in MONITORUL OFFICIAL no. 286 286 of 30 April 2009. b ^ 1) the pre-transfer on request and the transfer of teaching staff made redundant by activity restriction or by the abolition of some school units is also carried out from rural to urban areas, if the person has obtained a minimum average of 7 at the tenure contest or if it had a minimum average of 7 on the government distribution; ----------- Point b ^ 1) of par. ((1) of art. 10 10 was introduced by section 4.2. 5 5 of art. II of EMERGENCY ORDINANCE no. 40 40 of 22 April 2009 , published in MONITORUL OFFICIAL no. 286 286 of 30 April 2009. b ^ 2) the pre-transfer on request and the transfer of teaching staff made redundant by activity restriction or by the abolition of some school units is also carried out between the educational levels, provided that refresher/training program continues for the last 5 years; ------------ Point b ^ 2) of par. ((1) of art. 10 10 has been amended by section 4.2 6 6 of art. I of LAW no. 387 387 of 17 December 2009 , published in MONITORUL OFFICIAL no. 898 898 of 22 December 2009, amending section 5 5 of art. II of EMERGENCY ORDINANCE no. 40 40 of 22 April 2009 , published in MONITORUL OFFICIAL no. 286 286 of 30 April 2009. c) posting in the interest of education, through specific competition; d) filling, by contest, the posts declared vacant; e) secondment, at the request of interested persons, by specific competition; f) the occupation, by contest, of the reserved posts and of the posts left vacant following the operations provided in lett. a)-e), by replenishment, by cumulation or by hourly payment, by substitute staff, holder or associate. (2) Annually, the posts declared vacant from state and private pre-university education shall be brought to the attention of interested persons, at least 30 days before the contest, by publication in the central, local press and by display at school inspectorates and educational establishments concerned. (3) Calendar of activities referred to in par. (1) and (2), the theme and the conditions of competition shall be made public every school year, until 15 November. + Article 11 (1) The work on the mobility of teaching staff in state pre-university education is coordinated by a commission, appointed by the general school inspector, having as its president a deputy general school inspector. The composition of the commission and its tasks shall be established by the Regulation approved by the Minister of Education, -------------- Alin. (2) The subjects for the written tests at the competitions organized by the school inspectorates shall be established by the Ministry of Education, Research and Innovation. The subjects for competitions organized by private educational establishments, provisionally authorized or accredited, shall be established by them. -------------- Alin. (3) In the competitions organized by the school inspectorates, the written works for filling vacancies in state pre-university education shall be evaluated by commissions, on specialties, established at the level of the university center responsible for perfecting staff from the arondate counties. (4) In the competitions organized by the educational units, the written works for filling vacancies in state or private pre-university education shall be evaluated by commissions, on specialties, established at the level of the school unit That. (5) In state education the validation of competitions for the filling of teaching positions is done by the school inspectorate. The employment on the post is made by the director of the educational unit, based on the distribution decision signed by the general school inspector. In private education the validation of competitions and employment on the post are made by the management of the educational unit and are communicated in writing to the school inspectorate. ------------ Alin. ((6) Representatives of trade unions recognized at national level have the right of access to the commission documents provided in par. (1), after their completion. (7) The expenses for the works of the contests shall be borne by the organizers. + Article 12 (1) Appeals regarding the results of the contest for filling vacant teaching positions in state education are addressed to the school inspectorate, within 10 days from the communication of the results. ((2) Appeals shall be settled by the reassessment of the works in question by a commission established by the rector of the higher education institution where the evaluation of the works has been carried out. This commission cannot include the persons who have ensured the correction of the works. The decision of this committee is final (3) Appeals regarding the results of the competition in private education are addressed to the organizing unit. The Commission which will analyse them will be made up of members other than those who have corrected the works in question. The ruling panel's ruling is final. + Article 13 (1) The restriction of activity means the situation in which the post of educator, teacher, institute and teacher-educator no longer falls within the system of cloud regarding the flocks of preschoolers or students provided by law. (2) The school Inspectorate has the obligation to make public, by display at the inspectorate and at the educational establishments concerned, the list of posts subject to the restriction of activity, at least 30 days before the onset of the procedures provided in par. ((4) and (5). (3) In the case of teachers and master-instructors, the restriction of activity consists in reducing the number of hours below the level of a half-norm, without possibilities of completion, in the same school or in a close school, with hours of specialty or related specialties, which can be taught by the teacher in question. ((4) In case of restriction of the activity of an educational establishment, the following shall be waived: a) the activity performed by cumulation, by payment by hour or by replenishment; b) the activity performed by the teaching staff who meet the legal conditions of retirement; c) the activity performed by the teaching staff who request the departure from the unit on the grounds of the restriction of the post in (5) If the restriction of activity concerns two or more persons of the same specialty, outside the situation provided in par. ((3), the objective evaluation or the organization of a competition shall be carried out, according to the decision of the board of directors, at the proposal of the The evaluation, namely the contest, is carried out by a commission, appointed by the general school inspector, whose president is the specialized school inspector. The director of the educational unit is compulsorily part of the evaluation/competition committee. The objective evaluation, converted in unit score established by the Ministry of Education, Research and Innovation, consists of a school inspection in class, combined with: level of studies, teaching degree or doctor's title, graduation average, for trainees, school progress of students, didactic-scientific activity, scientific works, studies, articles, programs and school textbooks, approved teaching material, didactic experiments. If the result of the objective evaluation does not lead to the separation, the following socio-humanitarian criteria are applied in order: the husband/wife to work in education in the same locality; sot/wife residing in the locality; parents residing in locality; health reasons that do not allow leaving the locality, other objective causes proven with acts. The competition is organized according to art. 9. Appeals shall be solved according to the provisions of art. 12. Representatives of the representative trade union organizations at the branch level participate as observers at all stages of the restriction of activity. -------------- Alin. ((5) art. 13 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 14 (1) Detachment in the interest of education, provided in art. 10 10 (1) lit. c), is made with the consent of the requested persons, for the occupation of positions in educational establishments: kindergartens, schools or classes made up of students capable of performing, in groups, including preschoolers, or classes made up of children with requirements special education, pilot units, application units, deficient units in teaching staff and for ensuring the management of educational establishments, as well as in the functions of guidance and control. (2) Detachment of the titular staff in education, in the posts mentioned in par. (1), can be carried out according to the law and with the granting of the rights provided in the individual employment contract, subject to annual (3) Detachment in the teaching positions provided in par. (1) can be carried out for a duration of 1-4 years, corresponding to a cycle of education, and for the management, guidance and control functions, until the organization of the competition, but no more than the end of the respective school year. (4) The posted person retains the status of holder on the post in the unit where he was posted. (5) Detachment on the reserved teaching position ceases upon the return of the holder to the post + Article 15 The posting, at the request of the interested person, is made by competition At equal competition averages, the person whose husband is a teacher is a priority. The posting is made for a period of no more than two consecutive school years, with the preservation of the status of holder on the post and the unit where it was posted. + Article 16 (1) The posts left vacant following the operations provided for in art. 10 lit. a)-e), as well as those reserved according to art. 101 can be handled by competition by the substitutes who meet the conditions provided in art. 4 4 and 7, for a period of no more than one school year, respectively until the holder's return to the post. (2) The posts published for the replenishment shall be handled by the candidates who participated in the contest organized according to art. 10 10 para. ((1) lit. c), in the order of the averages obtained, for a period of school year. ------------ Alin. ((2) of art. 16 16 has been amended by section 9 9 of art. I of LAW no. 349 349 of 14 July 2004 , published in MONITORUL OFFICIAL no. 683 683 of 29 July 2004. (3) The posts provided in par. (1), remaining vacant after the operations referred to in par. (2), shall be dealt with by a new competition organized by the school inspectorate, to which candidates who meet the conditions provided by this law may participate. (4) The remaining unoccupied hours shall be assigned by the school principal, by his cumulation by hourly payment, to the titular teaching staff, to the associate staff or to the retired teachers. (5) The titular teaching staff on unpaid leave cannot be assigned to replenishment activities, cumulation or hourly payment. (6) Exceptionally, in the absence of qualified teaching staff, after the exhaustion of the situations provided in par. (1)-(4), may be classified, for a period of no more than one school year, substitutes without appropriate studies, who have graduated at least from high school, with a baccalaureate diploma, and who are tested by interview and written work, in the profile of the requested post. Priority persons are given priority for education, who are provided with continuity on the job, if they do not deal with the competition, and the people who worked in the previous year with the status of substitutes, receiving at least Good " rating. The non-qualified teaching staff is obliged to participate periodically in initiation courses in the profile of the post and in the methodology of teaching the respective discipline, organized by the school inspectorate. + Article 17 The release from education of the titular teaching staff, by transfer to another sector of activity or by the dissolution of the employment contract, is made by the body that ordered the employment, according to the law. + Article 18 Appeals on mobility of teaching staff, except for the provisions of art. 12, shall be solved by the board of the school inspectorate, in compliance with the provisions of art. 11 11 para. ((6). Its decisions are final and can be appealed only through the procedures of the administrative litigation. + Article 19 (1) The auxiliary teaching staff in education shall be committed by competition, according to the provisions of 8. (2) The employment and dismissal of the auxiliary teaching staff in the educational units with legal personality shall be made by the director of the unit, with the approval of the board of directors. (2) The occupation of the positions of director and deputy director shall be made following the winning of the contest held on the basis of the criteria of professional and managerial competence, with the advisory opinion of the board of directors. (2) In educational establishments with teaching departments in the language of a national minority, it is recommended that one of the directors be also connoisseur of that language. (3) In the educational establishments provided in par. (2), with a single management position, by exception it is also called a deputy director from another ward than the one from which the director comes. (4) The directors and deputy directors, appointed according to the provisions of this article, must be good connoisseurs of the Romanian language. + Article 24 (1) The position of general school inspector shall be handled by competition by the titular teaching staff, with a bachelor's degree or equivalent, which meets the criteria of professional competence, managerial and moral prestige, assessed by: a) curriculum vitae; b) proven qualities in teaching and leadership, guidance and control functions, previously, in the education system; c) title of doctor or teaching degree I; d) interview in front of a ministerial commission, on school inspection, school legislation, educational management and professional deontology. (2) The functions of deputy general school inspector and director of the house of the teaching staff shall be handled by competition, in accordance with the provisions of par. ((1). (3) The ministerial commission for the position of general school inspector and deputy general school inspector, appointed by order of the Minister of Education, Research and Innovation, is made up of 5 members, of which: the Secretary of State for pre-university education, as president; 3 school inspectors general from the territory and a director from the Ministry of Education, Research and Innovation, with skills in the field. In the competition committee for the position of deputy general school inspector or director of the house of the teaching staff will be included the general school inspector of the respective county. -------------- Alin. (2) The position of specialized school inspector for pre-school and primary education can be handled, by exception to the regulations provided in par. (1) on the conditions of studies, by the teaching staff with training for the mentioned educational steps, who carried out methodical activities within the pedagogical high school and the teaching staff house or led methodical activities at school or interschool level. (3) In the counties with education in the languages of national minorities, the structure of the school inspectorates also includes an appropriate number of school inspectors for this education, under the conditions established in par. ((1) and (2). + Article 27 The guidance and control functions of the Ministry of Education, Research and Innovation, provided in art. 25 lit. b), deals by competition, in compliance with the conditions set out in art. 26 26 para. (2) The candidate for a guidance and control function, provided for in art. 25 lit. b), also supports a written test in the profile of the post for which he is + Article 29 (1) The Commission for the contest for the employment of guidance and control functions, provided for in art. 25 lit. a), consists of: the general school inspector-as president; the main specialist inspector from the Ministry of Education, Research and Innovation or a delegate of this ministry; a professor or university lecturer from the profile to the station or to the training of the teaching staff, appointed by the rector of the higher education institution to which he is the holder (2) The Commission for the contest for the employment of guidance and control functions, provided for in art. 25 lit. b), consists of: the secretary of state of the department in which the post is put out for the competition-as president; the general manager of the respective department; a professor or a university lecturer from the job profile, established by Minister for Education, Research and Innovation (3) Appeals to the decisions of the commissions shall be addressed to the Minister of Education, Research and Innovation and shall be settled according to art. 24 24 para. (2) The training activity of the teaching staff is coordinated by the Ministry of Education, Research and Innovation and is carried out in: -------------- The introductory part of para. ((2) art. 32 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. a) higher education institutions, through faculties, departments and chairs, to improve the specialized training of teachers; b) higher education institutions, through the departments or departments of training of teaching staff, for the improvement of the methodical and psycho-pedagogical training of teachers; c) pedagogical colleges and pedagogical high schools, for specialized, methodical and psycho-pedagogical improvement of teaching staff in pre-school and primary education; d) educational units of profile, for maistri-instructori; e) houses of the teaching staff, for the continuous training of teaching staff and auxiliary teaching staff; f) centers, institutes and other institutionalized forms, for the preparation and improvement of the management, guidance and control personnel; g) National Children's Palace, for the improvement of teaching staff in palaces and children's clubs, as well as school camps. (3) School inspectorates and houses of the teaching staff, together with the institutions and units provided in par. (2), ensures the organization and realization of the improvement of teaching staff, according to the methodology of the Ministry of Education, Research and Innovation -------------- Alin. (4) The main forms of organization of the improvement of teaching staff in pre-university education are: a) methodical-scientific and psycho-pedagogical activities, carried out at the level of the educational establishment or by groups of units (methodical commissions, chairs and pedagogical circles); b) methodical-scientific sessions of communications, symposiums and exchanges of experience on specialized and psycho-pedagogical issues; c) periodical scientific information internships and in the field of education sciences; d) forms of correspondence improvement (distance learning); e) non-frequent courses, organized by higher education institutions, combined with regular consultations, according to the participants ' choices; f) courses organized by scientific societies and other professional organizations of the teaching staff; g) refresher courses of specialized, methodical and psycho-pedagogical training or for obtaining the completion in education or teaching degrees, in accordance with the provisions of the law; h) training and refresher courses for management, guidance and control personnel, according to specific programs; i) refresher scholarships and study and documentation internships, carried out in the country and abroad; j) postgraduate courses; k) PhD. (. The refresher programmes shall include: a) specialized scientific information; b) pedagogical, psychological and sociological information; c) methodical information; d) information in the field of general and school legislation; e) practical activities in the field of specialty. + Article 33 (1) The teaching staff, as well as the management, guidance and control staff shall participate, every 5 years, in a refresher program provided for in the methodology referred to in art. 41. (2) The interval provided in par. (1) may be reduced in the following situations: a) when essential changes occur at the level of school curricula or when new methods or training and evaluation technologies are introduced; b) when taking office, for the management, guidance and control personnel who have no attested training in the field of educational management; c) at the request of the school board or school inspectorate, if gaps are found in the scientific, methodical and psycho-pedagogical training of the respective person; d) on its own request, with the recommendation of the teaching council (3) The condition provided in par. (1) shall be considered fulfilled, if the person concerned has obtained, in the said period, the completion in education or a teaching degree. + Article 34 (1) Definitivation in education can be obtained by teaching staff who meet the conditions of studies provided in art. 7 and who has an internship of at least 2 years at the department, having during this period the basic function in education. (2) Associate teaching staff, at least 1/2 teaching norm in specialty, which meets the conditions of studies provided in art. 7, can present himself in the examination of completion in education, after an effective internship of at least 3 years at the department. (3) The presentation of the exam for completion in education is mandatory after 2 years from the minimum internship provided in par. ((1). ((1 ^) Eliminated. ------------ Alin. (4) The teaching staff may present themselves at this exam in three sessions, in no more than 5 years. The titular teaching staff who do not get the completion in education lose the status of holder and, as a result, his individual employment contract is opened, according to the law. (5) The examination for completion in education consists of a special school inspection, as well as in the support of written and oral evidence evaluating the specialized, methodical and pedagogical training, based on programs approved by the Ministry Education, Research and Innovation. -------------- Alin. (6) The teaching staff who obtained the completion in education shall be recognized the finalization for any of the other teaching positions provided in art. 5, if it meets the conditions of studies required to fill those functions. (7) University assistants and university preparers with a seniority at the department of at least 3 years, who pass in pre-university education, are granted, on the basis of a special inspection, the completion in education. (8) University preparers who pass in pre-university education are recognized as an internship at the department during which they functioned in this capacity. + Article 35 (1) The teaching degree II can be obtained by teaching staff who have a seniority at the department of at least 4 years after completion in education and who demonstrate competence in instructive-educational activity, recorded in the annual evaluation. (2) The samples for obtaining the teaching degree II consist of: a) a special school inspection, preceded by at least two current school inspections, staggered during the 4 years; b) a specialized test and the methodology of the specialty, with interdisciplinary approaches and creativity, elaborated on the basis of a theme and a bibliography approved by the Ministry of Education, Research and Innovation, for each specialty; -------------- Lit. b) a par. (10) In case of non-promotion, the exam for obtaining the teaching degree II can be repeated at a interval of at least 2 school years, and the one for the teaching degree I, at a interval of at least 3 school years. + Article 38 (1) Special school inspections in order to obtain completion in education and teaching degrees can be carried out by teaching staff from higher education institutions (university lecturers/heads of works, lecturers and teachers), by teachers from pedagogical high schools, by school inspectors, as well as by other teachers in pre-university education, delegated for this purpose, according to the methodology developed by the Ministry of Education, Research and Innovation. -------------- Alin. Other members of the interested teaching staff can participate in these courses, within the limits of the places established by the organizers, based on managerial skills tests. + Article 41 The modalities of organization, conduct, evaluation and financing of activities to improve the training of teaching staff and to obtain completion and teaching degrees are established by the methodology approved by the Ministry of Education. (2) The concrete activities, corresponding to the provisions of (1), are provided in the job description, typified at national level, developed by the Ministry of Education, Research and Innovation together with the trade union federations recognized at national level and included as an annex to the collective agreement. The individual job description includes the concrete activities contained in par. ((1) lit. a) and those activities provided in par. ((1) lit. b) which correspond to the profile, specialization and skills of the person occupying the respective teaching position. -------------- Alin. ((1) lit. b), contained in the individual job description, refers to activities specific to the national education system. + Article 43 The teaching norm of teaching-learning, practical training and current evaluation of preschoolers and students in the classroom represents the number of hours corresponding to the activities provided in art. 42 42 para. ((1) lit. a) and shall be determined as follows: a) a post of educators (institutes) for each group of preschoolers or for combined groups, in units where no separate groups can be constituted; in kindergartens with extended hours and those with weekly schedule, the posts are cloudy on Shifts; b) a position of teacher (institute) for each class in primary education or for simultaneous classes within it, where no separate classes can be constituted; c) 18 hours per week for teachers in pre-university education; d) 24 hours per week for master-instructors; e) for the teaching staff in the units and classes of art education, physical education, as well as from the units with extracurricular activities and from the centers or offices of psycho-pedagogical assistance, the teaching norm is established according to the provisions of lit. a)-d); f) for teaching staff in special education and children's homes, the teaching norm is established as follows: teachers and teachers in teaching and teachers for specific activities-language disorders therapy, auditory-perceptive education compensatory, orthophony, labiolecture, orientation, mobility and sensory education, compensatory visual-perceptive education, psychodiagnosis, school and professional orientation, psychotherapy and counselling, medical physical culture, physiotherapy, psychomatic and other education of this type-16 hours per week; teacher-educator, institute-educator, teacher-educator and foreman-instructor-20 hours per week; g) for the teaching staff in the specially integrated education, for the one in the interschool speech centers, for the travelling teaching staff, as well as for the psycho-pedagogical teachers in the children's homes, the teaching norm is 16 hours per week. + Article 44 (1) The teaching norm includes hours provided for in the educational plans in the subjects corresponding to the specialization or specializations registered on the bachelor's or graduation diploma. (2) By exception, in the teaching norm provided in par. (1) may also include hours from the disciplines established by the methodology approved by the Ministry of Education, Research and Innovation, with the maintenance of salary rights. -------------- Alin. ((2 ^ 1) Teachers/institutes who teach in primary education from schools with teaching in the language of national minorities have the same teaching norm provided in the educational plans for schools with the Romanian language of teaching. (3) In pre-school and primary education, the language classes, provided for in the educational plans, are not included in the norm of the teacher, teacher or institute. These hours can be taught by teachers with specialized higher education, being included in their norm, or by paying by the hour or through the cumulation. (4) Orele of foreign languages in pre-school and primary education can be taught, under the conditions of par. ((3), and of educators, teachers or institutes from the respective group or class, if they provide proof of qualification by diploma of studies or by attestation issued by the pedagogical high school for that language, validated by the Ministry of Education, Research and Innovation. -------------- Alin. (4 ^ 1) In primary education, the physical education classes provided for in the educational plans are taught by teachers with specialized higher education, being included in their norm or by paying with the cumulation. --------------- Alin. (5) In the palaces and in the children's clubs, the teaching norm includes the activities provided in the education plans corresponding to the profiles of circles and workshops, approved by regulation by the Ministry of Education, Research and Innovation, in limits of the rules laid down in 43. -------------- Alin. ((5) art. 44 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 45 (1) The teaching and practical training staff, with a seniority in education for over 25 years, with the teaching degree I, benefit from the reduction of the teaching norm by two hours weekly, without diminishing the salary. (2) In secondary education in rural areas, where the teaching norm cannot be constituted according to the provisions of art. 43 and 44, it can be diminished, for the titular teaching staff, at 16 hours per week, being made up of hours from the specialization or basic specializations and from hours from the disciplines established to art. 44 44 para. (2), without diminishing salary. (3) The activity of supervision, included in the educational plans, is not included in the teaching norm, except for the situation provided in par. ((2). + Article 46 (1) The staff of guidance and control and the directors of the educational units are relieved, totally or partially, of the teaching norm of teaching. (2) Deputy directors are required to effectively teach between 2 and 6 hours weekly. (3) The teaching staff provided in par. ((1) and (2) may not carry out teaching activities on a cumulation or hourly basis. ------------- Article 46 has been amended by section 6.6. 15 15 of art. I of LAW no. 349 349 of 14 July 2004 , published in MONITORUL OFFICIAL no. 683 683 of 29 July 2004. + Article 47 The weekly activity time of the auxiliary teaching staff is identical to that established for the staff with equivalent functions in the other budgetary sectors, according to the law. Its tasks are set out in the individual job description. Art. 42 42 shall apply accordingly. + Section 2 Salary conditions of auxiliary teaching and teaching staff + Article 48 (1) Salarization of teaching and auxiliary teaching staff is done in compliance with the principle that education is a national priority, taking into account the responsibility and complexity of work, training and experience professional, role and importance of the work performed. The salary of the teaching staff consists of the basic salary, established according to the law, and a variable part, consisting of additions, bonuses and other additional salary rights. (2) Additional salary rights, social rights, other rights and facilities of auxiliary and non-teaching teaching staff, the amount of which is established by law between minimum and maximum limits, shall be negotiated, within the limits of the law, by collective agreements concluded between employers and representative trade union organizations in education, according to the law. ------------- Alin. The amount of this premium shall be determined by (6 ^ 1) The level of management allowances granted to directors and deputy directors in educational establishments shall be determined by the school inspectorate, with the opinion of the school board, depending on the number of students, the number of classes, the volume and the degree of complexity of the activity carried out by the educational unit and their managerial performance. The criteria on the basis of which the size of these allowances is established are formulated in the methodology of appointment and pay of directors of educational establishments, developed by the Ministry of Education, Research and Innovation, approved by decision of Government. -------------- Alin. (6 ^ 2) The salary and extrasalarial income of the directors and deputy directors, as well as the salary of the teaching staff in the private educational establishments, shall be established by negotiation between the management of the financing legal person and the person in question, with the opinion of the school unit's management board. -------------- Alin. (8) The teaching staff may also be paid by the payment by the hour or by the cumulation, according to the provisions of art. 49 49 para. ((1). The calculation for the payment by the hour or by the cumulation is made at the didactic norm provided in art. 43. The salary rights arising from the cumulation or from the hourly payment, the money rights due for inventions and innovations, productive or other activities, carried out in the interest of education, shall be broken down, in order to impose, on the months to which refers, and is taxed distinctly for each activity, separately from the other income. (9) vacant or temporarily vacant teaching positions may be replenished, by cumulation or by hourly payment, by the existing teaching staff, assigned to the maximum norm, by retired teachers, as well as by specialists from other sectors of activity, under the present law. (11) The leaders of the educational unions, with the right of reservation of the department, can be paid by hourly payment for a maximum of 4 hours weekly. (12) Salarization of teaching activities that cannot be normalized in teaching positions is quantified in physical hours and is made by hourly payment, under the conditions established by the Ministry of Education, Research and Innovation. -------------- Alin. ((12) art. 51 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 52 (1) The evaluation of teaching, auxiliary, management, guidance and control staff is done annually, according to the evaluation sheet developed by the Ministry of Education, Research and Innovation. -------------- Alin. ((1) art. 52 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (2) The evaluation sheet, correlated with the individual job description, is noted by scoring from 1 to 100. (3) The evaluation procedure shall be triggered by self-assessment, recorded in the individual job description. (4) For teaching staff, the evaluation sheet, concerned, as the case may be, by the Head of Department or by the Methodical Commission Officer and by the Director of the School Unit, shall be considered on the Management Board, which, in the presence of the person concerned, decides on the final score. (5) In the evaluation sheet, the activities carried out outside the individual job description in the field of education, as well as other activities requested by the management of the unit or the higher hierarchical organs, are also scored. (6) The evaluation sheet is a basic document for the establishment of salary rights, for promotion and access to refresher programs. + Title III Higher education + Chapter I Teaching and research functions. Conditions for their occupation + Section 1 Teaching and Research Functions + Article 53 (1) The teaching functions are: university preparer, university assistant, university lecturer/head of works, university lecturer, university professor and consultant university professor. (2) In higher education may operate associate teaching staff for the following functions provided in par. (1): university assistant, university lecturer/head of works, university lecturer and university professor. (3) Teachers in higher education, retired for their work and age limit, can continue, according to the law, some teaching and scientific activities, as consultants teachers. They are certified in this position by university senates. (4) In relation to their own academic needs, higher education institutions may call to the department specialists with recognized value in the field, from the country or abroad, as invited associate professors, for a fixed duration. + Article 54 (1) The teaching staff provided in art. 53 also carries out scientific research, technological development, design activity and artistic creation, according to the specificity. (2) In the chairs, departments, units or in research and microproduction centers can operate on distinct and personally research positions, associated research personnel, including doctoral students and students, as well as other personnel, according to Law. They shall be drawn up, as the case may be, carnet of work. + Section 2 Conditions for filling teaching positions + Article 55 (1) For the occupation of the teaching positions referred to in 53 is required to be completed with the bachelor's degree of a higher education institution or with its equivalent diploma, or of a postgraduate academic institution, with the fulfilment of the conditions provided for in art. 68 of the Education Law no. 84/1995 . (2) For the occupation of teaching positions of university professor and university lecturer, candidates must hold the scientific title of doctor in the science branch corresponding to his post in a related branch. In order to fill the teaching position of university lecturer/head of works, candidates must be doctors or doctoral students in the science branch corresponding to the post or in a related branch. (3) The existing teaching staff in higher education, with an effective seniority at the department of at least 5 years, shall be considered fulfilled the conditions required by art. 68 of the Education Law no. 84/1995 . (4) In order to fill the position of university preparer, the conditions provided in par. ((1) and (8). (5) In order to fill the position of assistant professor, the conditions provided in par. ((1) and (8), as well as a minimum age at the 2-year department in higher education or in scientific research, respectively 4 years in pre-university education. For candidates who come from outside education or scientific research, a minimum of 5 years is required in the profile of the job for which they compete. (6) In order to fill the position of university lecturer/head of works, the conditions provided in par. (1), (2) and (8), as well as: a) for candidates who come from higher education or scientific research, a minimum age of 6 years or 4 years, in the case of candidates holding the title of doctor; b) for candidates who come from pre-university education, a minimum age of 8 years or 6 years, in the case of candidates holding the title of doctor; c) for candidates who come from outside education or scientific research, a minimum age of 10 years or 8 years, in the case of candidates holding the title of doctor. (7) For the position of university lecturer or university professor, the conditions provided in par. ((1), (2) and (8), as well as a minimum age at the 9-year-old department in higher education or in scientific research. For candidates who come from outside education or scientific research, it is required a seniority of at least 15 years of activity in the profile of the post for which they compete. (8) Higher education teaching positions can be occupied only by Romanian citizens, citizens of other Member States of the European Union, as well as of states belonging to the European Economic Area, under the conditions of this law. By way of exception, these posts can be filled with a fixed-term employment contract and citizens from third states, as an associate teaching staff, according to the law. ------------- Alin. ((8) art. 55 was amended by the single article of EMERGENCY ORDINANCE no. 88 88 of 24 June 2008 , published in MONITORUL OFFICIAL no. 480 480 of 30 June 2008. ((9) The candidate to fill a teaching position with teaching in a language other than that in which he did his higher education supports the practical test or, as the case may be, the public lecture in the language in which he is to make the This condition also remains in force if a teacher is proposed, after the competition, to carry out teaching activities in a language other than the one in which he did his studies. + Article 56 (1) The candidate for filling a teaching position of university lecturer/head of works, university lecturer or university professor, who comes from outside higher education, must provide proof of teaching skills by lecture. publish or by similar evidence, as appropriate. (2) Persons in higher education who meet the conditions provided in par. ((1) and in art. 55 55 para. ((1), (2) and (8), with a special activity in the field of the station for which they compete, demonstrated by specialized works of national or international value, may submit, with the approval of the university senate, to the contest for occupation a teaching position in higher education, without fulfilling the conditions of seniority established in art. 55 55 para. ((6) or (7), as applicable. + Article 57 (1) In medical higher education, candidates for the contest for filling the position of university assistant must have at least the title of resident doctor, with a minimum age of 3 years in the specialty of fasting. Exceptions are the posts from the disciplines that do not have correspondent in the Ministry of Health network. (2) In the medical higher education, in the subjects with correspondence in the network of the Ministry of Health, candidates for the contest for filling positions of head of works, university lecturer or university professor must also have Primary physician title. -------------- Article 57 was amended according to JUDGMENT no. 862 862 of 28 June 2006 , published in MONITORUL OFFICIAL no. 590 590 of 7 July 2006. + Section 3 Filling and issuing of teaching positions + Article 58 (1) The teaching positions provided in art. 53 53 para. (1) shall be handled by competition organized by accredited or provisionally authorized higher education institutions. The contest is valid only for the respective higher education institution. (2) The contest for filling teaching positions has an open character. Any person who fulfils the conditions of this Statute and of the present status may be present Education Law no. 84/1995 . (3) The competition commissions shall consist of the titular teaching staff from or outside the institution. (4) The public notice of contests for filling vacant or transformed teaching positions is made, by the higher education institution, in the Official Gazette of Romania and at least in a national circulation newspaper, as well as by display at the premises, no later than 45 days from the start date of the academic semester. (5) The registration for the competition is made within 30 days from the date of publication of the post in the Official Gazette of Romania. (6) The competition samples and their content shall be determined by the departments or departments. The theme of the competition samples, the methodology and the program of its conduct shall be made available to the candidates once with the registration (7) The application file for the contest for filling a teaching position shall include the following: a) application-type of registration; b) certified children from the baccalaureate diploma or equivalent, from the bachelor's degree or equivalent, accompanied by the matrix sheet, as well as a proof certificate of seniority; c) Doctor's degree in the science branch corresponding to the post, as well as other diplomas or scientific or academic titles, as appropriate; d) curriculum vitae; e) the list of published works, accompanied by a copy of the representative titles; f) proof of fulfilment of the conditions provided in 55 and 56, as well as the approval of the university senate, as applicable g) other materials requested by the university senate or by the regulations of the Ministry of Education, Research and Innovation. -------------- Lit. g) a par. (8) The competition samples shall be programmed and supported only once. (9) The duration of the competition and its completion at the level of the competition commission fall within 30 days from the date of conclusion of the registration. ((10) The completion of the contest at the level of the higher education institution is mandatory within 45 days from the submission of the competition commission report. + Article 59 (1) The contest for filling the position of university preparer or assistant consists of written, oral and practical tests, specific to the station, established according to art. 58 58 para. ((6). (2) The competition commission consists of the head of the department or its representative, as president, and of 2 members, having the teaching position of at least university lecturer/head of works or higher positions in the job profile. (3) The competition commission shall be proposed by the head of the department and shall be approved by the faculty council. (. The result of the competition shall be assessed by each member of the committee by grades from 10 to 1. The grade of the sample is their arithmetic mean. The Commission shall draw up, within 5 days from the last test, a report on the conduct of the contest, with conclusions of recommendation of the candidate who obtained the highest average. Candidates who have obtained at least average 8 and no grade below 7 can be recommended. The report is subject to the faculty board, by the dean, who approves the outcome of the contest by nominally open (5) The decision of the faculty council is subject to the validation of the university senate, regarding compliance with the criteria and the competition procedure (6) The appointment as a university preparer or assistant professor is made by the decision of the rector, starting with the first day of the following semester. + Article 60 (1) The contest for the position of university lecturer/head of works consists in verifying the fulfilment of the necessary conditions, by analyzing the registration file, as well as from the support of a public lecture, in the presence of the competition The topic of the lecture is set by a commission and is announced to the candidate 48 hours before support. (2) The competition commission shall be composed of the head of the department or of the department or its representative, as president, and of 3 members of the position profile, with teaching position of university lecturer/head of works, lecturer or university professor. The competition committee is proposed by the head of the department, approved by the faculty council and must include at least one lecturer or a teacher. (3) The appreciation of the candidate for the contest for filling the teaching position of university lecturer/head of works is done by scoring, based on a grid, adapted to the specificity of the department or department and approved by the university senate. The commission's report assesses the candidate's didactic and scientific activity, the extracuractic activity in the interest of education, as well as the appreciation of the public lecture. (4) The chairman of the competition committee presents its report to the faculty council, nominating the candidate with the best performances. The faculty board approves the outcome of the nominally open ballot (5) The decision of the faculty council shall be presented by the dean or a representative of the faculty and shall be submitted by the rector to the confirmation of the university senate on compliance with the criteria and the competition procedure, which shall be pronounced by vote Roll call (6) The appointment to the post of university lecturer/head of works is made by the decision of the rector, starting with the first day of the following semester. The appointment of the university lecturer/head of works, who is a doctoral student, is done for a period of 4 years. The appointment becomes final, if during this period the university lecturer obtains the scientific title of doctor in that specialty. + Article 61 (1) The contest for filling positions of university lecturer or university professor consists in verifying the fulfilment of the conditions provided by law, by analyzing the registration file for the competition, and for those who do not come from higher education, and from the support of a public lecture, before the students, in the presence of the competition committee. The topic of the lecture is set by the commission and is announced to the candidate 48 hours before support. (2) The competition commission shall consist of the dean of the faculty or a representative thereof, member of the university senate, as president, of 4 members, of which at least 2 from outside the respective higher education institution. The competition commission is made up of university lecturers and university professors, for the post of university lecturer, respectively from university professors, for the post of university professor. The competition committee is approved by the university senate, at the proposal of the faculty council. (3) The appreciation of the candidate for the contest for filling the teaching position of university lecturer or university professor is done by scoring, based on a grid adapted to the specificity of the department or department, approved by the university senate. The report of the commission includes the evaluation of the teaching and scientific activity of the candidate, the extracuractic activity in the interest of education, as well as the appreciation of the (4) The chairman of the competition committee presents its report to the faculty council, nominating the candidate with the best performances. The faculty board approves the outcome of the nominally open ballot (5) The decision of the faculty council shall be presented by the dean or by a representative of the faculty and shall be subject by the rector to the validation of the university senate on compliance with the criteria and the competition procedure, which shall be pronounced by Roll call. (6) The competition file, together with the commission's report and accompanying documents, shall be submitted to the National Council for the Attestation of University Titles, Diplomas and Certificates, which, based on their analysis, shall be pronounced by nominal vote open, within no more than 90 days. If a university lecturer or university professor holds a competition for a teaching position in the same specialty and for the same teaching title, acquired through a previous competition, it is no longer necessary to confirm by The National Council for Attestation of University Titles, Diplomas and Certificates. (7) Following the order issued by the Minister of Education, Research and Innovation, the appointment to the post of university lecturer, respectively of university professor, is made by the decision of the rector, starting with the first day of the semester following the one in which he held the contest validation in the university senate. -------------- Alin. ((7) art. 61 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 62 (1) Appeals shall be addressed, as the case may be, to the university senate or to the Ministry of Education, Research and Innovation, within no more than 10 days, and shall be resolved no later than 60 days after the expiry date of the appeal period. -------------- Alin. ((1) art. 62 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (2) If the post submitted to the competition has not been filled, the contest may be resumed, in compliance with the complete procedure. + Article 63 The functions and degrees of scientific researcher in the higher education network are obtained according to the legal regulations in force. + Article 64 (1) Retired university teachers may continue to operate in higher education, as consultant university professors, at the recommendation of the Chair, with the opinion of the faculty council and with the approval of the university senate, obtained by Roll call. (2) The university professors who, through scientific and pedagogical activity, have distinguished themselves at national and international level, can be recommended to fill this function. (3) The duties of the consultant university professor are established by the department through the individual job description. + Article 65 (1) The vacant teaching positions may be temporarily occupied, with annual reconfirmation, by the titular teaching staff from the respective higher education institution or by the associate teaching staff, by his cumulation by hourly payment. (2) The occupation of vacant teaching positions with associate teaching staff, outside the higher education institution, is done by competition, organized at the level of the department or department, consisting at least in the curriculum vitae and interview. (3) The competition methodology for filling vacant teaching positions with associate teaching staff is approved by the university senate. (4) The temporary employment of the associate teaching staff is made by decision of the rector. + Article 66 The employment of specialists with recognized value in the field, in the country or abroad, as invited associate teachers, is endorsed by the department or faculty council and is approved by the university senate. + Chapter II Management of higher education institutions + Article 67 The leading structures in the higher education institution are: the university senate, the faculty council, the college board, the department board and the department's office. Other specialized collective bodies can be established by the University Charter. + Article 68 (1) The institution of higher education is headed by the university senate, chaired by the rector. Each faculty in the institution's structure designates representatives in the university senate, teachers, researchers and students, according to the law and the University Charter. The deans of the faculties, the directors of departments and colleagues, directly subordinated to the institution of higher education, are part of the law of the university senate. At the meetings of the university senate may participate, as guests of its office, representatives of the trade unions in that institution, as well as any other person in or outside the institution. (2) The operative management of the higher education institution is provided by the office of the university senate, made up of the rector, as president, vice-rector/vice-rectors, scientific secretary, general administrative director and from a representative of students or legal student organizations constituted at the institute level, member of the senate. Members of the university senate office, with the exception of the administrative general manager, are elected to university senate positions. The rector may invite to the meeting of the Dean's Office, representatives of trade unions and student associations or any other person in or outside the institution. Through the University Charter, the university senate may include in its office deans or directors of departments or colleges. + Article 69 (1) The faculty is headed by the faculty council, chaired by the dean. The council is elected by the community of the titular teachers, the faculty, and the scientific researchers as a doctor from the departments and the departments subordinated to the faculty. In the faculty council, students are represented 1/4 of the number of its members. (2) In the faculty council can be chosen persons from all categories of titular and research teaching staff, contained in the states of functions. + Article 70 The department is headed by the board, chaired by the director The formation of the department council shall be determined by decision of the university senate or, as the case may be, of the faculty council. The same provisions apply to research, design, microproduction units. + Article 71 The Department, as the basic structural unit of the faculty or department, operates with at least 15 teaching positions. The management of the department is provided by the department's office, made up of the head of department and from at least 2 elected members of the teachers in that department. The operative leadership rests with the head of department. The head of a department with less than 12 teaching positions occupied with full teaching staff does not benefit from the allowance provided in art. 91 91 para. ((1) lit. a). + Article 72 (1) The structures and management positions in the higher education institution shall be chosen by secret ballot for a period of 4 years, according to the University Charter and under the law. Teachers in these structures and functions must be titular in the respective higher education institution. Any discrimination regarding the choice in the structures and in the management positions shall be prohibited. In the event of the release of a place in the management positions, partial elections are made, according to the University Charter. The same provision applies in the situation of defilling with more than 1/3 of the management structures. (2) The functions of leadership of rector, vice-rector, dean, vice-dean, department director, director of college or research unit, design, microproduction and head of department shall not be cumulated. These functions can only be filled by university professors or holders. (3) A person may not serve as rector for more than two successive terms. The same provision applies to the position of dean. (4) The number of vice-rectors and prodecans in state higher education institutions shall be determined by the number of students and the field of education, according to the uniform structure norms, approved by the Minister of Education, Research and innovation. -------------- Alin. ((4) art. 72 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (5) The attributions and competencies of the structures and management positions in higher education are established by the university charter of the institution, according to the law Decisions of the university senates, of the councils of the faculties and of the departments, except for the provisions of art. 74 74 para. ((3), shall be taken by a majority vote of the members present, if their number represents at least 2/3 of the total number of members. Members of these governing bodies shall have equal deliberative voting rights *). + Article 73 In university senates and faculty councils, only teachers participate in the vote to fill or release teaching positions. + Article 74 (1) The management functions of the higher education institution, with the exception of the rector, shall be confirmed by the university senate. The rector, elected by the university senate, is confirmed by order of the Minister of Education, Research and Innovation. In case of non-compliance, the provisions of par. ((3) of this Article. -------------- Alin. ((1) art. 74 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (2) The person in a management position may be removed from office by the procedure used for election, at the initiative of one third of the total number of electors. The hearing of that person is mandatory (3) The Minister of Education, Research and Innovation may suspend him from office on the rector of a state or private higher education institution, accredited or provisionally authorized. The suspension, duly justified in writing, is brought to the attention of the university senate, who has the obligation to validate or invalidate this decision within 30 days. It is considered invalidation, having as a consequence the maintenance of the respective person according to the rector, if he votes against the suspension at least 2/3 of the total number of members of the Otherwise, the procedure of choosing the new rector is triggered. The suspension procedure cannot be triggered during the university holidays. -------------- Alin. ((4) art. 74 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Chapter III Improving the training of auxiliary teaching and teaching staff + Article 75 Improving the training of teaching staff in higher education is mainly achieved through the forms provided for in art. 164 of the Education Law no. 84/1995 : a) programs of documentation and exchanges of experience at national and international level; b) programs of specialization and interuniversity cooperation, in the country and abroad; c) postgraduate education, organized according to the law; d) scientific research and technological development programs, carried out in the country or through international cooperation; e) educational innovation, scientific, technical and artistic creation. + Article 76 The improvement of the training of auxiliary teaching staff is carried out within a system of professional degrees, based on a specific methodology, approved by the Minister of Education, Research and Innovation. The forms of improvement, provided in art. 75, may be used, as appropriate, and for the improvement of auxiliary teaching staff. -------------- Article 76 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 77 The financing of the training activities of the training of auxiliary teaching and teaching staff in state higher education is provided by the Ministry of Education, Research and Innovation through the budgets assigned to educational institutions. The allocated funds can be supplemented by contributions of interested economic agents, from the funds of scientific bodies, as well as through domestic or international sponsorships, according to the law. -------------- Article 77 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 78 The evaluation of the improvement activity is done by the department, department or other institutional structures, according to the criteria established in the University Charter. + Chapter IV Teaching norm and salary conditions of teaching staff + Section 1 Teaching and research norm + Article 79 (1) The duties of teaching staff in higher education shall include: a) teaching activities, seminars and practical works, practical training and evaluation, according to curricula and analytical programs; b) scientific and methodical training activities and other activities in the interest of education; c) scientific research activities, technological development, design activities and artistic creation, according to the specificity. (2) The corresponding activities referred to in par. (1) are provided in the job description, typified at national level. The sheet, developed by the Ministry of Education, Research and Innovation together with the trade union federations in higher education, based on the proposals of the university senates, constitutes the annex to the collective agreement. -------------- Alin. ((2) art. 79 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (3) The individual member of the station shall nominate the activities of the typified sheet, established, with the agreement of the teacher, the department or the department. The individual sheet, revised every academic year, is the annex to the individual employment contract. + Article 80 (1) Teaching norm, according to art. 79 79 para. ((1) lit. a), may include: a) teaching activities; b) seminar activities, year projects, practical and laboratory work; c) project guidance, undergraduate and graduation works, pedagogical, productive and scientific research practice; d) didactic activities and scientific research, enrolled in the educational plans, for doctoral studies, as well as the guidance of the elaboration of doctoral theses; -------------- Letter d) a par. ((1) lit. a)-f) shall be determined as follows: a) university professor: 5-7 hours, of which at least 4 conventional classes of course; b) university lecturer: 7-9 hours, of which at least 4 conventional classes of course; c) university lecturer/head of works: 9-11 hours, of which at least 2 conventional classes of course; d) university assistant: 10-11 hours, including activities referred to in art. 80 80 para. ((1) lit. b) and c); e) university preparer: 4-6 hours, including activities referred to in art. 80 80 para. ((1) lit. b) and c); the university preparer will perform weekly 6 hours of assistance. (2) By exception, the teaching staff norm provided in par. ((1) lit. a)-c), which, due to the specificity of the disciplines, does not have in the structure of the lecture hours, is increased by 2 conventional hours. The norm of teaching staff who do not carry out scientific or equivalent research activities shall be increased by up to 4 conventional hours, without exceeding 15 conventional hours. These exceptions are approved by the faculty board. (3) The norm of the university assistant with the scientific title of doctor may include, at most, 2 conventional classes of course. (4) If the teaching norm cannot be made up according to par. (1)-(3), it shall be completed with scientific research activities, at the proposal of the head of department, with the consent of the faculty council. The reduction of the teaching norm is at most 1/2 of that norm, and the research time is equivalent to 0.5 conventional hours. The teacher maintains the status of holder in the teaching position obtained through the competition. (5) Titular teachers, whose teaching norm cannot be constituted according to the provisions of par. (1)-(4), may be temporarily passed, at their request, with the integral norm of scientific research financed from the state budget, within the department or department, maintaining their status as holder in the didactic function obtained by the competition. During this period, the teacher has the obligations of research staff in higher education. (4) The states of functions shall be drawn up at the departments or departments, by consulting their members, as a result of the teaching of the teaching tasks by the faculty council. (4) The teaching staff in the state education, as well as that of authorized or accredited private educational institutions, can meet no more than two teaching norms, with the consent of the management of the educational establishment where it is holder with carnet of work. (5) The conditions for collegial replenishment shall be established in the University Charter. + Article 94 (1) The number of posts for auxiliary teaching staff shall be established by the university senate, depending on the budget and specificity of the institution, faculty, specialization, department and department. (2) The teaching staff has obligations and responsibilities of a professional, material and moral nature, which guarantee the realization of the instructive-educational process, according to the law. + Article 96 The freedom of the professional initiative of the teaching staff refers, mainly to: a) the conception of the professional activity and the achievement of the educational objectives of the educational disciplines, through methodologies that respect the psycho-pedagogical principles; b) the use of the material base and resources of education for the purpose of professional obligations c) the implementation of innovative ideas for the modernization of the educational process; d) organization, with students or with students, of extracurricular activities with educational or scientific research purpose; e) collaboration with parents, through lectorates, and other collective actions of a pedagogical nature; f) establishment in the establishments and educational institutions of laboratories, workshops, offices, clubs, circles, cenacles, artistic and sports bands, publications, according to the law and the University Charter; g) evaluation of students 'or students' teaching performance on the basis of a validated system and according to their own conscience; h) participation in school and university life, in all compartments aimed at the organization and conduct of the educational process, according to the University Charter, professional deontology and, as the case may be, the collective agreement. + Article 97 (1) Teachers may not be disturbed during the conduct of teaching by any school or public authority. (2) The magnetic recording or equivalent procedure of the teaching activity can be done only with the consent of the one who leads it. (3) Multiplication, in any form, of the records of the teaching activity by students, students or by other persons is allowed only with the consent of the respective teacher. + Article 98 In school or university spaces, or in their vicinity, the teacher is protected by the authorities responsible for public order. Protection shall be ensured against the person or group of persons who affects the human and professional dignity of the teacher or who impedes the exercise of his rights and obligations. Protection is requested by the person authorized by the school regulation, respectively, by the University Charter. + Article 99 (1) The teaching staff is encouraged to participate in social and public life, for their own benefit, in the interest of education and of the Romanian society. (2) The teaching staff has the right to be part of trade union, professional and cultural associations and organizations, national and international, as well as from legally constituted political organizations, in accordance with the provisions of the law. (3) The teaching staff can freely express professional opinions in the school or university space and may take actions in their own name outside this space, if they do not affect the prestige of education and the dignity of the profession of educator. + Article 100 Teachers have a moral obligation to give mutual respect and support in fulfilling their professional obligations. + Article 101 (1) The titular teaching staff, elected to the Parliament, appointed to the Government or carrying out specific specialized functions in the apparatus of the Parliament, of the Presidency, of the Government and in the Ministry of Education, Research and Innovation, as well as those chosen by Parliament in the central bodies of the state have the right to book the teaching position or the department during the period in which they perform these functions. -------------- Alin. ((1) art. 101 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (2) Provisions of para. (5) The titular teaching staff, requested abroad for teaching, research, artistic or sports activity, on a contract basis, as a result of agreements, governmental, inter-university conventions or between institutions, or sent for specialization, he is booked the teaching position or department, for the period. (6) The period of reservation of the teaching position or of the department, under the conditions of this article, shall be considered seniority at the department. + Article 102 (1) The titular teaching staff, who on their own initiative request to specialize or participate in scientific research in the country or abroad, has the right to leave without payment. (3) The teaching staff, who are in the situation referred to in par. (1), benefit from the provisions of art. 101 101 para. ((6). Teaching staff under the conditions of par. They are provided with the home by the local government for the period of time they work in that locality. (2) The titular teaching staff, up to 35 years of age, will be supported, as the case may be, in the construction of the personal property home, in the rural locality where he is the holder, with the granting of long-term loans, with minimum interest, under the conditions Law. (3) The teaching staff from the state educational establishments, who do not have the dwelling and who cannot be offered an appropriate dwelling in the locality where he has the position, will be settled the expenses on public transport, from the place of residence at work and from the place of work in the place of residence. ((1) art. 48 of LAW-framework no. 330 330 of 5 November 2009 , published in MONITORUL OFFICIAL no. 762 762 of 9 November 2009. + Article 107 (1) The teaching, auxiliary teaching staff and the research staff integrated in the departments, sent by the unit or the educational institution to refresher activities or to scientific events, benefit from the rights provided by law for staff on the move, as well as the payment of the participation fee, within the budget funds allocated to these activities and from other sources, including scientific research or sponsorship contracts. (2) The teaching staff and the research staff integrated into the departments shall benefit, within the limits of the funds allocated by budget or from extra-budgetary funds, including through scientific research or sponsorship contracts, full coverage or partial of the expenses of travel and participation in scientific events organized abroad, with the approval of the board of the school inspectorate, respectively of the office of the university senate. (3) The staff provided in par. (1) and (2) will submit to the educational institution, respectively to the unit, within the period provided by the regulation or the university charter, proposals to capitalize on the results of the action for which it received the approval of travel. (4) The teaching staff benefits from 50% reduction, for 6 trips per year round trip, on the means of rail transport, on internal lines *). (5) The teaching staff who move under the conditions provided in par. ((1) and (2) benefit from a 50% discount on domestic means of transport. + Article 108 (1) Teachers and their children up to 14 years of age, who accompany preschoolers, students or students in camps and excursions, benefit from free travel, accommodation and meals, under the law. (2) Children of teaching staff in activity or retired after at least 10 years of teaching activity are exempt from the payment of registration fees in higher education admission competitions and benefit from free of charge at accommodation in Hostels and boarding schools. ------------ Alin. ((2) art. 108 108 was amended by the single article of LAW no. 150 150 of 1 June 2007 , published in MONITORUL OFFICIAL no. 388 388 of 8 June 2007. (3) Educational establishments and institutions, as well as professional and trade union organizations of teachers benefit from gratuity for official correspondence and dispatch of scientific and methodical materials. + Chapter II Rights and obligations of management, guidance and control staff in pre-university education + Article 109 (1) The director is the head of the school unit and represents it in relations with legal and natural persons, including the local administration and community. (2) The director shall operate under the guidance and control of the school inspectorate, to which he is subordinate. (3) The director shall be the chairman of the board and the board of directors, before which he presents quarterly and annual reports. (4) The decisions of the Director shall be taken in accordance with the decisions of the Board of Directors and those of the Management Board, according to the regulations of operation of these councils and Education Law no. 84/1995 . (5) The managerial contract, the decisions of the director, as well as the quarterly and annual reports (6) The director shall coordinate and respond to the entire educational activity and, as the case may be, to the activity of the subordinate unit, before the teaching council, the board of directors and the overordered school authorities. (7) The director shall design and coordinate the human resources development activity in the respective school unit and, where appropriate, from the subordinate units. (8) The director coordinates the rational and efficient use of the material and financial basis of the unit, ensures its development and modernization. (9) In the communes and small towns, with several school units, the director of one of them may receive from the school inspectorate the tasks of coordinating some activities within the other schools. + Article 110 (1) The Deputy Director shall perform the delegated tasks by the Director for specified periods or those established by the Regulation on organization and functioning of the respective unit. (2) The Deputy Director shall carry out his activity under the Director and shall be accountable to him, as well as to the professorial board, the board of directors and the control bodies, for their own activity, according to the job description. + Article 111 (1) The school inspection function is provided by the body of school inspectors of the school inspectorate and that of the Ministry of Education, Research and Innovation and aims: -------------- The introductory part of para. ((1) art. 111 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. a) carrying out the general school inspection, on objectives, and of the specialized inspection; b) evaluation of the educational process, as well as of ancillary and extracurricular activities; c) performing the diagnosis analysis and establishing the prognosis of human resources and specific materials; d) evaluation of training activities of specialized, methodical and psycho-pedagogical training; e) evaluation of the performance of the management contract of the school unit (2) The findings and assessments of the school inspection in the educational establishments shall be recorded in inspection documents, according to the regulation of organization and functioning of the school inspection, developed by the Ministry of Education, Research and Innovation. These documents shall be notified to the teaching staff of that establishment. -------------- Alin. ((2) art. 111 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. ((3) The minutes recorded by the school inspectors in the single inspection registers shall be considered official documents, with all the consequences provided by law. (4) The school inspection shall be completed, periodically, with diagnosis and forecasting studies on the state of education, with conclusions and proposals for executive and legislative. (5) School inspectors operate on the basis of the school inspection regulation and methodological norms, according to their own professional conscience. (6) The rights of inspectors from school inspectorates and the Ministry of Education, Research and Innovation are those established in Title IV cap. I of this law, as well as those arising from the own regulations of organization and functioning, according to the law. -------------- Alin. ((6) art. 111 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Title V Awards and Awards + Article 112 *) (1) The titular teaching staff with excellent results in didactic, educational and scientific activity can receive decorations, orders, medals, titles, as well as prizes, according to the law. (2) The orders and medals that can be conferred on the teaching staff are: a) Order Spiru Haret, classes Commander, Knight and Officer; the order is given to teaching staff in pre-university education; b) The Order of Alma Mater, classes Commander, Knight and Officer; the order is given to teaching and research staff in higher education; c) Medalia Honorary member of the teaching staff; the medal is awarded to retired teachers, with special activity in education. + Article 113 Apart from the distinctions provided in art. 112, the Minister of Education, Research and Innovation is authorized to give teaching and research staff the following distinctions and prizes: -------------- The introductory part of art. 113 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. a) Public thank-you address; b) Diploma Gheorghe Lazar, grades I, II and III, with the award of a prize of 20%, 15%, respectively 10% of the amount of basic salaries received in the last 12 months; the diploma is granted to teaching staff in pre-university education; c) Titu Maiorescu Diploma, 1st, 2nd and 3rd grades, with a prize of 25%, 20%, and 15% of the basic salaries received in the last 12 months; the diploma is awarded to teaching and research staff in higher education; d) Alexandru Rosetti Diploma, 1st, 2nd and 3rd grades, with a prize of 25%, 20%, and 15% of the basic salaries received in the last 12 months; the diploma is awarded to higher education librarians; e) The diploma of excellence is awarded to retired or pensionable teachers, with special activity in education; the diploma is accompanied by a prize of 20% of the amount of basic salaries received in the last 12 months *). + Article 114 The distinctions and awards provided in art. 113 of this law is granted on the basis of a regulation approved by the Minister of Education, Research and Innovation. -------------- Article 114 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Title VI Disciplinary and material liability of teaching staff, auxiliary teaching staff, management, guidance and control personnel + Article 115 Teaching staff, auxiliary teaching staff, as well as management, guidance and control in education respond disciplinarily for the violation of their duties according to the individual employment contract, as well as for violation of behavioral norms that harm the interest of the institution's education and prestige. + Article 116 Disciplinary sanctions, which may apply to the staff referred to in art. 115, in relation to the gravity of the misconduct, are: a) written observation; b) warning; c) the reduction of the basic salary, cumulatively, when applicable, with the management, guidance and control allowance, by up to 15%, for a period of 1-6 months; d) the suspension, for a period of up to 3 years, of the right of enrolment to a competition for the occupation of a higher teaching position or for obtaining teaching degrees or a management, guidance and control function; e) dismissal from the position of management, guidance and control in education; f) disciplinary dissolution of the employment contract. + Article 117 (1) In the units of pre-university education, the sanction proposal shall be made by the director or at least 1/3 of the total number of the members of the board of directors or of the teaching council. The same right has the higher hierarchical organs. (2) For the management, guidance and control staff of the school inspectorates and subordinate units, the sanction proposal shall be made by the general school inspector or at least 1/3 of the total number of the members of the council of administration. The same right has the higher hierarchical organs. (3) For the staff of the Ministry of Education, Research and Innovation provided in art. 25 lit. b), as well as for the one in the units directly subordinated, the sanction proposal is made, as the case may be, by the Minister of Education, Research and Innovation, the Secretary of State or the hierarchical head of the person concerned. -------------- Alin. ((3) art. 117 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 118 In higher education institutions, the sanction proposal is made by the head of department, department director or research unit, design, microproduction, by the dean or rector, or by at least 1/3 of the number total of the members of the department, of the department or of the management structures. + Article 119 (1) The disciplinary sanction shall apply only after carrying out the research of the deed referred to in writing, hearing the person concerned and verifying the statements made by him, in defence. (2) For the research of deviations committed by the teaching staff provided in art. 115 are constituted commissions consisting of 3-5 members, one of which represents the trade union organization that includes the person in question or a representative of the employees, and the others are teachers who have the teaching function at least equal to the one who committed the deviation. School inspectors can also be included in the research committees of the deviations of teaching staff in pre-university education. (. Research committees shall be appointed by: a) the teaching council of the respective unit, for pre-university education; b) the faculty council or the department council, for the sanctions provided for in 116 lit. a) and b); c) the university senate, for the sanctions provided in art. 116 lit. c)-f); d) the board of directors of the school inspectorate, for its own apparatus and for the conductions of directly subordinated units; e) Minister of Education, Research and Innovation, for the functions provided in art. 25 lit. b) and for the conductions of directly subordinated units. -------------- Lit. e) a par. ((3) art. 119 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 120 In the framework of the research of the presumed deviation, the facts and their consequences are established, the circumstances in which the guilt was committed, the existence or non-existence of guilt, as well as any other conclusive data. Hearing the one investigated and checking its defence are mandatory. The refusal of the investigated to appear at the hearing, although he was notified in writing at least 48 hours before, as well as to give written statements is found by minutes and does not prevent the completion of the research. The researched teacher has the right to know all the research papers and to produce evidence in defence. + Article 121 The rules on composition, organization and operation, as well as the duties of the discipline college of the school inspectorate, of the central discipline college of the Ministry of Education, Research and Innovation, of the honorary college of the higher education institution and the central honorary college of the Ministry of Education, Research and Innovation are established by regulation approved by order of the Minister of Education, Research and Innovation. -------------- Article 121 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 122 (1) The research of the proposal for sanctioning and communication of the decision shall be made no later than 30 days from the date of finding of the deviation, recorded in the condica of inspections or at the general registrar of the school unit or of the educational institution Superior, as appropriate. The innocent person is communicated in writing the non-existence of the facts for which he was investigated. (2) In pre-university education, the sanctioned persons have the right to contest, within 15 days from the communication, the respective decision at the discipline college of the school inspectorate, for the sanctions provided for in art. 116 lit. a)-c), and at the central discipline college of the Ministry of Education, Research and Innovation, for the sanctions provided in art. 116 lit. d)-f). -------------- Alin. ((2) art. 122 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (3) In higher education, the sanctioned persons have the right to contest, within 15 days from the communication, the respective decision, to the honorary college of the institution, for the sanctions provided for in art. 116 lit. a)-d), and at the central honorary college of the Ministry of Education, Research and Youth, for the sanctions provided in art. 116 lit. e)-f). -------------- Alin. ((3) art. 122 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (4) The decision of these colleagues shall be communicated to the person concerned within 20 days of the referral. (5) The right of the person sanctioned to appeal to the courts is guaranteed. + Article 123 ((1) The sanction shall be established, on the basis of the report of the research committee, by the authority referred to in 119 119 para. ((3), who appointed this commission. (2) In pre-university education, the sanctions provided in art. 116 lit. a)-c) shall be communicated to the one concerned, by a written decision, by the director of the educational establishment, and those of art. 116 lit. d)-f), by the general school inspector. (3) The sanctions provided for in art. 116 116, applied to the management, guidance and control staff, shall be communicated to him by the authority that made the appointment. (4) In higher education, the sanctions provided for in art. 116 shall be communicated, in writing, to the teaching staff, research staff and auxiliary teaching staff in subordination, by: a) the head of department, for the sanction of lit. a); b) dean or director, for the sanctions provided in lett. a)-c); c) rector, for the sanctions under lit. a)-f). (5) For the management positions eligible from higher education institutions shall apply, without right of appeal, the provisions of art. 74 74 para. ((2) and (3) *). + Article 124 If the sanctioned one has not committed disciplinary violations in the course of a year since the application of the sanction, improving his activity and behavior, the authority that applied the sanction provided in art. 116 lit. a)-c) may order the lifting and deletion of the sanction, making the appropriate mention in the personal service state of the one concerned. + Article 125 Material liability of the teaching staff provided in art. 115 is established according to labor law. The imputation decision, as well as the other acts for the recovery of damages and damages shall be made by the management of the unit or institution with legal personality whose employee is the one in question, apart from the cases when, by law, the Dispose otherwise + Title VII Retirement of teaching staff + Article 126 (1) The teaching staff benefit from the pension for the work done and the age limit, pension for the loss of work capacity, additional pension and other social security rights, under the law. (2) Family members may benefit, under the law, from survivor's pension. + Article 127 (1) The teaching staff may be retired only at the end of the school or university year. (2) For thorough reasons, the retirement of teaching staff can also be done during the school or university year, with the approval of the school inspectorate and the university senate. ((3) Abrogat. -------------- Alin. ((3) of art. 127 127 was repealed by lit. k) a art. 196 of LAW no. 263 263 of 16 December 2010 , published in MONITORUL OFFICIAL no. 852 852 of 20 December 2010. (4) Retired teachers may carry out teaching activities, paid by their cumulation or by hourly payment, after the retirement age. + Article 128 The teaching staff in the state pre-university education, with the teaching degree I or with the scientific title of doctor, which proves the special professional competence, can be maintained as a holder in the teaching position up to 3 years above the age of retirement on request, with the opinion of the teaching board of the educational establishment, expressed following the open nominal vote and with the annual approval of the school inspectorate. + Article 129 (1) University professors and university lecturers with the scientific title of doctor may remain in activity until the age of 65. ((2) Upon reaching the retirement age, university professors and university lecturers with the scientific title of doctor, with the exceptions provided for in Title VIII-Transitional and final provisions, which prove special professional competence, may be held as holders in the teaching position, upon request, with the consent of the faculty council and with the annual approval of the university senate, by nominally open vote, until reaching the age of 70. ((3) Cease legal effects. --------------- Alin. ((3) of art. 129 129 ceased its legal effects according to CONSTITUTIONAL COURT DECISION no. 599 599 of 14 April 2009 , published in MONITORUL OFFICIAL no. 329 329 of 18 May 2009. + Article 130 Repealed. -------------- Article 130 was repealed by the letter. k) a art. 196 of LAW no. 263 263 of 16 December 2010 , published in MONITORUL OFFICIAL no. 852 852 of 20 December 2010. + Title VIII Transitional and final provisions + Article 131 The teaching staff holder in education is booked the position during the period in which he attends, at the day courses, a form of postgraduate education. + Article 132 *) Maistrii-instructors holders in education, who have acquired completion in education, but do not meet the conditions of studies provided in art. 7, may keep their post only if in 8 years from the date of entry into force of this law they complete their studies and training provided for in art. 68 of the Education Law no. 84/1995 . + Article 133 Graduates of long-term university education institutions, holders in pre-university education, who did not pass the bachelor exam or its equivalent, lose the status of holder, if they do not obtain a bachelor's degree. They, by exception to the provisions art. 67 67 para. (4) of the Education Law no. 84/1995 , may be present at the bachelor's exam in no more than two sessions, within 3 years after the entry into force of this law. + Article 134 The teaching staff from the discipline "Choreography", holder in pre-university education, who has acquired the completion in education, can be kept in office without fulfilling the conditions of studies provided in art. 7 7 of this law. It is obliged to go through the training provided for in art. 68 of the Education Law no. 84/1995 . The salary of this staff is done at the level of college graduates ' studies. + Article 135 For the institutions of military education and public order and security education provided for in Head. X of Title II of the Education Law no. 84/1995 , republished, with subsequent amendments and completions, the following shall be provided: a) the application of the provisions of this law to military/public order and security is made by order, regulations and own instructions; b) military/public order and public and civil security personnel shall be made up of the teaching staff provided for in this Statute and from the corps of military/public order and security instructors; c) military/public order and public security personnel have the rights and duties arising from this law and from the quality of military framework in activity, respectively of civil servant with special status; d) the teaching functions for the body of military/public order and security instructors, the conditions required for their occupation, the teaching norms, the competences and responsibilities shall be determined by their own instructions; e) the management of educational institutions is carried out by the commanders/directors, who are appointed to positions according to internal regulations; the commander of the military/public order and public security higher education institution can also perform their duties as rector; f) the improvement of the training of the teaching staff is carried out according to the provisions of the present military/public order and security regulations; g) the teaching staff, including the one in the body of military/public order and security instructors, can obtain the completion in education and teaching degrees, under the conditions established by this law. ---------- Article 135 has been amended by section 6.6. 29 29 of art. I of LAW no. 349 349 of 14 July 2004 , published in MONITORUL OFFICIAL no. 683 683 of 29 July 2004. + Article 136 (1) The discipline "Religion" can be taught only by authorized personnel, based on the protocols concluded between the Ministry of Education, Research and Innovation and religious cults officially recognized by the state. -------------- Alin. ((1) art. 136 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (2) The staff of worship, graduate of higher education or theological seminary, at least 5 years old in the profession, who teach in the pre-university education the discipline "Religion", is salarized at the level of teacher studies, of the teacher, the category of permanent teaching staff, with the obligation that within 3 years from the entry into force of the present law to pass the examination of completion in education and to go through the training provided for in art. 68 of the Education Law no. 84/1995 . + Article 137 (1) The data on the professional situation of the teaching staff shall be recorded in a personal state of service. The personal state of service includes data on marital status, curriculum vitae, professional evolution and periodic assessments. The personal state of service shall be updated, at the request of the holder or management of the institution or unit. Access to the personal state of service is allowed to the holder and head of the institution or educational establishment. In pre-university education, the personal state of service can also be consulted by the guidance and control staff of the school inspectorate and the Ministry of Education, Research and Innovation. -------------- Alin. ((1) art. 137 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. (. The personal service shall be kept as follows: a) at school inspectorates, for school inspectors; at the Ministry of Education, Research and Innovation, for the general school inspector, for the deputy general school inspector, as well as for teaching and control teaching staff in ministry; -------------- Lit. a) a par. ((2) art. 137 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. b) at school inspectorates, for directors and deputy directors of subordinate units; c) at educational establishments or related educational establishments, for teaching staff and auxiliary teaching staff in these units; d) at higher education institutions, for teaching and auxiliary teaching staff in these institutions. + Article 138 The teaching staff employed for a fixed term benefit from the same rights as the titular teaching staff, corresponding to the period worked + Article 139 (1) Persons engaged in education, coming from other sectors of activity, who prove that they have practised in the specialty enrolled on the diploma of studies and who occupy a teaching position in this specialty, benefit from seniority, as seniority recognised in education, with a view to establishing salary rights (2) Romanian citizens who have worked abroad in education or in research are fully equivalent to seniority in education. The inclusion of periods worked abroad as seniority will be done according to the labor law in force. (3) For teaching staff who have been salarized from other sectors of activity, the reconstruction of seniority in education is based on the records of educational institutions where it has actually worked. + Article 140 They are recognized as seniority in education and periods determined by pension legislation, in which teaching staff, due to causes they could not remove, such as illness, subsequent scrapped convictions or other situations, was prevented from carry out those activities that are considered seniority in education. + Article 141 *) (1) University professors and university lecturers without the scientific title of doctor may continue their activity on the posts they occupy no more than 6 years after the entry into force of this Law, with the exceptions provided for in Title VIII- Transitional and final provisions. (2) The university lecturers/heads of works without the scientific title of doctor shall retain the position they occupy for 6 years after the entry into force of this Law. If during this period I do not get the title of doctor, I lose the title. + Article 142 *) They are exempted from the provisions of art. 55 55 para. ((2), art. 60 60 para. ((6), art. 129 129 and art. 141 specializations nominated by order of the Minister of Education, Research and Innovation, to which the doctorate is not organized. -------------- Art. 142 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 143 By exception to the provisions of this law, for provisionally authorized faculties, the positions of head of department and vice-dean can be filled, temporarily, and by titular teachers, with the teaching position of university lecturer/head of works, having Scientific title of doctor. + Article 144 Librarians with an internship of less than 3 years in office, who have not completed a course in the field of library economics, for the maintenance in office are obliged, in the next 3 years after the entry into force of this law, to participate in such a course and to pass the completion exams according to a methodology established by the Ministry of Education, Research and Innovation. -------------- Art. 144 was amended according to JUDGMENT no. 366 366 of 18 April 2007 , published in MONITORUL OFFICIAL no. 277 277 of 25 April 2007. + Article 145 Retired teaching staff in education receive medical assistance and access to rest homes and treatment facilities of teachers. + Article 146 Insofar as this Statute does not otherwise have, the teaching staff shall apply the other provisions of the labour law. + Article 147 (. This Law shall enter into force on 1 September 1997. (2) On the same date, Law no. 6/1969 on the Statute of the Teaching Staff of the Socialist Republic of Romania, published in the Official Bulletin no. 33 of 15 March 1969, as amended, and any other provisions contrary to this law shall be repealed. (3) Within 6 months from the publication of the present law in the Official Gazette of Romania, the Ministry of Education, Research and Innovation will develop the methodological norms, regulations and instructions arising from the application of the law, which also will publish in the Official Gazette of Romania. -------------- Alin.
