1 PROPOSAL of law No. 221/X explanatory annex 1 to the Convention on International Civil Aviation, adopted by Decree-Law No. 36158, 17 February 1947, and ratified on 28 April 1948, which deals with the personnel licensing, although predicting the lower limit of age for the exercise of operational air traffic controllers (ATC) , does not provide the corresponding upper limit of age. This limit is, however, laid down in national law, in article 27 of the Statute of the air traffic controller, approved by Decree-Law No. 503/75, of 13 December. Initially of 52 years, is now, by virtue of the amendment introduced by Decree-Law No. 154/95, of 1 July, of 55 years. The constant technical and technological developments in equipment and systems to support the provision of air traffic services, which has brought a significant improvement of the working conditions of air traffic controllers, as well as the harmonization with the practice that has been occurring in other European countries, advise the new extension of the upper limit of age for the performance of operational functions by air traffic controllers. On the other hand, there are no technical or human reasons of operational safety justifying the maintenance of that age limit, for what the Government intends to proceed to amend the legal provision that imposes, setting this limit in 57 years and adjusting it to the current reality of the air traffic control sector. Finally, the increase in the age limit for the performance of operational functions by CTA 2 Portuguese will end with the situation currently verified that prevents them from exercising those functions in situations in which the CTA in other European countries, which already have carried out such an increase, they can do it. Was heard the Commission of workers of NAV Portugal E.P.E.,-, and the Trade Union Association of air traffic controllers. So: under d) of paragraph 1 of article 197 of the Constitution, the Government presents to the Assembly of the Republic the following Bill: Single Article amendment to Decree-Law No. 503/75 of 13 September the article 27 of Decree-Law No. 503/75 of 13 September, as amended by Decree-Law No. 154/95, of 1 July is replaced by the following: ' article 27 upper limit of age for the performance of operational functions the upper age for the exercise of operational functions is 57 years old.» Seen and approved by the Council of Ministers of 31 July 2008 the Prime Minister, the Minister of Parliamentary Affairs Minister Presidency
