Chapter 1. Initial provisions § 1. Purpose the regulation should contribute to increased production of electric energy from renewable energy sources.

§ 2. The scope of the regulation with the corresponding attachment applies on Norwegian territory.

§ 3. Definitions in the regulations here be understood with: a) elsertifikat: a proof issued by the State that it's produced a megawattime (MWh) renewable electric energy according to the law on elsertifikater and this regulation.

b) elsertifikatberettiget: the holder of a production facility that has the right to elsertifikater if the terms of Chapter 2 of the law on elsertifikater and this regulation are met.

c) elsertifikatplikt: the duty of per 1. April every year to hold a certain number of certificates for cancellation according to the law on elsertifikater and this regulation.

d) renewable share: the part of the innmatet energy in a plant that is renewable energy and thus the basis for allocation of elsertifikater.

e) production facility: a facility for the production of electrical energy.

f) registry responsible: the entity that is designated as responsible for issuing elsertifikater, as well as develop and operate an online registry for elsertifikater.

g) allocation factor: the part of a fixed total production of electrical energy that qualify for the right to elsertifikater.

h) settlement responsible: the who, according to the energy law section 4-3 is designated as subject to responsible.

The production facility must in addition: a) be in accordance with the current licence, the licensing conditions or prerequisites for exemption for licensing, b) is placed in service by 31. December 2021, and c) have paid back any State investment support, with interest as provided by NVE, within 30. April 2012.

In production facilities that qualify for the right to elsertifikater it will exclusively be assigned to elsertifikater for the part of the production plant that has been put into operation by 31. December 2021.

§ 10. Requirements for documentation of the build start application for approval under section 6 shall contain documentation of the construction starts by the presentation of at least one of the following: a) message to the Labour Inspectorate for the start of construction work, b) approved detail plan from NVE, c) contract for the delivery of machine-and elektroutstyr, which together correspond to at least 20 percent of the total construction cost, or d) contract for all or part of the construction work , which together correspond to at least 20 percent of the total build cost.

Appendix 1. Content in the application for the approval of the production facilities as elsertifikatberettiget the following information shall be given in the application for approval: 1. Type of application (authentication for the entire production, approval for the parts of the production and/or approval of the production plants with variable renewable share).

2. Information about the holder of the production plant (name/company, VAT registration number, ownership structure, address, etc.).

4. Information about the production facility (name, type of facility, annual production, installed power, locality).

5. Documentation of the build start and/or commissioning.

Rebuilding and upgrading of existing thermal production facilities Existing thermal production facilities that produce electric energy based on renewable sources of energy and that is upgraded, qualify for the right to elsertifikater for net increase of production of electric energy based on renewable energy sources.
