Parliamentary Appraisal No 24 /XI/1ª

Decree-Law No. 207/2009 of August 31, which " proceeds to the amendment of the

Status of the Carrier Docent of the Personnel of Higher Education Polytechnic,

approved by Decree-Law No. 185/81 of July 1, as amended by the

Decree-Law No. 69/88, of March 3 "

The PSD advocates that the guiding principles set out in the set of changes,

now introduced by the Decree-Law No. 207/2009 of August 31 to the Statute of the

Career Docent of Polytechnic Education, represent a desired evolution and

necessary.

However, in addition to this general appreciation, the PSD considers that a subsist

problem that has not been properly considered in this review: the transitional regime of

careers.

In fact, there is a set of lecturers who are in a particular situation,

exercising faculty functions for dozens of years in the institutions, in conditions

precanceries, whose contracts have been periodic and repeatedly renewed, and that now if

see faced with a reality too pensive and unjust. In fact, the new

version of your Career Status does not adequately safeguard expectations

of these professionals.

These lecturers, who have filled permanent needs of the institutions where

they develop their work, they were victims of the deficiency of the opening of vacancies in

frames of these institutions.

It is thus a situation that, not to be corrected, becomes too much

penalizant in the face of expectations that were legitimately created.

There are legitimate expectations of these similar lecturers who should have been accommodated

by the government, when reviewing the Statute, being that they are in cause of expectations of

life that the system was generating and nurturing and that the institutions of polytechnic

have been benefitting.

It is, as such, of the recognition and respect for the work that has been developed

by the designated "riding lecturers" for years, or even decades, in the

Portuguese polytechnic institutes.

Considering that this situation should be corrected, since soon, in the name of

stability of the faculty of the Institutions of Polytechnic Higher Education, the

Lower-signed Members of the Parliamentary Group of the Social Democratic Party, to the

shelter from the provisions of Article 162º (c) and Article 169º of the Constitution of the

Portuguese Republic, and still of Article 189º of the Rules of the Assembly of the

Republic, come to apply for Parliamentary Appreciation of Decree Law No. 207/2009, of 31

of August, which " proceeds to the amendment of the Staff Career Status of the Personnel of the

Polytechnic Higher Education, approved by the Decree-Law No. 185/81 of July 1,

changed by Decree-Law No. 69/88, of March 3 ".
