Chapter I. Purpose and scope

§ 1. Purpose The purpose of this regulation is to prevent the spread of infectious diseases in connection with importation and exportation of live pigs.

§ 2. Scope These regulations apply animal health conditions for imports and exports within the EEA and the import and transit of live pigs from approved third countries, except for wild boar.
Regulations do not apply animal health conditions for imports and exports within the EEA of live pigs which the Regulation on 10 August 2007 no. 955 on animal health requirements for the movement of circus animals within the EEA.

§ 3. Definitions In these regulations:

1.

Pork: live domestic swine.

2.

Slaughter: swine to be passed to the slaughterhouse.

3.

Breeding or livestock: second pig than those mentioned in paragraph 2, including animals intended for breeding or meat production.

4.

Holding: an agricultural operation where it is kept or bred breeding, production or slaughter.

5.

Crew: an animal or group of animals kept on a holding as an epidemiological unit. If there is more than one crew in a holding these constitute a unit with the same health status.

Official veterinarian: the veterinarian appointed by the competent central authority.

8.

Assembly center: all locations, including holdings, collection centers and markets where swine coming from different holdings are collected, so that they form parties of animals intended for trade.

9.

Livestock Dealer: physical or legal person for commercial purposes directly or through intermediaries buy and sell animals, which have a fixed revenue of animal, and within 30 days after purchasing animals resells them or move them from the plants where they first was placed.

10.

Countries outside the EU: Land that is neither a member of the European Union (EU) or through the EEA Agreement has entered into an agreement with the EU on trade in swine.

11.


Approved third country: Countries outside the EEA, or area of ​​countries outside the EEA, which is authorized to export live pigs to the EEA, cf. Regulation 23 July 2010 No.. 1137 on imports from third countries of certain live animals, bees, bumblebees and fresh meat of certain animals ref. Regulation (EC). 206/2010.

Chapter II. Terms on importation and exportation within the EEA

§ 4. General animals must:

1)
undergo an identity check and physical examination, conducted by an official veterinarian within the last 24 hours before shipment. The animals should the investigation have shown clinical signs of disease,

2)
not be imposed slaughtered or be subject to animal health restrictions pertaining to swine,

3)
not come from holding or area which is covered by animal health restrictions pertaining to swine,

4)
be marked in accordance with applicable regulations.

It is forbidden to send animals vaccinated against foot-and-mouth disease from an EEA country to another.
The collection centers must be approved and assigned an approval number of public authority. Accumulation CP should at least meet the conditions of Annex B to this regulation. The approval shall include the category of pigs to be imported or exported. Accumulation Central approval numbers should be listed on the list published by the Government of that country.
Livestock dealers and their premises must be registered, approved and assigned an approval number of public authority. Livestock dealer and premises must at least meet the conditions of Annex C to this regulation. Livestock dealers and their premises with the approval numbers should be listed on the list published by the Government of that country.

§ 5. Transport Animals shall not at any time from leaving the holding of origin and until they arrive at their destination, come into contact with other cloven-hoofed animals of lower health status.
Animals must be transported in accordance with the Regulations of 8 February 2012 No.. 139 concerning the commercial transport of animals. The animals shall be appropriate to complete the whole journey, and this shall be stated in the accompanying health certificate. In addition, the following conditions are met:

1)
vehicles to be washed and disinfected immediately after and if necessary before each transport of animals or of products that may affect the animal health. The disinfectant used must be approved by a public authority. The carrier must either have appropriate cleaning and disinfection facilities approved by a public authority, including facilities for storing litter and manure, or be able to prove that this is performed by a third party approved by the Government

2)
feces, waste, feed or other things should not run out or fall off during transit,

3)
carrier shall ensure that it is passed a separate register for each vehicle used for the transport of animals. The register shall contain at least the information regarding the location, date and time of pickup and delivery of animals, sender's and recipient's name and address, type and number of animals transported, place and date of disinfection and information from the following documents, such as serial numbers and the like, and expected duration of the transit. The register shall be kept for at least three years,

4)
(repealed)

5)
it shall transport follow written documentation that the conditions in this paragraph are met.

Additional condition of registry does not apply when the transport distance between provenance and destination is 65 kilometers or less.

§ 6. Health Certificate animals must be accompanied by a health certificate in original as shown in Annex D. It must be signed by an official veterinarian. The certificate shall state that the terms of these regulations, health certificate and any additional guarantees for Aujeszky's disease approved by the EU in accordance with resolution 2008/185 / EC and EFTA in accordance with the ESA's decision 160/10 / COL, are met. The certificate must be on one sheet, or when there is a need for more than one page, be designed so that the pages form a whole. The certificate shall bear a serial number issued by the official veterinarian authority. Stamp and signature must be in a different color than the certificate. Each certificate will only include animals being transported on the same transport vehicle and to be of one and the same holding to the same receiver. The certificate shall be issued the same day as the clinical examination takes place and after the official veterinarian has carried out inspections, visits and controls necessary in accordance with these regulations. The certificate shall be issued at least one of the recipient country's official language, and is valid for 10 days. Health surveillance in connection with the issuance of the medical certificate may be made out on the holding or on an assembly center.

When it comes to animals from authorized collection centers or from an approved holding which is part of a surveillance network established under Directive 64/432 / EEC Article 14, the health certificate shall be issued on the basis of an official document containing the necessary information. The document must be completed by the official veterinarian responsible for the herd of origin or where the animals come from a holding which is part of a monitoring network, the responsible veterinarian.
The animals can be transported via an assembly center in one EEA country before shipment to the recipient country. In this case it shall accompany the animals two health certificates, a completed sending and a completed by the official veterinarian responsible for the assembly center in the transit country. The latter certificate must bear originalsertifikatets serial number and attaches at this or a certified copy. In such cases, the overall validity of the certificates shall not exceed 10 days.

§ 7. Additional requirements for breeding and production animals must before shipment have stayed on the same holding for 30 days or since birth. If they are transported via an approved assembly center in the country of origin, they should not have stayed there for more than 6 days. The animals must be originating in the EEA or previously be imported into the Community in accordance with applicable regulations. Official veterinarian shall ensure that the animals comply with those conditions.
Animals must come from countries or regions which have the status of free of Aujeszky's disease with prohibition of vaccination, ref. Annex A (Decision 2008/185 / EC Annex I as amended by Decision 2008/988 / EC and ESA resolutions 160 / 10 / COL). Animals that do not come from countries or regions mentioned in the first sentence shall meet the following conditions:

1.
Aujeszky's disease is notifiable in the country of origin.

2.
It should be in the country of origin or region be implemented a program for controlling and combating Aujeszky's disease in accordance with Directive 64/432 / EEC, under the supervision of a public authority. This program shall include appropriate measures for transport and movement of pigs to prevent disease spread between farms with different health status.

3.
When it comes to holding the animals come from:

A)
shall be in the last 12 months have not been proven clinical, pathological or serological evidence of Aujeszky's disease,

B)
shall be in the last 12 months have not been proven clinical, pathological or serological evidence of Aujeszky's disease on holdings located within a radius of 5 km from the farm animals come from, except in holdings where there regularly has been implemented to monitor and eradicate Aujeszky's disease under the supervision of a public authority and in accordance with the program referred to in paragraph. 2, and if these measures have effectively prevented the disease has spread to the current operating unit,

C)
should not have been carried out vaccination against Aujeszky's disease at least 12 months,

D)
animals shall be at least twice by at least four months apart have undergone a serological survey to detect ADV-GE, ADV-GB- or ADV-gD antibody or whole virus of Aujeszky's disease. This survey must have shown the absence of Aujeszky's disease and that vaccinated pigs were free from gE antibodies,

E)
shall be in the last 12 months have been introduced pigs from holdings of lower animal health status with regard to Aujeszky's disease, unless they have been tested for Aujeszky's disease with negative results.

4.
Animals to be moved:

A)
should not have been vaccinated against Aujeszky's disease,

B)
be in the last 30 days prior to movement have been kept isolated in a facility approved by a public authority in such a way that any risk of spreading Aujeszky's disease to these pigs avoided

C)
should have been kept at the original holding, or a holding with the same health status, since birth, and have been at this for at least 30 days for production pigs and at least 90 days for avlssvin,

D)
must have been examined by at least two serological tests carried out with a difference of at least 30 days, with negative results for ADV-gB or ADV-gD or whole virus of Aujeszky's disease. If the animals are younger than four months old may be used to a serological test for ADV-gE if the sample is taken during the last 15 days prior to shipment. Number of animals tested in isolation time must be sufficient to detect 2% seroprevalence with 95% confidence for production animals in the isolate and 0.1% seroprevalence with 95% confidence for avlssvin in the isolate.


The first of the two samples specified in the second paragraph. 4d) may be omitted if, in accordance with the above program, conducted a serological test in holding the animals come from between 45 and 170 days prior to shipment, demonstrating that Aujeszky's disease antibodies do not occur and that vaccinated animals are without gE antibodies. There is also a requirement that the animals be sent stayed in holding the animals come from since birth, and no new animals are introduced into that holding while the animals to be sent is kept in isolation.
The serological testing for Aujeszky's disease shall be conducted in accordance with the standards described in Annex III of Decision 2008/185 / EC.

§ 8. Additional requirements for slaughter Animals must come from countries or regions which have the status of free of Aujeszky's disease with prohibition of vaccination, ref. Annex A (Decision 2008/185 / EC Annex I as amended by Decision 2008/988 / EC and ESA decision 160/10 / COL). Animals shall importation attributed to:

1)
a slaughterhouse where the slaughter as quickly as possible and no later than 72 hours after arrival, or

2)
an approved assembly center where the animal as soon as possible and not later than three working days are taken directly to the slaughterhouse where the slaughter.

Animals coming from countries or regions that are not mentioned in the first paragraph shall comply with the following conditions:

1.
Aujeszky's disease is notifiable in the country of origin.

2.
The country of origin or region should have implemented a program for controlling and combating Aujeszky's disease, ref. § 7, no. 2

3.
The animals must be transported directly to the slaughterhouse and either

A)
come from a holding which complies with the conditions set out in § 7, no. 3, or

B)
be vaccinated against Aujeszky's disease at least 15 days prior to shipment and come from a holding where:

I)
it regularly implemented measures to monitor and eradicate Aujeszky's disease under the supervision of a public authority within the framework of the above program in the last 12 months

Ii)
they have been kept for at least 30 days prior to shipment, and where there is no demonstrated no clinical or pathological evidence of Aujeszky's disease at the time of the health certificate was issued, or

C)
not be vaccinated and come from a holding where:

I)
it regularly implemented measures to monitor and eradicate Aujeszky's disease under the supervision of a public authority within the framework of the above program in the last 12 months. It must not have been proven clinical, pathological or serological evidence of Aujeszky's disease in the past six months,

Ii)
public authorities have banned vaccination against Aujeszky's disease and the introduction of vaccinated pigs, because the holding is in the process of achieving the highest status with regard to Aujeszky's disease in accordance with the above program,

Iii)
they have been kept for at least 90 days prior to shipment.

The animals must be slaughtered as soon as possible and no later than 72 hours after arrival. The serological testing for Aujeszky's disease shall be conducted in accordance with the standards described in Annex III of Decision 2008/185 / EC.

§ 9. (Repealed by Regulation 14 November 2010 No.. 1460.)

Chapter III. Terms on imports from countries outside the EEA

§ 10. Approved third countries is only permitted to import pork from approved third countries or areas of third countries are listed in Regulation 23 July 2010 No.. 1137 on imports from third countries of certain live animals, bees, bumblebees and fresh meat of certain animals § 1 ref. Regulation (EC). 206/2010 Annex I, part 1

§ 11. Health Certificate With any consignment of animals from approved third countries or through the Community shall be accompanied by an original health certificate in the official language in the country of destination and in the EEA country who perform border control. The health certificate shall certify that the animals satisfy the conditions of the standard certificate model as the accompanying health certificate is based, cf. Regulation 23 July 2010 No.. 1137 on imports from third countries of certain live animals, bees, bumblebees and fresh meat of certain animals § 1 cf. . Regulation (EC). 206/2010 Annex I, part 2
the health certificate shall either consist of a single sheet of two or more pages which constitute one indivisible sheet or several consecutive pages are numbered in such a way that it emerges that each sheet represents a certain part of a limited number of pages.
The health certificate shall have an individual identification number, to be completed, signed and stamped by an official veterinarian in the country of origin. If the certificate consists of several sheets, this applies to each sheet.
The health certificate may contain statements as required by other EEA acts concerning public health, animal health or animal welfare.


§ 12. Sampling Swine going after importation isolated and examined in accordance with the provisions of Regulations 27 June 2002 No.. 732 on combating animal diseases and regulation on 31 January 1995 no. 107 on monitoring and control of the occurrence of salmonella in live cattle and swine.

§ 13. Transport Animals transported via other EEA countries, will be transported to the EEA country which is the final destination as soon as possible.
During the last 24 hours before the animals are sent to the EEA, the official veterinarian check that the animals are healthy and that the transport provisions of Regulation (EC) No. 1/2005 compliance, especially with regard to watering and feeding. On examination the animals must not have shown any clinical signs of disease, and they should be found suitable to carry out the transport.

§ 14. (Repealed by regulation 25 October 2010 No.. 1374.)

Chapter IV. Final provisions

§ 15. Supervision and control, isolation and examination Swine must be inspected in accordance with Regulation of 31 December 1998. 1484 on the supervision and control of imports and exports of live animals, other breeding stock and animal waste in the Community and importation of live animals from countries outside the EEA.

§ 16. Expenses All expenses associated with the importation and exportation of pork are the responsibility.

§ 17. Exemption FSA may in special cases grant exemptions from the provisions of this regulation, provided that it does not conflict with Norway's international obligations, including the EEA agreement.

§ 18. Safety regulations Ministry of Agriculture may at short notice and without compensation for the importer to stop the importation or exportation of pork, if special circumstances relating to the sending zoosanitære situation or other circumstances indicate this.

§ 19. Penalties Deliberate or negligent violation of these regulations or provisions and decisions issued pursuant thereto is punishable under the Food Act § 28

§ 20. Commencement This Regulation shall enter into force on 5 April 2002.
From the same date, the Regulations of 31 December 1998 no. 1490 concerning animal health conditions for importation and exportation swine.

Appendix B. The collecting centers in EEA countries

To be approved by a public authority shall assembly center meet at least the following conditions:

1)
be supervised by an official veterinarian and inspected regularly to ensure that approval requirements at any given time is fulfilled,

2)
lie in an area not covered by the relevant animal health restrictions,

3)
be cleaned and disinfected before each time they are used, as instructed by the official veterinarian

4)
depending on capacity have:

A)
premises designed exclusively for this purpose when used as assembly center,

B)

Suitable premises for loading, unloading and stabling of adequate standard for the animals, for watering and feeding of animals, and for giving them any necessary treatment. The premises must be easy to clean and disinfect,

C)
suitable premises for inspections,

D)
suitable premises for isolation,

E)
appropriate equipment for cleaning and disinfection of premises and vehicles

F)
suitable premises for storage of feed, waste and manure,

G)
a suitable system for collecting waste water and

H)
an office for the official veterinarian,

5)
only take in animals that satisfy the requirements of this regulation and that have been identified. The owner or the person responsible for the assembly center shall on animals arrival control or have controlled animal identification mark and the health documents or other documents that must accompany the animals.

The owner or the person responsible for the assembly center shall, on the basis of the document accompanying the animals, or on the basis of the animals' identification numbers or identification marks, list the following information in a register or a database and keep them for at least 3 year:

1)
owner's name, origin of animals, reception date and shipment date, number and identification of swine arriving home base, and their intended destination, and

2)
carrier's registration number and registration number of the means of transport which brings or retrieve animals on the exchange.

The official veterinarian responsible for the assembly center shall carry out all necessary investigations of animals arriving exchange.
The approval may be revoked or suspended by official veterinary authority of any breach of current legislation.

Appendix C. Livestock Dealers

To be approved by a public authority shall livestock dealer meet at least the following conditions:

1)
just taking in animals satisfying the requirements of this regulation and that have been identified. For this purpose, the owner or the person responsible for the assembly center, the animals' arrival check or get controlled animal identification mark and the health documents or other documents that must accompany the animals,

2)
on the basis of the document accompanying the animals, or on the basis of the animals' identification numbers or identification labels list the following information in a register or a database and keep them at least three years:

A)
owner's name, origin of animals, date of purchase, categories, number and identification of purchased pigs,

B)
carrier's registration number and registration number of the truck that brings or retrieve animals on the exchange,

C)
purchaser's name and address and the animals' destination, and

D)
copies of travel plans and health certificates' serial numbers, and

3)
if the animals residing in livestock dealer's premises, it shall ensure that:

A)
staff who have responsibility for the animals receive adequate training in order to meet the requirements of these regulations and requirements for animal care and welfare, and

B)
the official veterinarian regularly examines the animals and, if necessary take samples of them, and that all necessary measures are taken to avoid the spread of disease.

Construction used by livestock dealers must meet at least the following conditions:

1)
be supervised by an official veterinarian and inspected regularly to ensure that approval requirements at any given time is fulfilled,

2)
not lie in an area that is covered by the relevant animal health restrictions,

3)
be cleaned and disinfected before each time they are used, as instructed by the official veterinarian

4)
facility should have:

A)
suitable premises with sufficient capacity, with especially suitable inspection facilities and isolation facilities so that all animals can be isolated in the event of an outbreak of a contagious disease,

B)
suitable premises for unloading and stabling of adequate standard for the animals, for watering and feeding of animals, and for giving them any necessary treatment. The premises must be easy to clean and disinfect,

C)
an appropriate reception area for litter and manure, and

D)
a suitable system for collecting waste water.

The approval may be revoked or temporarily revoked by the official veterinary authority of any breach of current legislation.
