Short Title
Regulations on fees for veterinary controls

Adopted of Fisheries and Coastal Affairs, the Ministry of Health and Agriculture and Food 3 March 2010, pursuant to the Act of 19 December 2003 no. 124 relating to food production and food safety. (Food Act) § 21, cf.. Delegated Decision of 19 December 2003 no. 1790.

§ 1. Scope These regulations apply to imports and transit etc. in Norway of live animals, animal products and other products of animal origin, etc. from third countries, cf.

A)
Regulation on 18 October 1999 no. 1163 on the supervision and control on the import and transit etc. of animal products and products of animal origin, etc. from third countries and

B)
Regulation of 31 December 1998 no. 1484 on the supervision and control of imports and exports of live animals, other breeding stock and animal waste in the Community, and the import of live animals from countries outside the EEA.

§ 2. The obligation to pay fees importer shall pay a fee for veterinary checks in accordance with these regulations. A fee shall also be paid if the supervision and control has resulted in the rejection or destruction of the consignment.
The payment shall be made prior to customs clearance, transit or hospitalization in a customs warehouse or as a result of decisions on rejection or destruction. Alternatively, the importer provide security for payment of the fee.

§ 3. Fees for foodstuffs and products for imports of animal products, other products of animal origin and hay and straw must be paid

A)
£ 2,200 - per consignment or shipment and

B)
£ 73.90 per tonne for fish and fishery products, complete food for fish, animal products, nonfood, as well as hay and straw, or

C)
£ 0.74 per kg for other food than fish and fishery products or

D)
£ 17.65 per tonne of fishmeal or

E)
£ 14.68 per tonne of fish oil and oil for marine mammals.

For imports of very small consignments or shipments paid instead kr 1470, - per consignment or shipment.

§ 4. Fees for live animals for importation of live animals shall be paid

A)
£ 2200, - per shipment and

B)
NOK 76, - per ton of cattle, equines, swine, sheep, goats, poultry, rabbits, small game birds, small ground game, wild boar or ruminants.

For imports of very small shipments paid instead kr 1470, - per shipment.

§ 5. fee for transit, transhipment and re-import Upon transit of consignment or shipment shall, instead of the fee in accordance with § 3 and § 4, payable

A)
£ 735, - per consignment or shipment and

B)
£ 245, - for each commenced quarter for each of the Food Safety Authority employees involved in control of the consignment or shipment.

By transshipment of consignment or shipment shall be paid

A)
£ 190, - for each commenced quarter,

B)
if the FSA must make document control, NOK 735, - or

C)
if FSA must submit the consignment or shipment finally veterinary checks fee in accordance with § 3 and § 4

By re-importation of products and live animals which are rejected by the third country, the importer or his agent to pay a fee in accordance with § 3 and § 4

§ 6. Overtime Fee Required verification is carried out between the hours. 8:00 and 15:30 and this is not due to conditions at the border inspection shall be in addition to the fees set out in § 3 through § 5 payable

A)
£ 285, - for each started hour on weekdays between the hours. 6:00 and 08:00 and between 15:30 and 21.00 or

B)
£ 570, - for each started hour on weekdays between the hours. 21:00 and 06:00 and on Saturdays, Sundays and public public holidays.


§ 7. Wait fee Can control is not carried out at the time that is pre-reviewed and this means waiting for the Food Safety Authority personnel, and this is neither due to circumstances at the border inspection or force majeure on the importer side, shall be paid

A)
£ 735, - for each commenced hour of delay on weekdays between the hours. 08.00 15.30 or

B)
£ 985, - for each commenced hour of delay on weekdays between the hours. 6:00 and 08:00 and between the hours. 15.30 and 21.00 or

C)
£ 1265, - for each commenced hour of delay on weekdays between the hours. 21:00 and 06:00 and on Saturdays, Sundays and public public holidays.

§ 8. Copy fee for each certified copy of the original CVED being issued by the FSA, is NOK 340, -. With CVED means the common veterinary documents for imports, as set out in regulation 30 November 2005 no. 1347 on the implementation of Regulation (EC) No. 136/2004 laying down the procedures for veterinary checks at EEA border inspection posts on imports of products from third countries or regulation 30 november 2005 no. 1348 on the implementation of Regulation (EC) no. 282/2004 concerning the introduction of a document for the declaration and veterinary checks of live animals imported into the Community from third countries.

§ 9. Exemption FSA may in special cases grant exemptions from the provisions of this regulation, provided that it does not conflict with Norway's international obligations, including the EEA agreement.

§ 10. Entry into force These regulations enter into force immediately.
From the same date, the Regulations on 20 January 2000 no. 47 on fees for inspection and control of imports and transit etc. of live animals, animal products and products of animal origin, etc. from third countries.
