Regulation on conditions for entitlement to benefits

Adopted by Labour on 20 December 2010 pursuant to Act 28 July 1949 No.. 26 Public Service Pension Fund § 44, tenth paragraph, Law 26 June 1953 No.. 11 concerning pension scheme for pharmacy operations, etc. § 26, Law 22 June 1962 No.. 12 a pension scheme for nurses § 36 third paragraph and the Act of 16 December 2011 No.. 60 regarding a pension plan for members of parliament and government officials (parliamentary and government pension law) § 8-5 fifth paragraph.

§ 1. Scope These regulations apply when entitlement to old age, disability, widow and widower pensions and child pensions from the occupational scheme. For retirement regulations apply from age 67.

§ 2. Relations with other social security benefits for entitlement to a pension as mentioned in § 1, it is a condition that the member submit your application for the benefits which the person is entitled under the Insurance Act. The occupational pension scheme gives an order to put forward such a claim within a certain time limit. From the age of 67 can only retirement pension and disability pension when they have old age pension after at least equivalent degree.
When occupational scheme has received claims for pension scheme could assume that it is submitted claims for social security benefits within the prescribed period and pay a reduced performance, see Act of 6 July 1957 No.. 26 on the coordination of pension and insurance benefits § 1.

§ 3. Reimbursement from the National Insurance occupational pension scheme may claim overpaid pension refund from the State.

§ 4. Commencement This Regulation shall enter into force on 1 January 2011. From the same date, the Regulations on 18 November 1996 no. 1062 concerning the conditions for entitlement to benefits under the Act on pension for nurses when entitlement to benefits under the Act on Insurance and regulation 18 november 1996 no. 1084 concerning the conditions for entitlement to benefits under the Act on the state pension Fund and by certain other laws when entitlement to benefits under the National Insurance Act.
