LEGE No. 8 of March 7, 1994 on the establishment and use of the Special Fund for the development and modernisation of border control posts and other customs units

The Romanian Parliament adopts this law + Article 1 The Special Fund for the Development and Modernisation of the Border Crossing Control Points as well as the other customs units shall be constituted by charging a fee of 0,5% applied on the customs value of the imported goods or exported, for the supply of customs. It is exempted from the payment of the commission provided in par. 1 the goods subject to import on the basis of external credit agreements, agreements on non-reimbursable economic assistance programs granted to Romania by the member countries of the "24" Group and international economic bodies, including humanitarian aid, concluded between the Romanian Government and other countries ' governments. + Article 2 The payers of the customs service commission shall be the economic operators and the other legal persons carrying out definitive import-export operations. + Article 3 The budget of the Special Fund for the development and modernization of the control points for the crossing of the border, as well as of the other customs units shall be developed and administered, 10/1991 on public finances, by the Ministry of Finance through the General Directorate of Customs and is approved every year by the Parliament by the law on the adoption of the state budget. + Article 4 From the Special Fund for the Development and Modernisation of the Border Crossing Control Points, as well as the other customs units, capital expenditure is carried out on the opening of new control points for the border crossing and customs units, extension and modernization of existing ones. They shall be established annually by the investment lists developed under the law and presented as an annex to the budget of this fund, representing: -the costs of designing and drawing up technical and economic documentations; -construction-assembly works; -independent machinery and equipment; -bringing and connections; -purchase of new, unfinished or old buildings, and land related to them (possibly land concessions), in order to arrange the premises of the customs units. + Article 5 The availability of the Special Fund for the development and modernization of the border crossing control points, as well as the other customs units, existing on the account of the treasury of public finances, will be placed by the Ministry of Finance, by The General Directorate of Customs, with negotiable interest. The balance of the special fund and related interests remaining at the end of the year shall be carried over to the following year and shall be used under the conditions + Article 6 The Ministry of Finance will develop, within 30 days from the adoption of this law, methodological norms on the administration of the special fund. + Article 7 This law enters into force on the date of its publication in the Official Gazette of Romania. On the same date any provisions to the contrary are repealed. This law was passed by the Senate at the meeting of February 14, 1994, in compliance with the provisions of art 74 74 para. (2) of the Romanian Constitution. SENATE PRESIDENT prof. univ. dr.
