On the basis of article. 5. 4 of the Act of 30 April 2004 procedure in matters of State aid (OJ 2007, # 59, item 404, as amended) are managed as follows: § 1. [Range] The regulation defines the form, content, timing and manner of issuing a certificate stating that the granted public aid is: 1) using the de minimis aid, hereinafter referred to as "certificate of de minimis aid", or 2) with the de minimis rule in agriculture or fisheries, hereinafter referred to as "certificate of de minimis aid in the agriculture or fishing."



§ 2. [Certificate of de minimis aid] 1. the de minimis aid certificate shall be drawn up in accordance with the model set out in annex 1 to the regulation.

2. Certificate of de minimis aid in the agriculture or fisheries shall be drawn up in accordance with the model set out in annex 2 to the regulation.

3. the Designs referred to in paragraph 1. 1 and 2, shall not apply in the case of the granting of public aid, which is using the de minimis rule or with the de minimis rule in agriculture or fisheries on the basis of a decision, if its content is that all of the items listed, respectively, in § 3 and § 3a.



§ 3. [Content of the de minimis aid] The de minimis aid certificate and certificate of de minimis aid in the agriculture or fishing includes: 1) the date of issue;

2) seal of the entity providing the aid;

3) employer identification number (ein), name and address of the granting authority;

4) employer identification number (ein), name and surname or the name and address of the place of residence or seat of the beneficiary of the de minimis aid or de minimis aid in the agriculture or fisheries;

5) grant aid;

6) the value of the gross aid in dollars and in euros;

7) an indication of the legal basis for the provision of assistance;

8) declare that, given the de minimis aid or with the de minimis rule in agriculture or fisheries;

9) information on the proper regulation of the European Commission regulating the acceptability of the provision of assistance of a de minimis aid, which apply to de minimis aid or de minimis aid in the agriculture or fisheries;

10) the person authorized to issue a certificate.



§ 3a. [Content of the de minimis aid] Certificate of de minimis aid, in addition to the information specified in § 3, includes: 1) in the case of de minimis aid applied partner partnership, explicit or partner or general partner of a limited partnership or limited liability partnership limited by shares which is not a shareholder, in connection with the activities carried out in the company-employer identification number (ein), name and surname or the name and address of the place of residence or registered office of the partner or general partner;

2) whether de minimis aid was granted for activities in the road freight transport sector;

3) in the case of de minimis aid granted in connection with the performance of the service of general economic interest – description of the service.



§ 4. [Issuance of a certificate of de minimis aid] 1. the de minimis aid certificate and certificate of de minimis aid in the agriculture or fishing, it seems from the Office on the date of grant of State aid which is using the de minimis rule or with the de minimis rule in agriculture or fishing, and in the case of aid: 1) granted on the basis of the decision, together with the decision on the date of its issue;

2) in the form of a tax credit granted on the basis of the normative act without the requirement of the decision, within 2 months from the date of the grant of public aid.

2. The beneficiary may apply for a certificate of de minimis aid or de minimis aid certificate in agriculture or fisheries before the expiry of the time limit referred to in paragraph 1. 1 point 2.



§ 5. [The provisions of the repealed] Loses power regulation of the Council of Ministers of 11 August 2004 on proof of de minimis aid (OJ No 187, poz. 1930).



§ 6. [Entry into force] This Regulation shall enter into force after the expiry of 7 days from the date of the notice.
