DRAFT law No. 203/X explanatory statement Since 1997 that the Ota, as potential area of the new airport, is subject to preventive measures. The effectiveness of these preventive measures was justified by the need to prevent the change of circumstances in the potential installation of new Lisbon Airport, while developed work towards the realization of such an important project. Such preventive measures were imposed by Decree 42/97, of 21 August, extended by Decree No. 31-A/99, of 20 August. A few months later, the legislative authorization set out in article 12 of law No. 3-B/2000 of 4 April, enabled the Government to extend for a period of three years the preventive measures concerning the areas defined in tables A and B annexed to Decree No. 31-A/99, of 20 August. Under such legislative authorization, the Government set, by Decree-Law No. 170/2000 of 8 August, the extension for a period of three years, counted from August 22 2000, such preventive measures of soil occupation. Given that the period of validity of preventive measures would end on day 22 of August 2003, law No. 5/2003, of 27 February, enabled the Government to extend for a further period of three years the preventive measures concerning the areas defined in tables A and B annexed to Decree No. 31-A/99, of 20 August. Under such legislative authorization, the Government set, by Decree-Law No. 118/2003, of 14 June, the extension for a period of three years, counted from August 22 2003. The duration of such preventive measures was again extended by law No. 38/2006, of 17 August, under which those currently in force. It turns out by Council of Ministers resolution No. _ _ _/_ _ _, and following the study of the national laboratory of Civil Engineering, i. p. (LNEC) about the location of the firing range of Alcochete, understand the Government approving preliminarily the location of new Lisbon Airport in the firing range of Alcochete and fleeing the area of Ota as future zone Lisbon Airport installation 2 the changed circumstances that this preliminary decision represents enforces that if revoke immediately the preventive measures that still carry on that area, creating already new conditions for the development of that region, a new scenario, to which all those involved are called upon to contribute. The repeal of preventive measures is thus the respect for a commitment assumed by Government, publicly and a first step towards that, with the participation of all stakeholders, we can rethink the development of that important region of the country. So: under d) of paragraph 1 of article 197 of the Constitution, the Government presents to the Assembly of the Republic the following proposal of law: Article 1 subject-matter is abrogated law No. 38/2006, of 17 August. Article 2 entry into force this law shall enter into force on the day following your publication.
