DRAFT law No. 392/X amendment of article 65 of Act No. 98/97, of 26 August (in wording introduced by law No. 48/2006, of 29 August) Statement 1. Law No. 48/2006, of 29 August, has added to the article 65 of law No 98/97 of 26 August, a number that is expected to 7:00 pm: the first and second sections of the Court of Auditors may, therefore, be considered infringement liability only liable to financial penalty when this was paid voluntarily and:) ... b) ….. c) …..”
As can be seen, the transcribed rule contains a weakness which translates in do to require the voluntary payment of the fine when it was not previously set and, even if hypothetically could be fixed and paid, immediately cease to exist. There's no sense, therefore, the requirement referred to.
In these terms, it becomes necessary to your correction/modification, by eliminating the expression "this was paid voluntarily and" passing the wording of paragraph 7 of article 65 to be the following: the first and second sections of the Court of Auditors may, therefore, be considered infringement liability only liable to financial penalty when: 2 2 a) ... b) ….. c) …..”
2. Enjoy yourself, also, to clarify the value of the fine when the charge already has your payment in the previous phase of the trial, adding a new paragraph to article 65 (3).
