DECREE-LAW NO. 26/2010, OF March 30, WHICH " PROCEDE À

TENTH AMENDMENT TO DECREE-LAW NO. 555/99, OF 16 OF

DECEMBER, WHICH ESTABLISHES THE LEGAL REGIME OF URBANIZATION

And EDIFICATION, AND PROCEEDS TO THE FIRST AMENDMENT TO THE DECREE-LAW

No. 107/2009, OF May 15 "

The Decree-Law No. 26/2010, of March 30, published in the Journal of the Republic, 1 th

series, paragraph 62, of March 30, 2010 proceeds to the tenth amendment to the Decree-

Law No. 555/99 of December 16 laying down the legal regime for urbanization and

edification, and proceeds to the first amendment to Decree-Law 107/2009 of May 15.

The contents of the Decree-Law No. 26/2010 concretely in the numbers 8 and 9 of the

Article 13º, it introduces profound changes in the municipal licensing process of

technical facilities (where the gas and electricity installations are included). Among these

changes highlights the end of the mandatory evaluation of the " projects of the

specialties and other studies (...) when the project is accompanied by term of

liability underwritten by legally entitled project author technician ", well

as the end of the mandatory " survey, certification, approval or

opinion (...) on the compliance of the implementation of the projects of the specialties and other

studies ".

The procedures for the evaluation of gas and electricity projects and installations

achieved a degree of maturity that resulted in a clear increase in safety, well

as in a strengthening of the trust of citizens. Thus, the changes provided for in the Decree-

Law No. 26/2010 put into question Security and Trust currently achieved by

withdrawing mandatory assessment, by an external entity, of the

projects and their implementation.

In these terms, under the provisions of Article 162 (c) and Article 169 (c)

of the Constitution of the Portuguese Republic and still of Article 189 of the Rules of the

Assembly of the Republic, the Deputies and the Deputies below signed, of the Group

MP from the Left Bloc, come apply for Parliamentary Appreciation of the

Decree-Law No. 26/2010, of March 30, which " proceeds to the tenth amendment to the

Decree-Law No. 555/99 of December 16 laying down the legal regime of the

urbanization and edification, and proceeds to the first amendment to the Decree-Law

107/2009, of May 15 " .
