Chapter 1 General provisions

§ 1-1. Purpose reindeer Development Fund shall be through the use of economic instruments to promote the development of reindeer husbandry in accordance with the reindeer policy objectives. Economic constraints and parameters in general is determined in connection with Parliament's treatment of propositions about the reindeer herding agreement and the annual state budget.

§ 1-2. The Board of reindeer Utviklingsfond reindeer Development Fund is managed by a board of four members. The Board shall be appointed for two years. Agriculture and Food appoints two members and two alternates. Norwegian Reindriftssamers Association appoints two members and two alternates.
Fund Board disposes of a share of the reindeer Development Fund's total appropriation.
Agriculture Directorate secretariat for the Fund Board. Agriculture Directorate is also manager of the reindeer Development Fund and pays from the fund to the various grant recipients.

§ 1-3. Financial constraints reindeer Development Fund financed as part of the reindeer herding agreement. Legal basis for Fund Board grants and Agriculture Directorate subsidy payments recovered annually in the allocation letter from Agriculture and Food. Fund Board may refuse applications for financial support from the fund's financial situation. Fund Board shall be in accordance with Financial Management Regulations for the State.
Fund Board may issue guidelines and may stipulate the rates of support for individual schemes under the fund. Fund Board may issue lower limits for expenditure items which are entitled to subsidies.

§ 1-4. Reporting financial statements for the Fund is contained in Agriculture Directorate annual report presented as of March 15 each year.
Accounts are on a cash basis and the Auditor General is the auditor.
Fund Board shall report annually on its activities to the Ministry of Agriculture. The report shall include accounting for last year compared with budget and prior year financial statements, as well as a professional evaluation of the business by March 15 each year.

§ 1-5. Scope Financial support from reindeer Development Fund can be granted as grants or loans for schemes

Support the extensive reindeer lost in accidents, cf. Chapter 3,

2.
Husbandry equipment, including fences and slaughterhouses, ref. Section 4

3.
Reimbursement of documented expenses for participation in courses / training and the like herders, cf. Chapter 5,

4.
Grants for field nursery, cf. Chapter 6.

Financial aid may otherwise be granted for other measures in compliance with purpose, cf. § 1-1, including

A.
Market promotion,

B.
Hedge husbandry grazing rights, including support in the districts working to secure the reindeer husbandry areas,

C.
Practical measures within reindeer husbandry, including the transport of caribou and conflict prevention,

D.
Implementation of structural measures in districts in need of measures reindeer population adaptation and resource

E.
Disciplinary measures for the promotion of reindeer husbandry, including tutoring, courses, grazing investigation, planning and avlstiltak,

F.
Certificate scheme in husbandry,

G.
Development of binary units and purposes of general cultural importance for reindeer herders,

H.
Measures to promote gender equality and women's situation in reindeer herding,

In.
Facilitation of 1-2 day competence courses / training,

J.
Support for measures reindeer industry as a result of climate-induced changes.

K.
Research and knowledge dissemination.


§ 1-6. Common Terms A condition for support from reindeer Utviklingsfond that the measure promotes reindeer husbandry in the district and area. Where applicable, the measure must be assessed in relation to the effect it has on pasture wear and environment in general.
It is further assumed that the activities supported is in compliance with the prevailing laws and regulations.

§ 1-7. Application requirements Applications for grants from reindeer Development Fund should be sent to the Agriculture Directorate within any specified time limit.
If the Board of reindeer Development Fund has developed its own application form, these should be used. Required documentation must accompany the application.

§ 1-8. Procedural and control application will be decided by the Agricultural Directorate, which submits recommendations to the Board of reindeer Development Fund. Agriculture Directorate shall assess whether the area board / district board should be heard first.
Application decided by the Fund Board. It may set further conditions for support in the grant decision. By vote, the head casting vote. Fund Board may delegate decision-making authority to the Agriculture Directorate.
Agriculture Directorate assigns support for payment in accordance with the grant decision.
Fund Board may require all or part of the aid capped or repaid, possibly bringing the loan to maturity, if the key assumptions for the support turns out not to be true.

§ 1-9. Appeals Decisions pursuant to these regulations may be appealed to the Ministry of Agriculture for Administration Act.

Chapter 2. (Repealed)

Chapter 3. Support the extensive reindeer lost in accidents

§ 3-1. Definitions accident are in this chapter an unpredictable and acute incident, leading to a greater number of reindeer killed and who does not with reasonable effort could have been prevented by Herder. Examples might include drowning, avalanches, belching and acute disease outbreaks.
Losses caused by locked pastures, dilapidated pastures, low harvest withdrawal or of predators is not regarded as an accident of this chapter.
With operation in this regulation means the period from 1 April 2015 to 31 March 2016.

§ 3-2. Terms of support Support can be granted to individual siida share / tamreinlag if the following conditions are met:

A.
Loss is due to pure accident, cf. § 3-1,

B.
Loss is not replaced over other schemes,

C.
Number of lost reindeer in the same incident constitutes at least 10% of the herd's size before the loss. It can independently of this support is given when the loss exceeds 150 reindeer. It is not granted support for loss of less than 10 reindeer. With the crowd before the loss meant reindeer numbers at last publicly controlled counting. If such counting is not conducted last year of operation, added the number of reindeer in recent notification reindeer basis,

D.
Lost reindeer under subparagraph c approved documented, ref. § 3-3,

E.
Siida share / reindeer team has announced the loss immediately to the county governor and district control,

F.
Siida share / reindeer team implemented all necessary measures to prevent / minimize the loss,

G.
Siida proportion has received operating / produksjonstilskudd1 in at least one of the preceding three years of operation,

H.
Siida share has a number of reindeer that triggers the right to grant the operating year after regulations on subsidies for one's interests and tamreinlag § 2a, second paragraph.

§ 3-3. Documentation county governor, veterinary, public supervision authority or representative of one of these to document the number of lost animals through inspection and inventory of the carcass.
Loss in avalanches, documentation of cadaver made after snowmelt. § 3-4. Calculation of support The board establishes detailed guidelines for the calculation of support.
It should be deducting an excess of NOK 10 000, -.

§ 3-5. Particular requirements for the application Applications for funding by extensive reindeer lost in accidents must be sent as soon as possible and no later than 6 months after the accident occurred.
The application shall contain at least

A.
Overview of the number of lost animals, broken down by gender and age (over 2 years, 1-2 years, calf)

B.
Cadaver documentation, ref. § 3-3,

C.
Description of events until the loss,

D.
Description of measures implemented to prevent / minimize the loss.


§ 3-6. Specifically curtailment, advance payment and control board for reindeer Development Fund may refuse or curtail support if seeking

A.
Provided incorrect information in the application,

B.
Have not completed required count of the herd,

C.
Have not implemented satisfactory notification and loss prevention / mitigation measures.

In clear-cut cases can Directorate of Agriculture designate disbursed an advance of up to 50% of the amount expected to be disbursed in support for complete processing of an application.

Chapter 4. Grants for reindeer construction

§ 4-1. Definitions husbandry installations means slaughterhouses and permanent gjerder- / plant.
With grant basis are in this chapter subsidized costs. This includes material costs (with wall fixtures), transportation, special work and own work. The hourly rate for their own work is £ 150. Individual work can not exceed 50% of the subsidy basis.
In special cases, including the construction of larger plants, you hired consultancy included in the grant documents. By harvesting and fence construction can also cost of road / parking and water / wastewater depth. As special work considered elektriker-, plumbing and other work, which according to existing regulations requiring particular expertise.

§ 4-2. Terms of subsidies Subsidies to husbandry facility can be granted to siida share, siida, reindeer grazing and tamreinlag.
Grants are provided only to husbandry equipment described in approved use rules and elaborate regional plans.
Siida Shares applying for grants under this Regulation must meet the terms of the regulations regarding grants for one's interests and tamreinlag § 2a. Reindeer grazing applying for grants under this Regulation must meet the terms of the regulations on subsidies for reindeer grazing districts and tamreinlag § 2.
Subsidies should only be granted to new investments / new construction, expansions or major modifications.
Grants will not be awarded to husbandry facility that is commenced or completed before the application is submitted.
Costs of maintenance and costs of removable and temporary fences and plants are not subsidized costs, ref. § 5-1. Grants may nevertheless be granted demolition by other reindeer facility where ownership or responsibility is unknown. Grants for fences that conflict prevention between reindeer and other affected part1 not covered by this scheme.

§ 4-3. Calculation of grants To husbandry facilities is calculated supplementation with a fixed share of the subsidy basis, cf. § 4-1. Grants for reindeer construction of up to 35% of grants basis when seeking is siida share / siida and up to 50% when the applicant is a reindeer grazing / tamreinlag, fellesbeite district or at least two districts / tamreinlag jointly. For slaughterhouses that are clearly separated from other plants account subsidy up to 25% of grant basis. Lower limit for grants the foundation is set at NOK 20 000.
costs not included in the grant basis, cf. § 4-1, shall nevertheless be included in the cost overview, cf. § 4-4 second paragraph.
Contribution basis calculated from net material costs (excluding VAT).
In addition to grants can fund board grant loans to husbandry facility capped at 0.7 million. Such loans shall be granted only within the current budgetary constraints.
It may in special circumstances exception to this is the first paragraph.

§ 4-4. Particular requirements for the application as appendices to grant application to husbandry equipment required entry permit specified cost overview for all cost groups, real financing plan and targeted plan of the facility. For the construction / reconstruction / expansion of the slaughterhouse shall be a specific business plan for at least three years exist and necessary government approvals. More husbandry facilities that form a whole can be collected in one application, but the cost is assumed as specified in the appendix to the application.

§ 4-5. Particularly for payment, control and reporting As a rule, payment shall be made in arrears. Agriculture Directorate may, upon application, assign up to 50% of the grant payable in advance relative to the installation progress.
The subsidy paid by the Agriculture Directorate. Furthermore, the applicant must produce a report on how the funds are used through the accounts and whether any special conditions are met within one year after completion of the plant.

Chapter 5. Reimbursement of course fees

§ 5-1. Conditions for reimbursement Herders can get reimbursed expenses for course fees, travel and accommodation in connection with courses / training.

For the refund to be granted must leader / managers of siida share or tamreinlag documenting a taxable sales income from the sale of meat from reindeer in a separate notice of at least £ 50,000 excluding VAT.
Rein owner must also have reindeer in private label and course / continuing education will have as objective to acquire and / or develop husbandry practitioner expertise to the exercise of reindeer.

§ 5-2. Calculation of support Expenses for courses / training can be refunded with 50% of proven costs, up to £ 6000 per year.

§ 5-3. Application requirements Applications for reimbursement must be submitted reindeer Development Fund within 6 months after course completion. As an appendix to the application submitted the documentation Directorate of Agriculture requires.

Chapter 6. Grants for field nursery

§ 6-1. Purpose The purpose of the grant is to facilitate that several of the family can participate in larger husbandry activities in the reindeer grazing district, summer siida or reindeer team, and to build knowledge among children on these activities.

§ 6-2. Definitions field nursery means organized and time-limited passports of children under school age in relation to periods of herding activities. How childcare must include personalized training activities in reindeer husbandry.

§ 6-3. Terms of subsidies for field kindergarten Support for children in kindergarten field may be granted to reindeer grazing, summer siida or tamreinlag for up to 3 weeks pr. years in connection with major husbandry activities.
Support for children in kindergarten field may be granted until the month the child starts school.

§ 6-4. The amount of support for children over three years provided the grant to $ 1,000 per. children pr. week.
For children under three years provided grants to $ 2,000 per. children pr. week.

§ 6-5. Application and deadline Applications must be submitted Directorate of Agriculture no later than two weeks before herding activity will be conducted. Applicants must use the application form prescribed by the Agricultural Directorate.
Applicant must state who engaged Children passport and the name of the child covered. Agreement with childminder must be attached.
It must state which activities that children should participate in, and start and end dates for field nursery.

§ 6-6. Duty of disclosure and control Recipients of grants under these regulations is obliged to provide all information that reindeer authorities consider necessary in order to administer the grant.
Reindeer authorities may undertake on-site inspection at the recipient.

§ 6-7. Correction of errors payments Reindeer authorities may correct errors in disbursed grants, either by post-payment or claim for repayment of subsidies from the grant recipient.

§ 6-8. Curtailment and retention If the grant recipient negligently provided incorrect or incomplete information in the application, which has or would formed the basis for a wrongful payment of the grant, all or part of the subsidy reduced.
If the grant recipient under Reindeer authorities decision driver or have operated in violation of laws or regulations for the reindeer industry, and it is negligence, all or part of the grant be withheld until the situation is rectified. Is it in the contravention of the regulations of gross negligence or willful misconduct, the whole or part of the subsidy reduced.

§ 6-9. Collection of repayment or curtailment amount difference between the amount paid and justified subsidies resulting from recovery decision under § 7.6 or curtailment under § 6-8, can be recovered from the recipient or offset in subsequent grant payments.
Requirements of funding bodies arising from the arrangements of the reindeer herding agreement can be offset in subsidy payments to the recipient.
If the recipient was not in good faith about the payout may interest required from the time the repayment requirement has reached the recipient. By gross negligence or willful misconduct, interest is required from the time of payment of the unlawful grant. The rate of interest shall be equal to the interest rate at any given time is determined by the Ministry in accordance with § 3 of Law 17 December 1976 no. 100 relating to interest on overdue payments

Chapter 7. Commencement

§ 7-1. Entry into force This regulation comes into force on 1 July 2011. repealed on 14 June 2010 No.. 885 for reindeer Development Fund.
