Law No. 10 of 9 December 1982 concerning the obligations and responsibilities of the popular councils, Socialist and citizens units for the proper management, maintenance and cleaning of urban and rural settlements, keeping public order and discipline NATIONAL ASSEMBLY ISSUING Published in OFFICIAL GAZETTE No. 114 of 18 December 1982 In accordance with the plans of economic and social development of the country was allocated, year after year, significant funds which have ensured uninterrupted lifting the level of the household and urban-beautification of municipalities, towns and communes, to improve the quality of life of citizens in all localities.
Picking up on a Centaur upper stage of the degree of development of all localities to impose further popular councils, activity increase their role, based on the principles of workers ' self-management and economic and financial self-administration in making gospodariri concern, cities and municipalities, use with maximum efficiency of material and financial means with which they are entrusted, stimulating and full of energy, initiative and creative capacity of all working people.
Popular councils shall be responsible, under the law of leadership, guidance and coordination of all activities of the and beauty, keeping order and discipline, competent authorities should ensure, with the support of parliamentarians, standing committees, committees of citizens, participation of all inhabitants of municipalities, towns and municipalities at the debate and the adoption of decisions concerning the settlements to carry out self-management measures for developing, upgrading and beautification.
Citizens ' participation and the Socialist management, care and cleaning keeping settlements, dwellings, other buildings, courtyards and offices, the traffic arteries, of all places, and public transport vehicles, constitute an essential condition for meeting at a growing level of requirements and the civilized life of the entire population.
The fulfilment of these requirements requires increased responsibility of all citizens and the development of civic consciousness, Socialist, direct participation in measures of good management, upgrading and beautification of municipalities, towns and communes, strengthening law and order and discipline in order to maintain a permanent state of cleanliness and hygiene of communities.
To this end, the National Assembly of the Socialist Republic of Romania adopts this law.


Chapter 1 General provisions Article 1 the proper management, retention, compliance with strict cleanliness standards, such as hygiene and beautification of municipalities, towns and communes, constitute a permanent obligation of popular Socialist units, as well as of all citizens.


Article 2 the popular Councils and of the municipality of Bucharest municipal sectors of Bucharest, city and municipal services are responsible for the leadership, direction, coordination and control of the entire activities of the settlements, and beauty of keeping order and cleanliness in all cities and municipalities.


Article 3 in the exercise of their duties, popular councils apply the principles of workers ' self-management and economic and financial self-administration, ensure, in accordance with the provisions of the economic-financial mechanism, with a maximum effective use of financial and material means with which they are entrusted, reducing costs and eliminating material losses, particularly energy, fuel and water, continuous development and proper management of localities.


Article 4 the popular Councils based its entire business on settlements management strengthening of ties with citizens, and promote the initiative and their participation in realisation of maintenance and storage cleaning at the time of making the urban-household, to reinforce law and order and discipline.


Article 5 Units have the obligation to maintain Socialist permanent cleanliness and hygiene condition of buildings, the annexes thereto, of the premises, other spaces, as well as means of transport which they possess.
Also, have the obligation to participate in Socialist maintenance and housekeeping of streets, roads, parks and gardens surrounding the premises.


Article 6 all citizens have the obligation to provide the care, housing, household courtyards, annexes imprejmuirilor and participate directly to the maintenance and preservation of order and cleanliness in the streets, roads, squares, parks, gardens, and in other public places, and public transport.


Article 7 the citizens have the obligation to participate in the actions organized by the popular councils, committees of citizens and associations of lodgers, for proper management of localities, keeping cleaning and beautification of the communes, towns and municipalities, the aesthetic appearance of their lifting, strengthening public order and discipline.


Chapter 2 Obligations and responsibilities of the popular councils Article 8 popular Councils, with the support of Deputies, committees of citizens, of associations of lodgers and Socialist units, with direct participation of all citizens, are obliged to ensure strict compliance with: (a)) of legal provisions concerning the territory and systematization of localities, the rules governing discipline in construction;
  

b) cleanliness of streets, squares and other public places, snow removal, lifting and storage of rhythmic, household refuse collection and street, sorting and valuing reusable material resources;
  

(c) the proper management and maintenance) of the housing, other buildings, strict compliance by all citizens and Socialist units of laws concerning the use, cleaning, sanitization and their courtyards, pathways and green spaces related buildings;
  

d) repair and maintenance of streets, roads, bridges, ditches, podetelor adincirea, modernization and building of roads and traffic arteries;
  

(e) the strengthening and maintenance of dams) and banks, execution and maintenance of riverbeds and water rates, making other flood protection works, ensuring water leakage, land reclamation and water pollution prevention unwholesome;
  

f) harnessing resources for local heating, twigs, buddies and other materials resulting from the cleaning of forests, as well as reusable material resources from Socialist units;
  

g) smooth establishment and operation of public transport, rational and effective exploitation of means of transport, storage and cleaning of vehicles, strengthening law and order and discipline in the operation and use of the means of transport;
  

(h) compliance with strict rules) toilet in agro-food markets, fairs and in oboare, in the commercial catering units and establishments providing services;
  

I) arrangement, according to sketches of town-planning, and maintenance of green areas, parks, public gardens, sports fields and playgrounds for children, and other public places and amenities;
  

j) keeping cleaning and hygienic-sanitary standards in cinemas, theatres, sports halls, stadiums and in other units of culture and sports;
  

k) keeping, preservation, repair and restoration, under the conditions provided by law, the statues and other monuments which represent construction of art and culture.
  


Article 9 of the Municipal Councils, of the popular sectors of Bucharest, city and municipal services are obliged to draw up and submit programmes for citizens ' meetings debate concrete measures for organizing actions of good management, cleanliness and beautification of communities, to guide and oversee the implementation of such permanent actions.
The town councils of municipalities, the sectors of Bucharest, cities and municipalities will present their reports on the performance of the programmes of action referred to in paragraph 1. 1 civic meetings organized, on a semi-annual basis according to the law.
Popular councils deputies will mobilize citizens in electoral districts for maintaining the cleanliness and hygiene of housing, courts, traffic arteries, as well as for their participation in the beauty of actions.


Article 10 popular Councils, committees and executive offices, with the support of the citizens ' committees and residents ' associations, will act for the effective participation of all citizens and Socialist units to enable cleaning and beautification of cities and communes, in which purpose will determine the traffic arteries, parks, gardens and other public places or portions thereof which are to be placed in the care of citizens ' committees school, as well as units, and other socialist establishments.


Chapter 3 obligations of Socialist units with respect to the maintenance and preservation of buildings, premises, cleanliness of the arteries, as well as other public places Article 11 Councils working people and other collective bodies of all socialist units are obliged to take steps to ensure that all staff worker to participate in the actions of maintenance, cleanliness and beauty of its buildings, premises, courts , imprejmuirilor, traffic routes, as well as streets, roads and green areas.

d) conditions to safe hygiene through cleaning, disinsectisation operations and deratization of real estate;
  

e) to ensure the cleanliness of streets and sidewalks around the premises, and maintenance of green areas and plantations on such roads;
  

f) to preserve the cleanliness and order of the storage facilities established for residues, reusable materials and pavements.
  

Governing bodies of collective Socialist units are obliged to take measures to avoid noise over the acceptable limits set by the legal norms, in order to assure tranquility and rest of citizens in inhabited areas.


Article 12 governing bodies of collective farm and agricultural production cooperatives are obliged to ensure that all staff and worker mobilization of members of the cooperative works: a) cleaning and sanitizing stables, saivanelor and other places housing animals and birds, as well as traffic routes, their surroundings;
  

b) evacuation and transportation total quantity of manure and animal manure for use as fertilizer;
  

c) cleaning machinery and agricultural machinery at their exit on public ways.
  


Article 13 Socialist Units that execute works of construction, repair and demolition of buildings, building equipment and technical installations, repair or maintenance of these levels have the following obligations;

Article 14 Units of communal councils, subordination and other units who in the administration of their distribution networks or sanitation of localities in the territory, are obliged to execute, without delay, at the latest within 48 hours, the following works: (a) damage or deranjamentelor) remediation of the pipes with drinking water, hot water and heat distribution;
  

b) rainwater canals and Unclog channels for dhw, in order to avoid or remove stagnant water formation times flooding;
  

c) repair the driveway side of degradation that can lead to the occurrence of traffic accidents or disturbances in road traffic.
  

Also, household units will ensure, in municipal law, the realization of the works connected buildings, regardless of their beneficiaries or contractors, in order to avoid disposal and recovery of the carriageway and repeated the pavements of streets.


Article 15 Staff worker of trade, public catering and services is obliged: a) ensure order and cleanliness of the premises in which they operate and storage places of the products and packages;
  

b) comply strictly with hygienic-sanitary rules concerning the production, storage and sale of foodstuffs;
  

c) to ensure the maintenance of quality agri-food goods deposited;
  

d) to engage in social groups, cleaning equipment and furnishings;
  

e) to participate in the collection, removal and storage of residues, in places specially designed for this purpose.
  

The managers of the establishments referred to in paragraph 1. 1 are obliged to control the State of cleanliness and hygiene of premises, pavements and of roadway with their surrounding, ensuring follow-up of their cleanliness; You also need to take measures for the execution of the actions of deratization, disinfection and disinsectisation.


Chapter 4 obligations of citizens with regard to the care and maintenance cleaning the housing, household courtyards, annexes, streets, roads, and other public places article, all citizens have the duty to provide maintenance and cleaning of housing, household courtyards, annexes and imprejmuirilor, as well as to participate in implementing all measures relating to the proper management of localities. To this end, citizens have the following obligations: a) to carry out, under the conditions laid down by law, regulation, maintenance and repair of dwellings and household annexes;
  

b) to ensure, in accordance with the law, zugravirea and exterior painting of buildings, parts replacement and degraded jghiaburilor pipe, as well as carrying out other repairs and maintenance on the facades of homes;
  

c) clean installations for the disposal of household waste, crematoria and residue storage related buildings;
  

d) to store the debris only household receptacles or in facilities for this purpose;
  

(e) to maintain cleanliness and) hygiene in homes, in household courtyards, annexes, and other lands they hold;
  

f) to engage in suitable buildings pens;
  

g) to care for the trees, flowers and other plantings in front of courtyards and buildings they own;
  

h) to maintain cleaning sidewalks, driveway to side channel, street or road, parking lots and use to remove snow and ice from the right buildings in which they live;
  

I) to ensure that, in rural areas, roads, sidewalks, ditches, bridges, podetelor, fîntînilor, captarilor Springs, cleaning and sanitizing stables and other shelters for animals and birds and to participate in the swampy land reclamation;
  

j) to preserve the purity of movement, roadways in markets, fairs and oboare, parks, swimming pools, children's playgrounds and other recreational venues, Conference halls and in other public places;
  

k) to keep in good condition for use and not degraded, banks of securities baskets, signs, display signs, telephone booths, and other such amenities located on streets, in parks and other public places;
  

l) comply strictly the measures provided by the popular councils to ensure public hygiene and cleanliness in the localities.
  

All citizens have the duty to ensure law and order and contribute to the preservation of residential premises, to comply with the rules established to ensure tranquility and leisure residents and have a proper behaviour, likely to ensure the normal use of the dwelling for the other tenants, follow-up, according to law, in the event of such rules.


Article 17 residents Associations are obliged to mobilise all tenants to the proper management and maintenance of housing, sanitary installations, annexes, other household amenities related to payment at the time the contribution to common costs, in compliance with the rules of socialist coexistence, defending property, and maintenance of public green spaces.


Article 18 Committees of citizens with the support of lawmakers, are obliged to take steps to mobilize citizens in actions for upgrading, maintenance and preservation of the beauty of its buildings, courtyards and cleaning, care of green areas, trees, flowers and other plantation, workplaces, the cleaning of the sidewalks, streets and alleys, the removal of snow and ice, and other such actions.


Chapter 5 the obligations of Socialist and citizens units with respect to the maintenance and preservation of cleanliness in public transport article 19 to comply with strict order and strengthening safety in the movement of means of transport, cleaning and preservation of their appearance, and to comply with the ritmicitatii movement and ensuring optimal conditions for travel, collective organs of the Socialist units to carry out transport of goods and persons are obliged : a) to prohibit the entry into service of vehicles of any kind which are damaged, do not meet the conditions of cleanliness or hygiene, or pollute the atmosphere;
  

b) ensure cleaning and sanitizing of the means of transport on all the time they are put into circulation;
  

c) to ensure proper loading and sealing of vehicles carrying out transport of various materials, in order to thus preventing their scattering during transportation and public murdarirea or degradation paths;
  


d) ensure public paths after cleaning operations, loading or unloading of the means of transport;
  

e) ensure cleaning jobs loading-unloading from rail stations, bus stations, ports, airports, markets and fairs.
  


Article 20 drivers and controllers of the means of transport, as well as train conductors are required to control the exit of depots, as well as during transport, status of cleanliness and hygiene in the means of transport concerned and shall be responsible for maintaining it during transport.
Also, the persons referred to in paragraph 1. 1 are obliged to take measures, under the conditions provided by law, to punish those who break the rules laid down in respect of order and discipline in the use of means of transport.


Article 21 Citizens who use buses, trolleybuses, trams, trains and other means of public transport are obliged to abide by the following rules: a) behive throughout the journey and have a cuviincioasă attitude toward others passengers and staff serving the means of transport;
  

b) to preserve the cleanliness in public transport stations, parking lots, bus stations, in stations, ports, airports and not degrade their facilities;
  

c) behave according to the rules of travel-specific means of transport, to maintain the integrity and functionality of facilities and other amenities;
  

d) not carry baggage and materials which by their volume and stinjenesc packages, other travel, materials, flammable, explosive, radioactive, corrosive, caustic, and other materials that, by law, are not allowed for transport.

Article 23 all the inhabitants of cities and municipalities must manifest a high civic consciousness, to comply strictly with the rules of socialist coexistence and rules for use and maintenance of all household facilities and to contribute, through the whole of their behavior, to combating any manifestations of negligence and carelessness in keeping the State of hygiene and cleanliness of the settlements.


Article 24 citizens have the duty to ensure perfect order in the use of public transport, to contribute to the preservation and strengthening of public order and peace, and to manifest a high intransigenta comportarilor against relegation and mentalities, of contempt for the rules of proper decorum and negligence in maintaining the asset.
Furthermore, all citizens have the duty to assist law enforcement in fighting order demonstrations that express lack of decency or respect for the rules of socialist coexistence and to take action against any manifestations of violations of the norms of civilized behavior, of socialist legality.


Article 25 of the collective management body shall conduct a Socialist units supported the educational activity in the order of removal of people's Socialist labor consciousness, the formation and strengthening of ethical and moral features, for the promotion of fairness, self help, self esteem and respect for the laws of the State and the rules of socialist coexistence.


Article 26 the collective organs of the Socialist units shall take measures for heightens debate in cases of infringement of rules on good order and discipline in the management of localities, the rules of coexistence, of socialist legality, for forming a mass issuing opinions against such manifestations.


Article 27 the Ministry of education and education will take measures for improvement and improvement of education of youth in all educational establishments, the purpose of its formation in the spirit of respect for the public goods and the rules of civilized behavior in all circumstances.


Article 28 Ministry of the Interior, through the bodies of militia, will take operative measures to prevent and combat any manifestations of disregard of public order and discipline, the rules of socialist coexistence and record-keeping rules, as well as cleaning localities for prosecution under the law, those guilty.


Chapter 7 Liabilities and penalties Article 29 violation this law shall entail, as appropriate, disciplinary, material, administrative, civil or criminal sanctions to those guilty.


Article 30 the following facts Constitute irregularity unless they were committed in such circumstances that, according to the criminal law, be deemed to be offences and shall be imposed as follows: (a) violation of article 10.) 16 lit. b), c), (e)), f), g), (h)), i), (j)) and l) and art. 21, with fine from 200-1000 MDL;
  

b) breach art. 16 lit. d) and k) and art. 20, with fine 300-1500 lei;
  

c) violation of article 10. 11 lit. a), c), (d)) and e), art. 12 and art. 15 para. 2, with fine from 2000 to 6000 lei;
  

d) violation of article 10. 11 lit. b) and (f)), art. 13, art. 14 lit. a), b) and (c)) and art. 19, with fine 5000-10000 lei.
  

In the cases referred to in paragraph 1. and (b). c) and (d)), the fines can be applied to legal persons.


Article 31 Finding contraventions and penalties provided for in this law shall be made by the town councils of municipalities, the sectors of Bucharest, the cities and communes, to the persons empowered for that purpose by the committees and the executive offices of the popular councils, as well as by officers of militia and subofiterii.
Also finding contraventions and penalties provided for in this law shall be made by the persons who, under the laws, have the power to establish offences and sanctiona hygienic-sanitary norms and rules of use of the means of transport and their facilities of the Ministry of transportation and Telecommunications.


Article 32 Offences covered by this law are applicable to the provisions of law No. 32/68 on the establishment and sanctioning violations.


Chapter 8 final provisions Article 33 the executive Committees and the offices of the popular councils, residents associations, Socialist and citizens committees are obliged to take steps to ensure that the entire staff, all citizens to know thoroughly the provisions of this law, to understand the importance of compliance with the standards of cleanliness and proper management of localities, civilized behaviour toward public goods.
They shall also take measures to organise actions of popularization of this law by displaying at workplaces, on billboards in public places, in blocks of flats, corridors and other means of publicity, and in the assemblies of citizens.


Article 34 of the press, radio and television, as well as educational units, health and culture, will be held on a permanent basis an activity supported by the mobilization of citizens in actions of beauty and cleanliness of localities, the popularization of the provisions of this law, to educate the youth and all citizens to develop civic awareness.


Article 35 obligations laid down in this law for Socialist and other legal entities.
