FIRST AMENDMENT TO LAW NO. 79/98 OF November 24, WHICH

APPROVES THE FRAMEWORK OF THE REGION ' S BUDGET

AUTONOMOUS OF THE AZORES

EXHIBITION OF REASONS

The rules referring to the Budget of the Autonomous Region of the Azores, specifically in the

that refers to the procedures for the respective elaboration, discussion, approval,

implementation, amendment and surveillance and budgetary responsibility, as well as the rules

relating to the Account of the Region, they comply with the constant regime of Law No. 79/98, 24 of

November.

From the comparison of the above-mentioned Act with the Budget Framework Act of the

State and regime relating to the General Account of the State, approved by Law No. 91/2001, of 20

of August, amended and Republicaned by the Organic Law No. 2/2002 of August 28,

there is a divergence as to the deadlines for the submission of the Account of the

Region and General Account of the State to the regional and national parliament respectively,

for approval.

There is still a fact that there is a difference in the deadlines for issuing opinion by the

Court of Auditors as to the Account of the Region and to the General Account of the State.

The amendment of the scheme enshrined in Law No 79/98 of November 24 in what

concerne the deadlines for the submission of the Region Account, by the Regional Government, to the

Regional Section of the Azores of the Court of Auditors to appear and to the Assembly

Legislative of the Autonomous Region of the Azores for approval, justified by the facts

previously described, not only because it advises the existence of a homogeneity

of legal regimes in the performance of the state, as, too, because it will allow

welcoming the recommendations of the Court of Auditors conveyed in a timely way in the

respective opinion and correct, timely and in an effective manner, the negative points

eventually pointed out as to each Account of the Autonomous Region of the Azores, with

opportunity and swiftness.

The Legislative Assembly of the Autonomous Region of the Azores presents, in the terms of the

(f) of Article 227 (1) and Article 232º (1), both of the Constitution and of the

(b) of Article 31 (1) of the Critical-Administrative Status of the Region

Autonomous of the Azores, the following proposed law:

Article 1.

Subject

Articles 24º and 30 of Law No. 78/98 of November 24 are replaced by the wording

next:

" Article 24.

(Public accounts)

1. (...)

2. The Regional Government must publish quarterly provisional accounts 90 days after the term

of the quarter to which they relate and submit to the Legislative Assembly and to the Regional Section

of the Azores of the Court of Auditors the Account of the Region until June 30 of the following year

to the one who respects it.

3. The Legislative Assembly, after opinion of the Regional Section of the Azores of the Court

of Accounts, appreciates and approves the Account of the Region until December 31 following and, in the case

of non-approval, determines, if that there is place, the efectivation of the correspondent

responsibility.

2 - The Report and the account of the Legislative Assembly are submitted to the Regional Section

of the Court of Auditors until May 31 of the year following that which they relate to.

Article 2.

Legislative Assembly

In Law No. 74/98 of November 24, the reference to the Regional Legislative Assembly is

replaced by Legislative Assembly.

Article 3.

Entry into force

This diploma shall come into force on the immediate day when it is published.

Approved by the Legislative Assembly of the Autonomous Region of the Azores in the Horta in 6

of March 2007.
