DRAFT law No. 295/XI/1st "Amendment to the law on organization and functioning of the services of the Assembly of the Republic (LOFAR) the situation that the country is in real emergency of public finances, making it even more important to an effective combat public deficit, which provides visible results already in 2010. Recently, the Government has undertaken, in Brussels, with the aim of achieving, earlier this year, a further reduction in the deficit of at least 1 p.p. of GDP given the commitments of the stability and growth program, which objective was clearly assumed in return for the decisions that the European Council and the European Central Bank took in defending the stability of the Euro and therefore in defense of economic and financial stability of countries such as Portugal. The PSD understands how vital that this additional deficit reduction target to be met by Portugal, but considers that, in order to ensure transparency and accuracy of implementation of measures, in particular expenditure reduction, which will be adopted to achieve deficit reduction, should be monitored monthly budget execution by an entity independent of Government in particular by the Technical Unit of budget support (UTAO), being strengthened its means with the use of State organizations. Further considers that, for the reduction of the public deficit is actually achieved so sustained, it is essential to ensure the commitment of the order of the use of public debudgetisation, and set tight limits the Central Government indebtedness, public companies and Regional and Local Administration. To this end, it is necessary to grant legal status to UTAO and predict the right this unit through the technical committee responsible financial and budgetary request any services and agencies of the Public Administration or any entities that integrate business and public sector all elements of financial information that lacks, and if these entities the duty to provide in a timely manner. Accordingly, the Assembly of the Republic decrees, pursuant to articles 164, subparagraph (d)), and 169, paragraph 2, of the Constitution, as follows: article 1 is added to the law on organization and functioning of the services of the Assembly of the Republic (Law No. 77/88, of July 1, as amended by laws Nos. 53/93, of 30 July, 72/93 , 30 November, 59/93, of 17 August, and no. 28/2003, of July 30) a new article 27-A, as follows: ' article 27-Technical Unit 1 budgetary support. The Technical Support Unit (UTAO) is a specialized unit that operates under the guidance of the Committee with competence in budgetary matters and by providing financial support for the preparation of studies and technical work documents on budgetary and financial management. 2. The UTAO must, in the exercise of their competences, act with strict impartiality and objectivity in obedience to technical criteria properly explained. 3. In the exercise of its powers, UTAO can, with the agreement of the Committee before which works, request any services and agencies of the Public Administration or any entities that integrate business and public sector all elements of financial information that lacks, but on those of the duty to provide in a timely manner.»
Article 2 the present law shall enter into force on the day following your publication in Diário da República.
