Package Regulations

Adopted of Children and Family Affairs (now Ministry of Children, Equality and Social Inclusion) 19 April 1996 pursuant to the Act of 25 August 1995. 57 on package travel § 3-5. Ref. EEA Agreement Annex XIX paragraph 7 (Council Directive. 90/314 / EEC).

§ 1. Information in catalogs and brochures, ref. Package Tours Act, § 3-5, ref. § 3-2 Catalogue made available to the customer, must contain clear and understandable information about the following:

A)
- the total amount payable by the client including fees, taxes or charges for certain services (airports and port charges, charges relating to the boarding and disembarking, tourist tax etc.)

B)
- itinerary and destination of any destinations

C)
- the types of transport, as well as the transport to be used

D)
- accommodation site location and substantially facilities

E)
- accommodation site touristic classification (standard) according to the rules in the host country, possibly widely used klassifiseringsskriterier in that country or the organizer's own classification. If the operator uses its own classification, the significance of the different classification designations clearly stated. Unless classification is based on the classification in countries outside Norway, it must be stated that it can be different from the classification in other countries

- meals included

G)
- general information about the requirements for passport and visa

H)
- the health conditions of entry the host country puts

I)
- when and how the journey to be paid, including the amount of cash or the percentage of the price. These may be paid as an advance (deposit), as well as an indication of how the balance should be paid

J)
- though it required a minimum number of participants for the individual travel package to take place and, if so, when the customer recently must have received written notice in the event of cancellation

K)
- normal climatic conditions at the destination any destinations, when the holiday package will be implemented outside Norway

L)
- the travel guarantee is provided. Cf. Package Tours Act § 3-1 second paragraph, and who has made such a guarantee

M)
- the travel guarantee is faced Reisegarantifondet according to the rules of the Package Tours Act § 11-1, third paragraph, or guarantee is provided under the rules of another country that is party to the EEA Agreement, ref. § 11-1 fourth paragraph.

The individual disclosure requirements do not apply if they obviously have no meaning for the individual travel package.

§ 2. Information and conditions agreement shall contain, ref. Package Tours Act § 3-5 following information and conditions to be included in the individual agreement between the customer and the organizer, unless they obviously have no meaning for the relevant package tour:

A)
- information as described in § 1

B)
- what documents are part of the deal

C)
- when the parties are bound by the agreement, payment terms and consequences of the payment deadline is not met

D)
- date, time and place of departure and return journey as well as the arrival and departure of each destination where the package tour includes several such

E)
- visits, excursions or other services included in the total price agreed upon for the package tour

F)
- conditions for price changes, see. Package Tours Act § 4-5

G)
- special conditions provided by the customer, and that the tour operator or provider has accepted

H)
- customer complaints period in case of lack or deficient fulfillment of the agreement, and that the complaint should be directed to either the organizer or intermediary, cf. Package Tours Act §§ 5-1, second paragraph, 8-1 and 8-2 | ||
I)
- the conditions to cancel the package tour, ref. Package Tours Act §§ 4-1, 4-2 and 4-3

J)
- the name and address of the organizer and intermediary

K)
- how the customer can get in touch with Reisegarantifondet, any other guarantor / fund if the travel guarantee is set according to the rules of another country that is party to the EEA Agreement,. Package Tours Act § 11-1 fourth paragraph

L)
- the trade organizations organizer and promoter possibly a member of

M)
- an indication that the package tour is regulated by the law on package travel regulations.

All information and conditions shall be presented to the customer in a clear and understandable manner, before acting ref. Package Tours Act § 3-3.


§ 3. Entry into force This regulation comes into force on 1 September 1996 with the exception of § 1, which comes into force on 1 January 1997.
