LEGE No. 83 of 21 July 1992 on the urgent follow-up and trial procedure for some corruption offences

The Romanian Parliament adopts this law + Article 1 The offences provided in art. 254, 255, 256 and 257 of the criminal code, if they are flagrant, shall be pursued and judged according to the provisions of art. 465 and 467-479 of the Code of Criminal Procedure. + Article 2 In cases where the offences referred to in art. 1 are not flagrant, the prosecution shall be carried out no later than 10 days from the date of referral of the criminal prosecution body. If the prosecution cannot be carried out within this period due to the complexity of the case, the chief prosecutor of the county or of the city of Bucharest, or the superior hierarchical prosecutor, when the prosecution is carried out by a prosecutor General, it may order motivated the extension of the duration of the prosecution, no more than twice, each extension not exceeding 15 days. When the prosecution is carried out by the criminal investigation body, it is obliged to submit the file to the prosecutor at least 2 days before the expiry of the deadlines provided in par. 1. The judgment is made according to art. 471-479 of the Code of Criminal Procedure, with the derogations and completions provided in the following paragraphs. For the administration of evidence, the court may grant deadlines, which in total cannot exceed 15 days. In the course of prosecution and judgment, the legal assistance of the accused or defendant is mandatory; if he has not chosen his defender, measures are taken to determine a defender ex officio. This law was adopted by the Chamber of Deputies at its meeting on July 7, 1992, in compliance with the provisions of 74 74 para. (1) of the Romanian Constitution. p.
