1 MOTION for a RESOLUTION paragraph 62/X whereas trafficking in human beings constitutes a violation of human rights and an offence to the dignity and integrity of human beings, and may lead to a situation of slavery for victims; Recalling the statements of the Ministers for Foreign Affairs of the Member States on the occasion of the 112.ª (14:15 May 2003) and 114.ª (12 and 13 May 2004) sessions of the Committee of Ministers, calling for reinforced action by the Council of Europe in the field of trafficking in human beings; Bearing in mind the Convention for the protection of human rights and fundamental freedoms (1950) and its protocols; Taking into account the United Nations Convention against transnational organised crime and its additional protocol which aims to Prevent, Suppress and Punish Trafficking in persons, particularly women and children, with a view to strengthening the protection provided by these instruments and to develop the standards laid down therein; Given that this Convention is the most recent and comprehensive international legal instrument in this field, following the same strategy that other existing legal instruments, which aims to prevent and combat trafficking in human beings, protect victims ' rights, establishing a complete framework of protection and assistance, as well as ensure investigations and efficient procedures and promote international cooperation in this field;

So: under d) of paragraph 1 of article 197 of the Constitution, the Government presents to the Assembly of the Republic the following resolution: 2 article 1 Approves the Convention on action against trafficking in human beings the Council of Europe, opened for signature in Warsaw on 16 May 2005 and signed by Portugal in its opening date , the text of which, in the authentic version in the English and French languages, as well as their translation into Portuguese language, published in annex.

Article 2 pursuant to paragraph 2 of article 31 is formulated the following reservation: with regard to the powers laid down in points (a) to (d)) and article 31), the Portuguese Republic declares that it will not apply the jurisdiction rules established under the Portuguese criminal legislation establishing competence criteria more stringent and comprehensive than those provided for in points (a) referred to above. "
