LAW No. 67 of 7 October 1993 on the setting up and use of the special fund for research and development ISSUER PARLIAMENT Published in MONITORUL OFICIAL NR. 244 of 13 October 1993, the Romanian Parliament adopts this law.


Article 1 is hereby set up special fund for research and development, intended for the financing of national programmes for research and development, including basic research, technical, geological prospecting and research papers for discoveries of new deposits, the subsidizing of technical and scientific literature, information activity and actions for the promotion of research results, as well as capital expenditure, including for "Academy House".


Article 2 special fund for research and development shall be formed by contributing to economic agents, regardless of the form of organization and type of property, with the exception of economic entities exempt by law from paying corporation tax by applying a quota on the revenue realized, after deduction of value added tax and excise duty.


Article 3 the amount of the special fund for research and development and share of contribution to economic agents shall be established annually by the State budget law.


Article 4 For products, services and activities of the public budget is subsidized, businesses owe the contribution to the special fund for research and development.


Article 5 management of the special fund for research and development shall be made, under the provisions of law No. 10/1991 concerning public finances, by the Ministry of research and technology.
The establishment of research priorities and the designation will be made executanţilor of themes College Advisory Research and Development Activities through its specialized committees, which includes representatives of the ministries and departments, research and development programs.


Article 6 availability of special fund for research and development shall be kept in an account at the Bank and shall bear interest, and these constitute resources of the Fund.
The level of interest will be determined on the basis of negotiation.


Article 7 operators are required to be paid monthly amounts due the special fund for research and development, but not later than the end of the next.
The amounts paid are at the disposal of the Ministry of research and technology.
Failure within the economic agents of the sum representing the contribution payable is charged with 0.15% per day of delay.
The Ministry of research and technology together with the Ministry of finance will issue instructions on how another expenditure approved contribution funding, highlighting and reporting of that Fund.
The Ministry of research and technology, in cooperation with other ministries and departments concerned, will issue instructions on how stimulus tracking and recovery themes of research and development.


Article 8 the Government will present to Parliament reports semi-annually and proposals on how to use the special fund for research and development.


Article 9 the provisions of this law shall apply until the start of the year of implementation of the budget, following the date of entry into force of the law on research and development activities.
This law was adopted by the Senate at its meeting on 23 September 1993, in compliance with the provisions of art. 74 para. (2) of the Constitution of Romania.
