LAW No. 4 of 13 January 1994 on empowering the Government to issue ordinances and authorization of contracting foreign loans and ISSUING guarantee PARLIAMENT Published in MONITORUL OFICIAL NR. 7 of 13 January 1994, the Romanian Parliament adopts this law.
Article 1 pursuant to article 6. 114 para. (1) of the Constitution, it is the Government that link settlement on the date of entry into force of this law until the resumption of Parliament on the first regular session of 1994, to issue decrees in areas relating to: financial coverage has) some remaining expenses neregularizate by taking them to the internal public debt up to the limit of the sum of 210 billion lei;
(b) strengthening financial discipline) economic operators;
c) by extending the application of moderating inflation additional tax upon wages fund with prior consultation of trade unions and employers;
d) inclusion in the base salaries of staff of public institutions and of compensatiei granted separately from 1 May 1993 to correct and referencing, on this occasion, the wage level, with appropriate modification to transelor income for taxation purposes, as in the case of indexing;
(e) excise duty) amendment drinks obtained from distillation and at high-quality cigarettes and the imposition of excise duty for cars with engine capacity exceeding 1800 cc, us or run;
f) list of approval tariff concessions, the annex to the general agreement on tariffs and trade (G.A.T.T.) and modification of tariffs resulting from it and other international agreements to which Romania is part g) updating the level of premiums and limit claims by operation of law insurance civil liability with effect from 1 January 1994 h) stimulate development of housing construction public works, without changing the legal regime of land, putting the safety of the building, the quality of the construction and establishment of administrative fines provided for in law No. 50/1991 authorizing execution of construction and some measures for the realization of their housing, change between 200,000 and 2,000,000 lei;
I) ensure funding resources for continuing participation in the construction of the industrial complex of products containing nickel and cobalt from Cuba and Camariocas-electrical power station 3 x 12 MW from Cao-Cun-Chinese Folk Republic;
j) stimulating exports, imposing special taxes on exports of raw materials, as well as some imported products, while respecting the obligations from international treaties to which Romania is a party;
k) some measures for further work at the Cernavoda nuclear power plant-electric for the operation of the unit No. 1, and to ensuring the conditions for financing of these works;
l) Fund of development of autonomous public corporations;
m) improvement rules concerning value added tax;
n) amendment of the law nr. 32/1968 laying down and punish offences relating to increase fines for violations of limits the jurisdiction of the Government and changing the limits between 1,000,000 and 50,000 lei, as well as the modification of the scope for resolving complaints;
a) ratification of amendments to some international agreements concluded in the fields of finance, banking and shopping.
Article 2 In article 41(2). 114 para. (3) of the Constitution, until the resumption of Parliament on the first regular session of 1994, the ordinances issued by the Government pursuant to art. 1 of this law will be submitted to Parliament for approval, according to the legislative procedure, under penalty of termination of their effects.
Statutory instruments made by the Government, according to para. 1, will be debated in an emergency procedure.
Article 3 in the areas referred to in this law unconstitutional, if it were adopted draft laws or legislative proposals by one of the Chambers of Parliament or have been compiled and submitted reports by standing committees, they will be considered by the Government to issue ordinances.
Article 4 authorizes the Government and National Bank of Romania to contract and guarantee, during 1994, external financial credits to the extent of the amount of 2.0 billion dollars, in order to ensure the necessary currency resources supply with raw materials (fuel, energy and others), to finance investments and to increase foreign exchange reserves.
The Government will inform Parliament of progress every quarter loans according to para. 1, the conditions of the contract, guarantees given and use.
This law was adopted by the Chamber of deputies at its meeting on December 29, 1993, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
