Draft resolution nº 69/XI before extending the period of public consultation of the dam of Fridão following a complaint to the European Commission presents several environmental associations, against the National Program of dams (PNBEPH) and its extensive impacts, that European institution ordered, an outside consultant and independent, a technical study of evaluation of that programme. This study was daredevil on how the PNBEPH sub-avaliou or omitted key parameters of measurement of impacts of construction and operation of new dams proposed, indicating the serious deficiencies and weaknesses of the program, according to what has been widely publicised, in particular with regard to the strategic assessment procedures and commitments undertaken by Portugal under the water framework directive and the targets to be achieved at the level of water quality. Was the confirmation, precisely, the criticism that the ENP and many Portuguese environmentalists associations made the PNBEPH tirelessly. Following this process, the Portuguese State, was notified by the European Commission, in order to provide an information set. According to stated by Mrs Minister of Environment the Portuguese State's response to this notification followed on 15 December to Brussels. For the purpose of information and parliamentary work, under the duty of monitoring the action of the Government, the Party "the Greens" requested the knowledge provided by the Portuguese State response to the notification referred to, knowledge that the Ministry of the environment and regional planning refused. The ENP considers this refusal serious, unacceptable and intolerable, and we understand that she demonstrates a lack of transparency and respect for the watchdog role of the Assembly of the Republic. We believe that the members concerned shall have access to such information and not be at the mercy of any general system of access to administrative documents. In addition to this fact, this inquiry procedure adds information not made available to citizens who, by all indications, is very relevant to the analysis of the environmental impact assessment processes, not understanding so how do continue to take place, as if nothing happened, documents concerning the implementation of the PNBEPH, fundamentally those that imply knowledge of the entire process on the part of the interested such as the acts of public consultation. Considering that this information is not only relevant to a better weighting of PNBEPH, as a whole, and will be, of course, to evaluate each of its specific proposals relating to each of the projects; Considering also that, until February 15, the public consultation of the study of Environmental Impact of the dam of the Fridão; Whereas the public consultation is the last opportunity for citizens and entities if speak about concrete venture formally; Whereas the result of the action of the European Commission's investigation, as well as the content of independent study may result in fundamental data for the assessment of the impacts of this dam. The Assembly of the Republic shall act under the constitutional provisions and regulations applicable, recommend to the Government: 1-That the public consultation on the environmental impact assessment of the dam of the Fridão be resumed and continues until 30 days after the conclusion of the results of the investigation by the European Commission. 2-to be sent to the answer that the Portuguese State gave following the notification of the European Commission, on the PNBEPH. 3-to be provided, the members, access to the independent study commissioned by the European Commission, which gave rise to the notification to the Portuguese State.
