1 DRAFT RESOLUTION No. 224/X CONSTITUTION of the WORKING GROUP for the ELABORATION of a CODE of GOOD PRACTICE the Constitution of the Portuguese Republic has in your article 156 that a members ' powers is "asking questions to the Government about any acts of this or of public administration and get reply in a reasonable period of time" [paragraph (d))] and "request and obtain from the Government or any public body of the elements , information and publications as they may deem useful for the exercise of your mandate [subparagraph (e))]. For example, the current rules of procedure of the Assembly of the Republic establishes that the requirements must be answered "with the urgency of the question to justify". The use of various formulations by the Constitution and by the rules of procedure allows for different interpretations, rarely coincide, between Parliament and Government. Members of the Socialist Party, in your draft rules of procedure, a proposal to solve this issue. However, it is not only the time limit for replying to requests that require special care, also the quality of clarifications obtained need to be improved. There is often the formal compliance of the Constitution and of the rules of procedure, without resulting to satisfaction of the claim by Mr, so you see the best level to perform their duties. On the other hand, there is a certain trivialization in the use of applications, which, in certain cases and in view of your high number, gives rise to a real traffic jam in some offices. 2 these requirements not always feature concrete and objective questions or identify even the recipient, your just being sent to the Government. These repeated practices have contributed to the devaluation of the application while instrumental in controlling and monitoring the action and activity of the Government. In view of the foregoing, easily concludes by the need to create a working group to draw up a guide of good practice, which binds both the Assembly of the Republic, as the recipients of the requirements, including the Government.

Thus, the Members of the Socialist Party, the undersigned, in accordance with legal and constitutional regulations applicable, the following: draft resolution the Assembly of the Republic, in accordance with paragraph 5 of article 166 of the Constitution of the Portuguese Republic, solves the following: 1. The establishment of a working group, with multi-party composition to be decided in Conference of leaders, for the elaboration of a guide of good practices about the requirements and questions to the Government provided for in article 156 of the Constitution of the Portuguese Republic. 2. This working group aims to present proposals with a view to improving the preparation of requests and questions and the content of the answers. 3. This working group should submit a proposal for a best practice guide by the end of 2007, in order to be appreciated by the Assembly of the Republic, with a view to your eventual adoption. 4. It should also be recommended the adoption of the guide of good practice to the Government.
