Chapter I Scope and definitions

§ 1. Scope These regulations contain provisions on the composition, labeling and sale of foodstuffs intended for healthy infants and småbarn.1
regulations include foodstuffs covering special nutritional requirements of healthy infants and toddlers, and intended to

A)
infants under habituation to solid food or

B)
toddlers for gradual adaptation to an ordinary broom.

Following categories foodstuffs covered by the Regulation:

A. Processed cereal-based baby foods (may also be based on root vegetables, ref. Annex 1), grouped in categories

1.
Cereals to dissolve with milk or other appropriate, nutritious fluids,

2.
Cereal products containing a protein-rich food, to dissolve in water or other protein-free liquid,

3.
Pasta, to be eaten after boiling in water or other suitable fluids and

4.
Rusks and biscuits, which are eaten directly or after crushing, and addition of water, milk or other suitable liquids.

B. Other baby foods (ref. Annex 2).
Regulation does not milk intended for toddlers.
Provisions of this regulation apply in addition to the provisions of Regulation 21 December 1993 no. 1382 on foodstuffs intended for particular nutritional uses and replaces them in cases where the provisions of this regulation is substantiated.

§ 2. Definitions In this regulation be understood by

1.

Infants, children under 12 months.

2.

Toddlers: children from 1 until 3 years.

3.

Residues of pesticides, residues of pesticides, etc. in processed cereal-based baby food and other baby food, and their eventual toxic omdannelses- or degradation products, as defined in regulations 21 December 1993 no. 1388 on the residues of pesticides, etc. in food and feed.

Chapter II. composition

§ 3. General Processed cereal-based baby food and other baby foods to be sold on the Norwegian market must comply with the provisions contained in these regulations.
Processed cereal-based baby foods and baby foods must not contain any substances in such quantities that there is danger for infants and young children's health.

§ 4. Ingredients Processed cereal-based baby foods and baby foods for infants and young children must be manufactured from ingredients which by generally accepted scientific data has been established that they are suitable to be included in the diet of infants and toddlers.

§ 5. Composition of processed grain-based baby food Processed cereal-based baby foods shall comply with the composition as set out in Annex 1

§ 6. Composition of different baby food Other baby foods shall comply with the composition as set out in Annex 2.


§ 7. Addition of nutrients By adding nutrients to processed grain-based baby food and other baby food is only allowed to use the substances set out in Appendix 4.

§ 8. Remains of pesticides etc. Processed cereal-based baby foods and baby foods shall not contain residues of pesticides that exceed a limit of 0.01 mg / kg. This limit applies to each individual pesticide, with the exception of those pesticides which in Annex 6 are given special limits. In these cases, the limits set out in Annex 6
Analytical methods used for the determination of residues of pesticides must be methods which are based on generally accepted and standardized methods.
Pesticides listed in Annex 7 shall not be used in the production of ingredients to be included in cereal based baby food and other baby food. For supervisory purposes shall nevertheless following:

It is believed that pesticides listed in Table 1 of Annex 7 is not used if the analysis of residues of pesticides does not exceed 0,003 mg / kg. This level, which is assay quantification should be reconsidered if deemed necessary in light of new technologies.

2.
It is believed that pesticides listed in Table 2 of Annex 7 is not used if the analysis of residues of pesticides does not exceed 0,003 mg / kg. This level should be reassessed in light of new data referred to environmental pollution.

The provisions given in this section applies to grain-based baby food and other baby foods that are ready for consumption or prepared according to manufacturer's instructions.

Chapter III. marking

§ 9. General Requirements Processed cereal-based baby foods and baby foods should be labeled according to current regulations on labeling næringsmidler.1

§ 10. Use In labeling of processed cereal-based baby foods and baby foods should be disclosed what age the product can be used from. In determining this age should be taken of the product's composition, consistency and other special features. Recommended minimum age can not be lower than four months.
The products marked with that they can be used from four months of age, it can also be disclosed that the product can be used from this age unless otherwise recommended by independent health professionals with responsibility for monitoring of mother and child.

§ 11. Information about cooking A guide on the proper preparation of the product and the importance of following these instructions must be included in the labeling when necessary.

§ 12. Gluten Contents If the recommended age for use of the product is less than 6 months, a statement whether the product contains or does not contain, gluten.

§ 13. Declaration of nutrient

Processed cereal-based baby foods and baby foods should be labeled with the energy value expressed in kilojoules (kJ) and kilocalories (kcal) and the content of protein, carbohydrate and fat, expressed in numbers. The content must be expressed per 100g or per 100 ml of the product as marketed and, where appropriate, per specified quantity of the ready to use product.

Categories of processed grain based infant formula or baby foods which in Annexes 1 respective 2 is given requirements for a specific content of certain vitamins and / or minerals shall be labeled with the average content of the vitamins and / or minerals are given requirements if the relevant product type, expressed in numbers. The content must be expressed per 100g or per 100 ml of the product as marketed and, where appropriate, per specified quantity of the ready to use product.

Processed cereal-based baby food and other baby food can also be marked with the contents of the nutrients set out in Annex 4, expressed in numbers, when such declaration is not covered by section. 2. Content can be entered per 100g or per 100ml of the product as marketed and, where appropriate, per specified quantity of the ready to use product.

In addition to marking according to no. 1, 2 and 3, the content of the vitamins and minerals listed in Annex 5 also stated as a percentage of the referanseverdier1 set out in Annex. The percentage may be stated per 100 g or per 100 ml of the product as marketed and, where appropriate, per specified quantity of the ready to use product, provided the content of the appropriate vitamins / minerals constitute at least 15% of the reference values.

Chapter IV. Administrative provisions

§ 14. Inspection and decisions FSA supervises and makes decisions to implement the provisions laid down in and pursuant to these regulations.


§ 15. Notification requirement of consideration for an effective monitoring of the market to foodstuffs covered by this regulation be notified to the FSA when they are traded on the Norwegian market. The notification is done by the manufacturer / importer submits the following information:

A)
name and address of the reports and producer,

B)
all the ingredients including the complete chemical compound of added nutrients,

C)
foodstuff total content (sum of naturally occurring and added amount) of all vitamins and minerals is added, determined by analysis of the finished product at the time of manufacture,

D)
foodstuff content of other vitamins and minerals included in Annex 4, as determined by analysis of the finished product at the time of production or when calculating the content from known or actual average values ​​of the ingredients used in the product and | ||
E)
foodstuff use (age indication) and package types.

Any changes to the reported information and any withdrawal of products from the market should be notified to the FSA.
FSA may require additional information and documentation.

§ 16. Exemption FSA may in special cases grant exemptions from the provisions of this regulation, provided that it does not conflict with Norway's international obligations, including the EEA agreement.

§ 17. Penalties Deliberate or negligent violation of these regulations or provisions and decisions issued pursuant thereto is punishable under the Food Act § 28

§ 18. Entry into force These regulations enter into force immediately.

Appendix 1. Requirements for the composition of processed cereal-based baby foods for infants and young children

Requirements regarding nutrient content applies to the products ready for use, either sold as ready to use products or touched out according to manufacturer's instructions.

1.
Grain Contents

Processed cereal-based baby foods prepared primarily on the basis of one or more milled cereals and / or starchy root vegetables.
Contents of grain and / or tuber should constitute at least 25% of the dry matter content in the ready to use product.

2.
protein

2.1
For products covered by § 1, third paragraph, point A, no. 2 and no. 4, the protein content does not exceed 1.3 g / 100 kJ (5.5 g / 100 kcal).

2.2
For products covered by § 1, third paragraph, point A no. 2, shall be the amount of added protein comprise at least 0.48 g / 100 kJ (2 g / 100 kcal).

2.3
For biscuits covered by § 1, third paragraph, point A no. 4, which is obtained by adding a protein-rich food and presented as protein-rich, the amount of added protein comprise at least 0.36 g / 100 kJ (1.5 g / 100 kcal).

2.4
The added protein shall have a chemical score of at least 80% of referanseproteinets (casein as defined in Annex 3), or the protein efficiency ratio (PER) which is at least 70% of referanseproteinets.

Addition of amino acids are only allowed in order to improve protein mixture nutritional value and only in amounts necessary for this purpose.

3.
carbohydrates

3.1
If sucrose, fructose, glucose, glucose syrup or honey1 added products covered by § 1, third paragraph, point A, no. 1 or no. 4, shall

Amount of added carbohydrate from these sources do not exceed 1.8 g / 100 kJ (7.5 g / 100 kcal) and

-
Amount added fructose not exceed 0.9 g / 100 kJ (3.75 g / 100 kcal).

3.2
If sucrose, fructose, glucose syrups or honey1 added products covered by § 1, third paragraph, point A no. 2, shall

-
Amount of added carbohydrate from these sources do not exceed 1.2 g / 100 kJ (5 g / 100 kcal) and

-
Amount added fructose not exceed 0.6 g / 100 kJ (2.5 g / 100 kcal).


4.
fat

4.1
For products covered by § 1, third paragraph, point A, no. 1 and no. 4, the fat content does not exceed 0.8 g / 100 kJ (3.3 g / 100 kcal).

4.2
For products covered by § 1, third paragraph, point A no. 2, shall fat content does not exceed 1.1 g / 100 kJ (4.5 g / 100 kcal). If the fat content exceeds 0.8 g / 100 kJ (3.3 g / 100 kcal), the following applies:

A)
The amount of lauric acid shall not exceed 15% of the total fat content.

B)
amount myristic should not exceed 15% of the total fat content.

C)
amount of linoleic acid (in the form of glycerides = linolater) should be at least 70 mg / 100 kJ (300 mg / 100 kcal) and should not exceed 285 mg / 100 kJ (1200 mg / 100 kcal).

5.1
sodium

Sodium salts can be added to processed cereal-based baby food only if there is a technological need.

Sodium content in processed grain based infant formula should not exceed 25 mg / 100 kJ (100 mg / 100 kcal).


5.2
calcium

5.2.1
For products covered by § 1, third paragraph, point A no. 2, the content of calcium amounts to at least 20 mg / 100 kJ (80 mg / 100 kcal).

5.2.2
For products covered by § 1, third paragraph, point A no. 4, produced by the addition of milk (milk biscuits) and presented as biscuit fortified milk, the content of calcium amounts to at least 12 mg / 100 kJ (50 mg / 100 kcal).

6.
Vitamins

6.1

7.

Requirements regarding nutrient content applies to the products ready for use, either sold as ready to use products or cooked according to manufacturer's instructions.

1.

If meat, poultry, fish offal or other traditional protein source are the only ingredients mentioned in the product's trade name shall

-
Contents of the aforementioned types of meat, poultry, fish offal or other traditional protein source together comprise at least 40 weight percent of the total product,

Contents of each of the aforementioned types of meat, poultry, fish offal or other traditional protein source be at least 25 weight percent of said protein sources together and

-
Percentage of protein from the said protein sources constitute at least 1.7 g / 100 kJ (7 g / 100 kcal).

1.2
If meat, poultry, fish offal or other traditional protein source, alone or in combination, first mentioned in the product's trade name, whether the product is presented as a meal or not,

1.4a
Sauces presented as an accompaniment to a meal are not covered by the requirements of paragraphs 1.1 to 1.4.


1.4b In desserts or other sweet dishes where dairy products are mentioned as the first or only ingredient in the trade name, the content of milk protein at least 2.2 g / 100 kcal. Other desserts or other sweet dishes are not covered by the requirements of paragraphs 1.1 to 1.4.

1.5
Addition of amino acids are permissible only in the purpose of improving the protein present the nutritional value and only in amounts necessary for this purpose.

2.
carbohydrates

The total carbohydrate content of fruit and vegetable juices and nectars, in dishes that contain only fruit as well in desserts and puddings shall not exceed:

For the products referred to in section. 1.1 of this Annex, where meat or cheese are the only ingredients or are mentioned first in the product's trade name, the product's total fat content from all sources should not exceed 1.4 g / 100 kJ (6 g / 100 kcal).

3.2
For all other products covered by this Annex, the product's total fat content from all sources should not exceed 1.1 g / 100 kJ (4.5 g / 100 kcal).

4.
sodium

4.1
The final sodium content in the product shall be either a maximum of 48 mg / 100 kJ (200 mg / 100 kcal) or a maximum of 200 mg / 100 g.

If cheese is the only ingredient mentioned in the product's trade name, the final sodium content must be a maximum of 70 mg / 100 kJ (300 mg / 100 kcal).

4.2
Sodium salts may not be added baby food based on fruit, desserts or puddings except when there is a technological need.

5.
Vitamins

5.1
Vitamin C

In fruit juices, nectar and vegetable juices, the final content of vitamin C may be a minimum of 6 mg / 100 kJ (25 mg / 100 kcal) or at least 25 mg / 100 g.

5.2
Vitamin A

In vegetable juices, the final content of vitamin A be at least 25 micrograms RE / 100 kJ (100 mcg RE / 100 kcal) .1
Vitamin A can not be added to other baby foods covered by this Annex.

5.3
Vitamin D

Vitamin D can not be added to baby foods covered by this Annex.

6.
Maximum limits for content of vitamins, minerals and trace elements

By addition of vitamins, minerals and trace elements to the products covered by this Annex, the following maximum values ​​apply:
