Short Title
Regulations on licensing obligation for telecommunications networks
Established by the Ministry of Transport 3. October 2000 pursuant to the Act of 23 June 1995 no. 39 on telecommunication (Telecommunications Act) § 2-1, third paragraph, cf. Regulation of 15 December 1995 no. 1032 of functions within the telecommunications authority § 1.
§ 1. Purpose The purpose of this regulation is to ensure the fulfillment of national needs for telecommunications by licensing obligation for providers who construct, own or operate public policy network.
§ 2. Scope This regulation applies establishment and operation of PSTN granted exclusive permission to use frequencies for the Telecommunications Act Sec. 5.
§ 3. Obligation Any provider that does not have significant market power after the Telecommunications Act § 2-1, first paragraph and which has been granted an exclusive license by the Telecommunications Authority to use frequencies in the frequency bands 880-914 / 925-959 MHz, 1710-1785 / 1805-1880 MHz, 1900-1980 MHz and 2110-2170 must have permission of the Ministry of Transport to construct, own or operate public telecommunications networks for leased line or offer public telephone.
§ 4. Conditions may be attached to a license pursuant to § 3, ref. Telecommunications Act § 2-2.
§ 5. Implementation These regulations come into force immediately.
