Law No. 139 of 29 December 1995 (* updated *) national Red Cross Society from Romania (applicable as from 1 January 2016) ISSUER-PARLIAMENT------Parliament adopts this law.


Chapter I General provisions Article 1 the national Red Cross Society from Romania is a legal person governed by public law, autonomous, non-governmental, apolitical and without patrimonial purpose. It operates as a humanitarian aid organization, volunteer auxiliary of the public authority.


Article 2 (1) the national Red Cross Society from Romania is organized and operates on the basis of their own status as the only Red Cross Society, both in times of peace and in time of war, on the basis of the law and of the Geneva Conventions of 1949 to which Romania is a party.
  

(2) fundamental principles of moral and legal, after which the work of national Red Cross Society from Romania are those of the International Movement of Red Cross and Red Crescent movement: humanity, impartiality, neutrality, independence, voluntary service, unity and universality.
  


Article 3 (1) the national Red Cross Society from Romania is open to all, and its humanitarian actions are conducted throughout the country.
  

(2) the national Red Cross Society from Romania attend international activities organized in accordance with the agreements concluded in this field, to which Romania is a party, as well as to other international humanitarian action.
  


Article 4 (1) the emblem of the national Red Cross Society from Romania, adopted at its founding on July 4, 1876, is provided in annex II, which forms an integral part of this law.
  

(2) the emblem of the national Red Cross Society from Romania represents a cross, consists of five equal squares, red vermion, sitting on a white background and surrounded by two concentric circles of the same color. In the space between the two circles is written with letters of vermion, red on white background inscription: NATIONAL RED CROSS SOCIETY. Romania.
  


Article 5 (1) the emblem as a sign of indication, it uses, in time of peace, by: a) national society of red cross from Romania, during events or campaigns to collect funds;
  

b third party legal associated) at actions of the kind referred to. a);
  

c) means of transport;
  

d) first-aid stations if they are intended exclusively for free care.
  

(2) the authorization for the use of this logo in the cases referred to in points. b)-d) is issued by the National Red Cross Society from Romania.
  

(3) In time of armed conflict, the emblem as a sign of indication, used exclusively by the National Red Cross Society from Romania.
  


Article 6 (1) protective emblem, sign, can be used in peacetime by National Red Cross Society from Romania.
  

(2) In time of armed conflict, as a mark, emblem is used by the protector: a) sanitary services of the armed forces;
  

b) national society of red cross from Romania, but for its staff and for the materials through which they give an official sanitary service competition, obeying military regulations;
  

c) civil hospitals recognized as such by the State and authorized to use the logo for any purpose;
  

d) other companies help voluntary authorization only for staff and materials affected health services exclusively subject to military regulations.
  

(3) the authorisation of the use of the emblem as a protective sign, in the event of armed conflict, is made by the Romanian Government.
  


Article 7 National Red Cross Society from Romania operates in its own spaces and assigned in this regard so far, as well as other residential buildings which are made available by the local councils or district of the municipality of Bucharest, where appropriate, to carry out the work, and shall enjoy the same protection measures that the law establishes in favour of public institutions.


Article 8 the national Red Cross Society from Romania shall enjoy the protection and support of the State and has, as a public interest organization, the right to seek the support of all the public authorities, and they are required to grant it.

Article 9 the headquarters of the national Red Cross Society from Romania is in Bucharest, str. Amzei Church nr. 29, District 1 in the building as part of the private property of the national Red Cross Society from Romania.

Chapter II scope and main tasks of the national Red Cross Society from Romania Article 10 National Red Cross Society from Romania acting in every circumstance, in order to prevent the suffering of the people, and alinării without any difference in terms of nationality, race, religion, age, sex, social or military affiliation policy.


Article 11 the main tasks of the national Red Cross Society from Romania are: a) to act in the event of armed conflict and in times of peace to prepare and act as auxiliary to the public authorities in all areas provided for in the Geneva Conventions of 1949 and in favor of all those suffering, both civilian and military;
  

b) contribute to the improvement of health, the prevention of disease and the mitigation through aid programs for the benefit of the community;
  

c) organize, at the national and local levels, where appropriate, the services of emergency aid in favour of disaster victims, regardless of their causes and their nature;
  

d) to recruit, to train and to make available the personnel necessary to achieve its mission;
  

e) to promote the participation of children and youth in specific activities;
  

f) authorize the use of the emblem, in time of peace, in accordance with the law;
  

g) to organize and participate in international actions to assist victims, regardless of the causes and nature of disasters;
  

h) to make known to the general public, in particular children and youth, its actions and those of the International Movement of Red Cross and Red Crescent societies, as well as the fundamental principles of the Red Cross, the ideals of peace, respect and understanding among all people and all peoples;
  

I) to enter into collaborative agreements and to compile joint action programmes with other societies or associations engaged in humanitarian activities, with companies, with ministries and other institutions of Central and local public administration, in pursuit of its humanitarian mission;

j) participate, on the basis of the programmes initiated by the Ministry of health, in the recruitment of blood donors, to combating of epidemic and other actions.
  

k) organize courses of Red Cross voluntary sister and first aid courses, compulsory for professional categories at risk of injury and driving schools for amateurs and professionals.

Article 12 of the press, radio and television provide, free of charge, the popularization of humanitarian organized by national Red Cross Society from Romania.


Chapter III organization and heritage Component, Article 13 (1) the national Red Cross Society from Romania is open to all citizens, irrespective of nationality, race, sex, religion, profession, social affiliation or politics.
  

(2) the capacity as a member of the national Red Cross Society from Romania, the corresponding rights and obligations governing under the Statute and regulation, adopted by the General Assembly.
  


Article 14 (1) the national Red Cross Society from Romania is organized on the principle of territoriality, according to the Statute and the rules of their own.
  

(2) subsidiary undertakings of the sectors and Bucharest have legal personality and functional autonomy within the limits laid down by the Statute and regulations.
  

(3) the statutes of the national Red Cross Society from Romania will be published in the Official Gazette of Romania, part I.

Article 15 (1) the assets of the national Red Cross Society from Romania is made up of movable and immovable property, arising from: (a)) of contributions by individuals and legal entities;

b) testamentary donations and related;
  

c) sponsorships, contributions in cash and goods from any natural or juridical persons Romanian or foreign;
  


d) income from organizing public events, raffles, balls and other such actions, as well as from economic activities are compatible with its objectives;

e) publishing and selling their own periodic publications and books on the subject or activity.
  

(2) Repealed.

(3) the national Red Cross Society from Romania is exempt from paying value added tax for income from economic activities, where such income is used for the organisation, conduct and development of the activity of the national Red Cross Society from Romania.

Article 16 (1) of the State budget law shall determine annually the expenses for dues of Member of the International Federation of Red Cross and Red Crescent societies and for contributing to the financing of the International Committee of the Red Cross.
  

(2) from the State budget through the budget of the Ministry of public health, ensure funds necessary for carrying out the duties of the national Red Cross Society from Romania, as referred to in art. 11 lit. a)-(e)), g) and (h)), on the basis of the programmes drawn up by it.

(3) from the State budget shall ensure that the payment of value added tax in respect of supplies of goods, provision of services and execution of works which are financed wholly or partly from sources other than the European Union's financial contribution.

Article 17 (1) movable and immovable property of the national Red Cross Society from Romania, as well as materials that it receives or sends out, at home or abroad in pursuit of its humanitarian mission, are exempt from any taxes or fees.
  

(2) legal actions for valorizing its rights of any nature shall be exempt from stamp duty.
  


Article 18 in the event of disasters, natural calamities, as well as in time of armed conflict, staff transport national Red Cross Society from Romania, on mission, on the basis of ticket service is free on any means of transport that belong to the autonomous public corporations or companies.


Article 19(2) Annually during the months of May and September, it organizes "Red Cross in Romania".


Article 20 (1) all institutions of culture, entertainment, and sports organizations, federations and associations, sports clubs and foundations which organizes sports events are required to levy a stamp of the Red Cross for every ticket sold for cultural events, entertainment and sports, concerts, festivals, performances, movies on demand, cinemas, sports races locally, nationally and internationally, etc., representing a rate of 1% that will add to the selling price.

(2) annually during the months of the Red Cross, the national Red Cross Society from Romania will organize campaigns to collect funds.
  

(3) legal and natural persons who sell tickets as referred to in paragraph 1. (1) have the obligation to print the words on each ticket for Romanian Red Cross Contribution.
  

(4) For all of the events referred to in paragraph 1. (1) funds will be collected and paid quarterly on behalf of the national Red Cross Society.

(5) within 60 days after the entry into force of this law, the national Red Cross Society from Romania will issue detailed rules for the application, with the opinion of the Ministry of public finance.

(6) the tasks relating to the verification and monitoring of the collection of stamps and virării Red Cross specialized organs shall accrue to the Ministry of public finance.

Article 21 entry into force of the present law shall repeal: Decree No. 561/1973 concerning the Organization and functioning of health voluntary formations of Red Cross Society of the Republic of Socialist Romania; Decree No. 281/1981 relating to the Organization of "the week the Red Cross ' Socialist Republic from Romania, as well as other provisions to the contrary.

Article 22 (1) Blindness and failure by the contributions individuals and legal entities who also obligations laid down in this law and are subject to and shall be sanctioned with a fine of from 2,000 to 5,000 lei lei.

(2) Funds resulting from the levying of contributions provided for in this law for the functioning of the national Red Cross Society from Romania are not taxable.

This law was adopted by the Chamber of deputies at its meeting of 20 December 1995, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
