Proposal for Resolution No. 35 /XI
This resolution approves the Protocol amending the Protocol Relating to the Provisions
Transitional annexed to the Treaty on European Union, to the Treaty on the Functioning of the
European Union and the Treaty which Institutes the European Atomic Energy Community.
Once the Lisbon Treaty came into force after the parliamentary elections
european that took place from 4 a to June 7, 2009, it is necessary now to adopt
transitional provisions relating to the composition of the European Parliament until the end of the
legislature 2009-2014, thus changing the above Protocol.
Under the Treaty of Lisbon, twelve Member States have, when compared to the
Treaty of Nice, a superior number of mandates.
This Protocol shall thus allow Member States whose number of
European MPs would have been higher if the Lisbon Treaty had entered into
vigour before the date of the European parliamentary elections of June 2009, have
of that number of additional seats, as well as proceed to the respective designation.
By establishing the creation of 18 additional seats, this Protocol elevates
provisionally the total number of MPs to 754 by the end of the legislature 2009-
2014, passing the European Parliament, after that period, to be counted with 750 Members
in addition to the President, in accordance with the new allocation grid provided for in the Treaty of
Lisbon.

Thus:
Under the terms of the paragraph d) of Article 197 (1) of the Constitution, the Government presents to the
Assembly of the Republic the following motion for a resolution:
Approve the Protocol Altering the Protocol Relating to Transitional Provisions, Annex
to the Treaty on the European Union, to the Treaty on the Functioning of the European Union and to the
Treaty which Institutes the European Atomic Energy Community, signed in Brussels, the
June 23, 2010, the text of which in the authenticated version in Portuguese language, publishes in
attachment.
