LEGE No. 45 of July 4, 1991 amending certain provisions relating to the activity of judgment

The Romanian Parliament adopts this law + Article 1 County courts and tribunals in complete formats only of judges. + Article 2 Law no. 58/1968 for the organisation of the court, amend the following 1. Article 23 (4) (1), (a) and (b) shall read as follows: " a) the applications entered in the main way, relating to maintenance pensions; the patrimonial disputes between individuals, having as their object the payment of a sum of money or the surrender of a movable property, when the value of the dispute does not exceed 30,000 lei and not it concerns a succession or division of property; the shares of the owners; requests for records in civil status registers; complaints against the approval of the minutes of finding the customs contraventions; taking some precautionary measures or temporary measures in urgent cases; requests of any kind on attachment; labor disputes, except for appeals against the dissolution of the employment contract and imputation decisions whose value exceeds 50,000 lei; b) the reasons and requests that, according to the law, are settled by the judges as a last resort. " ... 2. Article 23 (1) shall read as follows: " In case of indivisibility or connection, even if only one of the requests or crimes does not meet the conditions provided for in the previous paragraph, the court panels shall be composed according to the provisions of par. 1 1. " 3 article 23 (2) and (3) and Article 26 (4) shall be repealed. + Article 3 Law no. 18/1968 on the control of the provenance of certain goods of natural persons, which have not been lawfully acquired, shall be amended as follows: 1. Article 4 (1) shall read as follows: " Verification of referrals and requests shown in art. 3 is made by a research commission, which operates in addition to each court and is made up of: -a judge from the court, appointed by the president of the county court, as president; -a prosecutor from the local prosecutor's office, appointed by the chief prosecutor of the county prosecutor's office, and a delegate appointed by the director of the county financial administration. 2. Article 12 (2) shall read as follows: " The appeal is settled by a commission that operates under each county court and is made up of: -the deputy chairman of the county court, as president; -a judge of the county court, appointed by the president of this court, the deputy chief prosecutor of the county prosecutor's office and the director of the county financial administration or his replacement. 3. Article 10 (3), Article 14 (2) and Articles 15 to 20 shall be repealed. + Article 4 Article 17 (2) of Law no. 3/1970 on the regime of protection of some categories of minors will have the following contents: " The court shall settle the appeal no later than 15 days from the date of referral, with the citation of the organs and persons shown in art. 16 16 para. 1, provisions of art. 15 15 para. 2 2 and art. 16 16 para. 3 3 being applicable. The participation of the prosecutor is mandatory + Article 5 Article 6 of Decree no. 203/1974 on the establishment and organization of maritime and river sections at some courts and prosecutors ' offices is repealed. + Article 6 Any other provisions contrary to this law shall be repealed.
