Law No. 1,135 of 2 April 1931 concerning the modification of the law concerning the exceptional regime of relations between landlords and tenants on 15 April 1930 published in PARLIAMENT ISSUING the OFFICIAL GAZETTE nr. 79 of 4 April 1931 to CHARLES II, by the grace of God and the will of the King of Romania's national team, all from the face and future Legislative Assemblies, health: voted and adopted, and we sanctionam what follows: Article 1 the provisions of the law concerning the exceptional regime of relations between landlords and tenants, of 15 April 1930, remain in force until 23 April 1932 with the modification of the following articles: "Art. 1.-common law procedure Back on April 23, 1931, lease contracts have been extended until this date with the following excepţiuni: 1. Oral or written contracts with tenants ' dwelling object or subchiriaşilor public officials or retirees who have been extended under section 1, point a, of the law of 15 April 1927, if the annual income of the tenant does not overtop the amount of 240,000 lei.
In point 3. Oral or written contracts with tenants ' dwelling object, whatever their quality, if the annual income of the tenant does not overtop the amount of 80,000 lei.
Art. 2. lease contracts provided for-these three excepţiuni, may be extended, in the power of this law, yet until 23 April 1932.
Art. 4 the benefit shall be granted an extension for the family and the deceased pensioner's public functionary before April 23, 1931, but it left the v or minor children, at this time.
Art. 5.-the transitional measure shall be granted As tenants, which benefited from the last extension legal and which does not fall under article 1, îngăduirea of living buildings till Octomvrie 26, 1931.
Art. 6, para. 1.-enforcement of judgments, handed down under article 13. 36 of the law of 15 April 1927, is suspended until April 23, 1932, or 26 Octomvrie 1931, after the distinctions of articles 2 and 5 of this law.
Paragraphs 1 and 2. 2.-in addition to the implementation work of the rental contracts concluded by the owner in respect of the flats occupied by tenants who are benefiting from the extension granted by this law, but with other people than the current tenant, shall postpone until 23 April 1932, Octomvrie 26, 1931, or the same distinctiuni.
Art. 13, para. 1.-in the range January 1, 1 end from March 1932, the State will pay to the owner the difference in rent what a bear, in accordance with articles 9 and 10.
Art. 16, para. 3.-Evacuation will not be able to be done before Octomvrie 26, 1931.
Paragraphs 1 and 2. 4. Notwithstanding, the State may evacuate on May 1, 1931 in Septemvrie, from its buildings, either, when tenants in those real estates are to be installed in hospitals, boarding schools or other State instituţiuni. 17, paragraph 2. 1.-the owner of the tenant will be able to evacuate the per tenant or from the same locality regardless of quality, if the building is rented only to urban built property, consists of four rooms and is acquired before 1 April 1928 with condiţiunea to he and his family reside.
Art. 18, para. 3.-Evacuation will not be able to take place before the Octomvrie 26, 1931.
Art. 19, paragraph 2. 1.-the owners and co-owners or tenants today with its newfound tolerated them or their wives at the latest by April 1, will be able to move into their building during aplicatiunii law evacuand on the face of their tenants, servants or retired public servants, wherever the latter may possess, apart from salary or pension, special revenue in relation to the condition, condition and their profession.
Paragraphs 1 and 2. 3.-Evacuation will not be able to take place before the Octomvrie 26, 1931.
Art. 20.-Tenants who are benefiting from the extension provided for in article 1 as well as those who benefit from the îngăduirea afforded by article 5, will pay castiul April 23, 1931, whatever the terms of the contract, until May 6, 1931.
Art. 21, para. 2. -Is an exception in the case of contracts referred to in article 1, paragraph 2, when the tenant may opt out of the contract and Octomvrie on May 26, 1931, announcing the owner two months ahead of schedule.
Art. 23, para. 1. (new)-by way of derogation to article 22 of which from the law for tenants under article 1, paragraph 3, of the law of the non-payment of rent, the term does not involve termination of lease. The judges may grant small terms of payment, which will not compete in filing the action four months dela tenants destitute and without work. After expiry of that period, in the event of non-payment, cancellation of occurs.
Paragraphs 1 and 2. 3, (new) all other dispoziţiuni and aligned to the law of 15 April 1930, unchanged by the presence of the law remain. "
Article 2 the civil servants whose wages have been reduced by law to reduce salaries, paid from the State budget and the budgets of the autonomous Houses and public commercial Companies, will be able to terminate the leases, in the course of enforcement, within 30 days after the date of promulgation of the present law, which from, if the owners concerned would refuse to reduce rents, in the proportion in which the reduction was made their salaries through the aforesaid law.
Denunciation of contracts will make its way through the body of the notification to the local court, portareilor or by notaries public.
This law was voted by the Assembly of deputies at its meeting on 31 March 1931, Dale and was adopted by a majority of one hundred forty-three votes against.
