REGULATION OF THE MINISTER OF SOCIAL POLICY 1)

of 2 July 2004

on the determination of the scope of the data contained in the payment document transferred by the financial institution to the Social Insurance Institution

On the basis of art. 37 par. 6 of the Act of 20 April 2004. on individual pension accounts (Dz. U. No 116, item. 1205) the following shall be managed:

§ 1. The Regulation lays down the detailed scope of the data to be provided by the financial institution on the payment document in the event of the transfer to the Social Insurance Institution 30% of the sum of the basic contributions paid into the occupational pension scheme and the manner and mode of conversion of the amount of contributions provided on the basis of the benefit dimension.

§ 2. Whenever there is a regulation in the regulation:

1) financial institution-this shall be understood by the financial institution as defined in the Article. 2 point 10 of the Act of 20 April 2004. individual pension accounts;

2) branch of the Department-this must be understood by the field organisational unit of the Social Insurance Institution competent on account of the place of residence of the saver;

3) saving-this must be understood by the natural person referred to in art. 2 point 3 of the Act of 20 April 2004. individual pension accounts;

(4) the amount of the contribution, which is to be understood by 30% of the sum of the basic contributions paid into the occupational pension scheme.

§ 3. 1. The financial institution transferring to the Social Insurance Institution the amount of the contribution shall be given on the payment document "Payment of the transfer/cash payment", as follows:

1) in the field "name of the consignee"-the name of the branch office;

2) in the field "Recipient's account number"-the bank account number indicated by the branch of the Plant;

3. in the field "amount"-the amount of the contribution;

4. in the field "Account number of the payer"-the number of the bank account of the financial institution;

5. in the field "name of the principal"-name, tax identification number (NIP) and address of the financial institution;

6. in the field "title":

a) [ 1] name and surname, the PESEL number of the saver, and if the saver is not given the PESEL number, the series and the number of the identity card or passport shall be given,

b) the payment identifier-IKE.

2. The certified true copy of the payment document shall be sent by the financial institution to the saver by registered letter within 30 days from the date of termination of the IKE agreement, if the saver has not received the copy before the expiry of that time limit. for the endorsement of such a certified copy of the payment document.

§ 4. 1. The amount of the contribution shall be converted by dividing it by 19,52%. The resulting amount shall be rounded up to the nearest groszy.

2. The amount of the contribution subject to conversion shall be determined on the basis of the payment document referred to in § 3 (1). 1, attached by a saver to an application for retirement in the event of applying for an old-age pension, the amount of which according to the separate provisions is calculated from the base of the dimension.

3. The amount resulting from the conversion shall be taken into account when determining the basis for the assessment of the pension by counting that amount to the basis of the assessment of the pension insurance contributions for the month in which the amount of the contribution was transferred to the branch office.

§ 5. This Regulation shall enter into force on 1 September 2004.
