§ 1. Scope This regulation determines which live animals, other genetic material, animal waste, animal products and composite products from countries outside the European Economic Area, which will be conducted veterinary checks at a border inspection post or underlying control center.

§ 2. Definitions In this regulation be understood by:

A)

Structured products: foodstuffs destined for human consumption and that contains both processed products of animal origin and products of plant origin, including products where the processing of the raw material is an integral part of the production of the final product.

B)

Processed products: products as defined in Regulation 22 December 2008 no. 1624 on specific hygiene rules for food of animal origin (animaliehygieneforskriften) § 1, ref. Regulation (EC) No. 853/2004 Annex I, Section 7 || |
C)

Meat products which are defined in animaliehygieneforskriften § 1, ref. Regulation (EC) No. 853/2004 Annex I, Section 7.1.

D)

Dairy products which are defined in animaliehygieneforskriften § 1, ref. Regulation (EC) No. 853/2004 Annex I, Section 7.2.

§ 3. Veterinary border control of animals and products listed in Annex I for animals and products etc. listed in Annex I to this Regulation shall be conducted veterinary checks at a border inspection post or underlying control center for the following provisions of the Regulations on 18 October 1999 no. 1163 on the supervision and control on the import and transit etc. of animal products and products of animal origin, etc. from third countries and Regulation of 31 December 1998 no. 1484 on the supervision and control on the import and export of live animals, other breeding stock and animal waste in the Community, and imports of live animals from third countries.
Identification of animals and products which will be conducted veterinary checks of as specified by the codes in column 1 and 2 of Annex I bounded closer according to the specific text or reference to the relevant provisions of the Annex, column 4.

§ 4. Veterinary border structured products following composite products must undergo veterinary checks at a border inspection post or underlying control center:

A)
composite products containing processed meat products,

B)
composite products where at least half of the content consists of one or more processed products of animal origin, which is not a processed meat product,

C)
composite products containing no processed meat products, and where less than half the contents consist of a processed milk product, if the final products do not meet the requirements of § 6

§ 5. (Repealed)

§ 6. The requirement of veterinary checks for certain composite products and foodstuffs for the following composite products and foodstuffs that do not contain meat products shall not be implemented veterinary legislation as set out in § 4:

A)

Composite products where less than half of the product is composed of other processed products, and product:

1)
is durable at room temperature, or is cooked through or fully heat treated so that all ingredients are denatured,

2)
are clearly marked as destined for human consumption

3)
is packaged or sealed in clean containers and

4)
accompanied by a commercial document and labeled in an official language of the EEA country so that document and labeling together give information on the nature, quantity, number of packages of composite product, country of origin, manufacturer and ingredients.

B)
Structured products and foodstuffs listed in Annex II.

However, milk products contained in composite products, comply with the treatment and come from the states that the regulations 11. March 2013 no. 269 on animal and public health conditions for imports, transit and temporary storage of milk and milk products from third countries § 2, ref. Regulation (EC). 605/2010 Annex I.

§ 7. Inspection and decisions FSA supervises and may make the necessary decisions,. Food Act § 23, to achieve compliance with the provisions laid down in or pursuant to these regulations. The Authority can also issue individual decisions pursuant to the Food Act § 24 to § 26

§ 8. Dispensation FSA may in special cases grant exemptions from the provisions of this regulation, provided that it does not conflict with Norway's international obligations, including the EEA agreement.

§ 9. Penalties Contravention of the provisions of these regulations or decisions made pursuant to these regulations is punishable under the Food Act § 28

§ 10. Entry into force These regulations enter into force immediately.

Appendix I. List of live animals and products, which will be conducted veterinary checks of

This list indicated animals and products in accordance with applicable Goods Nomenclature of the European Union to determine the selection of the consignments to undergo veterinary checks at a border inspection post.
Norwegian customs positions specified in column 2 for the corresponding EU customs codes. There is, however, scope and interpretation of EU customs codes that are essential in cases where there is a mismatch between the Norwegian customs positions and EU customs codes.
Notes to table:
1. General remarks
These general remarks are added to certain chapters to clarify which animals or products covered by the relevant chapter. Moreover, there is necessary to the specific requirements laid down in the fourth column "conditions for the import and transit" in the various tables set out in Annex XIII and XIV to Regulation (EU) No. 142 / 2011.5 likewise as in column 4 of this list.
2. Note to Chapter
These notes to the chapters are explanations, as required in the form of excerpts from the comments on the individual chapters of the Combined Nomenclature (CN) as laid down in Annex I to Regulation (EEC) No. 2658/87.
3. Excerpt from the explanatory notes to the harmonized system
Additional information on the different chapters are required been extracted from the World Customs Organization's explanatory notes to the harmonized system from 2007.
4. Column 1 - CN code
This column indicated the EU customs codes CN codes. KN, introduced by Regulation (EEC) No. 2658/87, is based on the international harmonized system of description and coding of goods (HS) drawn up by the Customs Cooperation Council, now the World Customs Organization and adopted by the international convention signed in Brussels 14 June 1983 and approved on behalf of the European economic community by Council decision 87/369 / EØF1 ( "HS Convention"). KN renders positions and subheadings in the HS six digits, while the seventh and eighth century used to create further subheadings which are specific to the system.
If a four-digit code used: Unless otherwise specified, all products with this four-digit code or a code starting with these four digits, undergo veterinary checks at a border inspection post. In most of these cases, the relevant CN codes in TRACES system, introduced by Decision 2004/292 / EC, divided on six- or eight-digit level.
When only certain products falling under a code with four, six or eight digits shall undergo veterinary checks, and there is no separate section of this code in KN, the code by "Ex" (for example Ex 3002: it only required veterinary checks for animal derived material, including on straw, and not everything that heading, subheading or CN code covers). The relevant codes are also listed in the TRACES system.
5. Column 2 - Norwegian customs position

This column specifies the Norwegian customs positions corresponding EU customs codes. The Norwegian customs positions must be seen in light of EU customs codes in column 1. Where there is no agreement between the Norwegian customs positions and EU customs codes, EU customs codes decisive.
6. Column 3 - Product Description
This column specified item descriptions as they appear in the Norwegian customs tariff, except for chapter 99 where it stated descriptions of EU Goods Nomenclature KN.
7. Column 4 - Qualification and explanation
This column gives details of the relevant animals and products.
In the description of the animals and products covered is shown to Norwegian customs positions. Further information on the animals or products covered by the different chapters of EU Goods Nomenclature CN, found in the latest version of the explanatory notes to the European Union combined nomenklatur.2 An up to date information can be found in the latest amendment or consolidated version of these explanatory notes .
For certain live animals (such as reptiles, amphibians, insects, worms or other invertebrates) and certain animal products, it is currently not entered into any special import conditions for the Union, and there are at the present time, therefore, no harmonized import certificates.
The conditions for import of live animals that are not provided for in other regulations in the Union, however covered by regulation 20 February 2004 No.. 464 on animal health conditions for imports and exports of live animals, semen, ova and embryo.3 For such animals also get national rules on the documentation accompanying such consignments apply. Government veterinarians must examine the consignments and issue a Common Veterinary Document for imports (CVED) to show that it is carried out veterinary checks, and that the animals may be released for free circulation.
Products derived from animal by-products covered by Regulation (EC) No. 1069/20096 and Regulation (EU) No. 142 / 2011.5 is not stipulated in Union law. Veterinary checks shall be made of the products that are partly processed but still raw, that will later be processed in an approved or registered activities at the destination.
Government veterinarians at border inspection posts must needed to evaluate and specify whether a derived product is sufficiently processed to no longer require the veterinary checks laid down in Union legislation.

Chapter 4 milk and dairy products, bird eggs, natural honey and edible products of animal origin not specified or included elsewhere

Notes to Chapter 4

1. By "milk" is meant whole milk or totally or partially skimmed milk.

2. Under CN code 0405 apply:

A)

"Butter" natural butter, myssmør or recombined butter (fresh, salted or rancid, including butter in hermetically sealed containers), exclusively made from milk, with a milkfat content of 80 weight percent or more but not exceeding 95 percent by weight, with a content fat-free milk solids of at most 2 percent by weight and having a water content of 16 weight percent. Butter does not contain added emulsifiers, but may contain sodium chloride, colorants for use in foodstuffs, neutralizing and cultures of harmless lactic acid producing bacteria,

B)
'spreadable milk fat products »spreadable emulsion of the water in oil containing milkfat as the only fat ingredient in the product, with a milkfat content is at least 39 percent by weight, but less than 80 percent by weight.

3. Products derived from whey concentration and added milk or milk fat are to be classified as cheese in CN code 0406, provided that they have the following three features:

A)
a milk fat content calculated on the dry matter of at least 5 weight percent,

B)
a solids content of at least 70 weight percent, but not exceeding 85 weight percent, and

C)
they are formed or can be formed.

4. This chapter does not cover:

A)
products derived from whey, which contains more than 95 weight percent lactose, expressed as anhydrous lactose, calculated on the dry substance (CN code 1702) or

B)
albumins (including concentrates of two or more whey proteins, containing weight more than 80 percent whey proteins, calculated on the dry matter) (CN code 3502) or globulins (CN code 3504).

Excerpt from the explanatory notes to the harmonized system
CN code 0408 includes whole eggs without shell and egg yolks of all birds. Products falling within this code, may be fresh, dried, cooked by steaming or boiling in water, molded (eg. Cylindrical "long eggs"), frozen or otherwise preserved. All these fall under the code whether they are added sugar or other sweetener, and whether they are intended for human consumption or for industrial use (eg. Tanning).
This code does not include:

A)
Eggolje (CN code 1506).

B)
Cooked eggs containing condiments, spices or other additives (CN code 2106).

C)
Lecithin (CN code 2923).

Excerpt from the explanatory notes to the harmonized system
CN code 0409 covers honey produced by bees (Apis mellifera) or by other insects, and who is hurled, in boards or pieces of boards, provided that it is neither added sugar or other substances. Such honey may be designated by the flower it originated, origin or color.
CN code 0409 excludes artificial honey and mixtures of natural and artificial honey (CN code 1702).

Position exists only in KN and are not used in Norway. Norway classifies such deliveries by what they contain. These deliveries will therefore go under other headings in the Norwegian customs tariff, depending on the content of the parcel.
