LAW no. 33 33 of 23 November 1990 for amendment Decree no. 214/1977 on state military pensions

The Romanian Parliament adopts this law + Article 1 Decree no. 214/1977 on state military pensions is amended as follows: 1. Article 9 shall read as follows: "" ART. 9. -(1) Militaries from permanent staff who have the quality of aeronautical personnel shall be placed in reserve on request with the right of service pension as follows: -aircrew on aircraft of hunting, hunting-bombing and research, supersonic: -after 20 years of actual activity in this capacity, regardless of age; -after 15 years of actual activity in this capacity, at the age of 45 years; -aircrew on aircraft of hunting, hunting-bombing, research, subsonic and military paratroopers: -after 22 years of actual activity in this capacity, regardless of age; -after 17 years of actual activity in this capacity, at the age of 47 years; -aircrew on transport, school and helicopter aircraft: -after 24 years of actual activity in this capacity, regardless of age; -after 19 years of actual activity in this capacity, at the age of 50; -technical and engineering personnel of aviation and soil navigators: -after 26 years of actual activity in this capacity, regardless of age; -after 21 years of actual activity in this capacity, at the age of 50. (2) Militaries from permanent staff who have the quality of divers, as well as those who operate under special working conditions and who have served in such activities for at least 15 effective years, can be retired if they have at the date of exit of the permanent staff a service of 25 years and have reached the age of 50 years. " ... 2. Article 13 shall read as follows: "" ART. 13. -(1) The aeronautical staff shall apply the percentages of the first or second groups of work, as the case may be, provided by the State Social Insurance and Social Assistance Pensions Act, if they have actually worked in these groups for at least 15 years in Group I or 17 years in the second group of work; if they have worked less, at the percentages corresponding to group III, an increase is granted in proportion to the time actually worked in groups I and II. (2) Scafanders and other personnel, who have carried out their activity under special working conditions, shall be applied the percentages of groups I or II of work, as the case may be, provided by the Law on State Social Insurance Pensions and Assistance social, if they actually worked in these groups for at least 20 years, in group I, or 25 years, in the second group of work; if they worked less, at the percentages corresponding to the group III-a spore proportional to the time actually worked in groups I and II. ... (3) For those referred to in par. ((1) and (2), when determining the pension shall be taken into account, for each year worked in these groups, as follows: ... a) 2 years, for group I of work; ... b) 1 year and 6 months, for the second group of work. ... (4) The places and activities that entitle the military to benefit from the pension in relation to group I or II of work shall be established according to the regulations in force. " ... + Article 2 The provisions of this Law shall enter into force on 1 November 1990. Decree no. 214 214 of 12 July 1977 on state military pensions, with subsequent amendments and completions, shall be republished in the Official Gazette, giving the articles a new numbering. This law was passed by the Senate at its meeting on November 14, 1990.
