LAW No. 8 of 7 March 1994 on formation and use of the special fund for the development and modernization of the checkpoints for crossing the border, as well as other customs PARLIAMENT ISSUING units Published in MONITORUL OFICIAL NR. 62 of 10 March 1994, the Romanian Parliament adopts this law.


Article 1 Fund specifically for the development and modernization of the checkpoints for crossing the border, as well as other customs units, by charging a fee of 0.5% applied to the customs value of goods imported or exported, for the provision of customs services.
Shall be exempt from the payment of the fee referred to in paragraph 1. 1 the goods are subject to import based on external credit agreements, agreements relating to economic assistance programs of grants granted to Romania by the Member countries of the Group of 24 "and international economic bodies, including humanitarian aid, concluded between the Romanian Government and Governments of other countries.


Article 2 the fee Payers for the customs services are businesses and other legal entities which are engaged in import-export operations.


Article 3 special fund budget for developing and modernizing checkpoints for crossing the border, as well as other units shall develop and administer according to law No. 10/1991 concerning public finances, by the Ministry of finance through Directorate General of Vamilor and approved each year by Parliament by law for the adoption of the State budget.


Article 4 of the special fund for the development and modernisation of control points for crossing the border, as well as other units shall carry out capital expenditure relating to the opening of new checkpoints for crossing the border and customs units, extension and modernisation of existing ones. These are established annually through investment lists drawn up in accordance with the law and submitted as annex to the budget covering expenses for:-design and drawing up technical and economic documentation;
-construction-Assembly works;
equipment and facilities;
-Interior and fittings;
-purchase of buildings new or old, unfinished, and Lands attached to them (possibly land concession contracts) for installation on the premises of the customs units.


Article 5 availability of the special fund for the development and modernization of the checkpoints for crossing the border, as well as other units existing in the customs, public finance, Treasury will be placed by the Ministry of Finance, through the Directorate-General of Vamilor, with Daniel negociabila.
The balance of the special fund and related interest remaining at the end of the following year shall be carried over and used under the present law.


Article 6 the Ministry of finance will elaborate, within 30 days of the adoption of this law, guidelines concerning the management of the special fund.


Article 7 this Act comes into force on its publication in the Official Gazette of Romania. At the same time any provisions to the contrary are hereby repealed.
This law was adopted by the Senate at its meeting on February 14, 1994, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
