Law No. 13 of 19 December 1980 establishing, and use resources for counties supplying the population with meat, milk, vegetables and fruit for the ISSUING NATIONAL ASSEMBLY and published in OFFICIAL GAZETTE No. 111 of 24 December 1980 pursuant to art. 57 of the Constitution of the Socialist Republic of Romania sign and we have to be published in the Official Gazette of the Socialist Republic of Romania law No. 13 of 19 December 1980 establishing, and use resources for counties supplying the population with meat, milk, vegetables and fruit.
NICOLAE CEAUŞESCU PRESIDENT of the SOCIALIST REPUBLIC of ROMANIA Pledge program to lift the living standards of the whole people, established by the 12th Congress of the Communist Party, calls for increasing agricultural production, vegetable and animal, in all State and cooperative enterprises, in greater measure of resources from households, in order to improve the supply of citizens with food, hold the base of raw materials of industry and for meeting other needs of the national economy.
Popular councils have an obligation to act on a permanent basis for carrying out regularisation programmes for the development of agricultural production plant and animal in the territorial-administrative units in which it operates.
In each county and city, the establishment and use of resources of meat, milk, vegetables and other foodstuffs shall be carried out on the basis of the application of the principles of workers ' self-management and economic and financial self-administration.
By using the full production potential of the land and proper management of existing resources, in terms of higher efficiency as well as the popular councils should ensure the food needs of the population in each district in close correlation with increasing production and increasing the contribution to the achievement of the State Fund, to meet the other requirements of the national economy.
To this end, the National Assembly of the Socialist Republic of Romania adopts this law.
Article 1 popular Councils are required to provide the leadership of Agriculture of territorial-administrative units in which it operates, based on the principles of workers ' self-management and economic and financial self-administration in order to increase agricultural production, serving the needs of the population of each County resources and participation in an ever greater measure to the State Fund.
Article 2 application of Councils responsible for popular measures as provided for in the programmes for the development of agricultural production in territorial, harnessing the full production potential of the land, using high-efficiency of other means of production and rational use of the workforce occupied in agriculture, in order to increase the production of meat, milk, vegetables and fruits in agricultural enterprises and cooperatives and in households.
Article 3 the production obtained in all sectors of agriculture must ensure that, in each district, carrying out all delivery obligations to the State of the production of meat, milk and other animal products, vegetables, potatoes and fruit, as well as the development of additional quantities of products through OK and purchases from households.
All the inhabitants of rural and urban, who own farmland, are obliged to cultivate and grow livestock and poultry in order to cover their own needs, as well as for the creation of facilities that must be harnessed to the State or to the market, under the conditions provided by law.
Article 4 the popular Councils are responsible under the law of commodity fund to satisfy entirely the rhythmic basis, the consumption needs of the population with the meat, milk and milk products, potatoes, vegetables and fruits in fresh condition, organization and procurement, in appropriate circumstances, agri-food markets for serving members of the public, the establishment of stocks of fall and winter, providing industry with raw materials as well as creating installation to meet other needs of the national economy.
Decisions in relation to the supply of the population, the establishment and use of resources, the distribution of foodstuffs, develop and diversify its range of products, good organization and supply of agro-food markets shall be taken jointly by the committees or the executive offices of the popular councils and territorial trade union councils.
Article 5 popular Councils carries full responsibility for fulfilling all obligations to the supplies of meat, milk, vegetables and fruit for the State Fund. The achievement of State Fund in accordance with the provisions of the single national plan, Contracting and purchase additional quantities of products from households and other development activities must ensure the smooth supply of the population with dairy products, fresh vegetables and fruit production obtained in each County, as well as compliance with the other needs of the national economy.
Resources of meat, milk, vegetables and fruits for consumption by market fund and other needs of national economy shall ensure that: 1. the State Fund set up under the law: a) the production delivered by the State agricultural enterprises;
b) production and acquisition through OK harnessed by the agricultural cooperative units;
c) purchases from OK and households.
2. additional resources made in every County: a) the quantities of products manufactured by OK and additional purchases to households;
b) production units in the annexes of cantine-restaurant, eating-tourist huts, public wards and forest cantons and the like;
c) other production activities organised locally under the conditions provided by law.
Article 6 the necessary quantities of products supply to the population of the State Fund and additional resources set up in each county shall be determined on an annual basis, the national plan for developing unique economic and social development, differentiated on counties, according to the total number of inhabitants, the population of the urban centers and workers, including seasonal population, and production conditions prevailing in each region, the following average proportions : a) for meat, 90 per cent of the State and 10 per cent of the resources provided in each county and originated from the acquisition of OK and households, the production carried out in the annexes and other activities organised locally;
b) for dairy products, 85 percent of the Fund and 15 per cent of the products taken over by additional purchases from OK and households from the County;
c) for fresh fruit and vegetables, in a proportion of 70 percent of the State and 30 percent of additional acquisitions, OK and made in the County, depending on the structure of production and pedagogical conditions.
The supply plan in each district, it will ensure the setting up of agro-food products of up to 5 per cent to 10 per cent meat, milk and milk products and 15 per cent to vegetables and fruits, the quantities of products planned to supply the population of the State.
Article 7 in relation to delivery tasks to overcome Fund State, levels of consumption, sales and delivery to the market, Fund established on each county shall be supplemented as follows: a) with 10 per cent of the quantities delivered over plan by the State-owned agricultural enterprises;
b) with 40% of the quantities delivered over plan of cooperative agricultural enterprises;
c) 70 per cent of the quantities delivered over plan to fund state of OK and acquisitions from households;
d) quantities obtained by overcoming their own production tasks by the canteens, restaurants and other catering establishments will be used entirely by establishment.
The provisions of this article relating to consumption levels to supplement meat shall apply only on condition the plans for the achievement of the livestock and overcoming the burdens of State Fund delivery throughout the County.
Deliveries in addition to the tasks set by the plan may be made only from municipalities which carry out livestock planned households. For additional deliveries of Socialist live animals will be able to do under the terms of the realisation of the herd, cutting the average weights, as well as to advise the consumer rules.
Article 8 in the event of failure to fully comply with the obligations of the State Fund delivery quantities intended to be distributed from the Fund for each county shall be reduced in proportion to the degree of failure of delivery of live animals, milk and milk products, fresh vegetables and fruit.
Article 9 supply of meat, dairy products, fresh vegetables and fruits, the creselor, gradinitelor, hospitals and healthcare units ensure the State Fund, based on the rules laid down by the law of the consumer.
Meat supply of canteens, restaurants and other catering is made from the State Fund, as well as from their own production, according to the tasks laid down in the plan of each unit.
For this purpose, the committees or executive offices of city and municipal councils ' popular will take measures for the development of production capabilities for growth and fattening pigs, cafeterias, restaurants and other catering establishments, for use in animal nutrition full of debris, as well as the necessary equipment for fitting with furajarii animals, under the observance of health rules.
Also, the county councils will take action against popular identification and attribution of vacant land from building perimeters of settlements, which annually will be made available to the units with collective consumption canteens, restaurants, boarding schools and other units or individuals, for the purpose of these cultivars fields with vegetables, potatoes and other food crops.
Article 11 the establishment, use and distribution of resources are determined by the plan for additional supplies to the market population, collective consumption and other costs, with meat, dairy products, vegetables and fruits is done by the popular councils in consultation with territorial trade union councils, on the basis of programmes prepared and approved under the conditions established by law.
Popular councils are obliged to submit to supply programs to debate population and present reports in meetings of citizens regarding the decisions and measures taken in connection with the establishment of agri-food products and the distribution of resources, on municipalities and commercial systems.
Article 12 the Central Union of consumption cooperatives and cooperative consumer units should ensure the intensification of activity of capitalizing on the path contractarilor and purchases of agricultural products available in households.
In order to increase agricultural production, consumer cooperatia will hold their own capacities, in production of day-old chicks, breeding stock sows growth for piglets and multiplying rabbits. Chickens, rabbits and piglets suckling House in cooperative consumer units will be vinduti households in population, with ending contracts for animals and birds to the State Fund or through additional acquisitions and OK, and to satisfy their own needs.
In addition, the cooperative consumer units can sell piglets, chickens and rabbits of canteens, restaurants and home of the other establishments catering to organize the activity of its own growth and fattening of animals, birds and rabbits for meat.
Article 13 the Ministry of agriculture and food industry together with the National Union of Agricultural Production Cooperatives and popular councils will take measures for carrying out regularisation programmes for breeding, wintering and accomplishment, the indices of breeding, as well as for the delivery of the rhythmic and weights are determined by law animals destined for sacrificarii.
It also will provide the basis of the feed by growing and using integral surfaces intended for fodder plants, crops, as well as grasslands and natural reînsămînţarea finetelor, harvesting, storage and use of forage resources in volume and plant by-products.
The Ministry of agriculture and food industry and the Central Union of consumption cooperatives are required to ensure, in accordance with the tasks laid down in the national plan unique pedigree material and hatching eggs cooperative consumer units. In addition, the Ministry of agriculture and food industry will provide the necessary technical assistance for organizing the activity of hatching and breeding cooperative consumer units.
Article 14 the Ministry of agriculture and food industry together with the National Union of Agricultural Production Cooperatives and popular councils are obliged to ensure that all agricultural enterprises, State and Socialist cooperative, keepers of farm land to implement the measures laid down for the use of all land and increase its production potential, its use with high efficiency of work force and material and technical base carry out all works in good condition are determined by technologies of agricultural production, to create programmes entirely to increase the agricultural production, plant and animal.
Failure to comply with the provisions of article 15 of this law shall entail, as appropriate, disciplinary, material liability, civil or criminal.
This law was adopted by the National Assembly at its meeting of 19 December 1980.
